House Rent Allowance not a right, merely a compensation: HighCourt


   MUMBAI: The HC has ruled that house rent allowance (HRA) is not a right. A division bench of Justice B P Dharmadhikari and Justice A P Bhangale ruled that a government employee not staying in the quarters despite its availability can be disentitled from claiming the special allowance. The bench was hearing a petition filed by the defence ministry against its employees working in the ordinance factory in Nagpur, who were staying in their own accommodation.

   Nagpur has surplus government accommodation and is one of the few cities where a central government employee, who lives in his own house has to submit a "non-availability certificate" before he can ask for HRA. The government claimed that its employees, who are offered accommodation but refuse to occupy the same, would not be entitled to HRA.

   (i) All workers and employees of State Public Sector Undertakings who are drawing a Grade pay of Rs. 4300 in the scale of pay of Rs.9300-34800 and below (Pre-revised scale - Rs. 5300-150-8300 and below) i.e. those who are in the C & D Groups, irrespective of their eligibility, be paid a minimum Bonus of 8.33% and Ex-gratia of 1.67% before 30.09.2011 to claim it as an eligible expenditure under Income Tax Act, subject to the salary ceiling limit of Rs. 3500/- for the purpose of determination of Bonus for the year 2010-11 and in relaxation of the eligibility salary ceiling of Rs. 10,000/

All-India Consumer Price Index Numbers for Industrial Workers on Base 2001=100 for the month of August 2011


   All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of August, 2011 increased by 1 point and stood at 194 (one hundred & ninety four) .

   During August, 2011, the index recorded maximum increase of 9 points in Amritsar centre, 8 points each in Bhilwara and Chindwara centres, 6 points in Kolkata centre, 5 points in Jharia centre, 4 points in 6 centres, 3 points in 7 centres, 2 points in 16 centres and 1 point in 16 centres. The index decreased by 3 points each in Giridih, Quilon and Kodarma centres, 2 points in Rajkot centre, 1 point in 9 centres while in the remaining 15 centres the index remained stationary.

   The maximum increase of 9 points in Amritsar centre is mainly on account of increase in the prices of Rice, Wheat Atta, Fresh Milk, Onion, Vegetable & Fruit items, Tea (Readymade), Kerosene Oil, Electricity Charges, Medicine (Allopathic), etc. The increase of 8 points each in Bhilwara and Chindwara centres is due to increase in the prices of Wheat, Gram Dal, Groundnut Oil, Soyabeen Oil, Milk, Onion, Vegetable & Fruit items, Tea (Readymade), Bidi, Firewood, Toilet Soap, etc. The increase of 6 points in Kolkata centre is due to increase in the prices of Rice,

Antony’s Message to Defence Accounts on Annual Day

   The Defence Minister Shri AK Antony today asked senior Defence Finance officials of his Ministry to consider the satisfaction level of Ex-Servicemen (ESM) pensioners as the benchmark of their performance. Addressing the 264th Annual Day Celebration of the Defence Accounts Department (DAD) here today, Shri Antony pointed out that his office still continues to receive several pension settlement related grievances.

   “True, most of these cases were a baggage from the past as a consequence of Pay Commission recommendations and Cabinet decision on pay and pension hike, yet these needed to be addressed at the shortest possible time,” Shri Antony said. “Ultimately, the taste of the pudding lies in its eating,” he quipped adding that “the veterans deserved their due as they had sacrificed the prime of their life safeguarding our borders.”

Production Linked Bonus for Railway Employees



   The Union Cabinet has accepted the proposal of the Ministry of Railways for payment of Productivity Linked Bonus (PLB) equivalent to 78 days` wages for the financial year 2010-2011 for all eligible non-gazetted Railway employees.

   The financial implication of payment of 78 days` PLB to railway employees has been estimated to be Rs.1098.58 crore. The wage calculation ceiling prescribed for payment of PLB to the eligible non-gazetted railway employees is Rs.3500/- p.m.

   In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951(LXI of 1951), the Central Government, after consultation, with the Government of the States concerned, hereby makes the following rules, namely:-

   1. Short title and application-

 (1) These rules may be called the All India Services (Medical Attendance) Rules, 1954.

   (2) they shall apply to members of the Service while they are on duty or on leave or under suspension, within India [ ]

2. Definitions.- In these rules, unless the context otherwise requires-

   2 (a) "authorised medical attendant" means the principal medical officer appointed by the Government to attend its officers in the station or district (where the member of the Service falls ill) and includes a medical officer who, in rank, is equal or immediately junior to such principal medical officer and who is attached to any hospital or dispensary in the station where such principal medical officer is posted:

   Provided that if there is no principal medical officer appointed by the Government for the station at which or the district in which the member of the Service falls ill, the principal medical officer shall be the officer appointed by the Government of the State in which the station or district is situated

VRS IS DANGEROUS TO BSNL AND EMPLOYEES



   The BSNL Management supplied a copy of its VRS proposal to BSNL Employees Union on 20.09.2011 seeking its view on the proposal. The BSNL Employees Union as well as JAC have decided to go on struggle against the VRS, since it is against BSNL and employees. The following are the reasons for opposing the VRS.

1. VRS is bad in theory and failed in practice

   VRS is bad in theory since it is in essence nothing but blaming the employees and the expenditure on their wages as responsible for the losses incurred by the Company. It is based on the false presumption that by reducing the number of employees, the losses can be reduced and profits can be revived. 3 rounds of VRS were already implemented in MTNL. But it resulted in further losses to MTNL. Thus VRS is bad in theory and failed in practice.

2. Large scale removal of one lakh employees from service

   Since the removal of a small number of employees failed to save MTNL from losses, now the BSNL management proposes to remove employees in large number. Its proposal aims at removing one lakh employees from service, out of the existing 2,76,000 employees. This indicates a large scale attack on the employees.

3. It is not VRS but it is CRS

   Fixing the target of removal one lakh employees in the name of VRS reveals that it is not voluntary and the employees will be coerced to take VRS till the target is reached. Therefore in practice it is CRS

Sub : Housing Loan Scheme for the employees of the Government of West Bengal in association with the United Bank of India & West Bengal State Co-operative Bank Ltd.

   Government of West Bengal, with a view to offering encouragement to Government servants to construct /purchase their own residential houses /flats, used to disburse loans to Government employees. Sanctions of loans were governed by rules 308 to 312 of West Bengal Financial Rules Vol-I. and also on the basis of executive orders issued from time to time. In the year 1999, Finance Department issued a Government order 1300-FB dated 31st May, 1999 revising the existing rules 308 to 312 of West Bengal Financial rules Volume - I. In terms of para 9 of G.O. No. 1300-FB dt. 31.5.1999 Government employee was also eligible to avail himself of House building loans from Nationalised banks/ Government Financial Institutions in addition to house building loans obtained from Government. In those cases, the only Condition was imposed that the Government employee will have to execute a bond mortgaging his property as “First Charge” in favour of the State Government.

   The undersigned is directed to refer to this Department’s earlier office memoranda No. 1/17/86-P&PW(E), dated 29th August, 1986, 25th January, 1991 and 18th February, 1993 and No. 1/28/04-P&PW(E) dated 31st March, 2009 and 2nd July, 2010 regarding grant of family pension to the eligible members of the family of an employee/pensioner reported missing and whose whereabouts are not known.

   2. As per this Department’s O.M. Dt. 29.8.1986, subject to fulfilment of certain conditions, the family pension can be granted to the family of an employee reported missing and whose whereabouts are not known after a period of one year reckoned from the date of filing the FIR with the police authorities. DA for central staff up 7%


   The government on Thursday announced a 7% hike in the dearness allowance (DA) of its employees to give them relief from the near double-digit inflation ahead of the festival season. Besides the five million central government employees, about four million pensioners will also stand to benefit from the decision taken by the cabinet on Thursday.

   Although the DA will increase from 51% to 58% of basic salary from July 1, employees, especially those who are in the junior scales, do not seem to be happy with the quantum.

   “The inflation index, the basis of calculating the dearness allowance, is not actually reflecting the cost of living and erosion in employees’ remuneration due to price rise,” said KKN Kutty, secretary general of the Confederation of Central Government Employees and Workers.

   The general inflation for August was at a near-one-year high of 9.78%.

   The DA and dearness relief hike will cost the exchequer Rs 7,229 crore a year, while for the remaining period of the current fiscal the implication will be Rs 4,819 crore, information and broadcasting minister Ambika Soni told reporters on Thursday.

Central government staff to get bonus


   Ahead of the festival season, the Government today announced an ad-hoc bonus of up to Rs 3,500 to Group C and D central government employees and personnel of the armed and para military forces.

   The government has sanctioned grant of non-productivity linked bonus (ad-hoc bonus) equivalent to 30 days emoluments for the accounting year 2010-11 to the central government employees (Group C and D), a Finance Ministry's office memorandum said.

   The limit for bonus is Rs 3,500, it added. The bonus will also be given to all non-gazetted employees in Group B, who are not covered by any productivity- linked bonus scheme.

   "The payment will also be admissible to the central Police and para-military personnel and personnel of armed forces," it added.

   Employees of the Union Territory Administration, which follows the central government pattern of emoluments and not covered by any other bonus or ex-gratia scheme would also be eligible for this ad-hoc bonus.

   The expenditure incurred on this account will be debitable to the respective heads to which the pay and allowances of these employees are debited, the Finance Ministry said.

NOTIFICATION

New Delhi. the ;26th August. 2011.

   G.S.R - In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules. 1972. namely: -

1. (1) These rules may he called the Central Civil Services (Leave) (Third Amendment) Rules. 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. For rule 38-A of the Central Civil Services (Leave) Rules. 1972, the following rule shall he substituted, namely:-

"38-A. Encashment of Earned Leave along with Leave Travel Concession while in service.

(1) A Government servant may he permitted to encash earned leave up to ten days at the time of availing of Leave Travel Concession while in service, subject to the conditions that -

(a) a balance of atleast thirty days of earned leave is available to his credit after taking into account the period of encashment as well as leave being availed of:

(b) the total leave so encashed during the entire career does not exceed sixty days in the aggregate;

(2) The cash equivalent for encashment of leave under sub-rule (1) shell be calculated as follows. namely:-

Cash            Pay admissible on the date of      Number of days of earned
equivalent    availing of the Leave Travel       leave being encashed subject
=                Concession plus Dearness +      to the maximum of ten days
                   Allowance admissible on that    at one time.

(3) No House Rent Allowance shall be included in the cash equivalent calculated under sub-rule (2);

(4) The period of earned leave encashed shall not be deducted from the quantum of leave that can normally be encashed by the Government Servant under rules 6. 39, 39-A, 39-B, 39-C and 39-D:

   (5) If the Government Servant fails to avail the Leave Travel Concession within the time prescribed under the Central Civil Services (Leave Travel Concession) Rules, 1988, then he shall be required to refund the entire amount of leave so encashed alongwith interest at the rate of two percent above the rate of interest allowed by the Government as applicable to Provident Fund balances and shall also be entitled for credit back of leave so debited for leave encashment.

The Union Cabinet today approved release of additional instalment of Dearness Allowance to Central Government employees and Dearness Relief to pensioners as due from 01.07.2011 at the rate of 7 per cent over the existing rate of 51 per cent.
The total financial implications on account of both Dearness Allowance and Dearness Relief would be Rs.7228.76 crore per annum and Rs.4819.22 crore in the current financial year.

The undersigned in directed to say that the period of probation to be prescribed for different posts/services in Central Government have been laid down in this Department’s 0M. No. F 44/1/59-Ests(A) dated 15.4 1959 as amended from time to time. With a view to prevent Government servants from becoming possible victims of arbitrary actions or inordinate delay in considering completion of probation/confirmation, the existing instructions on provisions regarding probation in the service recruitment rules relating to Central Civil Services and Posts have been reviewed. It is proposed that in the service / recruitment rules for all Central Civil Services and Posts, in addition to the period of probation, wherever prescribed, corresponding provisions as envisaged in the draft guidelines enclosed herewith, may be incorporated in consultation with this Department.

OFFICE MEMORANDUM
 

SUBJECT: Probation in various Central Civil Services.
 

The undersigned in directed to say that the period of probation to be prescribed for different posts/services in Central Government have been laid down in this Department’s O M No.F 44/1/59-Ests(A) dated 15.4 1959 as amended from time to time. Although instructions exist to the effect that save for exceptional reasons probation should not be extended for more than a year and no employee should be kept on probation for more than double the normal period apart from instructions for timely action on completion of probation/confirmation, these are not invariably followed.
 

2. With a view to prevent Government servants from becoming possible victims of arbitrary actions or inordinate delay in considering completion of probation/confirmation, the existing instructions on provisions regarding probation in the service/recruitment rules relating to Central Civil Services and Posts have been reviewed, it has now been decided that:
 

(i) 1f during the period of probation, a probationer has not undergone the requisite training course or passed the requisite departmental examinations. if any prescribed, or has not been on duty/training for at least 75% of the probation period the period of probation may be extended by such period or periods as may be necessary subject to the condition that the total period of probation does not exceed double the prescribed period of probation except in the cases mentioned in (ii) below:
 

(ii) the period of probation may be extended for such period as the Central Government may think fit in the circumstances of the case in respect of a probationer who is:
(a) under suspension
(b) against whom disciplinary proceedings are pending: or
(c) against whom prosecution for criminal charge is pending
 

(iii) Where a probationer who has completed the period of probation to the satisfaction of the Central Government is required to be confirmed, he shall be confirmed in the Services/Post at the end of his period of probation, having been completed satisfactorily. In such cases, where no order extending the probation period has been issued and no order of confirmation is issued within one year of completion of the prescribed period of probation, the probationer would be deemed to be confirmed in the service/ post.
 

3. In the Service/Recruitment Rules for all Central Civil Services and Posts, in addition to the period of probation. wherever prescribed, corresponding provisions, as in para 2 above, may be incorporated in consultation with this Department in the light of the above instructions.

Subject :- Sixth review meeting with cadre authorities on issues pertaining to CSS/CSSS/CSCS.

The undersigned is directed to say that the next review meeting (6th) with the cadre authorities on issues pertaining to CSS/CSSS/CSCS will be held under the chairmanship of JS(AT&A) on 15.09.2011 between 3.00 PM to 5.00 PM In Room No.119, North Block, New Delhi.

2. The following Agenda items will be discussed in the meeting.

(i) APAR completion of all CSS Officers for 2009-2010 and 2010-11;

(il) Updating of APAR monitoring software by nodal officers;

(iii) Status of submission of Immovable Property Returns for the years 2009 and 2010;

(iv) Non-relieving of Section Officers on ad-hoc promotion to the grade of Under Secretary,

(v) Non-receipt of information from Ministries/Departments for Rotational Transfer of Under
Secretaries;

(vi) Orientation/Induction training and Department Darshan of DR Assistants:

(vIi) Non-relieving of PSs on their promotion as PPS on ad-hoc basis;

(viii) Non-relieving of PAs on their promotion as PS on ad-hoc basis;

(ix) Non-relieving of Steno Grade D’ on their regular and ad-hoc promotion as PA.

(z) Non-receipt of ACR Dossiers of PS for regular panel of PPS of 2010:

(xiv) Furnishing of information in respect of Parliament Assurance given in respect of Lok Sabha unstarred Question No.1654 for 10.08.2011 regarding Rotational Transfer Policy:
(xv) Issue of Service Newsletter for CSS/CSSS/CSCS.

2. It is requested that the updates on the above agenda items may please be furnished latest by 14.09.2011.

3. It is also requested that a DS/Director level officer. well conversant with issues of CSS/CSSS/CSCS may kindly be nominated to attend the meeting scheduled for 15.09.2011.

Generally, the CAPF personnel have cited personal/domestic problems as reasons for seeking voluntary retirement.
 
            Following steps have been taken by the Government to deal with the situation:-
 
i.Implementing a transparent leave policy;
ii. Regular interaction, both formal and informal, among commanders, officers and troops;
iii. Revamping of grievances redressal machinery;
iv.  Provision of basic amenities/facilities for troops and their families;
v. Better medical facilities for troops and their families;
vi.   Increased Risk, Hardship and other allowances;
vii.  Provision of STD telephone facilities to the troops to facilitate being in touch with their family members and to reduce tension in the remote locations;
viii.Yoga Classes for better stress management;
ix.   Recreational and sports facilities etc.;
x.   Central Police Centeen facilities to the troops and their families ; etc.
 
   This was stated by the Minister of State in the Ministry of Home Affairs, Shri Jitendra Singh,  in written reply to a question in the Rajya  Sabha today.
