Sir,
In partial modification of this Ministry sanction letter No 12630/Tpt. Al Mov C/246/D (Mov)/17 dated 15th September, 2017 on the subject noted above, para 2(iii) of said sanction may be substituted as under:
For :–
Physically disable service personnel as mentioned in this Ministry letter No. 12198/Q Mov C/3337/D Mov dated 30.08.1979 as amended vide letter No. 12198/Q Mov C/697/D Mov dated 26.02.1980 shall continue to be paid Transport Allowance at double the normal rates, subject to fulfilment of the stipulated conditions, which shali, in no case, be less than Rs.2250/- p.m. plus applicable rates of Dearness Allowance.

REPLACED BY :-
Physically disable employees in respect of the categories viz., visually impaired, orthopaedically. handicapped, deaf and dumb/hearing impaired, spinal deformity, shall be paid Transport Allowance at double the normal rates, subject to fulfilment of the stipulated conditions, which shall, in no case, be less than Rs.2250/- p.m. plus applicable rates of Dearness Allowance.
2.These orders shall take effect from 1st July, 2017.
3. This letter issues with the concurrence of Ministry of Defence (Fin/QA) vide their U.O. No. 9(1) Fin/QA/17 (Dy. No. 386) dated 02.07.2018.

References have been received from Department of Telecom, D/o Revenue and Central Secretariat (Promotee Assistants) Association seeking clarification regarding admissibility of DA on Transport Allowance at pre-revised rates from 01.07.2016 (@132%) and from 01.01.2017 @ 136%
2. As per recommendations of 7th CPC, rates of Transport Allowance had been revised w.e.f. 01.07.2017. Details of rates during 6th CPC and as prescribed by 7th CPC are given below:

3. It may be seen from the above table that rates of Transport Allowance as recommended by 7th CPC are inclusive of DA @ 125% as on 01.01.2016.
4. It is clearly mentioned in the Resolution dated 25.07.2016 that ’till a final decision on Allowances is taken based on the recommendations of this Committee, all Allowances will continue to be paid at existing rates in existing pay structure, as if the pay had not been revised with effect from 1st day of January, 2016.” Therefore, between 01.01.2016 and 30.06.2017, no DA had been allowed on any Allowance.
5. In case, if the enhanced rate of DA i.e. 132% w.e.f. 0.07.2016 & 136% w.e.f. 01.01.2017 given for pre-revised pay scale of 6th CPC, is allowed on Transport Allowance rates as per 6th CPC, it would exceed the rates of Transport Allowance as recommended by the 7th Central Pay Commission which is not permissible. Therefore, we may clarify to D/o Telecommunication, D/o Revenue and Central Secretariat Association (Promottee Assistants) that enhanced rate of DA on 6th CPC rates of Transport Allowance from 01.07.2016 to 30.06.2017, is not admissible. Kindly see for consideration.

 Sub: Government’s decision on recommendation of the 7th Central Pay Commission – Transport Allowance to the Railway employees – Deprival of higher rate to those working in pay Level 1 &2-reg.
Ref: (i) Railway Board’s leffer No.PC/V/2017/A/TA/1 dated 17/08/2017 (RBE No.9612017). (ii) NFIR’s letter No.IV/NFIR/7CPC/Allowance/2016/Part I dated 28/08/2017. (iii) Railway Board’s letter No.PC-V/2015/PNM/NFIR/4 dated 17/20-1l-2017.

Federation does not agree with the view taken by the Railway Ministry in this case as conveyed to NFIR vide Board’s letter dated 17/20-11-2017. Federation wants that the Railway Ministry should prepare proper case based on the facts and contentions of NFIR as explained in our letter dated 28/08/2017 tobe placed before DoP&T/MoF.

II. Federation reiterates that as a result of issuance of instructions dated 17/08/2017, a situation has arisen wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above upto Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs.1800 + DA thereon) have been deprived of the said rate due to the new norm for entitlement only when their pay reaches Rs.24,2001/-.

III. Further it is relevant to take note that pursuant to acceptance of the recommendations of 5th CPC and 6th CPC, the rates revised as follows:-

(a) Recommendations of 5th CPC – Transport Allowance RBE No. 179/1997 (rates w.e.f. 01/08/1997)

Above position reveals that all the employees working in pay scale below Rs. 6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irespective of their pay.

(b) The Railway Board vide circular (RBE No.111/2008 – effective from 01/09/2008 and RBE No.95/2015) had prescribed following rates for payment of Transport Allowance to the Railway employees.

IV. From the comparison of two tables mentioned above, it could be seen that the Railway employees were allowed higher rate of Transport Allowance on drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. The modified Board’s instructions issued vide letter dated 03/08/2017 and I7/08/2017, have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs.24700/- ignoring the fact that the staff were already drawing pay @ Rs.7440 in 6th CPC Pay Band/Grade Pay. Federation, therefore requests the Railway Ministry to kindly anange to make out case in the light of NFIR’s contentions for rendering justice to those staff of Pay Level 1 & 2 for granting Transport Allowance at rate i.e. 3600/- + DA thereon when they reach the corresponding pay @ Rs.21700/- and not 24200/- to meet the ends of justice and refer to MoF.

A copy of the reference made to the MoF may be endorsed to the Federation for taking follow up action.

Respected Sir,

Sub: General Budget 2018-19

We hope that, standard deduction, up to Rs.40,000 in the Budget (2018-19) announcement, was provided to give some relief to the salaried class, but at the same time, there is serious resentment in the salaried class in general and the Central Government Employees in particular because of non-enhancement of limit of the Income Tax.

We were hopeful that, in this budget, the Central Government would provide Income Tax exemption, if not Rupees Five Lakh, definitely Four Lakh, but nothing has been done, which has resulted in desperation in the Government Employees. Moreover, Education Cess has been increased from 3% to 4%, which will further put additional tax burden on the salaried class. In such a situation standard deduction given by the government will definitely not going to help to any salaried employees.

Not only the above, Transport Allowance and Medical Reimbursement, used to exempt earlier, have also been stopped in this budget, has given another blow to the salaried class.

Since there is all-round resentment in the salaried class, it would be in all appropriateness if the Income Tax Exemption is enhanced to minimum Rupees Four Lakh.

Sir, 
Government Employees are also very eagerly awaiting for improvement in the Minimum Wage and Fitment Formula as well as announcement of the Guaranteed Pension to the employees covered under the National Pension System(NPS). These also need to be given top priority to keep industrial peace among the Government Employees.

It is also requested that, Transport Allowance and Medical Reimbursement, almost exempted from the Income Tax, should also remain exempted from the Income Tax, to give some relief to the government employees in distress.

Subject : Clarification on admissibility of Transport Allowance in the cases where the officers are drawing Grade Pay of Rs. 10,000/- in PB-4 — regarding.

Reference is invited to this Department’s Office Memorandum No.21 (2)/2008- E.II(B) dated 29.08 2008. Para ‘3 of the stipulates that Officers drawing Grade Pay of Rs.10,000/- & above and those in the HAG* Scale, who are entitled to the use of official car in terms of Department of Expenditure (DoE) OM. NO. 20(5)/E.II(A)/93 dated 28.01.1994, shall be given the option to avail themselves of the existing facility or to draw the Transport Allowance at the rate of Rs.7,000/- p.m. plus Dearness Allowance thereon

2. Several references have been received in this Department seeking clarification on the admissibility of Transport Allowance to officers drawing Grade Pay Rs. 10000/- under Dynamic ACP Scheme or NFU Scheme, A few cases have also been filed in the Courts in this regard. Hon’ble Central’ Administrative Tribunal (CAT), Principal Bench, New Delhi, in Order dated 13.05.2014 in O.A. No.4062/2013 filed by Shri Radhacharan Shakiya & Others V/S union of India & Others, held that the Applicants were not entitled to draw Transport Allowance @ Rs.7,000/. p.m. plus DA thereon. The said order of the Tribunal has also been upheld by Hon’ble High Court of Delhi in their Order dated 03.09.2014 passed in writ petition (Civil) NO. 3445/2014, filed by Shri Radhacharan Shakiya & Others.

3. Accordingly, it is clarified that the officers, who are not entitled for the use of official car for commuting between residence to Office and back, in terms of DoE’s OM 20(5)/E-II(A)/93 dated 28-01-1994, are not eligible to opt for drawal of Transport Allowance @ Rs.7000/- p.m. + DA thereon, in terms of DoE’s O.M, No.21(2)/2008-E.II(B) dated 29.08 2008, even though they are drawing Grade pay of Rs. 10,000/- in PB-4 under Dynamic ACP Scheme or under the scheme of Non Functional Upgradation (NFU).

Denial of payment of HRA, Transport Allowance etc. to trainees appointed on compassionate ground in Grade Pay 1900/- in artisan category

The undersigned is directed to refer to NFIR’s Ieuer No.Il/I-A’Part 20, dated 05.10.2015 on the above subject.. The matter has been examined in consultation with Estt. Dte. of Railway Board and it is stated that Board’s instructions dt. 14.09.2012 was issued in pursrsurance of DoP&T’s clarification issued on 03.04.2012, which in turn emanated from the earlier clarification given by DoP&T in December, 2009 while reviewing the Scheme of Compassionate appointment in the light of specific para 2.2.9 and 2.2.10 of the 6th Pay Commission recommendations as accepted by the Government of India. In para 2.2.9, a separate running Pay Band designated as -IS scale was recommended for posts belonging to Group ‘D’. However, the same was not to be counted for any purpose. In pam 2.2.10, Commission has also recommended that no direct recruitment in -IS scale would take place. The scale would, however, be operated for regulating emoluments during the training period of candidates who do not possess the minimum qualification of Matric. The Commission was of the firm view that candidates not possessing the minimum qualifications of Matric could not be recruited in the Government. At the same time, Commission also recommended that in exceptional circumstances like compassionate cases, Government might need to provide employment opportunities to certain classes of persons not immediately meeting the minimum educational standards and Government could recruit them as trainees who would be given a regular Pay, Band and Grade Pay only on acquiring minimum qualification prescribed under the Recruitment rules.

Thus, it is amply clear that.Board’s instructions dated 14.09.2012 applied only exclusively in cases, where candidate being considered for appointment on compassionate grounds are not meeting the minimum qualification of entry into the Government service that is, in Grade Pay Rs.1800/- and the word ‘trainees” have been coined only for this limited purpose. It has nothing to do with trainees in various posts of Grade Pay Rs.1900 & above, where it is mandatory for persons being considered to clear the entire training period before joining a working post. There is a difference between a trainee and an employee. While a trainee gets stipend, the employee gets salary along .with all other allowances. The recruitment rules provide what benefit be given to trainees.Therefore, Federation’s demand is not feasible for acceptance.

Ministry of Finance, Department of Expenditure(Government of India) vide above cited letter(photocopy enclosed for ready reference) has communicated revised classification of cities, towns and localities for the purpose of grant of Transport Allowance at higher rates to the Central Government Employees.

The Board are, therefore, requested to implement the orders of the Ministry of Finance in the Railways also, so that Railway employees can also avail this benefit from April 2015.

An early action in the matter shall be highly appreciated.

Attention is invited to Board’s letter of even number dt. 07.07.2014 (RBE No.68/2014) on the above subject whereby it was clarified that those officers who are upgraded to Grade Pay of Rs.10000/PB-4 scale on the basis of Dynamic ACP or due to non-functional in-situ upgradation shall not be eligible for grant of Transport Allowance @7000 p.m+DA thereon. On receipt of representations from IRMS

Association this matter was further reviewed by the Board in the light of earlier instructions contained in Boards letter No.PC-V/2008/ACP/2, dt. 07.07.2010 and Board have decided that the IRMS Officers having Grade Pay of Rs.10000/- on promotion through DACP Scheme are toga treated at par with SAG Officers for payment of Transport Allowance @7000 p.fn plus DA thereon. However, officers of other organized services who get similar grade on non-functional upgradatlon basis shall not be eligible for the same.

2. Necessary action as per above decision may please be taken.

   Ref: AIRF’s letter No.AIRF/DC/JCM/13/2004 (66) dated 28.3.2011

   The undersigned is directed to state that the AIRF’s letter under reference was put up to the Board, who have observed that since the decision as regards recovery of excess amount of Transport Allowance paid in three cities viz., Lucknow, Nagpur and Jaipur has been taken by the nodal department i.e. Ministry of Finance, meeting with the officials of Railway Board is not going to change the situation. However, if the Federation can come out with new facts pertaining to the case, the same could be referred to the Ministry of Finance for reconsideration.

   As regards the source of information of recoveries made in the concerned cities, it is mentioned that the said information has been duly collected from the concerned zonal Railways.
