Modi Government considers closing some loss-making state firms like BSNL, MTNL, Air India

Government officials will meet on Tuesday to discuss proposals to shut down some loss-making state-owned companies, risking a conflict with powerful trade unions.

After two decades of halting privatisations, the central government still owns about 260 firms and thousands more at the state level, involved in activities ranging from generating nuclear power to making condoms.

Some of them, including Oil and Natural Gas Corporation and Steel Authority of India are successful, but there are dozens more that have been bleeding cash for decades and kept afloat by budgetary support each year.

On Tuesday, Cabinet Secretary Ajit Seth has called a meeting of top officials to consider what to do with the 10 firms that make the biggest losses. They had a combined net loss of Rs 245 billion ($4 billion) in 2012/13.

The list includes Bharat Sanchar Nigam, Mahanagar Telephone Nigam, Air India, Hindustan Photofilms and Hindustan Fertilisers Corporation, according to a note prepared by the Department of Public Enterprises.

Officials at the department have drawn up proposals to close some.

They include Hindustan Photofilms, a company set up in 1960 to make film rolls and take on the likes of Kodak but declared a sick company in 1996 and recommended for closure by the department in 2003 on the grounds that it could not compete with private players.

The company, based in the southern town of Ottacamund in the Nilgiri hills, went to court and won a stay order on any further proceedings that could lead to its closure.

In 2010 the firm proposed a recovery plan but the government has been sitting on it, with no decision having been made since about the company's future. In the meantime the company's accumulated losses have piled up to 82.32 billion rupees, about 40 times its paid-up capital.

"There is no future for this company in the current environment. It is a fit case for winding down," said a government official at the Department of Public Enterprises, which is overseeing the privatisation of state firms. The official did not wish to be named due to the sensitivity of the matter.

The department will be making a presentation at Tuesday's meeting.

The government is also considering a proposal to wind down the watch-making division of HMT Machine Tool Limited after years of losses that have forced it to borrow from the government to pay wages.

UNIONS

Trade unions are opposed to any moves to shut down state firms and the Bharatiya Mazadoor Sangh (BMS), a body affiliated to the ruling Bharatiya Janata Party, said it would work with other unions to block the move.

"We are co-ordinating with all central trade unions on the matter. We are fortunate that all trade unions are on the same page when it comes to these issues," said Vrijesh Upadhyaya, general secretary of the BMS.

Prime Minister Narendra Modi's administration, which took office in May pledging to reignite growth, has embarked on a cautious course of shedding stakes in state firms although it has eschewed big moves.

The government increased its privatisation target for its fiscal year 2014/15 budget to 630 billion rupees from the interim budget's target of 480 billion. The target is nearly four times larger than total government divestments in the past four years.

Officials said the government was also looking for ways to revive some of the sick companies through capital infusion, joint ventures and by bringing in new management.

No. 1-15/2011 -PAT(BSNL)
 Dated, 01-July, 2014

OFFICE ORDER

Subject: Pay fixation in case of Group “C” & “D” officials absorbed in BSNL who have opted for IDA pay sale from the date of promotion after 01.10.2000 - withholding of recovery reg.

I am directed to say that BSNL CO issued Office order No. 1-5/2004-PAT(BSNL) dated 30.6.2004 indicating availability of an option under Para 4 of DOP&PW OM No. 4/18/87 P&PW(D) dated 05.07.1989 to Government employees seeking permanent absorption in BSNL to retain Government pay scales till their promotion or retirement (whichever is earlier). Subsequently, it was clarified vide BSNL letter No. 1-37/2004-PAT(B) dated 24.9.2004 that the pay of such officers on promotion is to be fixed in CDA pay scales under FR and thereafter the enhanced pay is to be converted into IDA pay scales on point to point basis. In this regard, DOT vide letter No. 1-1(04)/2005-PAT(Pt.) dated 24.9.2008 had conveyed to CCA Kerala to decide the case provisionally based on existing instructions of BSNL till any further clarification is issued by them. However, in many other circles also, O/o CCA have nullified this option of the BSNL employees, which has resulted in reduction of their pay and consequently the pensionary benefits.

2. Subsequently, in respect of Group ‘B’ employees, DOT vide letter No. 2-49(3)/2009-PAT dated 4.11.2010, conveyed the decision for extending the pensionary benefits to all retiring / retired BSNL Employees, who had opted for their pay fixation in IDA pay scale from the date of promotion after 1.10.2000, provisionally as per BSNL letter dated 24.9.2004, on execution of bonds by them to the effect that subject to the final decision of the Government on the issue, they will abide by that decision and they are liable to refund the excess amount paid, if any, on account of provisional pay fixation in IDA pay scale from the date of their promotion after 1.10.2000.

3. The matter was referred to DOT to confirm the applicability of DOT letter No. 2-49(3)/2009-PAT dated 4.11.2010 regarding provisional pay fixation in respect of absorbed Non-executives who have already given option to switch over to pay scales from the date of regular promotion / retirement whichever is earlier. The decision of DOT is awaited in the matter.

4. It has been decided with the approval of competent authority that the recovery of overpayment due to nullifying of the option exercised by Group “C & “D” employees (Non-executives), may be withheld till a decision in this matter is received from DOT, subject to an undertaking to be obtained to the effect that in case the DOT does not agree to BSNL’s proposal for extending the benefit of para 4 of DOP&PW OM No. 4/18/87-P&PW (D) dated 5.7.1989 to the Non-executives, the overpayment on this account would be recovered from those employees in whose case recovery is being withheld.

VRS IS DANGEROUS TO BSNL AND EMPLOYEES

The BSNL Management supplied a copy of its VRS proposal to BSNL Employees Union on 20.09.2011 seeking its view on the proposal. The BSNL Employees Union as well as JAC have decided to go on struggle against the VRS, since it is against BSNL and employees. The following are the reasons for opposing the VRS.

1. VRS is bad in theory and failed in practice

VRS is bad in theory since it is in essence nothing but blaming the employees and the expenditure on their wages as responsible for the losses incurred by the Company. It is based on the false presumption that by reducing the number of employees, the losses can be reduced and profits can be revived. 3 rounds of VRS were already implemented in MTNL. But it resulted in further losses to MTNL. Thus VRS is bad in theory and failed in practice.

2. Large scale removal of one lakh employees from service

Since the removal of a small number of employees failed to save MTNL from losses, now the BSNL management proposes to remove employees in large number. Its proposal aims at removing one lakh employees from service, out of the existing 2,76,000 employees. This indicates a large scale attack on the employees.

3. It is not VRS but it is CRS

Fixing the target of removal one lakh employees in the name of VRS reveals that it is not voluntary and the employees will be coerced to take VRS till the target is reached. Therefore in practice it is CRS

Encashment of Earned Leave along with Leave Travelling Concession (LTC) for the staff of BSNL

BHARAT SANCHAR NIGAM LTD
(A Government of India Enterprise)

CORPORATE OFFICE
PAT SECTION
Bharat Sanchar Bhawan
H.C. Mathur Lane, New Delhi-01

No: 1-10/2010- PAT(BSNL)
Dated:30-Jun-2011

Subject: Encashment of Earned Leave along with Leave Travelling Concession (LTC) for the staff of BSNL (absorbed, directly recruited & un-absorbed employees) without deducting the same from the overall accumulation limit of 300 days - clarifications regarding.

Following the issue of this office order (No. 19 of 2010) of even no. dated 27 10.2010, this office has received references from various circles seeking clarifications regarding encashment of EL while availing LTC The matter has been considered in this office and points of doubts raised by the circles and the clarifications thereto are issued as under:-

Query

Clarifications

1.Whether encashment is allowed for cases where the employee alongwith some other members of his/her family has already availed LTC before 28.9.2010 but remaining members avail LTC on or after 28.9.2010?

2. Whether the Earned Leave Encashment of 10 days is admissible. if the employee does not proceed on LTC and only the eligible family
members are availing the LTC

The encashment of Earned Leave while availing LTC is admissible to the employees of BSNL where the outward journey is performed by him/her:-

a) On or after 28-09-2010 PAT, BSNL order (No.19 of 2010) No. 1-10/2010-PAT(BSNL)/Encashment of EL dated 27.10.10 is applicable

b) b) Prior to 28-09-2010 PAT, BSNL order no. 13- 2/20 1 0-PAT(BSNL) dated 18-03-2010 is applicable.
[the concerned employee should avail LTC for himself/herself for getting encashment of earned leave at the time of availing LTC]

3. Whether amount of encashment of EL can be paid before commencement of LTC journey considering the fact that if the LTC journey is cancelled by the employee due to any reason, there would be overpayment on such encashment. which is required to be recovered forthwith In such cases of cancellation of LTC journey, how the recovery of penal interest for the period the encashment amount is lying with the
employee will be charged?

The amount of encashment of EL can be paid either in advance i.e. before commencement of journey on LTC or after completion of journey on LTC. However, employee should apply for leave encashment before proceeding on journey.

In case of payment of EL encashment paid in I advance and cancellation of LTC journey, the employee concerned should intimate about cancellation to the sanctioning authority and refund the full amount of encashment of EL immediately (i e. within a week from the date of cancellation of LTC journey).

In case of non-refund of amount of encashment of EL within the stipulated time, the amount may be recovered in one lump—sum from the next issue of his/her salary and the penal interest on the entire advance from the date of drawal to the date of recovery will be charged Regarding rate of penal interest and other terms & conditions of recovery Rule 15 of CCS I (LTC)Res, 1988 should be followed

4. Whether BSNL permitted its employees to avail encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.

As per this Office Order (No.05/20 10) issued under letter No.13-2/2010-PAT(BSNL) dated 18.3.2010, there is no linkage to the number and nature of leave availed while proceeding on LTC for availing encashment of EL upto 10 days at the time of availing LTC, for the
present.

5 .Whether the 10 days leave encashment can be granted to the officers/officials, who are availing less then ten days E/L or C/L for LTC purpose.

Yes. Encashment of EL. is admissible subject to the terms and conditions available in the existing relevant orders.

6. Whether the word ‘LTC’ qualify an official to avail leave encashment on home town LTC also.

The Encashment of EL is admissible on the Home Town LTC and All India LTC once in a block of two years & four years respectively as the case may be.

7. How the Earned leave encashed alongwith LTC will be debited into the account of the employees.

The number of days of Earned Leave encashed on LTC together with number of days of Earned leave availed will be deducted from the account of EL of the concerned employee.

However, at the time of cessation of service due to superannuation! retirement) resignation, he/she will be allowed the actual number of days of earned leave at the credit of the employee on the last day of his service, subject to overall limit of 300 days/i 50 days as the case may be.
