Sub: Children Education Allowance – Clarification

Please refer to Railway Board’s letter of even number dated 01.10.2008 followed by subsequent letters regarding revised policy instructions / clarifications on Children Education Allowance admissible to Railway Servants, based on the recommendations of Sixth Central Pay Commission.

2. In terms of DOP&T’s recent OM No.A-27012/01/2015-Estt.(AL) dated 22.08.2016, it is clarified that E-Receipts produced by Railway employees as a proof of payment of fee, etc., may be treated as original and hence may be allowed for claiming reimbursement of Children Education Allowance. This is for guidance of all concerned.

Subject: Children Education Allowance (CEA) – Clarification

The undersigned is directed to refer to Department of Personnel & Training’s O.M. No.12011/ 03/ 2008-Estt.(Allowance) dated 2nd September, 2008 and subsequent clarifications issued from time to time on the subject mentioned above and to say that E-Receipts produced by Central Govt. employees as a proof of payment of fee, etc., may be treated as original and hence may be allowed for claiming reimbursement of CEA.

2. This issues with the approval of Joint Secretary (Establishment).

Eligibility criteria of a school for Reimbursement of Children Education Allowance – Clarification issued by CGDA

SUB: Clarification on Reimbursement of Children Education Allowance
REF: This HQrs letter No. AT/IV/4909/Vol V dated 22nd May 2014

The matter regarding admissibility of CEA in r/o of the children studying in Pre-primary schools run by Army welfare Education Society (AWES) was referred to MoD by Hqrs office.

2. MoD D (Pay/Services) has stated that criteria of eligibility of a school is clearly mentioned in para 3 of DOPT O.M. No. 21011/03/2008-Estt (A) dated 23rd November, 2009 which reads “Recognized school/institution in this regard means Govt. school or any education institution whether in receipt of Govt. aid or nor, recognized by the Central or State Govt. or Union territory administration or by University or a recognized educational authority having jurisdiction over the area where the institution is situate.” The MoD D (Pay/Services) has further stated that it is for the concerned beneficiaries to obtain the necessary details from the school regarding its recognition by the concerned authorities and submit them to the paying authorities alongwith the claim for reimbursement.

3. The subject claim may be regulated accordingly.

Instruction regarding simplified procedure for claiming Children Education Allowance: Revised Procedure: JCOS/ OR – PCDA(CC) Instruction

Sub: Instruction regarding simplified procedure for claiming Children Education Allowance: Revised Procedure: JCOS/ OR (the involvement of LAOS in the Revised audit procedure for CEA claims).

Ref: This office letter No. even dated 10.06.15 (copy enclosed).

Please take the reference of above mentioned letter which has been forwarded to your office along with HQrs office letter No.AT/16/Appex-J/Revised 2011/VI dated 27.05.2015 (copy enclosed), stating that after implementation of HRMS 2.0, audit procedure of payment of CEA will undergo substantial change. These instructions, inter-aha, stipulate involvement of LAOS in caring out audit of CEA claims.

2. The HRMS 2.0 has since been implemented in PAO (OR) AMC and PAO(OR) 11 GRRC, Lucknow w.e.f. November 2015. It is, therefore, requested that JCOs ORS of the units whose Pay & allowances are maintained by PAO(AMC), PAO 11 GRRC and also fall under your audit jurisdiction, the CEA claims of JCOs/ OR of the those units will be post audited by your office.

3. Further, a meeting on monthly pay system for Pay and Allowances of JCOs/ OR and Dolphin security was held on 26th October, 2015 at HQrs office. It has been decided during the conference that LAOS should also be involved, may be once in a month, to find out the ground reality and to take up the matter with Unit authority to reduce percentage of DOS-II rejection.

4. It is, therefore, directed by the Competent Authority that LAOS will provide the list of units under their jurisdiction in r/o each of the six PAOS to the respective PAO I / Cs. PAOS will provide a list of rejected DOS II along with reasons of these units to LAOS to take up the matter with Unit authority to check whether action on rejection of DOs II is being taken by unit authorities to reduce percentage of DOS-II rejection. In case of NCC units, if the DOs II of ABF are being published at higher rate vis & vis the stipulated rates, LAOs may also test check the amount from original tickets kept in units.

It may please be noted for strict compliance. Compliance report may be communicated to this office.

Please refer to Railway Board’s letter of even number dated 01.10.2008 followed by subsequent letters regarding revised policy instructions /clarifications on Children Education Allowance admissible to Railway Servants, based on the recommendations of Sixth Central Pay Commission.

2. Now, DOP&T has inter-alia issued clarification on reimbursement of Children Education Allowance in the form of frequently asked questions (FAQ) in terms of their Office Memorandum No. 1-11020/1/2014-Estt.(AL).

The text of OM is tabulated below for guidance of all concerned.

S.No./Question/Answer

1. Whether reimbursement of Children Education Allowance is admissible for the 

(a) Nursery/LKG/UKG as there is no provision of recognition of these classes in most of the States/UTs'; 
Reimbursement is permissible only if the child is studying in a recognised educational institution.

(b) Third child if either of the first two children is disabled to the extent that he/she cannot go to school; 
Reimbursement is allowed to only the two eldest surviving children of the Government servant except when the 2nd child birth in multiple births of the Child is born due to failure of sterilization operation.

(c) The children borne out of second marriage or the children of second wife/husband in additions to children from first marriage; 
Reimbursement is allowed to only the eldest surviving children of the Government servant.

(d) Entitlement of number of Note Books; 
Reimbursement is permissible for any number of note books as may be prescribed by the recognised educational institution.

Dear Sir,
Sub: Children Education Allowance/Hostel Subsidy – Clarification -reg.

Ref: DC/JCM Item No.1/20I2 discussed with the Railway Board on 26th & 27th June2 012.

Federation invites kind attention of the Railway Board to the issues pending with the Railway Board on the subject under DC/JCM Item No.1/2012.

2. In this connection, NFIR desires to state that as per extant instructions, the term “Hostel Subsidy” means expenses incurred by the Railway employees to meet with the Hostel fees if his/her children who have been studying in the school/college located at a minimum distance of 50 Kms., Federation desires to reiterate that there are institutions/colleges in various cities where the students are mandatorily required to opt for Hostel, those who do not opt are denied admission. In view of this reality of situation, imposing the condition of 50 Kms., distance is unjustified and therefore needs to be withdrawn.

3. It has also been reported to NFIR by its affiliate SERMC that the South Eastern Railway Authorities have imposed another condition that the distance of 50 Kms., is to be certified by the District Revenue Officer of the State Government every time the claim is made.

4. Federation further desires to bring to the notice of Railway Board following contradictory situations,arising out of extant provisions:

(i) Para 1(a), (e) & (i) of DoP&T O.M. dated 02nd September 2008 circulated under Railway Board’s letter dated 01/10/2008 (RBE 135/2008) clarifies that the Children Education Allowance and Hostel Subsidies are distinct, Railway employees cannot claim both concurrently.

(ii) Instructions issued by the Railway Board under letter dated 07/06/2013 (RBE- 55/2013), (further reference to question No. 9 of DoP&T O.M. No.21/011/08/2013-Estt./AL) have clarified that Hostel Subsidy includes fee charged for boarding and lodging in addition to fee mentioned in para 1(e) of DoP&T O.M. dated 2nd September 2008.

The position brought out above shows that the two OMs are contradictory and are not conveying clear cut institctions for payment of Children Education Allowance and Hostel Subsidy.

NFIR., therefore, requests the Railway Board to examine the points raised above and arrange to issue clarificatory instructions to the Zonal Railways/PUs to remove confusion. A copy of the instructions issued may be endorsed to the Federation.

Reimbursement of Children Education Allowance

It has been informed by the Department of Personnel and raining that the annual ceiling limit for reimbursement of Children Education Allowance (CEA) is Rs. 18,000/- per child. The Hostel subsidy shall be Rs. 4,500/- per month per child. The annual ceiling for reimbursement of CEA for disabled children of Government employees if Rs. 36,000/- per annum per child and the rates of Hostel subsidy for disabled children of Government employees is Rs. 9,000/- per child per month. These revisions are applicable with effect from 1st January, 2014. The reimbursement is admissible for children studying in institutions affiliated to any Board or recognized institution, whether in receipt of Government aid or not, recognized by the Central or State Government or Union Territory Administration or by University or a recognized educational authority having jurisdiction over the area where the institution is situated. No change is proposed to be made in the same.

This information was given by the Union Minister of Finance, Shri Arun Jaitley in written reply to a question in Lok Sabha today.

After due consideration of the references, in consultation with the Ministry of Finance, Department of Expenditure, it has been agreed to allow reimbursement of 'examination fee' as part of reimbursable items as indicated in para 1(e) of O.M. dated 2nd September, 2008, with effect from the current academic year, subject to the fulfillment of other existing conditions.

Sub:- Children Education Allowance/Hostel Subsidy- clarifications thereon.
   In terms of Railway Board’s letter No. E(W)/2008/ED-2/4 dated 01-10-2008 revised instructions were issued on Grant of Children Education Allowance to Railway employees based on the recommendations of Sixth Central Pay Commission. These instructions provide that Children Education Allowance shall be admissible to Railway servants up to a maximum of two children at the maximum rate of Rs.12,000 (since revised to Rs.15,000/-) per annum per child to cover expenses on education of children under various heads of fee as mentioned in the said letter. In respect of aforesaid policy it was further clarified under Board’s letter No. E(W)2008/ED-2/4 dated 10/06/2009 based on the advice received from Department of Personnel and Training and adopted by Railway Board, that reimbursement of Children Education Allowance is admissible for eldest two surviving children studying in schools affiliated to Board of Education.
