Confederation One Day Strike on 15.11.2018 Postponed CONFEDERATION ONE DAY STRIKE ON 15-11-2018 POSTPONED TO 2019 JANUARY 8th & 9th.

TWO DAYS STRIKE JOINTLY WITH CENTRAL TRADE UNIONS AND ALL INDIA STATE GOVERNMENT EMPLOYEES FEDERATION (AISGEF).
NO CHANGE IN THE CHARTER OF DEMANDS
SCRAP NPS WILL BE THE NUMBER ONE DEMAND.
Dear Comrades,
As you are aware, in the National Convention of Workers held at Mavlankar Hall, New Delhi on 28th September 2018, all the Central Trade Unions (except BMS) and all other independent Federations have declared two days nationwide strike on 8th & 9th January 2019 against the anti-people and anti-labour policies of the NDA Government.
In the resolution adopted in the June 10th Hyderabad National Convention of Confederation and also in the National Secretariat meeting held thereafter, we have decided that the 2018 November 15th strike of Confederation will be changed, if the Central Trade Unions declare nationwide strike, so that the dates of both strikes will be synchronized to make it a joint strike.
Accordingly, the National Secretariat of Confederation has decided to postpone the 15th November 2018 strike to 2019 JANUARY 8th & 9th. The strike will be for two days. There is no change in the Confederation charter of demands.

SCRAP NPS AND RESTORE OPS FOR ALL

will be the number one demand.
 All India State Government Employees Federation has also decided to postpone the strike to 2019 JANUARY 8th & 9th.

Observe Work-Life-Balance, in letter and spirit

You are aware that the officers fraternity has been subjected to enormous stress due to ever increasing workload, inadequate staff, continuous pressure from multifarious controllers, over-ambitious targets, mis-placed business priorities, extended working hours et al. This has taken a heavy toll on the efficiency level and is the root cause of frustration and anxiety disorder resulting in depression, helplessness and life-style diseases viz Diabetes, High BP and Cardiac problems etc. Officers are constantly receiving SMS and instructions over WhatsApp messages even at odd hours. This has adversely affected their social and family life. Banking system has forgotten that an Officer is just not an employee of the Bank, but also a spouse/son/father/mother and an integral part of society. This situation has become intolerable as we find Officers are virtually chained to their official duties and have no respite, even while at home.

Work-Life-Balance is the need of the hour. Many top global companies are addressing this sensitive issue through various measures. State Bank of India has issued a comprehensive instruction addressing the need for a Work-life balance. However, the ground reality almost in every institution is that majority of the officers are stressed and do not have a work-life balance, which is attributed specially to the instructions received through SMS and WhatsApp.

All four officers’ organisations have unanimously decided to address this menace. It has been decided to call upon all our Officers not to attend/respond to the ‘official’ SMS/WhatsApp messages, received from their Controlling Authority/Zonal Heads between 8pm and 8am.

We urge upon our members to respond to our clarion call and implement the instructions in letter and spirit forthwith.

Subject: All India Protest Day for 19th September, 2018 – Instructions under CCS (Conduct Rules) 1964 – Regarding.

It has been brought to the notice of the Government that National Joint Council of Action (NJCA), New Delhi has decided to observe “All India Protest Day” on 19th September, 2018 in support of the following issues:

i. Upward Revision of Minimum Wage and Fitment Formula, ii. Scrapping of the New Contributory Pension Scheme; and iii. Allow Option No.1 as one of the Pension Fitment Formula.


2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow etc. or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also ruled in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Attention of all employees of this Department is also drawn to this Department’s O.M. dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed protest, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on protest, all Divisional Heads are requested to forward report indicating the number and details of employees, who are absent from duty on the day of protest, i.e., 19.09.2018.

NJCA DECIDES TO OBSERVE “ALL INDIA DEMANDS DAY” ON 19th SEPTEMBER 2018

Dear Comrades,
NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP – led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.

Demands :- 1) Upward revision of Minimum Wage and Fitment Formula
2) Scrapping the New Contributory Pension Scheme. 
3) Allow Option-1 as one of the Pension Fitment Formula.

This Circular is issued in pursuant to 139(1) of the Tax Act, 1961 is to clarify that rumors spreading across in media regarding extension in due date for non-tax audit is fake and no such plans to extend this deadline beyond 31st July, 2018. The department already received over 1 crore returns filed electronically.
As per Section 234F of the Income Tax Act, from 1st April 2018, the penalty for late filing income tax return would be as
(a) five thousand rupees, if the return is furnished on or the 31st day of December of the assessment year;
(b) ten thousand rupees in any other case:
Provided further that if the total income of the person not exceed five lakh rupees, the fee payable under this section shall not exceed one thousand rupees. Therefore, the assessees are hereby asked to file their ITRs before the due date to avoid the penalty.

The NJCA met today and took note of the inordinate delay in honouring the commitment made by the Government on 30th June, 2016 in respect of Minimum Wage, Fitment Formula, Scrapping the New Contributory Pension Scheme, Option No.1 to Pensioners, Outsorucing, Regularization of Contract/Casual Workers, JCM revival etc.
At the end of the deliberations it was decided to adopt a resoultion and forward the same to the Government. Copies of the Resolution and letter to the Cabinet Secretary are enclosed herewith, which are self-explanatory.
The NJCA will again meet on 18.08.2018 to finalize the future course of action in the matter of Indefinite Strike which was deferred on 06.07.2016.

Dear Sir/Madam,

Sub: Filing of Returns by every Government Servant – Reg.

As you might be aware, every person who is having income more than Rs.2,50,000 is bound to file his/her return of income. This includes the Government Servants also. However, the data of returns filed indicate that more than 50% of the Government Servants at Chennai are not filling their income tax returns. I hope, you will agree that as government servants, we should abide by laws and to be role models to the common citizens of our country. If we, Government servants ourselves are violating law by not filling our income tax returns, we don’t have any moral right to blame other sections of society.

From this year i.e Assessment Year 2018-19 onwards, the Parliament has amended the Income Tax Act by introducing a new section 234F for imposing late fee on every person who is not filling his/her return of income within the due date. For salaried employees, the due date is 31-07-2018. This means all the salaried employees have to file their returns of income for the Financial Year 2017-18 (Assessment Year 2018-19) on or before 31-07-2018. Otherwise they all mandatorily have to pay late fee amounting between Rs.1,000 to Rs.10,000 as per the provisions of Section 234 . Also, a penalty of Rs.5,000 can be imposed under section 271F on them. In addition to this, they can be prosecuted under section 276CC of the Income Tax Act for jail termsvarying between three months to seven years.

It may please be noted that these provisions are applicable to all the persons having gross income (excluding deductions) above Rs.2,50,000/-. It is understood that many persons who are claiming deductions under section 80C etc. (on GPF contribution, Life Insurance Policies, Housing Loan Repayment etc.) and adjustment of Interest on Housing Loan are under the impression that they need not file the return as their net income is below taxable limit and no TDS is deducted from their salary.
Therefore, I request you to kindly intimate and advice all the employees to whom the gross salary paid in the last year is more than Rs.2,50,000 to file their returns of income before 31-07-2018. It may also be noted that all the incomes earned by an employee such as rental income (including subletting of house/s), interest incomes, dividend from Co-operative societies and all such incomes should be declared in their returns of income. Later, if found to have omitted any such incomes, they are liable for separate penalty and prosecution for concealing those incomes.

A copy of this letter may be handed over to each of your employees who draw their salary through you. You may also discuss this issue with the Head of your Office/Department and request him/her to issue a circular to all the employees to file their return of income well in time.

Subject: Online generation and recording of Annual Performance Assessment Report (APAR) on SPARROW (Smart Performance Appraisal Report Recording Online Window) for all Organised Group ‘A’ Services – Extension of timelines for completion of APAR for the year 2017-18.

The undersigned is directed to invite a reference to this Department O.M. of even number dated 16th April, 2018 on the above subject.

2. As some of the Cadre Controlling Authorities of Organised Group ‘A’ Services are facing practical difficulties in getting the self-appraisal of the officers under their cadre on SPARROW web portal due to technical problems, it has been decided that the target dates prescribed in this Department O.M. No.21011/1/2005-Estt.(A) (P(II) dated 23rd July, 2009 be further relaxed as one time measure only for online generation, filling up of self-appraisal, reporting, reviewing and acceptance of APAR for the year 2017-18 through SPARROW web portal. The revised target dates for recording of APAH online for the year 2017-18 is enclosed as Annexure. This relaxation is subject to the condition that no remarks shall be recorded in the APAR for the year 2017-18 after 31.12.2018. Where the reporting, reviewing and accepting authority fail to record their comments within the time frame, the officer may be assessed on the basis of the overall record and self-assessment for the year, if he has submitted his self-assessment within the stipulated time.

The undersigned is directed to refer to JCA Section’s OM No. 11/1/2015-JCA dated 29.11.2017 and OM No. 3/3/2016-JCA dated 18.01.2018 on the above mentioned subject. With regard to request of JCA Section to discuss the issue with Staff Side. It is stated that it is not known on which issue Staff-Side desires to discuss the issue. Since the MACP Scheme is very complex, it would be appropriate that the matter may be discussed in the JCM meeting itself. 7th CPC has recommended in Para 11.40.81 for stepping up of pay in circumstantial ground prevalent in M/o Railways.
On the proposal of M/o Railways for accepting this recommendation of 7th CPC, file has been referred to D/o Expenditure for approval

Suitable instructions to be issued that wherever promotions are given on non selection basis (seniority-cum-fitness) the prescribed benchmark as mentioned in para 17 of Annexure 1 of MACPS dated 19.05.2009 will not be applicable and the benchmark for promotion will apply for the purpose of MACPS.

Ensuring Five Promotions in the Service Career and Grant of MACP in the promotional hierarchy.
It was observed by Secretary (P) that the reason behind delay in promotion was also due to delay in completion and implementation of cadre review report and instructions would be issued to speed up cadre review.

With regard to other demand i.e. grant of MACP in promotional hierachy, it is stated that if MACP will be granted in the promotional hierarchy, it will give rise to uneven benefit to employees falling in the same pay scale since several organizations adopted different hierarchical pattern. Consequently employees working in organizations having greater number of intermediate greater number of intermediate grades will suffer because financial upgradation under MACPS will place them in lower pay scale vis-à-vis similarly placed employees in another organization that had lesser intermediary grades.
Further, 7th CPC has also recommended that MACP will continue to be administered in the hierarchy of level in the Pay Matrix

Ensuring Five promotions in the Service Career
It was informed that when this anomaly was earlier pointed out to the Joint Committee it was promised that this would be reconsidered and rectified. They suggested that if the MACP scheme was considered more beneficial the employee should be given option to choose whether be wants ACP Scheme of MACP scheme. The Chairman desired to know if there was any pay commission recommendation on this issue, on which he was informed that there was not.
It was decided that the Establishment Division would examine the issue further.
It is stated that if MACP will be granted in the promotional hierarchy it will give rise to uneven benefit to employees falling in the same pay scale since several organizations adopted different hierarchical pattern. Consequently employees working in organizations having greater number of intermediate grades will suffer because financial upgradation under MACPS will place them in lower pay scale vis-à-vis similarly placed employees in another organization that had lesser intermediary grades.
Further, 7th CPC has also recommended that MACP will continue to be administered in the hierarchy of levels in the Pay Matrix.

Establishment Division had through their letter dated 09.02.2017 informed that a formal proposal of M/o Defence had been received. The matter was discussed with the representatives of M/o Defence twice i.e. on 19.01.2016, and 26.01.2016. The issue will be referred to D/o Expenditure for reconsideration of their earlier advice.
The Staff-Side expressed satisfaction with the action taken. It was decided that the item may be closed.

JS (Admn and JCA) informed that ever since the introduction of disclosure of APARs, the number of employees getting higher level of gradings may rise. Proposal needed to be evidence based. It was decided that the Ministry of Railways may provide data on the trend of recorded gradings of APARS.
Though the matter assigned to M/o Railways, however, it is stated that the issue of enhancing the benchmark for promotion is under active consideration of the Government and the modalities decided in the matter of promotion will be made applicable in the case of MACP

Action taken report on the minutes of the standing Committee National Council JCM held on 03.05.2017

Minutes – Reacting to the comment made by the official side, the staff side pointed out that prima-facie, on introduction of computerized functioning in almost all departments, the functions assigned to LDCs have become redundant.

Decision – What is required is to get the report from each department and take a conscious decision, as LDC is a common category.

Report of the Ministry of Railways (OM dated 01.12.2017)

In view of functional requirement of Ministry of Railways (Railway Board) and promotional aspects of MTS, proposal to abolish and upgrade all posts of LDCs (LDC now as Junior Secretariat Assistant) to UDCs (now called as Senior Secretariat Assistant) may not be recommended and besides this, RBSCS is patterned on the lines of the CSCS and the existing system is working well, unless there is any change in CSCS, no change is desirable in RBSCS. 7th CPC has also not provided upgradation of to LDCs; therefore to abolish and upgrade all posts of LDCs to UDCs is considered not feasible.

Sub: – Application of “Very Good” bench mark for grant of Financial upgradation under MACPS.

DOP&T vide OM No. 35034/3/2015-Estt (D) dated 28.09.2016 had clarified that with effect from 25.07.2016, for grant of financial upgradation under MACPS, the prescribed bench mark would be “Very Good” for all posts. It is also clarified that there is no question of allowing second opportunity of representation against APAR as these are already disclosed to the employees in APAR process.

Notwithstanding our demand for withdrawal of “Very Good” bench marking condition for MACPS, it is submitted as follows: Since the earlier “Good” bench mark for MACPS was applicable upto 25.07.2016, the employee having “Good” grading in their APARs for the previous years before 25.07.2016 may not have had a reason to represent gradings given, as they met the then prescribed criteria of bench marking for MACPS. Now since the benchmark for MACPS has been raised to “Very Good”, there is justification to allow the employees having “Good” or below grading for a period of five years APAR grading immediately preceding the cut-off date ibid an opportunity to represent against the same.

Considering the above aspect, it is requested that employees who had been awarded “Good” or below grading in their previous five years APARs may be given an opportunity, as one time measure, to represent against the same.

In fact, Railway Board, Ministry of Railways had already granted such an opportunity to its employees as a one-time measure vide Railway Board letter No. E(NG)/1-2018/CR/2 dated 27.02.2018.
