Consumer Price Index for Industrial Workers (CPI-IW) – June, 2016

The All-India CPI-IW for June, 2016 increased by 2 points and pegged at 277 (two hundred and seventy seven). On 1-month percentage change, it increased by (+) 0.73 per cent between May, 2016 and June, 2016 when compared with the increase of (+) 1.16 per cent between the same two months a year ago.

The maximum upward pressure to the change in current index came from Food group contributing (+) 2.51 percentage points to the total change. At item level, Rice, Wheat, Besan, Black Gram, Gram Dal, Groundnut Oil, Eggs (Hen), Goat meat, Poultry (Chicken), Milk, Garlic, Onion, Tomato, Potato Brinjal, Cabbage, other seasonal Vegetables, Tea Leaf, Doctors’ Fee, Petrol, Repair Charges, etc. are responsible for the increase in index. However, this increase was checked by Arhar Dal, Fish Fresh, Coconut, Mango (Ripe), Electricity Charges, putting downward pressure on the index.

The year-on-year inflation measured by monthly CPI-IW stood at 6.13 per cent for June, 2016 as compared to 6.59 per cent for the previous month and 6.10 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 8.33 per cent against 8.48 per cent of the previous month and 6.67 per cent during the corresponding month of the previous year.

At centre level, Mercara reported the maximum increase of 13 points followed by Vadodara (12 points), Darjeeling and Ahmedabad (10 points each), Bhavnagar (9 points) and Nagpur (8 points). Among others, 7 points increase was observed in 2 centres, 6 points in 5 centres, 5 points in 5 centres, 4 points in 5 centres, 3 points in 12 centres, 2 points in 15 centres and I point in 14 centres. On the contrary, Quilon recorded a maximum decrease of 6 points followed by Chennai (4 points), Salem (3 points) and Coonoor (2 points). Among others, 1 point decrease was observed in 3 centres. Rest of the 7 centres’ indices remained stationary.

The indices of 34 centres are above All-India Index and other 44 centres’ indices are below national average.

The next issue of CPI-IW for the month of July, 2016 will be released on Wednesday, 31st August, 2016. The same will also be available on the office website www.labourbureaunew.gov.in.

7th CPC Fixation of Pay and Payment of Arrears — Instructions - Regarding.

Subject: Implementation of the recommendations of the 7th Central Pay Commission — fixation of pay and payment of arrears —instructions- regarding.

The undersigned is directed to refer to the Government of India, Ministry of Finance, Department of Expenditure’s Resolution No. 1-2/2016-IC dated 25.07.2016, bringing out the decisions of the Government on the recommendations of the 7th Central Pay Commission as well as the consequent promulgation of the Central Civil Services (Revised Pay) Rules, 2016, notified vide G.S.R No. 721(E) dated 25th July, 2016 regarding fixation of pay in the revised pay structure effective from 01.01.2016 and to say the provisions governing such fixation of pay have been clearly enunciated in the said Rules.

2. Accordingly, in pursuance of the CCS (RP) Rules, 2016, appropriate necessary action to fix the pay of the employees covered thereunder in the revised pay structure needs to be carried out forthwith in accordance with the provisions contained therein. In order to facilitate a smooth and systematic fixation of pay, a proforma for the purpose (Statement of Fixation of Pay) is enclosed at Annexure. The statement of fixation of pay in revised pay structure as per CCS (RP) Rules, 2016 be prepared in triplicate and one copy thereof be placed in the Service Book of the employee concerned and another copy made available to the concerned accounting authorities [Chief Controller of Accounts/Controller of Accounts/Accounts Officer] for post-check.

3. The revised pay structure effective from 01.01.2016 includes the Dearness Allowance of 125% sanctioned from 01.01.2016 in the pre-revised pay structure. Thus, Dearness Allowance in the revised pay structure shall be zero from 01.01.2016. The rate and the date of effect of the first installment of Dearness Allowance in the revised pay structure shall be as per the orders to be issued in this behalf in future.

4. The decision on the revised rates and the date of effect of all Allowances (other than Dearness Allowance), based on the recommendations of the 7th Central Pay Commission shall be notified subsequently and separately. Until then, all such Allowances shall continue to be reckoned and paid at the existing rates under the terms and conditions prevailing in the pre-revised pay structure as if the existing pay structure has not been revised under the CCS (RP) Rules, 2016 issued on 25.07.2016 .

5. The contributions under the Central Government Employees Group Insurance Scheme (CGEGIS) shall continue to be applicable under the existing rates until further orders.

6. The existing system on interest free advances for medical treatment, Travelling Allowance for family of deceased, Travelling Allowance on tour or transfer and Leave Travel Concession shall continue as hitherto.

7. The arrears as accruing on account of revised pay consequent upon fixation of pay under CCS (RP) Rules, 2016 with effect from 01.01.2016 shall be paid in cash in one installment along with the payment of salary for the month of August, 2016, after making necessary adjustment on account of GPF and NPS, as applicable, in view of the revised pay. DDOs/PAOs shall ensure that action is taken simultaneously in regard to Government’s contribution towards enhanced subscription.

8. With a view to expediting the authorization and disbursement of arrears, it has been decided that the arrear claims may be paid without pre-check of the fixation of pay in the revised scales of pay. However, the facilities to disburse arrears without pre-check of fixation of pay will not be available in respect of those Government servants who have relinquished service on account of dismissal, resignation, discharge, retirement etc. after the date of implementation of the Pay Commission’s recommendations but before the preparation and drawl of the arrears claims, as well as in respect of those employees who had expired prior to exercising their option for the drawal of pay in the revised scales.

9. The requirement of pre-check of pay fixation having been dispensed with, it is not unlikely that the arrears due in some cases may be computed incorrectly leading to overpayments that might have to be recovered subsequently. Therefore, the Drawing & Disbursing Officers should make it clear to the employees under their administrative control, while disbursing the arrears; that the payments are being made subject to adjustment from amounts that may be due to them subsequently should any discrepancies be noticed later. For this purpose, an undertaking as prescribed as per a “Form of Option” under Rule 6(2) of the CCS(RP) Rules, 2016 shall be obtained in writing from every employee at the time of exercising option under Rule 6(1) thereof.

10. In authorizing the arrears, Income Tax as due may also be deducted and credited to Government in accordance with the instructions on the subject.

11. On receipt of the necessary options, action for drawal and disbursement of arrears should be completed immediately.

The date of effect of allowances

Comrades,

The Central Government employees are always be cheated in respect of date of implementation of allowances especially on HRA , from past twenty years it is observed that these allowances are issued from a later date in 5th CPC case it was issued after 20 months , in case of 6th CPC it was issued after 32 months , in 7th CPC we hoped it will be issued in 7 months , but it was not the case , now it is likely to be issued only after 12 months . There by causing financial loss to the employees, the cost of living index is going up every month, but the allowances especially the HRA is not issued from the date of effect of the pay commission.

The following are the facts :

The Fifth Central Pay Commission was set up by the Government of India by Resolution No. 5(12)/E. III/93 dated 9th April, 1994. The Commission submitted on the 30th January, 1997. The revised allowances, other than dearness allowance, was effective from 1st day of August, 1997 instead of 1st January 1996.

The Government constituted the Sixth Central Pay Commission vide Resolution No. 5/2/2006-E.III(A) dated October 5, 2006. and Gazette Notification for implementation of 6th CPC was issued on 29th August 2008, all allowances were issued effective from 1st August 2008 instead of 1st January 2006.

In a resolution dated 28th February, 2014, Government of India has appointed the Seventh Central Pay Commission. The Gazette Notification for implementation of 7th CPC was issued on 25th July 2016 (without allowances) , all allowances are likely to be issued from 1st December 2016 instead of instead of 1st January 2016 after a committee headed by the Finance Secretary gives its report .

The present HRA and other allowances as per 6th CPC is totally insufficient, the cost of housing has gone up drastically and cost of living has gone up hence urgent need to revise the HRA and other allowances , we hope the Government to review the allowances at the earliest, so that the Central Government employees will get the enhanced allowances especially HRA from 1st July 2016 as per earlier practices.

G.S.R. 746(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, namely:-

1. Short title and commencement : –

(1) These rules may be called the Railway Services (Revised Pay) Rules, 2016.

(2) They shall be deemed to have come into force on the 1st day of January, 2016.

2. Categories of Railway servants to whom the rules apply: –

(1) Save as otherwise provided by or under these rules, these rules shall apply to persons appointed to Railway services.

(2) These rules shall not apply to : –

(i) Permanent employees of former Indian States absorbed in Railway Services so long as such persons continue to be governed by the pre-absorption conditions of service under the Railway Services;

(ii) persons locally recruited for services in Diplomatic, Consular or other Indian establishments in foreign countries;

(iii) persons not in whole-time employment;

(iv) persons paid out of contingencies;

(v) persons paid otherwise than on a monthly basis including those paid only on a piece-rate basis;

(vi) persons employed on contract except where the contract provides otherwise;

(vii) persons re-employed in Railway service after retirement;

(viii) any other class or category of persons whom the President may, by order, specifically exclude from the operation of all or any of the provisions contained in these rules.

3. Definitions: –

In these rules, unless the context otherwise requires: –

(i) “existing basic pay” means pay drawn in the prescribed existing Pay Band and Grade Pay or pay in the existing scale;

(ii) “existing Pay Band and Grade Pay” in relation to a Railway servant means the Pay Band and the Grade Pay applicable to the post held by the Railway servant as on the date immediately before the notification of these Rules whether in a substantive capacity or in officiating capacity;

(iii) “existing scale” in relation to a Railway servant means the pay scale applicable to the post held by the Railway Servant as on the date immediately before the notification of these Rules in the Higher Administrative Grade, Higher Administrative Grade + and the Apex scale whether in a substantive or officiating capacity;

(iv) “existing pay structure” in relation to a Railway Servant means the present system of Pay Band and Grade Pay or the Pay Scale applicable to the post held by the Railway Servant as on the date immediately before the coming into force of these Rules whether in a substantive or officiating capacity.

Explanation- The expressions “existing basic pay”, “existing P ay Band and Grade Pay” and “existing scale”, in respect of a Railway Servant w ho on the 1st day of January, 2016 was on deputation out of India or on leave or on foreign service, or who would have on that date officiated in one or more lower posts but for his officiating in a higher post, shall mean such basic pay, Pay Band and Grade Pay or scale in relation to the post which he would have held but for his being on deputation out of India or on leave or on foreign service or officiating in higher post, as the case may be;

(v) “existing emoluments” mean the sum of (i) existing basic pay and (ii) existing dearness allowance at index average as on 1st day of January, 2016;

(vi) “Pay Matrix” means Matrix specified in Part A of th e Schedule, with Levels of pay arranged in vertical cells as assigned to corresponding existing Pay Band and Grade Pay or scale;

(vii) “Level” in the Pay Matrix shall mean the Level corr esponding to the existing Pay Band and Grade Pay or scale specified in Part A of the Schedule;

(viii) “pay in the Level” means pay drawn in the appropri ate Cell of the level as specified in Part A of the Schedule;

(ix) “revised pay structure” in relation to a post mea ns the Pay Matrix and the Levels specified therein corresponding to the existing Pay Band and Grade Pay or scale of the post unless a different revised Level is notified separately for that post;

(x) “basic pay” in the revised pay structure means the pay drawn in the prescribed Level in the pay matrix;

(xi) “revised emoluments” means the pay in the Level of a Railway servant in the revised pay structure; and

(xii) “Schedule” means a schedule appended to these Rules .

4. Level of posts: –

The Level of posts shall be determined in accord ance with the various Levels as assigned to the corresponding existing Pay Band and Grade Pay or scale as specified in the Pay Matrix.

5. Drawal of pay in the revised pay structure: –

Save as otherwise provided in these rules, a Railway servant shall draw pay in the Level in the revised pay structure applicable to the post to which he is appointed:

Provided that a Railway servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure:

Provided further that in cases where a Railway servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these Rules on account of promotion or upgradation, the Railway servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.

Explanation 1 – The option to retain the existing pay structure under the provisos to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.

Explanation 2 – The aforesaid option shall not be admissible to any person appointed to a post for the first time in Railway Service or by transfer from another post on or after the 1st day of January, 2016, and he shall be allowed pay only in the revised pay structure.

Explanation 3 – Where a Railway servant exercises the option under the provisos to this rule to retain the existing pay structure of a post held by him in an officiating capacity on a regular basis for the purpose of regulation of pay in that Pay Structure under Rule 1313 (FR 22) of Indian Railway Establishment Code, Volume II, or under any other rule or order applicable to that post, his substantive pay shall be substantive pay which he would have drawn had he retained the existing pay structure in respect of the permanent post on which he holds a lien or would have held a lien had his lien not been suspended or the pay of the officiating post which has acquired the character of substantive pay in accordance with any order for the time being in force, whichever is higher.

6. Exercise of Option: –

(1) The option under the provisos to Rule 5 shall be exercised in writing in the form appended to these Rules so as to reach the authority mentioned in sub- rule (2) within three months of the date of notification of these rules or where any revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within three months of the date of such order:
.
Provided that –

(i) In the case of a Railway servant who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the said authority within three months of the date of his taking charge of his post in India; and

(ii) where a Railway servant is under suspension on the 1st day of January, 2016, the option may be exercised within three months of the date of his return to his duty if that date is later than the date prescribed in this sub-rule.

(2) The option shall be intimated by the Railway servant to the Head of his Office along with an undertaking, in the form appended to these rules.

(3) If the intimation regarding option is not received by the authority within the time specified in sub-rule (1), the Railway servant shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.

(4) The option once exercised shall be final.

Note 1 – Persons whose services were terminated on or after 1st January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned posts, resignation, dismissal or discharge on disciplinary grounds, shall be entitled to exercise option under sub-rule (1).

Note 2 – Persons who have died on or after the 1st day of January, 2016 and could not exercise the option within prescribed time limit are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date as is most beneficial to their dependents if the revised pay structure is more favourable and in such cases, necessary action for payment of arrears shall be taken by the Head of Office.

Note 3 – Persons who were on earned leave or any other leave on 1st day of January, 2016 which entitled them to leave salary shall be entitled to exercise option under sub-rule (1).

7. Fixation of pay in the revised pay structure:-

(1) The pay of a Railway servant who elects, or is deemed to have elected under rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2016, shall, unless in any case the President by special order otherwise directs, be fixed separately in respect of his substantive pay in the permanent post on which he holds a lien or would have held a lien if such lien had not been suspended, and in respect of his pay in the officiating post held by him, in the following manner, namely : –

(A) in the case of all employees: –

(i) the pay in the applicable Level in the Pay Matrix shall be the pay obtained by multiplying the existing basic pay by a factor of 2.57, rounded off to the nearest rupee and the figure so arrived at will be located in that Level in the Pay Matrix and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.

CHARTER OF DEMANDS

PART A

1. Urgent measures for containing price rise through universalization of public distribution system and banning speculative trade in commodity market.

2. Containing unemployment through concrete measures for employment generation.

3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.

4. Universal social security cover for all workers.

5. Minimum wage of not less than 18000/- per month with provisions of indexation (for unskilled worker).

6. Assured enhanced pension not less than 3000 p.m for the entire working population (including unorganized sector workers).

7. Stoppage of disinvestment in Central/state public sector undertakings.

8. Stoppage of contractorisation in permanent/perennial work and payment of same wage and benefits for contract workers as that of regular workers for the same and similar work.

9. Removal of all ceilings on payment and eligibility of bonus, provident fund and increase in quantum of gratuity.

10.Compulsory registration of trade unions within a period of 45 days from the date of submitting application and immediate ratification of ILO conventions C-87 and C-98.

11.No FDI in Railways, Defence and other strategic sectors.

12.No unilateral amendment to labour laws.

PART B

Demand of the Central Govt. Employees

1. Avoid delay in implementing the assurances given by Group of Ministers to NJCA on 30th June 2016, especially increase in minimum pay a fitment formula. Implement the assurance in a time bound manner.

2. Settle issues raised by the NJCA, regarding modifications of the 7th CPC recommendations, submitted to Cabinet Secretary on 10th December 2015.

3. Scrap PFRDA Act and New Pension System (NPS) and grant Pension/Family Pension to all Central Government employees under CCS (Pension) Rules 1972.

4. No privatization, outsourcing, contractorisation of Government functions.

5. (i) Treat Gramin Dak Sevaks as Civil Servants and extend all benefits on pay, pension and allowances of departmental employees.

(ii) Regularise casual, contract, contingent and daily rated workers and grant equal pay and other benefits.

6. Fill up all vacant posts by special recruitment. Lift ban on creation of new posts.

7. Remove ceiling on compassionate appointments.

8. Extend benefit of Bonus Act amendment 2015 on enhancement of payment ceiling to the Adhoc bonus/PLB of Central Govt. employees with effect from the financial years 2014-15. Ensure payment of revised bonus before Pooja holidays.

9. Revive JCM functioning at all levels.

(A) in the case of all employees:-

(1) There shall be two dates for grant of increment namely, 1st January and 1st July of every year, instead of existing date of 1st July:

Provided that an employee shall be entitled to only one annual increment either on 1st January or 1st July depending on the date of his appointment, promotion or grant of financial upgradation.

(2) The increment in respect of an employee appointed or promoted or granted financial upgradation including upgradation under Modified Assured Career Progression Scheme (MACPS) during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of an employee appointed or promoted or granted financial upgradation including upgradation under MACPS during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.

Illustration:

(a) In case of an employee appointed or promoted in the normal hierarchy or under MACPS during the period between the 2nd day of July, 2016 and the 1st day of January, 2017, the first increment shall accrue on the 1st day of July, 2017 and thereafter it shall accrue after one year on annual basis.

(b) In case of an employee appointed or promoted in the normal hierarchy or under MACPS during the period between 2nd day of January, 2016 and 1st day of July, 2016, who did not draw any increment on 1st day of July, 2016, the next increment shall accrue on 1st day of January, 2017 and thereafter it shall accrue after on year on annual basis:

Provided that in the case of employees whose pay in the revised pay structure has been fixed as on 1st day of January, the next increment in the Level in which the pay was so fixed as on 1st day of January, 2016 shall accrue on 1st day of July, 2016:

Provided further that the next increment after drawal of increment on 1st day of July, 2016 shall accrue on 1st day of July, 2017.

(3) Where two existing Grades in hierarchy are merged and the junior Government servant in the lower Grade happens to draw more pay in the corresponding Level in the revised pay structure than the pay of the senior Government servant, the pay of the senior government servant shall be stepped up to that of his junior from the same date and he shall draw next increment in accordance with this rule.

The Recommendations on Allowances (except Dearness Allowance) will be referred to a Committee comprising Finance Secretary and Secretary (Expenditure) as Chairman and Secretaries of Home Affairs, Defence, Health and Family Welfare, Personnel and Training, Posts and Chairman, Railway Board as Members. The Committee will submit its report within a period of four months. RESOLUTION

New Delhi, the 25th July, 2016

No. 1-2/2016-IC.— The Seventh Central Pay Commission (Commission) was set up by the Government of India vide Resolution No. 1/1/2013-E.III (A), dated the 28th February, 2014. The period for submission of report by the Commission was extended upto 31st December, 2015 vide Resolution No. 1/1/2013-E.III(A), dated the 8th September, 2015. The Commission, on 19th November, 2015, submitted its Report on the matters covered in its Terms of Reference as specified in the aforesaid Resolution dated the 28th February, 2014.

2. The Government, after consideration, has decided to accept the recommendations of the Commission in respect of the categories of employees covered in its Terms of Reference contained in the aforesaid Resolution dated the 28th February, 2014 in the manner as specified hereinafter.

3. The Government has accepted the Commission’s recommendations on Minimum Pay, Fitment Factor, Index of Rationalisation, Pay Matrices and general recommendations on pay without any material alteration with the following exceptions in Defence Pay Matrix in order to maintain parity in pay with Central Armed Police Forces, namely :-

(i) the Index of Rationalisation of Level 13A (Brigadier) in Defence Pay Matrix may be revised upward from 2.57 to 2.67;

(ii) additional three stages in Levels 12A (Lieutenant Colonel), three stages in Level 13 (Colonel) and two stages in Level 13A (Brigadier) may be added appropriately in the Defence Pay Matrix.

4.
(1) The Pay Matrix, in replacement of the Pay Bands and Grade Pays as in force immediately prior to the notification of this Resolution, shall be as specified in Annexure I in respect of civilian employees.

(2) With regard to fixation of pay of the employee in the new Pay Matrix as on 1st day of January, 2016, the existing pay (Pay in Pay Band plus Grade Pay) in the pre-revised structure as on 31st day of December, 2015 shall be multiplied by a factor of 2.57. The figure so arrived at is to be located in the Level corresponding to employee’s Pay Band and Grade Pay or Pay Scale in the new Pay Matrix. If a Cell identical with the figure so arrived at is available in the appropriate Level, that Cell shall be the revised pay; otherwise the next higher cell in that Level shall be the revised pay of the employee.

(3) After fixation of pay in the appropriate Level as specified in sub-paragraph (2) above, the subsequent increments in the Level shall be at the immediate next Cell in the Level.

5. There shall be two dates for grant of increment namely, 1st January and 1st July of every year, instead of existing date of 1st July; provided that an employee shall be entitled to only one annual increment on either one of these two dates depending on the date of appointment, promotion or grant of financial up-gradation.

6. The Commission’s recommendations and Government’s decision thereon with regard to revised pay structure for civilian employees of the Central Government and personnel of All India Services as specified at Annexure I and the consequent pay fixation therein as specified at Annexure II shall be effective from the 1st day of January, 2016. The arrears on this account shall be paid during the financial year 2016-2017.

7. The recommendations on Allowances (except Dearness Allowance) will be referred to a Committee comprising Finance Secretary and Secretary (Expenditure) as Chairman and Secretaries of Home Affairs, Defence, Health and Family Welfare, Personnel and Training, Posts and Chairman, Railway Board as Members. The Committee will submit its report within a period of four months.

Till a final decision on Allowances is taken based on the recommendations of this Committee, all Allowances will continue to be paid at existing rates in existing pay structure, as if the pay had not been revised with effect from 1st day of January, 2016.

8. The recommendations of the Commission relating to interest bearing Advances as well as interest free Advances have been accepted with the exception that interest free Advances for Medical Treatment, Travelling Allowance for family of deceased, Travelling Allowance on tour or transfer and Leave Travel Concession shall be retained.

9. The recommendations of the Commission for increase in rates of monthly contribution towards Central Government Employees Group Insurance Scheme (CGEGIS) for various categories of employees has not been accepted. The existing rates of monthly contribution shall continue. Department of Expenditure and Department of Financial Services will work out a customised group insurance scheme for Central Government employees.

10. The Government has accepted the recommendations of the Commission on upgrading of posts except for those specified at Annexure III. The recommendations on upgradation specified at Annexure III will be separately examined by Department of Personnel and Training for taking a comprehensive view in the matter.

11. The Government has not accepted the recommendations of the Commission on downgrading of posts and normal replacement will be provided in such cases.

12. While revising the pay of Doctors in respect of whom Non Practicing Allowance is admissible and Railway employees in respect of whom Running Allowance is admissible, it will be ensured that the actual raise in pay at the time of initial fixation is about 14.29 percent as recommended by the Commission.

13. The pay of officers posted on deputation under Central Staffing Scheme will be protected and the difference in the pay will be given to them in the form of Personal Pay to be made effective from the date of notification.

14. Recommendations not relating to pay, pension and allowances and other administrative issues specific to Departments/Cadres/Posts will be examined by the Ministries/Departments concerned as per the Allocation of Business Rules or Transaction of Business Rules. Until a decision is taken by the Government on administrative issues pertaining to

(i) Non Functional Upgradation (NFU) presently admissible to the Indian Police Service/Indian Forest Service and Organised Group ‘A’ Services,
(ii) two years’ edge to Indian Administrative Service officers vis-a-vis other All India Services/Organised Group ‘A’ Services in empanelment under Central Staffing Scheme,
(iii) grant of two additional increments at Senior Time Scale, Junior Administrative Grade and Selection Grade to Indian Police Service and Indian Forest Service at par with Indian Administrative Service and Indian Foreign Service
(iv) a uniform retirement age for all ranks in Central Armed Police Forces, where the Commission could not arrive at a consensus, status quo shall be maintained.

15. A Committee of Secretaries comprising Secretaries of Departments of Personnel and Training, Financial Services and Pension and Pensioners’ Welfare will be set up to suggest measures for streamlining the implementation of the National Pension System (NPS).

16. Anomalies Committees will be set up by Department of Personnel and Training to examine individual, post-specific and cadre-specific anomalies arising out of implementation of the recommendations of the Commission.

17. Regarding pay and related issues concerning All India Services, appropriate action will be taken by Department of Personnel and Training to give effect to the decisions on these matters as may be applicable to them.

18. The Government of India wishes to place on record their appreciation of the work done by the Commission.

All of you know that Government approved the recommendations of 7th CPC without any change in Cabinet Meeting on 29.06.2016. But Government did not pay heed to resolve the objections raised by the federations affiliated to BMS.

On the call of GENC we extended our moral support to indefinite strike proposed by NJCA which was scheduled to commence on 11 July 2016. But NJCA deceived the employees and called off the strike without any genuine settlement. NJCA proved itself incapable to get the problems of employees redressed and bowed before pressure exerted by Government.

Since neither any anomaly of earlier pay commissions has been resolved nor any demand related to 7th CPC has been accepted so far. In such situation GENC has decided to lead and conduct a humongous rally at Parliament in Delhi on 29 Aug 2016 to get resolved issues related to 7th CPC. Being a constituent of GENC this federation has also decided to be part of it to exert pressure on Government to redress the anomalies and settle the genuine demands made by us.

Therefore, you are requested to take part in the rally with massive number of supporters. The venue of Rally is Jantar Mantar and the programme is scheduled from 10 am to 3 pm. All the arrangements related to accommodation and lodging should be made by union itself.

Your support for tremendous success of the programme is solicited. The charter of demands (Annexure – A) has been attached.

After the Cabinet approval, the Finance Minister tweeted, “Congratulations to central government officers, employees & pensioners on a historic rise in their salary & allowances through the 7th Pay Commission.”

The Central Government Employees were dismayed by this tweet and wondered how it was described as historic rise. There are so many hidden facts in the cabinet approval for implementation of 7th Pay Commission recommendations

1. What did the Empowered Committee of secretaries do in Sixth months and what did they recommend? There was nothing mentioned about the report of this committee submitted to Cabinet and Whether the cabinet considered the ECoS recommendations or not.

2. This is the first time in the Pay Commission History that Pay Commission recommendation are going to be implemented in staggered manner. Only Basic Pay alone will be revised. All other Allowances will be revised after four months.

3. After second Pay Commission, this is the lowest hike recommended in Pay Scale. Just 14.27%. 30% hike is expected invariably by all cg employees.

4. This is the first time the central government employees are not so excited about the Hike recommended in 7th pay Commission and its Implementation. The reasons are, Very Minimal hike and Implementation of Allowances is deferred.

5. There was an anomaly in sixth pay Commission in granting Annual Increment for the New entrant. If the Govt Servants recruited in the first six months of the year from January 2nd to June 30th, the Annual Increment will be granted on 1st July of next year (i.e after 13 to 18 Months ) .This anomaly is also not addressed by 7th Pay Commission.

6. To address this issue, NCJCM proposed Two Increment dates i.e on 1st January and 1st July . This is not considered by Govt.

7. The Sixth CPC has recommended to grant MACP on Grade Pay Hierarchy. Many Court Cases are won by Govt servants in favour of granting MACP on Promotional hierarchy. But this issue also not considered by Govt and 7th Pay Commission.

8. The Central Government Employees were shocked by the recommendation of reducing the Rates of HRA to 24%, 16% and 8%. Adding further fuel to the fire, the reduced allowances are also not implemented with immediate effect.

9. The Cabinet also decided not to accept the steep hike in monthly contribution towards Central Government Employees Group Insurance Scheme (CGEGIS) recommended by the Commission. But the CG Employees welcomed the Pay Commission recommendation in CGEGIES, as it is providing high risk cover. But it is turn down by Government.

10. The only positive fact in 7th Pay Commission Recommendation is its PAY MATRIX. In Sixth Pay Commission, there was disparity in Pay fixation for promotes and new Entrants. The Entry Pay fixed for particular Grade to the New Recruits is higher than the Pay fixed for the Govt Servants promoted to that same Grade. This issue is somehow addressed in 7th Pay Commission by fixing Entry Pay for all Levels in New Pay Matrix.

(a) & (b): The Government has decided to implement the recommendations of the 7th Central Pay Commission relating to pay, pension and related issues. The requisite notifications are being issued shortly.

(c) The increase in pay as recommended by the 7th Central Pay commission is based on the detailed deliberations by the Commission keeping in view all relevant factors having a bearing upon the prevailing circumstances
.
(d) Employee Associations of Central Government had given a call for strike with effect from 11.07.2016 which has since been deferred. However, the Government is responsive to the concerns of the Employees’ Association and it would be the endeavour of the Government to ensure that the eventuality of a strike does not arise.

(e) In view of the multiplication factor having been accepted based on the recommendations of the 7th Central Pay commission, no such proposal is under consideration of the Government, at present.

A Judicial Committee on OROP headed by Justice L. Narasimha Reddy, Retired Chief Justice of Patna High Court has been appointed vide Government order dated 14.12.2015 to look into anomalies, if any, arising out of implementation of OROP. The Committee shall make its recommendation within one year of the date of its constitution.

This information was given by Minister of State for Defence Dr. Subhash Bhamre in a written reply to Shri Mahendra Singh Mahra in Rajya Sabha today.

On the call of the National Joint Council of Action(NJCA), on hopeless recommendations of VII CPC, scrapping of National Pension System (NPS) and other long pending genuine demands of the Central Government Employees, covering lakhs and lakhs of Railwaymen, Defence (Civilian) personnel, Postal employees, working in different Central Government offices throughout the country, unitedly not only participated and contributed regularly in agitational programmes of different stages of struggle but also succeeded to reflect such an environment in the entire length and breadth of the country well before the date of commencement of nationwide “Indefinite Strike” from 11th July, 2016; that compelled the Government of India to think better than Rs.18,000 as Minimum Wage, change in the Fitment Formula and many other important heartburning aspects, like National Pension System (NPS) and to handover all such issues to the committees with a commitment to consider the same within a timeframe of four months. Considering positive attitude of the senior ministers of the Government of India, the National Joint Council of Action (NJCA) had decided to give another four months time to the government.

I am fully aware that, our Central Government Employees and the youth with full sincerity and dedication had unitedly created an unprecedented environment throughout the country, enlightening all the fellowmen about our demands in support of “Indefinite Strike” continuously, for which they deserve to be thanked a lot.

Earlier too I had drawn your attention and warned to be aware of such elements who will confuse and mislead you by various baseless arguments and try to weaken and derail our united struggle.

I know that, such negative thinking persons neither would have participated in the strike nor moved shoulder to shoulder in the movement of struggle. Negative thoughts not only weaken the individual, but also malign mental attitude of the others. Certain such persons, pouring in forcefully their polluted views on others, only try to break the broader unity of the movement. After all, it is not a new phenomena, such elements were found in all the strikes of the past. But nowadays; propaganda scenario has changed. Earlier, social media – WhatsApp, Facebook etc. were not available, so, such elements were launching propanganda campaign in the Canteens, Pan shops etc. In the present era, instead of using social media, WhatsApp, Facebook etc, in positive way for uniting co-workers, such elements unsuccessfully attempt to break the unity with their contaminated thought, reflecting the fellowmen that they are the only genius and ever alert and real friends of them, but such individuals always deceived and show their back at the climax of the struggle.

I had earlier mentioned; to be very careful of such vindictive personalities who have destructive thought during the struggle, meant to secure their own rights. It is waste to have even least hope of any contribution in any struggle from such individuals who during agitation/strike try to side-away themselves by all means.

For complete preparation of strong background in any movement, struggle/strike, role of an individual unit, branch, division, zonal and national level, strong change can never be devaluated, and such an strong united movement at all levels leaders ultimately encourages to give a clarion call of struggle at the national level. National leadership has to take care of all even-odd circumstances, lead his attitude, patience and safety of their force. Deep contemplation yields of the movement for him to cause execution to implement various strategies and timelines for the fulfillment of the objective of the obligation to go beyond such a positive approach rather than criticism for decisions on the subtleties of the churning the movement extended to the middle of your peers and get validness struggling peace succeeds.

I have full faith that, all the Central Government Employees were ready, already even today and will remain ready with the time slot to fight for their rights.

I again remind my colleagues to be aware and give befitting reply to those having negative thinking, and a strong movement only can go ahead.

Subject: Simplification of procedure for endorsement of Family Pension entitlement in the PPO of living Armed Force Pensioners-reg.

I am directed to refer Gol, MoD letter No.6(4)/87/1369/B/D(Pens/Sers) dated 30.06.1988, which was issued for taking appropriate action for endorsement of Family Pension in the Pension Payment Orders of Armed Forces Personnel. For this purpose an application from “Appendix A” was enclosed along with ibid letter under which details of re-employment, family pension from other sources were required to be filled.

(2) After implementation of Cabinet Secretaries Commitee-2012 recommendations for grant of dual family pension to NOK of Armed Forces Pensioners, the matter was under consideration of this ministry for modification in “Appendix A”. It has now been decided to modify Appendix ‘A‘. The revised Appendix ‘A’ is attached with this letter.

(3) The other terms and conditions for endorsement of family pension in the PPO shall remain unchanged.

(4). These orders issue with the concurrence of MoD(Fin/Pen) vide their ID No.10(16)/2015/Fin/Pen dt. 30th June 2016.

Employees who fail to buy air tickets at the lowest price available on the day while undertaking journey on Leave Travel Concession (LTC) claim will face severe penal action, as per the draft guidelines finalised by the Centre.

The move comes after the government noticed instances where some of its employees colluded with private travel agents to submit LTC claims showing inflated airfare to clandestinely obtain undue benefits like free boarding, lodging, transport or cash refunds.

The Central Bureau of Investigation (CBI) is also looking into cases of alleged irregularities in availing the LTC claims.

The ministries concerned will also carry out random checks with airlines to ensure that the tickets were booked at the lowest fare available on the date of purchase.

“It has now been decided that in accordance with the canons of financial propriety, government servants should purchase tickets at the lowest rate available at the time of booking for the date and time of scheduled journey.

“Government servant will be required to submit print-out of tickets showing date and time of booking in addition to the fare charged,” the new guidelines drafted by the Department of Personnel and Training (DoPT) said.

Any violation of the existing norms by authorised travel agents — M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours and IRCTC — will invite blacklisting.

A government employee gets reimbursement of tickets for to-and-fro journey, in addition to leaves, when he avails LTC.

There are about 50 lakh central government employees.

The proposed guidelines have cited provisions of the service rules “which require the government servants to maintain absolute integrity at all times”. In addition, cheating and fraud also attract various sections of the Indian Penal Code (IPC), it said.

“Ministries and departments should therefore not hesitate to take severe action against employees guilty of deliberate malpractices, particularly in collusion with travel agents etc,” the DoPT said.

The new guidelines are likely to come into force from next month, a senior government official said.

The DoPT has also warned the employees that any plea of ignorance of rules will not be entertained and any deviation will be handled legally and in accordance with the service rules.

As per the draft guidelines, while submitting the LTC claim after completion of the journey, the government servant will be required to submit a self-certificate on plain paper that the airfare claimed by him or her in respect of the fare charged by the airline is for the air journey only and does not include any charges for any facility, undue benefit including boarding, lodging or local transport.

The employees need to certify that the tickets were booked “at the lowest fare available for the destination at the time of booking for the scheduled date and time of departure” and that they are aware that suppression of any information or furnishing wrong information will render them liable to disciplinary action.
