Modified Assured Career Progression Scheme (MACPS) for the Railway Employees – Implementation of 7th CPC Recommendations

Modified Assured Career Progression Scheme (MACPS) for the Railway Employees – Implementation of 7th CPC Recommendations

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(Railway Board)

S.No.PC-VII/12
No.PC-V/2016/MACPS/1

RBE No.155/2016
New Delhi, dated 19/12/2016

The General Managers
All Indian Railways & PUs
(As per mailing list)

Subject: Modified Assured Career Progression Scheme (MACPS) for the Railway Employees – lmplementation of seventh CPC recommendations.

The Modified Assured Career Progression Scheme was introduced with effect from 01.09.2008 in pursuance of the recommendations of the Sixth Pay Commission by this Ministry’s letter No.PC-V/2009/ACP/2, dated 10.06.2009 (RBE No.101/2009). Thereafter, subsequent amendments/clarifications were issued from time to time. These instructions are in force with effect from 01.09.2008.

2.The 7th Central Pay Commission (CPC) in para 5.1.44 of its report has recommended inter-alia as follows:

“MACP will continue to be administered at 10, 20 and 30 years as before. In the new Pay Matrix, the employee will move to immediate next level in hierarchy. Fixation of pay will follow the same principle as that for a regular promotion in the Pay Matrix. MACPS will continue to be applicable to all employees up to Higher Administrative Grade (HAG) level except members of Organised Group ‘A’ Services.”

3.The Government has considered the above recommendation and has accepted the same. In the light of the recommendations of the 7th CPC accepted by the Government, the Modified Assured Career Progression Scheme (MACPS) will continue to be administered at 10, 20 and 30 years as before. Further, Para 1 and 2 of the existing Scheme (Annexure to this Ministry’s letter No.PC-V/2009/ACP/2, dt.10.06.2009) will be substituted by the following words:-

“1. There shall be three financial upgradations under the MACPS as per 7th CPC recommendations, counted from the direct entry grade on completion of 10, 20 and 30 years services respectively or 10 years of continuous service in the same level in Pay Matrix, whichever is earlier.

2. The MACPS envisage merely placement in the immediate next higher level in the Pay Matrix as given in PART ‘A’ of Schedule of Railway Services (Revised Pay) Rules. 2016. Thus, the level in the Pay Matrix at the time of financial upgradation under the MACPS can, in certain cases be different than what is available in the normal hierarchy at the time of regular promotion in one’s AVC. In such cases, the higher level in the Pay Matrix attached to the next promotion post in the hierarchy of the concerned cadre/organization will be given only at the time of regular promotion.”

4. The 7th Central Pay Commission (CPC) in Para 5.1.45 of its report has in teralia recommended as follow:-

“Benchmark for performance appraisal for promotion and financial upgradation under MACPS to be enhanced from ‘Good’ to ‘Very Good’.”

5. The Government has considered the above recommendation and has accepted the same. In the light of the recommendations of the 7th CPC accepted by the Government, Para 17 of the Scheme (Annexure to Board’s letter No.PC-V/2009/ACP/2, dt. 10.02.2009) shall be substituted by the following words:-

” 17. For grant of financial upgradation under the MACPS, the prescribed benchmark would be ‘Very Good’ for all the posts.”

6. These changes will come into effect from 25th July, 2016, i.e., from the date of resolution notified by Department of Expenditure, Ministry of Finance regarding acceptance of the recommendations of the 7th CPC.

6.1 MACPS where it was due earlier to 25.07.2016, but not decided yet due to Administrative delay, will be decided as per criteria prevalent at that time. Cases that became due on or after 25.07.2016, will be decided as per new criteria. However, Past Cases, decided otherwise, need not be re-opened.

7. The comprehensive MACP Scheme on acceptance of Seventh Central Pay Commission recommendations will be issued separately.

8. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Admissibility of House Rent Allowance in the event of Non-Acceptance or Surrender of Railway Residential Accommodation

Admissibility of House Rent Allowance in the event of Non-Acceptance or Surrender of Railway Residential Accommodation

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)

No. E(P&A)-II/2012/F.E.2/4.

The General Secretary,
NFIR,
3, Chelmsford Road,
New Delhi — 110 055.

New Delhi, dated 31/10/2016.

Sub.:- Admissibility of House Rent Allowance in the event of non-acceptance or surrender of railway residential accommodation —reg.

Ref.:- 1. NFIR’s letter No. 1/5(c )/Part I dated 22/02/2016.
2. NFIR’s letter No. 1/5(c )/Part I dated 25/04/2016.

I am directed to refer to your letters quoted above. The subject item (No. 40/2012) refers to admissibility of HRA in the event of non-acceptance or surrender of Railway residential accommodation. While this is governed by Railway Board’s letter No. E(P&A)-II/99/HRA-2 dated 16/03/2000; the Federation vide their letter No. 1/5(c) Pt. I dated 09/04/2012 had asked for review of the clause mentioned in Board’s letter ibid that HRA will not be admissible to railway employees for whom railway accommodation is specifically earmarked or to those employees, whose occupation of railway quarters is essential for easy accessibility during emergencies and efficient discharge of their duties etc. (“essential staff’).

2. Subsequently, as recorded in the PNM meeting held on 30-31 January, 2014, it was explained to the Federation that wherever there is a house earmarked the employee cannot be allowed HRA. Federation contended that administration cannot deny HRA when earmarked quarters are not fit for occupation and wanted that a clarification be issued in the matter.

3. The item was further discussed by the Federation with the Board on 15/07/2015 and it was recorded as “As decided in the earlier meeting, a clarification after reviewing the matter is to be issued. Official Side stated that they propose to issue instructions in consultation with Civil Engineering Directorate. Federation stated that while they do not understand the need for a consultation with the Civil Engineering in this case, they requested the clarification be issued quickly. It was agreed to do so. The item to be closed thereafter” .

4. Accordingly, the matter had seen referred to Land & Amenties Dte. who confirmed that instructions were in place (issued vide RB/L&A No. 009/2011 dated 19/09/2011 to all Zonal Railway, PUs etc.) regarding dismantling of condemned/abandoned quarters, and that quarters declared condemned are not made available for allotment.

5. In line with the assurance recorded at para 3 above, letter No. E(P&A)- II/2012/F.E.2/4 dated 12/10/2015 was issued to all Zonal Railway and Production Units etc. that before allotment of Railway quarters, it should be ensured that such quarters are fit for occupation. Copy of this letter was also endorsed to the Federation.

6. It is, therefore, submitted that the letter dated 12/10/2015 referred to had already been issued by the time minutes of the discussions on the item held with NFIR on 8th and 9th October, 2015 were finalized/received and this was also explained in the meeting with NFIR in 18/01/2016. There has, therefore, been no deliberate violation of the assurance given to the Federation.

7. As, in terms of extant instructions, quarters unfit for occupation are not to be allotted, the question of allowing HRA against such allotment does not arise, in general. Any violation of the extant instructions can be taken up with the concerned field formation for appropriate remedial action.

Affiliated to:

No.IV/MACPS/09/Part 10

Dated: 12/09/2016

The Secretary (E),
Railway Board,
New Delhi

Dear Sir,

Sub: Grant of GP 6600/- in PB-3 as 3rd MACP to Nursing Personnel in Railways-reg.

Ref: Ministry of Health and Family Welfare’s O.M. No. Z-28015/5/2016-N(Pt.) dated 09th September 2016.

NFIR invites kind attention of Railway Board to the O.M. dated 09th September 2016 issued by the Ministry of Health and Family Welfare (copy enclosed) on the subject relating to granting GP 6600/- (PB-3) as 3rd MACP to the Nursing Personnel of the Central Government. Para A of the said O.M. states that those staff nurses/nursing sisters/assistant nursing superintendents who have been awarded 1st and 2nd financial upgradation under ACP Scheme in the hierarchy of Pay Scales Rs. 5500-9000 and 6500-10500 upto 31st August 2008 are entitled for replacement Grade Pay of Rs. 4800/- (PB-2) and Rs. 5400/- (PB-3). In the said para it has also been stated that the 3rd financial upgradation under MACPS wherever granted in GP 5400/- (PB-3), the same be revised to GP 6600/- (PB-3).

From the above decision of the Ministry of Family Health and Welfare, it is clear that those Nursing Personnel in Railways, promoted to Scale Rs. 5500-9000 (V CPC) or got ACP benefit are to be treated as holders of GP 4800/- (PB-2) and those who were in Pay Scale Rs. 6500-10500/7450-11500 either through 2nd ACP or through promotion upto 31st August 2008 be treated as holders of GP 5400/- (PB-3). As the MACPS came into effect from 01/09/2008, those Nursing Personnel who got Grade Pay 5400/- (PB-3) and fulfilled the condition for entitlement of 3rd financial upgradation, they should be granted GP 6600 (PB-3) as 3rd MACP. The Federation states further that the cases of Nursing personnel who have been granted GP 5400 as 3rd financial upgradation under MACPS, needs to be reviewed for granting GP 6600 as 3rd MACP instead GP 5400 (PB-3).

NFIR, therefore, requests the Railway Board to issue modified instructions to the GMs etc., for allowing GP 6600/- (PB-3) as 3rd financial upgradation under MACPS to the Nursing Personnel in lieu of GP 5400 (PB-3).

Yours faithfully,

Sd/-

Implementation of the recommendations of 7th CPC — Fitment Factor and Pay Fixation for Running Staff-reg.

NFIR
National Federation of Indian Railwaymen
3, CHELMSFORD ROAD, NEW DELHI – 110 055
Affiliated to :
Indian National Trade Union Congress (INTUC)
International Transport Workers’ Federation (ITF)

No. IV/NFIR/7CPC(Imp)/2016/R.B.

Dated: 04/08/2016

The Secretary (E),
Railway Board,
New Delhi

Dear Sir,

Sub: Implementation of the recommendations of 7th CPC — Fitment Factor and Pay Fixation for Running Staff-reg.

Ref: (i) NFIR’ s letter No. IV/NFIR/7CPC(Imp)/2016/R.B. dated 13/07/2016.
(ii) Board’s letter No. PC-VII/2016/RSRP/2 dated 02/08/2016 (RBE No.93/2016).

The Federation vide its letter dated 13/07/2016 requested the Railway Board that in view of 30% pay element of Running Staff needed to be taken for arriving at the “multiplier factor”, it was suggested to maintain the same at “3” instead of “2.57”. Federation is however disappointed to note that the Railway Board instead of following the simple procedure has complicated and mutilated the pay fixation formula/procedure of Running Staff as per illustration given in Annexure ‘C’ of Board’s letter No. PC-VII/2016/RSRP/2 dated 02/08/2016 (RBE No. 93/2016).

In this connection, the Federation brings to the notice of the Railway Board that in the Resolution circulated by the Ministry of Finance (Department of Expenditure) vide No. 12/2016-IC on 25th July 2016 in Para 12, it has been mentioned that in respect of Railway employees to whom Running Allowance is admissible, it will be ensured that the actual rise in pay at the time of initial fixation is about 14.29% as recommended by the Pay Commission. Federation feels sad to convey that the said decision of the Ministry of Finance has not been complied with by the Railway Ministry particularly in respect of Running Staff.

In case of Running Staff with Rs.1000/- Basic Pay, he will get Dearness Allowance Rs.1,625/-, thus, the total would be Rs.2,625/-. In terms of Gazette Para 12, minimum benefit 14.29% should be given to Running Staff. 14.29% of Rs.2,625/- is Rs.375/-. Thus Basic Pay + Dearness Allowance + Minimum Guaranteed Benefit = 1000 + 1625 + 375 = Rs.3,000/-. From this, it is clear that the Running Staff having Basic Pay of Rs.1000/- should be fixed at Rs.3000/-. But in the illustration given in RBE 93/2016, Running Staff with Basic Pay of Rs.19,930/- is fixed at Rs.58,694/-, which works out 12.19% which is clear violation of Para 12 of Gazette Notification.

In view of the above, the Annexure of Board’s letter dated 02/08/2016 is needed to be redrawn to ensure justice to the Running Staff. NFIR, therefore, requests the Railway Board to consider the above points and issue modification immediately duly endorsing copy to the Federation.

Yours faithfully

Productivity – Linked Bonus to Railwaymen for the year 2015-16

A.I.R.F
All India Railwaymen’s Federation
4,State Entry Road
New Delhi – 110 055
India

No.AIRF/387

Dated: August 3, 2016

The Secretary(E)
Railway Board
New Delhi Kind Attn: Shri Dhruv Singh, EDPC-I, Railway Board

Dear sir,

Sub: Productivity – Linked Bonus to Railwaymen for the year 2015-16

In referencet to our discussion with the Additional Member (Staff), railway Board, on 2nd August, 2016, we have emplained threadbare about the modalities and norms fixed for thr Productivity -Liked Bonus to railwaymen for the year 2015-16.

It is a well-known fact that, the formula envisaged for calculation of number of days for PLB in November 1979 has been sactosanct and the federations had never agreed for any alteration in that formula.

Railway Board is quite aware that the railwaymen are putting their best efforts for running Indian Railways system smoothly and efficiently 365 x 24 x 7 days even by laying their precious lives, therefore, any alteration with PLB Formula, which reduces the number of days, will demotivate them and will be proved counter – Productive to the interests of the Indian Railways. Though the number of railwaymen is being reduced, they are carrying more number of passenger and freight trains, therefore, it is quite evident that, productivity of the railwaymen has increased to a great extent.

AIRF has already explained thatm any reduction in the number of days of PLB in comparison to last year will never be tolerated, and that can lead to further agitations.

Here it is pertinent to mention that, every time when the government changed, ceiling of the PLB also changed in the Railways. Last time (in 2009-10) when PLB ceiling was changed from Rs.2500 to 3500 p.m., railwaymen were paid PLB along with the arrear. Similarly, we expect that, this time also, since PLB ceiling has been enhanced from Rs.3500 to Rs.7000 p.m., Railwaymen will be paid PLB @ Rs.7000 p.m. along with arrear.

Yours faithfully
