Background: Railways were the first departmental undertaking of the Government of India wherein the concept of PLB was introduced in the year 1979-80. The main consideration at that time was the important role of the Railways as an infrastructural support in the performance of the economy as a whole. 7th CPC Allowances Related to Working on Holidays

7th CPC Allowances Related to Working on Holidays

7th Central Pay Commission Recommendations on Allowances Related to Working on Holidays

Allowances Covered
1. Holiday Compensatory Allowance
2. Holiday Monetary Compensation
3. National Holiday Allowance

Employees, who are regularly required to work on holidays, are compensated in a variety of ways. Some, like the employees of Delhi Police and the CISF, are granted an extra month’s pay per year. Employees of other CAPFs are granted extra thirty days’ leave. Some other categories of staff are paid allowances, which are dealt with in this section. There are 3 such allowances.

1. Holiday Compensatory Allowance

It is a compensation for non-gazetted staff of IB who are required to perform duties on holidays and weekends; granted at the rate of one day’s (Basic Pay + DA) for up to thirty days in a financial year. No demands have been received regarding this allowance.

Analysis and Recommendations

The Commission notes that employees in almost all ministries/departments are, sometimes, required to work on weekends. They are usually compensated by providing a “compensatory off.” Thus, grant of an allowance for weekend working is not justified.

At the same time, the sensitive, and time bound nature of work done by IB should also be kept in mind. Therefore, it is recommended that the non-gazetted staff of IB, presently covered under Holiday Compensatory Allowance, should, henceforth, be covered by National Holiday Allowance. They will be granted this allowance for up to twelve holidays in a year (including the three National Holidays) at the rates prescribed. Accordingly, Holiday Compensatory Allowance, as a separate allowance, should be abolished.

[Government Decision on Holiday Compensatory Allowance: Abolished as a separate allowance. Eligible employees to be governed by National Holiday Allowance. Not to be subsumed and retained as a separate allowance. Existing system to continue in Intelligence Bureau (IB) and Research and Analysis Wing (RAW)]

2. Holiday Monetary Compensation

This allowance is granted in Department of Posts and is payable to postmen and other departmental staff who are required to perform duty on second holiday if three consecutive holidays occur. The existing rates are:

Category
 Rate of Remuneration
Supervisor
₹85 per holiday for 4 hours
Postal Assistant
₹85 per holiday for 4 hours
Postmen
Sorting Postmen/₹85 per holiday
Multi-tasking staff
₹60 per holiday for 4 hours
Demands have been received to increase the rate of this allowance to ₹600 per holiday.

Analysis and Recommendations
Since the allowance is not DA indexed, it is proposed to raise the amount to ₹200 per holiday for Supervisors, Postal Assistants and Postmen/Sorting Postmen; and ₹150 per holiday for Multi-tasking Staff. The rate of allowance will further increase by 25 percent each time DA increases by 50 percent.

[Government Decision on Holiday Monetary Compensation: Retained. Rationalized. Accepted ]

3. National Holiday Allowance

This allowance is paid to non-gazetted Railway employees who are rostered to work on a “National Holiday.” The existing rates are:

Pay in Pay Band + Grade Pay
 Rate
up to ₹7260
 ₹256 per day
₹7261-₹9700
 ₹318 per day
₹9701 and above (limited to non-gazetted staff)
 ₹420 per day
There are demands to increase the amount of this allowance to 1.5 x (one day’s Basic Pay + DA)

Analysis and Recommendations

The Commission notes that although there are only three National Holidays, this allowance is granted for twelve days in a year due to operational constraints. Also, the allowance is already partially indexed to the DA. Hence, it is recommended that the amount should be increased by 50 percent to the following:

Level
Rate of Allowance (per day)
1 and 2
₹384
3 to 5
 ₹477
6 to 8 (limited to non-gazetted staff)
 ₹630
The rate of allowance will further increase by 25 percent each time DA rises by 50 percent.
[Government Decision on National Holiday Allowance: Retained. Enhanced by 50%. Accepted ]

Physical Attack on Railway Employees – NFIR

Incidents of violent attacks on Railway employees in the course of performing their duties

NFIR National Federation of Indian Railwaymen

Affiliated to: Indian Natoinal Trade Union Congress (INTUC)

No. II/34/2018-Part I
Dated: 19/09/2018
The Chairman,
Railway Board,
New Delhi

Dear Sir,

Sub: Incidents of violent attacks on Railway employees in the course of performing their duties-reg.

Of late, it is noticed that the Railway employees are becoming targets of physical attacks by the unruly people/antisocial elements. In this connection, NFIR cites the case of recent physical attack on Travelling Ticket Examiner of S.C. Railway (Secunderabad Division) by a group of people who are habituated of travelling unauthorizedly and threatening on duty staff. It has further been reported that three persons have attacked the Gate Keeper (Track Maintainer) at Level Crossing Gate on Northern Railway and chopped off his left arm on 17th September, 2018. Similar attacks on staff were also reported from different places and no adequate action has been taken by the concerned Law & Order Authorities to deter the miscreants.

Also read: Latest NFIR Letters to Railway Board

The Railway Staff who perform duties in the field and at remote places are developing constant fear of criminal attacks on them by the miscreants. In order to maintain the morale of staff, it would be necessary to urge upon the concerned high level authorities who are accountable for maintaining Law & Order situation to take effective measures. So far as Level Crossing Gates are concerned, provision of CCTV cameras may be considered seriously to facilitate detecting the culprits for further action.

NFIR, therefore, requests the Railway Board to kindly see that concrete steps are taken to protect the Railway Staff working in the field and in the remote sections of the Railway system. Federation may please be kept advised of action being taken by the Railway Board early.

Yours faithfully

‘All India Leave Travel Concession’ (AILTC) facility to Railway Employees

‘All India Leave Travel Concession’ (AILTC) facility to Railway Employees
Scheme of optional ‘All India Leave Travel Concession’ (AILTC) facility to Railway Employees

Scheme of optional ‘All India Leave Travel Concession’ (AILTC) facility, once in a block of four years (i.e. 2018-2021 onwards) on surrender of Privilege Passes (PP)

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)
No.E(W)2017/PS5-1/3
New Delhi, dated 10.09.2018
The General Managers (P)
All Zonal Railways &
Production Units

Sub: Scheme of optional ‘All India Leave Travel Concession’ (AILTC) facility, once in a block of four years (i.e. 2018-2021 onwards) on surrender of Privilege Passes (PP).
Ref: Department of Personnel & Training (DoP&T)’s OM No.31011/15/2017-Estt.A-IV dated 27.03.2018.
Pursuant to recommendations of Seventh CPC, DoP&T have communicated Government’s decision, vide their OM referred above, to allow the Railway employees to avail AILTC facility in accordance with the ‘Central Civil Services (Leave Travel Concession) Rules, 1988’ i.e. CCS (LTC) Rules.
2. Accordingly, in exercise of powers conferred vide Rule 1(3)(iii) of Railway Servants (Pass) Rules, 1986 (Second Edition-1993), the Competent Authority in the Ministry of Railways has accorded approval to exclude such railway servants and other eligible persons (i.e. eligible for PP) from the facility of Privilege Passes in that particular calendar year in which they opt for AILTC facility. Applicants may avail AILTC facility subject to conditions stipulated in para 2 of the referred OM dated 27.03.2018 (copy enclosed as Annexure-I). This facility is further subject to procedural guidelines/conditions stipulated hereunder.
3. These orders shall be applicable to
(i) Railway Servants entitled to PPs;
(ii) Other government department’s officials serving in railways on deputation and entitled to PPs; (iii) Other officials serving in railways and entitled to PPs; and
(iv) Officials of Audit Department (Railway) entitled to PPs. The Competent Authorities concerned shall modify terms and condition of such officials as required and necessary. These orders would not be applicable to those who are undergoing minor penalty of stoppage of even a single PP at the time of application for availing AILTC.
4. Those officials, who opt for AILTC facility, would be issued a “Privilege Pass Surrender Certificate” (PPSC) i.e. a pre-requisite for availing AILTC facility. The “Pass Issuing Authority” (PLA) shall issue the PPSC as per format at Annexure-II, duly following the procedure stipulated as under:-
 (i) Applicant employee will submit an application (format at Annuexure-III) to the concerned PIA for issue of a PPSC.
(ii) Thereafter, the PIA will first check the “Privilege Pass Account” (PPA) of the applicant to verify whether the applicant has already availed any PP or not in that particular calendar year.
(iii) If applicant has already availed a PP in that particular calendar year, then the application for issue of PPSC would be rejected and the applicant should be intimated accordingly, as per format at Annexure-IV.
(iv) If applicant has not availed any PP in that particular calendar year, the PIA concerned will disallow operation of PPA by blocking it with an entry (PPSC issued on date …/…/…./) in PPA so that the applicant is barred from drawing any PP, even inadvertently, during that particular calendar year in which AILTC facility has been opted.
(v) If both husband and wife are entitled to PPs, both have to surrender their respective entitled PPs that are admissible to them in the calendar year in which either of them opt for AILTC facility. In this scenario, PIA will issue a single composite PPSC duly completing Part-II of the PPSC.
The following procedure will be followed, additionally, in such cases:-
(a) If PPAs of both the spouses are maintained by same PIA at the time of applying for AILTC facility, then the composite PPSC will be issued by the PIA after receipt of a joint application from both of them.
 (b) If PIAs of both the spouses are different (due to any reason or on account of their working in separate Railways/Divisions/Units, etc.,), the PPSC shall be issued by the PIA concerned of the applicant only after receipt of a “Confirmation Note in lieu of PPSC” (CN) to be issued (by other PIA as per format in Annexure-V) in favour of spouse of the main applicant. The spouse will apply for CN as per format at Annexure-VI.
(vi) In case of a deputationist (i.e. Railway servant serving on deputation etc in any other organization) and eligible for PPs as per statutory rules, the PIA concerned will issue PPSC as per aforementioned procedure.
(vii) The PIA will issue PPSC/CN or intimate about rejection/non-acceptance of the request, as the case may be, within ten working days of receipt of application.
(viii) After issue of PPSC/CN, request for its cancellation and re-opening of PPA will not be entertained on any ground, even if AILTC facility could not be availed due to whatsoever reason i.e. whether administrative or personal reasons.
(ix) The role of PIAs will cease once “PPSC” is issued to the applicant. Matters such as advance/reimbursement/travel entitlements during availing of AILTC shall be dealt by other respective Sections of Personnel/Accounts Department handling Travelling Allowance claims, taking into account PPSC as a basic document alongwith other documents stipulated in the CCS (LTC) Rules.
(x) A duplicate PPSC/CN can only be issued under special circumstances by the PIA concerned after taking approval of the Principal CPO.

5. The Railways should administer the AILTC facility strictly in accordance with the CCS (LTC) Rules-1988, as modified from time to time, without any deviation. It may be noted that ‘Home Town LTC/Home Town converted LTC’ shall not be admissible to railway servants and the definitions of beneficiaries for LTC (e.g. members of family, dependents), dependency critieria, etc are different from that Railway Servants (Pass) Rules, 1986. A copy of DoP&T’s letter No.31011/7/2013-Estt.(A)-IV dated 26.09.2014, containing clarifications and illustrations on administering LTC entitlements of “Fresh Recruits” is enclosed as Annexure-VII. Accordingly, the AILTC facility shall be regulated fully by the conditions and definitions as laid down in the CCS (LTC) Rules.
6. Regarding travel entitlements for availing of AILTC facility, copies of following OMs, as applicable on date, are enclosed:-
Issued by
Details
Annexure No.
Ministry of Finance
OM No. 19030/1/2017-E.IV dated 13.07.2017

Annexure-IX
DoP&T
OM No. 31011/8/2017-Estt.A-IV dt. 18.01.2018

It may be noted that DoP&T have stipulated vide their OM dated 19.09.2017 that (i) the travel entitlements for the purpose of LTC shall be the same as TA entitlements as notified vide MoF’s OM dated 13.07.2017, excepting the air travel entitlements for the employees in Level 6 to 8 of the Pay Matrix (para 3) and (ii) the other conditions that would govern the LTC facility (para 4). Hence, the same entitlements prevailing in civil side (i.e. not as per railway entitlement) will be applicable for availing AILTC facility.

Hence, these orders/instructions will not be circulated separately by the Ministry of Railways. Accordingly, the Railways and PUs should regularly visit the official website of DoP&T and download the latest instructions from time to time for settling claims of LTC etc and for compliance.

ACP & MACP Schemes for the CG Civilian Employees including Railway employees

ACP & MACP Schemes for the Central Government Civilian Employees including Railway employees

Grant of financial upgradation under ACP & MACP Schemes for the Central Government Civilian Employees including Railway employees

No.IV/MACPS/09/Part II
Dated: 21/08/2018
The Secretary
(Department of Personnel PG & Pension)
Department of Personnel & Training
North Block,
 New Delhi

Dear sir,
Sub: Grant of financial upgradation under ACP & MACP Schemes for the Central Government Civilian Employees including Railway Employees – reg.

Ref: (i) DOP&T OM No.350344/1/97-Estt(D) dated 09-08-1999 (ii) DOP&T OM No.35034/3/2008-Estt(D) dated 19-05-2009

NFIR invites kind attention to the OM dated 09/08/1999 wherein the Government of India (DOP&T) had introduced ‘Assured Career Progression Scheme’ (ACPS) for the Central Government Civilian Employees pursuant to the recommendations of 5th Central Pay Commission. The ACP Scheme was made effective in the Central Government departments from 1999. The ACP Scheme remained functional until 31/08/2008 (as clarified by the DoP&T vide para 9 its OM dated 19/05/2009) due to the fact that the ‘Modified Assured Career Progression Scheme’ was introduced by the DoP&T, replacing ACPS w.e.f. 01/09/2008, pursuant to the recommendations of 6th CPC.

The Federation has however been receiving representations from the Central Government Civilian Employees, mainly railway employees from all corners of the country to make the MACP Scheme operational w.e.f. 01/01/2006 instead from 01/09/2008, pursuant to the order dated 08th December, 2017 passed by the Hon’ble Supreme Court in Civil Appeal Diary No.3744 of 2016. In this connection, NFIR places following facts for consideration:-

On perusal of the order of the Apex Court, it is found that the Hon’ble Apex Court has held that the MACP is a part of pay structure recommended by the 6th CPC, the same cannot be considered as allowance which had been given effect from 01/09/2008. The said order has also cited the Resolution dated 30/08/2008 of the Government which was referred in the notification issued by the Ministry of Finance wherein MACP has been defined part of ‘Pay structure’ and not as ‘Allowance’ and therefore should be given effect from 01/01/2006.

The order dated 8th Dec’2017 passed by the Apex Court has already been implemented by the Ministry of Defence, giving effect to the MACPS w.e.f. 01/01/2006 through an OM dated 25/07/2018.
DoP&T may kindly take note that in para 6.5.2 & 6.5.4 of the report of 6th CPC, the Commission had recommended for implementation of the revised pay structure consisting of Pay Band and Grade Pay w.e.f. 01/01/2006 while the revised allowances were given effect from prospective date i.e. 01/09/2008.
Ministry of Finance vide Gazette of India, Extraordinary Notification of Resolution No. 1/1/2008-IC dated 29/08/2008 had implemented revised pay structure (Pay Band & Grade Pay) w.e.f. 01/01/2006 whereas the implementation of MACPS was made effective from 01/09/2008. Accordingly, Ministry of Railways also implemented revised Pay structure w.e.f. 01/01/2006 vide its order dated 04/09/2008 while the rates of Non Practicing Allowance (NPA) were revised w.e.f. 01/01/2006 vide Board’s order dated 22/09/2008. Therefore, the MACPS which is part of Pay structure as decided by Apex Court should be given effect from 01/01/2006 in railways and all other Central Government departments.
Another important fact which cannot be ignored is, that the Apex Court had held that the benefit of ACP granted to an employee is part of the Pay structure which not only affects the pay but also pension of the employee, therefore, decided that the ACP is not allowance but a part of pay. At the same time, the Hon’ble Supreme Court further held that there can be no dispute that grant of ACP is part of pay structure and that the resolution dated 30/08/2008 relating to implementation of 6th CPC recommendations on pay structure, pay bands, grade pay etc have been given effect from 01/01/2006 and also added that this is the decision of the Cabinet which could not have been modified by issuing executive instructions.
NFIR suggests that while issuing modified instructions, in compliance with Apex Court order, the DoP&T may allow option opportunity to all those beneficiaries of ACPS as well MACPS to exercise their option for financial upgradation from the dates advantageous to them so as to avoid further grievances.
Summing up, NFIR urges upon the DoP&T to kindly consider the above points and issue modified instructions for granting financial upgradation under MACPS with effect from 01/01/2006 as was done by the Ministry of Defence. A copy of the instructions issued may be endorsed to this Federation.
Yours faithfully

7th CPC Transport Allowance to the Railway employees – NFIR

7th CPC Transport Allowance to the Railway employees – NFIR
Transport Allowance to the Railway employees – Deprival of higher rate to those working in pay Level 1 & 2

No. IV/NFIR/7 CPC (Imp) / Allowance/2016/Part I
Dated: 08/06/2018
The Secretary (E), Railway Board, New Delhi Dear Sir,
Sub: Government’s decision on recommendation of the 7th Central Pay Commission – Transport Allowance to the Railway employees – Deprival of higher rate to those working in pay Level 1 & 2 – reg. Ref: (i) Railways Board’s letter No. PC-V/2017/A/TA/1 dated 17/08/2017 (RBE No. 96/2017) (ii) NFIR’s Letter No. IV/NFIR/7 CPC/Allowance/2016/ Part I dated 28/08/2017. (iii) Railway Board’s letter No. PC-V/2015/PNM/NFIR/4 dated 17/20-11-2017. (iv) NFIR’s letter No. IV/NFIR/7 CPC (Imp)/ Allowance/2016/Part I dated 05/04/2018.
Kind attention of Railway Board is invited to the references cited above.
NFIR reiterates that pursuant to issuance of instructions dated 17/08/2017, situation has arisent wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above and also upto Pay Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs 1800 + DA thereon) have been deprived of the said rate (due to the new norm for entitlement)
In this context, Federation furnishes below the rates granted pursuant to acceptance of the recommendations of the 5th CPC and 6th CPC:- (a) Recommendations of 5th CPC – Transport Allowance RBE No. 179/1997 (rates w.e.f 01/08/1997)
S.No.
Pay Scale of the employees
A1/A Class City
Other Places
1
Rs. 8000-13500 or above
800
400
2
Rs. 6500-10500 or above but below Rs. 8000-13500
400
200
3
Below Rs. 6500-10500
100
75
From the above, it could be seen that those in pay scale below Rs.6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irrespective of their pay. (b) After introduction of 6th CPC Pay Band/Grade Pay, the Railway Board vide circular (RBE No. 111/2008 – effective from 01/09/2008 and RBE No. 95/2015) had prescribed following rates for payment of Transport Allowance to the employees.
Employees drawing Grade Pay of
Rate of Transport Allowance
For A1/A class cities
GP 5400 & above
3200 + DA
GP 4200 – 4800,
GP below 4200 and pay in pay band = RS 7440
1600 + DA
GP below 4200 and Pay below RS 7440
600 + DA
A comparison of two tables mentioned above, reveals that Railway employees were allowed higher rate of Transport Allowance on their drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. However, the modified Board’s instructions issued vide letter dated 03/08/2017 and 17/08/2017,have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs. 24700/- Federation, therefore requests the Railway Ministry to kindly refer the matter to Ministry of Finance, for mitigating the problem.
Yours faithfully, (Dr. M. Raghavaiah) General Secretary
