With a view to expedite authorization and disbursement of arrears, arrear claims may be paid without pre-check of fixation of pay in the revised scales of pay. However, the facility has not been dispensed with in respect of those Government servants who have relinquished service on account of dismissal, resignation, discharge, retirement etc. after the date of implementation of the pay Commission’s recommendations but before the preparation and drawl of arrear claims, as well as in respect of those employees who had expired prior to exercising their option for the drawal of pay in the revised scales.

The requirement of pre-check of pay fixation having been dispensed with, it is not unlikely that the arrears due in some cases may be computed incorrectly leading to overpayments that might have to be recovered subsequently. Therefore, paying authority, should, make it clear to the employees under their administrative control. while disbursing the arrears; that the payments are being made subject to adjustment from amounts that may be due to them subsequently sholud any discrepancies be noticed later. For this purpose, an undertaking may also be obtained in writing from every employee at the time of exercising option under Rule 6(1) thereof. A specimen form of the undertaking as prescribed as per a “Form of Option” under Rule 6(2) of CCS (RP) Rules 2016 is enclosed as Annexure-III.

In order to facilitate a smooth and systematic fixation of pay, a proforma has been annexed for the purpose (Statement of Fixation of Pay) is enclosed as per CCS(RP) 2016 to be prepared in triplicate and one copy thereof be placed in the service book of the employee concerned and another copy made available to the concerned accounting authorities [Chief controller of Account/controller of Accounts/Accounts Officer] for post check.

Hidden facts about 7th Pay Commission Implementation

Hidden facts about 7th Pay Commission Implementation

After the Cabinet approval, the Finance Minister tweeted, “Congratulations to central government officers, employees & pensioners on a historic rise in their salary & allowances through the 7th Pay Commission.”

The Central Government Employees were dismayed by this tweet and wondered how it was described as historic rise. There are so many hidden facts in the cabinet approval for implementation of 7th Pay Commission recommendations

1. What did the Empowered Committee of secretaries do in Sixth months and what did they recommend? There was nothing mentioned about the report of this committee submitted to Cabinet and Whether the cabinet considered the ECoS recommendations or not.

2. This is the first time in the Pay Commission History that Pay Commission recommendation are going to be implemented in staggered manner. Only Basic Pay alone will be revised. All other Allowances will be revised after four months.

3. After second Pay Commission, this is the lowest hike recommended in Pay Scale. Just 14.27%. 30% hike is expected invariably by all cg employees.

4. This is the first time the central government employees are not so excited about the Hike recommended in 7th pay Commission and its Implementation. The reasons are, Very Minimal hike and Implementation of Allowances is deferred.

5. There was an anomaly in sixth pay Commission in granting Annual Increment for the New entrant. If the Govt Servants recruited in the first six months of the year from January 2nd to June 30th, the Annual Increment will be granted on 1st July of next year (i.e after 13 to 18 Months ) .This anomaly is also not addressed by 7th Pay Commission.

6. To address this issue, NCJCM proposed Two Increment dates i.e on 1st January and 1st July . This is not considered by Govt.

7. The Sixth CPC has recommended to grant MACP on Grade Pay Hierarchy. Many Court Cases are won by Govt servants in favour of granting MACP on Promotional hierarchy. But this issue also not considered by Govt and 7th Pay Commission.

8. The Central Government Employees were shocked by the recommendation of reducing the Rates of HRA to 24%, 16% and 8%. Adding further fuel to the fire, the reduced allowances are also not implemented with immediate effect.

9. The Cabinet also decided not to accept the steep hike in monthly contribution towards Central Government Employees Group Insurance Scheme (CGEGIS) recommended by the Commission. But the CG Employees welcomed the Pay Commission recommendation in CGEGIES, as it is providing high risk cover. But it is turn down by Government.

10. The only positive fact in 7th Pay Commission Recommendation is its PAY MATRIX. In Sixth Pay Commission, there was disparity in Pay fixation for promotes and new Entrants. The Entry Pay fixed for particular Grade to the New Recruits is higher than the Pay fixed for the Govt Servants promoted to that same Grade. This issue is somehow addressed in 7th Pay Commission by fixing Entry Pay for all Levels in New Pay Matrix.

Submission of Memorandum against Central Government Cabinet Decision on the 7th CPC

Submission of Memorandum against Central Government Cabinet Decision on the 7th CPC

Bharatiya Pratiraksha Mazdoor Sangh

TO,

The Prime Minister
Govt. Of India,
South Block, Raisina Hills
New Delhi – 110 011

Through: proper Channel

Subject: Submission of Memorandum against Central Government Cabinet decision on the 7th CPC

Hon’ble sir,

Through this memorandum we the members of this union who are central Government Employees and believe in the ideology of Bharatiya Mazdoor Sangh reflect our disappointment, grief, sorrow and anger due to non-settlement of long pending demands related to the recommendations of 7th CPC.

It is a matter of great concern that all the recommendations which are against the lower rung of central Government Employees have been accepted in toto on 29th June, 2016 by the Central Cabinet. though we had got opportunity through out federation Bharatiya Pratiraksha Mazdoor Sangh, GENC & BMS to reflect out concerns before the Hon’ble Finance Minister, Defence Minster & MoS for DOP&T over the issues of enhancement in Minimum Pay Rs.24000/- from Rs.18000/- Multiplying Factor for fitment 3.42 from 2.57, rate of increment 5% from 3%, merging of some of the pay scales/grade pay of Group “C”, resolving the issue of MACP, scrapping of NPS etc. and the Hon’ble Ministers had assured to take care of the issues but it appears that they have reneged.

Government employees are further disappointed on the communication received through press release published in press Information Bureau (release ID 146885) dated 06.07.2016 that the issues related to the pay scales and other recommendations of 7th CPC would be considered by a High Level Committee that will further delay in the implementation.

Hence, on the call of Bharatiya Mazdoor Sangh, Government Employees National Confederation and Bharatiya Pratiraksha Mazdoor Sangh, this union has observed agitation programme in this Defence Establishment from 30.06.2016 to 08.07.2016 to invite the attention of Govt of India towards the discontentment prevailing amongst the central Government employees including Defence civilians.

Earlier, we have also observed the demand week from 01.03.2016 to 05.03.2016 and from 13.06.2016 to 18.06.2016 on the retrograde recommendations of 7th CPC but no fruitful result has come till date.

In such circumstances, you are requested to intervence into the matter personally so that demands mentioned hereinabove may be accepted by Govt of India and all financial benefits of the 7th CPC may be granted forthwith.

An early action is solicited please.
With regards,

sincerely yours

7th Pay Commission: Government expected to take a decision by end of this week

7th Pay Commission: Government expected to take a decision by end of this week

Central government employees are likely to get their revised salaries based on the recommendations made by the 7th Central Pay Commission (CPC) by August this year.

A decision is expected to be taken on June 11 when the empowered committee headed by cabinet secretary P K Sinha meets to discuss the subject.

“Central government employees could get the revised pay scales with their July salaries that would be credited on Aug. 1,” the Financial Express quoted finance ministry sources as saying.

The commission had suggested an average hike of 23.5 percent in pay and allowances for about 47 lakh central government employees and 52 lakh pensioners with retrospective effect from January this year.

The Narendra Modi government allocated Rs. 70,000 crore in this year’s budget for implementing the proposals, the full-year impact of which has been estimated at about Rs. 1.02 lakh crore in 2016-17.

The implementation of the 7th CPC recommendations is being seen as a double-edged sword. While consumption is expected to get a fillip and in turn spur growth, the government’s finances are bound to come under strain with the full implementation, leaving less money in its hands to spend on infrastructure.

In its latest monetary policy statement released on Tuesday, the Reserve Bank of India (RBI) had listed the 7th CPC recommendations as one of the three risks for inflation.

“…there are upside risks – firming international commodity prices, particularly of crude oil; the implementation of the 7th Central Pay Commission awards which will have to be factored into projections as soon as clarity on implementation emerges; the upturn in inflation expectations of households and of corporates; and the stickiness in inflation excluding food and fuel,” it said.

National Joint Council of Action [NJCA] – Meeting with the Cabinet Secretary

NJCA
National Joint Council of Action
4, State Entry Road New Delhi-110055
Ph: 011-23365912, 23343493, Fax: 23363167

No.NJCA/2016

Dated: May 17, 2016

All Constituent Organisations,
National Council(JCM)

Dear Comrades,

Sub: Meeting with the Cabinet Secretary

On 5th May, 2016 I met the Cabinet Secretary, Government of India, and once again draw his attention towards my letter No.NC/JCM/2016 dated: May 2, 2016, a copy of the said letter was also handed over to him.

During discussion I also mentioned about the anguish of the Central Government employees because of inordinate delay in implementation of VII CPC recommendations and also their anxiety about enhancement in Minimum Wage as well as Multiplying Factor etc.

I also demanded a meeting with the Staff Side, NC/JCM on all the issues raised by the Staff Side, NC/JCM and demanded that, views of the Official Side should also be made known to the Staff Side.

The Cabinet Secretary agreed to hold a meeting with some of the Secretaries, particularly with the Secretary(Exp.), Secretary, DoP&T and whosoever is required, particularly for discussion.

It has been assumed that, a Cabinet Note is being prepared and is likely to be submitted to the Cabinet, Government of India, very shortly. We are not very sure that, the demands raised by the Staff Side, NC/JCM have been incorporated in that Cabinet Note.

In these circumstances I believe that, we should call a meeting of the NJCA and discuss about the strategy and future course of action, particularly in regard to Strike Notice on 9th June, 2016 and “indefinite Strike” from 11 th July, 2016.

The meeting of the NJCA will be held on 3rd June, 2016 at 16:00 hrs. in JCM Office 13-C, Ferozshah Road, New Delhi.

Hope, all members of the NJCA will make it convenient to attend the meeting.

Comradely yours,

7th Pay Commission: Reasons of delay in Implementation

7th Pay Commission: Reasons of delay in Implementation

Central Government employees must be wondering why Centre is taking so much time to implement Seventh Pay Commission recommendations.

It’s already four months since Pay Commission had submitted its report to Finance Ministry to give final touch to it.

Though, Modi Government recently dropped enough hint that it will implement increment process soon, but no particular time frame was given to the Central staff.

Here are the possible reasons why Government is taking time to implement the hike.

Government needs to arrange fund

As Rs 1.02 lakh crore is needed to implement whole increment process, Centre needs to have proper strategy for the same.

At a time when OROP’s expenditures is already taking toll on the exchequer, pay Commission will put extra burden on the government budget.

Grievances of various stakeholders

Government needs to address grievances of various stakeholders including government staff and Army men before taking final call on the same.

While Babus are unhappy with minimum basic pay, Defence personnels say that they shouln’t be treated at par with their civilian counterparts in terms of salary and allowances.

Assembly elections

As model code of conduct is in place, Government doesn’t want to take risk by announcing implementation date. Centre doesn’t want to displease voters at a time when poll process is going on in many crucial states. It is being believed that notification for the ‘increment proposal’ will be issued once State election will be over.

Procedural delay

Pay Commission will be implemented after cabinet will give it a final approval. Currently, the Implementation cell of the Empowered Committee of Secretaries is trying to address various issues with it. After giving final touch to the report, Empowered Committee will send recommendations to PMO for its nod. Once PMO will through the report, it will be placed before the Cabinet.

Implementation of 7th CPC : Minutes of the 2nd meeting of Empowered Committee of Secretaries (E-CoS)

Implementation of the recommendations of the 7th Central Pay Commission — 2nd meeting of the E-CoS

A meeting of the Empowered Committee of Secretaries (E-CoS) was held on 1 st March, 2016 in the Cabinet Secretariat under the chairmanship of the Cabinet Secretary to discuss issues raised by Staff„side of JCM

2. Welcoming the members of E-CoS and JCM Staffside, Cabinet Secretary observed that the meeting had been called to take a note of concerns of Staff-side of JCM regarding recommendations of the 7th CPC and invited the members Of Staff-side of JCM to share their views on the recommendations.

3. Opening the discussion, representative of Staff-side of JCM expressed gratitude to Cabinet Secretary for inviting them for interaction regarding the recommendations of the 7th CPC and requested that more frequent interactions of JCM may be held to resolve outstanding issues across the table. It was expressed that 7th CPC has recommended a meager increase of 14% in the minimum pay as against increase ranging up to 54% during previous Pay Commissions. It was further stated that the recommendations on minimum pay, allowances, advances etc. will cause difficulty to employees. Representative of Staff-side informed that they have already submitted a charter of demands to the Cabinet Secretary bringing out the issues. These have also been discussed in the meeting of JS (IC) with Staff-side of JCM held on 19.02.2016.

4. Major concerns expressed by JCM Staff-side were as under:

The minimum pay of Rs. 18000/- p.m. recommended by the Commission is on lower side and needs to be revised upward by taking into account the prices of commodities as on 01.07.2015 and appropriately factoring in for social obligations & housing.

(ii) New Pension Scheme should be done away with. Persons governed by the NPS are deprived of Family Pension and do not have provision of provident fund. As a result they are at a disadvantageous position as compared to the persons governed by the old system.

(iii) Recommendations on allowances need to be properly examined before taking a decision.

(iv) Fixed Medical Allowance should be increased from existing Rs. 500 p.m. to Rs. 2000 p.m. as majority of cities are not covered under CGI-IS and people residing outside the CGHS covered area are unable to meet their medical needs with meager amount of Rs. 500 p.m.

(v) Recommendation regarding withdrawal of non•interest bearing advances may not be accepted.

(vi) Outsourcing of services should be discouraged as the contract workers are being exploited by contractors and at the game time the service delivery is being compromised due to inefficiency and lack of accountability of low aid contractual staff.

(vii) Enhancement in contribution towards Group Insurance Scheme, is not justified as this would reduce the actual increase in take home salary considerably. If the rates are to be raised, the Government should bear the insurance premium

(viii) The recommendation regarding grant of only 80% of salary for the second year of Child Care Leave need not be accepted as this would deter women from availing of CCL, which was introduced as a welfare measure.

(ix) Annual increments be granted @ 5% instead of existing 3% and increments may be granted on two dates viz., 1 st of January and 1 st of July of every year as in the present system of grant of increment on 1 st July of every year, employees joining/promoted after 1 st January, who do not complete 6 months services as on 1 st July, have to wait for up to 18 months for grant of increment.

(x) The Commission’s recommendation of downgrading the Assistants of Central Secretariat for bringing in parity with their counterparts in the field offices is not appropriate.

(xi) Recommendation regarding PRIS need not be accepted as no scientific mechanism has been devised to assess the performance of employees and the same could e courage favoritism.

5. Issues regarding financ al upgradation under MACPS in promotional hierarchy without grading stipulation. grant of two increments on promotion introduction of Productivity Linked Bonus, treating Grameen Dak Sevak as Government employees, removal of pap of 5% on compassionate appointment 8i full pay and allowances In case of Work Related Illness and Injury Leave improving promotional avenues for technical and supervisory staff etc. were also raised by members of JCM.

6. During the discussion, representatives of JCM also suggested that the Nodal Officers nominated by various Ministries/Departments may hold interactions with recognized Staff Associations and other stakeholders under their purview so as to identify issues specific to those Ministries/Departments for redressal.

7. After hearing the participants, Cabinet Secretary observed that the deliberations have helped E-CoS in understanding the major concerns of the Staff-side and said that all issues have been taken note of. He assured that fair consideration will be given to all points brought out by JCM before taking a final view. He further stated that the E-CoS needs to examine the Report of the Commission in entirety as well as the issues raised by JCM in consultation with all other stakeholders. As such, it may take some time to take a final call on the recommendations of the Commission.

8. Cabinet Secretary also advised the members of E-CoS to hold interactions with their Staff Associations and other stakeholders under their purview preferably within a week.

9. Meeting ended with vote of thanks to the chair.

7th CPC Implementation- Minutes of the Meeting of Nodal Officers held on 02-02-2016

MINUTES OF THE MEETING OF JOINT SECRETARY (IC) WITH NODAL OFFICERS HELD ON 2ND FEBRUARY, 2016

A meeting of all the Nodal Officers of various Ministries/Departments, who have been appointed to interact with the Implementation Cell in connection with the processing of the recommendations of the 7th Central Pay Commission, was held on 02.02.2016. Joint Secretary (IC), Department of Expenditure, presided over the meeting.

2. While explaining the background and the context in which the meeting of Nodal Officers was held, it was brought out in the meeting that after the receipt of the report of the 7th Central Pay Commission on 19.11.2015, Ministry of Finance initiated a proposal to setup an appropriate mechanism to process the recommendations of the Commission. With the approval of the Cabinet, an Empowered Committee of Secretaries (E-CoS) headed by the Cabinet Secretary has been set up on 27.1.2016 to screen the recommendations and to firm up the conclusions for approval of the Cabinet. An Implementation Cell (IC), as a dedicated and focused wing in the Department of Expenditure (DoE) has been created to work as the Secretariat for the E-CoS.

3. As the recommendations of the Commission relate to various Ministries/ Departments, their views/comments would be essential to process the matter for submitting the same before the E-CoS. JS(Pers), D/o Expenditure wrote a d.o. letter to the Secretaries of various Departments on 21.11.2015, wherein all the Departments were requested to formulate their views/comments on the recommendations of the Commission pertaining to them after taking into account the representations of the Staff Associations and also to nominate a Joint Secretary level Nodal Officer for interaction with the Implementation Cell. While a number of Ministries/Departments have sent their comments and nominated their Nodal Officers, the comments received from some Ministries are simply in the nature of forwarding the representations of the Staff Associations without their comments.

4. In the above background, JS(IC) explained that there was a need for all the Ministries/Departments to furnish their comments in a structured format so that their collation and analysis could be placed before E-CoS in a systemic manner. Accordingly, JS(IC) impressed upon the following action points to be acted upon by the Nodal Officers to enable an expeditious processing of the recommendations of the 7th Central Pay Commission:

Departments who have not yet nominated a Nodal Officer, should do it within the next 2 days.

(ii) To be ensured that Nodal Officers are not changed midway, unless extremely unavoidable.

(iii) Nodal Officers may get acquainted with the recommendations of the Commission as specifically applicable to their Departments. Nodal Officers to find out which Wing/Office (attached or subordinate or UT) is concerned with the recommendations of the Commission. The mechanism of Nodal Officers should also be put in place in attached/subordinate/UTs so that the comments of such offices could be properly coordinated at the level of the Department concerned without any further delay.

(iv) The comments of the attached/subordinate offices/UTs should be compiled by Nodal Officers at the Department level itself.

(v) Nodal Officers to take note of any representation or demand of the Staff Association under the administrative purview of their Department. Nodal Officers to ascertain the views/comments of the concerned office on the recommendation of the Commission in the light of the representation /demands raised by the Staff Association.

(vi) In case, there is any need for consultation with the Staff Association at the level of the Department, the same may be done as per the assessment of the Department.

(vii) Thereafter, the formal views/comments of the Department should be sent to the Implementation Cell (IC) on the recommendations of the Commission, which are specifically and directly related to that Department.

(viii) In case, the Department is of the view that any recommendation which are specifically related to their Department, need any modification, adequate justification in clear-cut terms should be brought out while sending the comments to the Implementation Cell (IC).

(ix) In case of any modification, the extra financial implications (per annum) over the recommendation of the Commission should be clearly indicated.

(x) If no modification of the recommendations of the Commission is suggested, approval of the Secretary of the Department should be obtained before sending the recommendations to the Implementation Cell (IC). if, however, any modification is suggested, approval of the Minister should be obtained.

(xi) While the views/comments of the Departments on the recommendations of the Commission directly and specifically applicable to that Department are mandatory, a Department is free to offer views/comments on the recommendations which are of general nature or concerning other Departments.

(xii) Besides sending the comments/views of the Department in the running format, the same should also be sent to the Implementation Cell (IC)in the `prescribed proforma’ within two weeks. The soft copies of the same should also be sent through email. The email id of JS(IC) is : jsic-cpc@nic. in

(xiii) Nodal Officers shoud regularly keep a watch on the website of the Finance Ministry at the link http://www.finmin.nic.in/the ministry/dept expenditure/ notification/7cpc/index.asp. E-mails should also be checked regularly for the purpose. The updates/further action to be taken shall be posted there to facilitate quick action.

5. Apart from the above action points, it was also felt that sub-groups may be formed after the receipt of comments from the Ministries/Departments to accord focused consideration to certain specific issues, if necessary.

6. Besides above, after detailed deliberations, the Nodal Officers also agreed to the following :

(i) Even if the Department has no comments, it should send a response, saying that it has `Nil Report’.

(ii) While certain Departments have already given their comments, these comments would be sent again in the ‘prescribed format’ and in accordance with the points brought out in para 4 above.

(iii) Nodal officers would ensure that the comments of their Departments on all the recommendations of the Commission and also on the representations received so far from the Staff Associations are forwarded to Implementation Cell (IC) in the prescribed format in a consolidated fashion and not in piece-meal within next two weeks.

(iv) If a representation was made by a Staff Association before the 7th Central Pay Commission and the Commission after due diligence has not accepted the demand made therein, the same matter should normally not be considered at this stage. However, if Departments consider that the issues are of such nature that they require consideration at this stage also, then they may give their comments with full justifications to the Implementation Cell (IC).

7. With the above discussions, the meeting ended with a vote of thanks to the Chair.
