ONE DAY STRIKE on February 15th to MARCH 16th 2017 THURSDAY.

ONE DAY STRIKE on February 15th to  MARCH 16th 2017 THURSDAY.

Dated : 05th January,2017

To
(1) All National Secretariat Members
(2) Chief Executives of all Affiliated Organisations
(3)General Secretaries of all C-O-Cs

Dear Comrades,

As Assembly elections to five States are scheduled to be held from February 4th to March 11th (including declaration of results) and as February 15th is also poll date in two states , the National Secretariat of Confederation of Central Government Employees & Workers has decided to postpone the proposed ONE DAY STRIKE on February 15th to MARCH 16th 2017 THURSDAY.

As 13th March is holiday for Holi in North India and the celebrations are to continue on 14th also, the strike date is fixed as 16th March. There is no change in the 10th January Mass Dharna Programme.

All those Organisations who had served the strike notice as February 15th shall give a letter to their Head of the Departments intimating the postponement of the strike to 2017 March 16th , showing reasons as mentioned above , WITHOUT FAIL.

Those organisations who have not yet served the Strike Notice should serve the notice before 15th January 2017 WITHOUT FAIL.

Regarding already announced campaign programme of National Secretariat members , if necessary , dates may be rescheduled by the National Secretariat members in consultation with the concerned C-O-Cs.

General Secretaries of C-O-Cs are also requested to contact IMMEDIATELY, the concerned National Secretariat members and finalise the date of campaign programme. Intensive campaign should be conducted by all C-O-Cs and Affiliated Organisations in all States, especially in those states where elections are declared, so that employees and general public will become aware of the totally negative attitude of the Central Government towards the legitimate demands of the Central Government Employees and Pensioners.

The betrayal of the Group of Cabinet Ministers of NDA Govt by not fulfilling their assurance given to NJCA leaders on 30th June 2016, should be exposed.

CONFEDERATION NEWS - REVISED ALLOWANCES WILL NOT BE PAID IN THIS FINANCIAL YEAR.

CONFEDERATION NEWS - REVISED ALLOWANCES WILL NOT BE PAID IN THIS FINANCIAL YEAR.

THE CAT IS OUT OF THE BAG

REVISED ALLOWANCES WILL NOT BE PAID IN THIS FINANCIAL YEAR.

ALLOWANCES COMMITTEE'S TIME LIMIT EXTENDED UPTO 22.02.2017

CENTRAL GOVERNMENT EMPLOYEES AGAIN CHEATED BY NDA GOVERNMENT

STRIKE IS INEVITABLE

MAKE 15th DECEMBER PARLIAMENT MARCH
A THUNDERING SUCCESS!

Dr. Urjit R. Patel, Governor, Reserve Bank of India has made the following observations in a media conversation which is published in RBI website.

(1) The disbursement of salaries and arrears under 7th Pay Commission award has not been disruptive to inflation outcomes.

(2) The extension of two months given to the Ministry of Finance to receive the notification on higher allowances under the Pay Commission's award, COULD PUSH IT'S FULLER EFFECT INTO THE NEXT FINANCIAL YEAR rather than this financial year.

The above statement by the Governor, RBI clearly indicates that THE ALLOWANCES WILL BE REVISED ONLY AFTER FEBRUARY 2017 AND WILL COME INTO EFFECT IN THE NEXT FINANCIAL YEAR ONLY.

Earlier to a question regarding increase in Minimum Pay and Fitment formula Minister of State for Finance Shri Arun Ram Meghwal gave the following reply in the Raja Sabha on 23.11.2016.

"The anomalies arising out of implementation of 7th Central Pay Commission will be examined by the Anomaly Committee which has already been constituted. Based on the report of the Committee, the matter will be considered by the Government and appropriate decision will be taken.

From the reply it is clear that the question of increase in Minimum Pay and Fitment factor is to be decided by the Anomaly Committee. That is why the Government has not formally constituted THE HIGH LEVEL COMMITTEE as assured by the Group of Ministers to the JCM Staff side leaders in the  30th June night  discussion. And this is the reason for Group of Senior Officers behaving as if they .don't know what the task is assigned to them. Now by 30th December SIX months will be over after the 30th June assurance given by Group of Ministers including Shri Rajnath Singh , Hon'ble Home Minister , Shri Arun Jaitley , Hon'ble Finance Minister and Shri Suresh Prabhu , Hon'ble Railway Minister . Employees and Leaders have never expected such blatant breach of assurance given by Senior Cabinet Ministers of NDA Government.

The revision of pay and pension of thousands of Autonomous body employees and Pensioners  is also pending for the last six months. On 17.11.2016 Finance Ministry has given instructions to all Autonomous bodies NOT TO EXTEND the benefits of 7th CPC to employees and Pensioners of Autonomous bodies UNTIL FURTHER ORDERS.

The One man Committee constitute by Government for revision of wages and service conditions of three lakhs Gramin Dak Sevaks of Postal Department had submitted it's report to Government on 24th November 2016.  Even after 20 days, the Government is not ready to publish the report or give copy to the recognised Federations.

The revision of wages of Casual, Part-time Contingent and Contract workers, consequent on implementation of 7th CPC wage revision is also pending.

The one and the only favourable recommendation of 7th CPC ie; Parity between past and present pensioners (Option - 1) stands referred to a Committee which has taken a stand that Option - 1 is not feasible.

None of the demands raised by Confederation in its 20 point charter of demands is settled.

THERE IS NO SHORT-CUT OTHER THAN STRUGGLE.

AWAKE!    ARISE!!  UNITE COMRADES!!!

RALLY ROUND CONFEDERATION.

WE THE WORKERS, WE THE NATION,
WE ARE NOT BEGGAR FOLKS

To,
Controller General of Accounts
Mahalekha Niyantrak Bhawan,
Ministry of Finance,
GPO Complex, Block E, Aviation Colony, INA Colony, New Delhi – 110003

Sir,

Sub: -Request for issuing instructions for disbursement of salary of Central Government Employees for the month of November 2016 in cash.

As you are aware , the difficulties being experienced due to demonetization of Rs.500/- and Rs. 1000/- currency notes may continue for about 50 days as made clear by the Goverment. Further Banks have imposed a cap of 24000/- for withdrawal from savings Bank Accounts. Even for withdrawing that amount, one has to stand in long que for hours together. Naturally Central Government employees are likely to face much problem for getting their salary for this month in time. Employees waiting in que for cash may adversely affect the functioning of Central Goverment offices also.

In view of the above situation, I request you to issue necessary instructions to all pay drawing and disbursing officers, to make advance arrangements for payment of salary for November 2016, in cash, to all Central Government employees, on or before 30th November 2016.

Yours faithfully,

Draft Minutes of Allowance Committee - DOP&T Specific Allowances

Draft Minutes of Allowance Committee - DOP&T Specific Allowances
No.6/8/2016-CPC
Government of India
Ministry of Personnel, Public Grievances & Pensions
Department of Personnel & Training
(CPC Section)

North Block, New Delhi
Dated the 7th November 2016

To
 Shri Shiv Gopal Mishra
Secretary, Staff Side
National Council Staff Side (JCM),
13-C, Ferozeshah Road
New Delhi – 110001

Subject: Draft minutes of the meeting held on Tuesday the 25th October 2016, under the Chairmanship of Secretary (P) with the representatives of Staff Side, National Council (JCM) on issues relating to the DoPT- Specific Allowances.

Sir,
Please find enclosed a copy of the Draft Minutes of the meeting held under the Chairmanship of Secretary (P) on Tuesday the 25th October 2016 with the representatives of Staff Side on issues relating to the DoPT- Specific Allowances. You are requested to send your comments on the draft minutes by 15/11/2016 positively.

Yours faithfully,

(D.K. Sengupta)
Deputy Secretary (CPC)

RECORD NOTE OF THE DISCUSSION ON DOPT-SPECIFIC ALLOWANCES, HELD WITH THE STAFF-SIDE, NATIONAL COUNCIL (JCM) AT 3.00 P.M. ON 25.10.2016 UNDER THE CHAIRMANSHIP OF SECRETARY(P).

A discussion on the DoPT-specific allowances with the Staff-Side National Council (JCM) was held at 3.00 p.m. on 25.10.2016 under the Chairmanship of Secretary(Personnel) in Room No. 119, North Block, New Delhi in compliance with the direction contained in the minutes of the 2nd meeting of the Committee on Allowances held on 01.09.2016 that every Ministry/Department should firm up its views/comments on allowances relating to the Ministry/Department after holding discussion with their Staff Associations.

List of participants is at Annexure.

At the outset JS(JCA) welcomed all the members of the Staff side of the National Council of JCM to the discussion on department specific allowances. JS(JCA) informed that in the second meeting of the Committee on Allowances it was decided that all the department specific allowances will be discussed with the JCM. After a brief introduction it was decided to discuss the following department specific allowances on which DOPT has received the comments for Staff-Side.
Children Education Allowance (CEA)

The Staff-Side has stated that the benefit of Children’s Education Allowance should be extended to the Graduate and Post Graduate levels also. They have informed that the private institutions are charging exorbitantly. So, subject to a ceiling on tuition fees and hostel fees, the CEA should be extended to the Graduates and Post Graduates level. Staff-Side has informed that they had also represented to the Pay Commission for simplifying the procedure wherein they had suggested that reimbursement should be based on the bonafide certificates from the schools where the children are studying. This suggestion has been accepted by the Pay Commission and the Staff-Side has requested that it should be implemented.

On the issue of DOPT’s circular on e-receipt, Secretary, DoPT clarified that this circular had been issued before the government accepted the 7th Pay Commission recommendation.

(Action: JS(Estt.)

Night Duty Allowance (NDA)

Staff-Side has pointed out that the Night Duty Allowance (NDA) is still being paid at the 4th CPC rate. Even though there is a Board of Arbitration award in favour of employees that from 01.01.1996 it should be given in the 5th CPC pay scale, the government did not accept the arbitration award and even today employees are getting it at the same rate as it was prevalent during the 4th CPC period.

In the Ministry of Defence a lot of litigation had taken place and the matter went up to the Supreme Court. Hon’ble Supreme Court directed that it should be paid on the basis of the actual pay drawn and that NDA should be revised w.e.f. 01.04.2007 at the 6th CPC pay scale which has been implemented by the government. However, the audit authorities came up with an objection that there is a ceiling for it which has been objected to by the Staff-Side.

Apart from that, the 7th Pay Commission has recommended that it should be worked out with the actual pay of the employee being the criterion. However, in spite of that, except for the Ministries of Defence and Railways, employees working in other Ministries/Departments are getting it at 4th CPC rate. Thus, the absence of uniformity on this allowance across Ministries/Departments is very glaring which, according to the Staff-Side, is a principal source of litigation and will continue to remain so. Therefore, the Staff-Side has suggested that an early revision of the NDA without ceiling, and on the basis of the actual basic pay, and extending it to whoever is asked to do night duty will go a long way in reducing litigations in the future.

(Action: JS(Estt.)

Over Time Allowance (OTA)

Staff-Side has pointed out that there are two types of over time duty. One is covered under the Factories Act, 1948, and the other is for the office staff. In the first case, since it is a statutory obligation, the Pay Commission has not recommended anything on it. But for those Central Government employees who are not covered under the statutory provisions of the Factories Act, OTA is paid at a single rate of Rs.15.85/- only and, that too, for the first hour immediately after the scheduled office closing time, it is Nil. In case of OTA there is also an arbitration aw-ld from 01.01.1996 that it should be at par with the 5th CPC pay scale. However, neither it has been implemented nor have the rates been revised.

The Staff-Side has stated that if an employee is asked to work after hours the rate of OTA should be as per 7th CPC pay scale. Staff-Side is of the opinion that overtime means working after office hours, and asking an employee to work beyond office hours automatically entitles him/her to this allowance. The over time rates should also be above the normal level. It was pointed out by them that as per 7th CPC, an MTS is paid @ Rs.75/ hour; whereas overtime allowance is @ Rs. 15.85/- only. Even an outsider employed on casual basis is being paid hourly wages which are more than OTA. The Staff-Side is strongly of the view that if government is deploying a person on overtime work then he has to be paid at least according to the rate of salary which he is getting

(Action: JS (Estt.)

Cash Handling Allowance (CHA)

Staff-Side has informed that the 7th CPC recommendation on its abolition is based on the fact that in most of the offices today salary disbursement is not made in cash. It is credited to the individual bank accounts. But cash transactions do take place in certain offices like the Post Offices where cash handouts are made under the Mahatma Gandhi National Rural Employment Guarantee Act. PLI is also another example. Therefore, if it is stopped all of a sudden, no person will show interest in working as cashiers and take the additional responsibility of handling huge amounts of cash. Therefore, the Staff-Side has contended that till all cash transactions are eliminated, CHA should continue.

It was also pointed out by them that this allowance depends on the amount of cash transaction; when the volume of cash transaction comes down, the allowance will also proportionately come down.

(Action: JS(Estt.)

Uniform related allowances subsumed in a single Dress allowance (including shoes)

Staff-Side has informed that the 7th Pay Commission has recommended that Persons Below Officers Rank (PBOR) should be given Dress Allowance @ Rs.10,000/- per month. There are 5 Ordnance Factories under Ministry of Defence where persons are exclusively deployed to produce special high altitude dresses for the combat forces of the army. 12000 employees are working in these 5 factories. Therefore, if a uniform rate like this is maintained, it will have an adverse impact on the quality of these high altitude uniforms and will thus jeopardise the safety of the armymen and the nation as a whole. Staff-Side is stated to have already made a request to M /o Defence not to implement this recommendation. Army has also taken a stand that this will result in substandard or sub quality material. So this recommendation on the Dress allowance for PBOR should not be implemented.

As far as Civilian employees are concerned, it has been stated that the 7th CPC has recommended four slabs of Dress Allowances for various categories. One of the categories is called ‘others’. Whereas, in the Department of Posts there are about 75,000 postmen and Multi Tasking Staff wearing uniform. There is no mention about these postmen and multi tasking staff in any of the categories shown by the Pay Commission. If it is presumed that they come under ‘Others’, then they will be getting Rs. 5,000 whereas at present they are getting around Rs. 7,000 plus washing allowance. As such a separate category should be there for postmen and MTS also and the allowance should be Rs.10,000/-

It has also been pointed out that there are many categories like canteen employees, security staff, chowkidars which have not been mentioned and who are eligible for uniform or uniform allowances. It has to be clarified whether these categories will be covered under ‘others’. Staff-Side has stated that whosoever is getting Dress Allowance as on today should continue to get that. Staff-Side has also informed that the recommendations on Dress Allowance have created a lot of discrimination among staff working in similar circumstances.

Staff-Side has also drawn attention to the Dress Allowance with respect to the Nursing Staff. It has been stated that earlier also Nursing Staff were not given normal washing allowance or dress allowance considering the importance or the peculiar conditions prevailing in hospitals. Now they have also been bracketed in the general category. They were getting Rs.750 as Uniform Allowance and Rs. 450 as Washing Allowance per month. Now there is no separate category that has been given to them. For them a different dispensation was made taking into account their special requirements because they work in such an environment where their uniforms require regular washing entailing a substantial expenditure. As these have not been accounted for in the 7th CPC, the nursing staff should have a special dispensation, as is strongly felt by the Staff-Side.

JS (JCA) has requested Staff-Side to submit a note on the justification or break-up of the amount of Rs.32,400(maximum) as suggested by them and the Staff-Side has agreed to provide the same.

Secretary, DOPT summed up the demands of the Staff-Side by observing that those who were getting Dress Allowances, their allowances should not come down. And the categories of the employees which had special dispensation in the past and have not been mentioned this time or have been clubbed together with other categories need clarification.

(Action: JS(JCA)/Staff-Side)

Risk Allowance

The Staff-Side has informed that Ministry of Defence is engaged in arms and ammunitions manufacturing etc. In the process of manufacturing them, the staff engaged for this purpose, have to handle hazardous chemicals, acids and so many other poisonous combinations. Cabinet has approved 45 risk operations pertaining to Defence civilian employees. Apart from that, because of the technological developments taking place fast and as the requirement of the armed forces is increasing for getting modern equipments, ammunitions and explosives, new risk operations have also come into existence of which Ministry of Defence is aware and have recommended also accordingly. In spite of this, the existing Risk Allowance has been abolished by the Pay Commission. It has been pointed out by the Staff- Side that it has not been subsumed under the risk and hardship matrix. Rather it comes in the abolition list. In no matrix are the risk operations of Defence civilians are covered. Staff-Side has informed that they have discussed this with Defence Secretary and Defence Ministry is going to recommend in favour of its inclusion in one of the matrix.

In response to the query of Secretary, DOPT as to whether the activities which have been considered to be risky have all been identified, Staff-Side has clarified that it has been identified by a high level committee and approved by the Cabinet. 45 risk operations have been identified and approved. But within a period of 2 decades, lot of new ammunitions and new explosives have come in the arsenal, alongwith a lot of hazardous chemicals and acids. So, M/o Defence has again appointed a committee and they have identified that all these are additional risk operations over and above the 45 identified, where Defence Civilian employees are actively involved. But the Pay Commission has abolished Risk Allowance. So this has to be incorporated in one of the risk matrix.

(Action: JS(Estt.)

Other Items

Staff-Side has pointed out that in the 7th CPC report it has been stated that any allowance not mentioned and hence not reported to the Commission shall cease to exist immediately. They have requested that this recommendation should be rejected. On the contrary, the administrative Ministries should come forward and recommend for their abolition or retention.

Staff-Side has also stated that 7th CPC has abolished all advances completely. Noting that we regularly celebrate a number of festivals like Diwali, Holi, Eid and keeping the general sentiment in mind, they are of the view that advances are very necessary. Moreover, these advances are required to be paid back to the government.

On Family Planning Allowance, the Staff-Side has stated that since the Government has not changed its Family Planning policy, the allowance should be continued. At least in the case of those people who were getting it they should continue to get as they have fulfilled all conditions when the allowance was granted. Otherwise there will be drop in their emoluments.

Prepare for Strike - Confederation of Central Government Employees and Workers Karnataka State

Prepare for Strike - Confederation of Central Government Employees and Workers Karnataka State

Comrades,

The meetings of allowances and standing committee of National JCM scheduled on 13th October 2016, has been postponed to 25th October 2016. It was expected that the recommendations of allowance committee will be made in October 2016 , with the postponement of meetings now we can expect in November 2016 the allowances committee will submit its report .

Meanwhile the Finance Ministry has issued orders on advances. The 7th CPC has recommend for abolition of all advances, the staff side JCM demanded retention of all advances , the some of the advances such as medical, computer and travelling allowances are retained, but the important festival advance is been abolished.

The Government has so far not set up the high level committee on minimum wage, fitment formula revision and other main demands of CG employees as assured by Cabinet Ministers in July 2016. Since four months’ time which was sought by the Cabinet Ministers is going to end shortly.

The Central Government has shown urgency in issuing orders on advances, but the same urgency is not shown in case of issue of orders on allowances and revision of minimum wage, fitment formula which will benefit lakhs of Central Government employees.

To put more pressure on the Central Government to accept the main demands of the Central Government employees all are requested to observe the following programs.

1ST PHASE – 20th OCTOBER 2016 – THURSDAY
Demonstration at all centres/all office gates and forwarding of resolutions adopted on charter of demands to Hon’ble Prime Minister of India (2) Hon’ble Home Minister (3) Hon’ble Finance Minister and all Departmental heads.

Ref:Confdn/7th CPC/Autonomous/2016-19

Dated:  20.09.2016

To,
The Secretary (Expenditure)
Ministry of Finance (Govt. of India)
Department of Expenditure
North Block, New Delhi – 110001

Sir,

Sub: – Implementation of recommendation of 7th CPC – Fixation of Pay and Payment of arrears in respect of – (a) Autonomous organisations (b) Central Government Employees who are working in Autonomous bodies on deemed deputation.

1. Please refer to the Government of India, Department of Finance & Department of Expenditure Resolution No. 1-2/2016-IC dated 25.07.2016 bringing out the decisions of the Government on the recommendations of 7th Central Pay Commission as well as consequent promulgation of the Central Civil Services (Revised Pay) Rules 2016, notified vide G. S. R. No. 721(E) dated 25th July 2016 regarding fixation of pay in the revised pay structure effective from 01.01.2016.

2. Every time, when Revise Pay Rules in respect of Central Government Employees are used, the Government used to issue separate orders regarding the extension of those benefits to the employees of Autonomous Organisations etc. whose pattern of emolument structure are identical to those of the Central government employees. Last time the Revised Pay Rules was issued on 30.08.2008 and orders extending the benefit to similarly placed employees of Autonomous bodies was issued on 30.09.2008. This time eventhough the Revised Pay Rules are issued on 25.07.2016, till this day i.e. even after a lapse of more than one month orders regarding Autonomous bodies is not issued.

3. Further it is reported that the employees of working at Central Food Laboratory, Kolkata (Health and Family Welfare Department, Government of India) who are on deemed deputation has not been paid the Revised salary for the month of August 2016 in terms of CCS (RP) Rules 2016 by the Director, Central Food Laboratory. Director, CFL has issued orders to draw the pay on the basis of pre-revised pay even in respect of those Central Government employees working at CFL who are on deemed deputation. He has equated employees of the Autonomous organizations with the employees on deemed deputation. Above action of the Director, CFL, Kolkata appears to be not in conformity with the Para- 7 of OM No. 1-5/2016-IC dated 28.07.2016 in letter and spirit.

4. In view of the above, it is requested that clear instructions may be issued to all Ministries regarding applicability of CCS (RP) Rules 2016 in respect of
(a) Employees of Autonomous Bodies
(b) Central Government employees who are on deemed deputation to Autonomous bodies.

A line in reply from your end will be highly appreciated.

DEFERRING OF THE INDEFINITE STRIKE – CLARIFICATIONS

DEFERRING OF THE INDEFINITE STRIKE – CLARIFICATIONS

M. Krishnan, Secretary General,
Confederation of C. G. Employees & Workers

Dear Comrades,

We are in receipt of messages and emails from our grass root leaders and workers conveying their concerns over the decision of NJCA to defer the indefinite strike. Comments are circulated in other social medias like whats app etc. also. As it is not practically possible to reply to all the queries and comments, to put the record straight, we are clarifying below the common points raised by most of our comrades and well-wishers. We sincerely thank all those leaders, comrades and well-wishers, who have conveyed (and still conveying) their views, opinions, criticisms and concerns to the confederation CHQ.

1.      CONVEYING THE DEFERMENT OF THE STRIKE EVEN BEFORE THE NJCA FORMALLY ANNOUNCED IT:

NJCA has taken serious note of this incident and shall take precautionary measures in future.

2.      WHETHER IMPLEMENTATION OF THE CABINET DECISION ON 7TH CPC RECOMMENDATIONS WILL BE DELAYED FURTHER FOR FOUR MONTHS

The question of keeping in abeyance the implementation of the Cabinet decision on 29th June 2016 regarding 7th CPC recommendations, till the High Level Committee submits its report to Govt, was discussed in the NJCA meeting. It is decided that NJCA should not demand it, as the employees may be put to hardship, especially those who are in the verge of retirement. Com Shiv Gopal Misra, Convenor, NJCA has confirmed from the Finance Ministry that Govt notification on 7th CPC recommendations is under process and it will be issued shortly, payment may be made from August salary.

3.      WHAT IS THE DIFFERENCE BETWEEN EMPOWERED COMMITTEE CONSTITUTED EARLIER AND THE NEW HIGH LEVEL COMMITTEE?

The new High Level Committee is the product of the discussion held by Group of Ministers including Home Minister, Finance Minister and Railway Minister with NJCA leaders after announcement of the Cabinet decision, in the wake of an impending indefinite strike. Govt is compelled to appoint the new Committee, as the decision taken by the Govt on the proposals submitted by the Empowered Committee headed by Cabinet Secretary (details of proposals of ECoS is not known to staff side) is not acceptable to the NJCA. Hence the new Committee shall be to reconsider the decision of the Govt. especially regarding minimum wage and fitment formula. Inspite of the assurance of the Groups of Ministers that the Committee is being constituted to reconsider the Govt. decision, if the Govt. again reject our demand, the NJCA have to reconsider its stand and deferred strike shall be revived.

4.      POSITION REGARDING ALLOWANCES

All allowances including HRA, transport allowance, fixed medical allowance to pensioners etc. are referred to a committee headed by Finance Secretary. Committee shall submit its report within four months. Pending final decision based on the report of the Committee, all existing allowances to be paid as per the existing rates in existing pay structure. Govt. may try to deny arrears of revised rate of allowances by implementing it from prospective date as in the past. This issue will be further discussed by the NJCA with the proposed Committee.

5.      WE WOULD HAVE GOT A BETTER SETTLEMENT IF NJCA HAS GONE AHEAD WITH THE INDEFINITE STRIKE

All of us are aware that NJCA is not a monolithic, composite organization. It is a united forum of independent organisation. Each Federation has its own identity and individuality and take decision as per the direction of the managing bodies of each organization. Hence different views may emerge in the NJCA, but final decision is taken by consensus. If each organization stick on to its own stand and others to follow it, there is no question of consensus and NJCA will not exist.

With all its inherent weakness and limitations, the NJCA has successfully challenged the NDA Govt’s stand that there is no negotiation with the staff side on the 7th CPC recommendations. Govt. thought that once the Cabinet decision is announced unilaterally, followed by unleashing of well-orchestrated media propaganda that big bonanza is given for Central Govt. Employees, the NJCA will be forced to withdraw its indefinite strike decision. But the calculation of the Govt went wrong. NJCA took a firm stand that unless and until the retrograde recommendations especially minimum wage and fitment formula is modified, there is no question of withdrawing the strike. All the Federations are firm on this demand which ultimately compelled the Hon’ble Prime Minister to intervene. (NJCA has written to Hon’ble Prime Minister for intervention even before the Cabinet decision, but the Govt. ignored the NJCA’s appeal at that time). As per the direction of the Hon’ble Prime Minister, Hon’ble Home Minister Sri Rajnath Singh, Finance Minister Sri Arun Jaitly and Railway Minister Sri Suresh Prabhu discussed the main issues raised in the Charter of demands with NJCA leaders, and assured that Govt. will appoint a High Level Committee to reconsider the decision of the Govt., especially on minimum pay and fitment formula. This assurance was given with the approval of Hon’ble Prime Minster.

Inspite of it, the NJCA has not deferred the strike and insisted written confirmation of the assurance regarding constitution of High Level Committee. Again Hon’ble Home Minister Sri Rajnath Singh called the NJCA leaders and reiterated the earlier assurances and informed that the Finance Minister will issue a press statement confirming the assurance given to NJCA. Only after receipt of the copy of the press statement issued by the Finance Ministry, NJCA has deferred the strike till the finalization of the report of High Level Committee.

As the Hon’ble Prime Minister of  our country has intervened and as three Cabinet Ministers of Govt. of India discussed the demands with NJCA leaders and gave assurance that the demands, especially minimum pay and fitment formula will be reconsidered, and as the Home Minister has again reiterated the assurances to NJCA leaders and Finance Minster has issued press statement confirming the constitution of High Level Committee, the NJCA felt that before embarking upon an indefinite strike which is the last weapon in the hands of the workers, we should give time to the Govt. to implement the Minister’s assurances given as per the direction of the Prime Minister and honour its commitment given to NJCA leaders. NJCA taking a stand that we don’t believe the Ministers and their assurance and shall go ahead with the strike, may not be taken in good spirit by the general public and the media. In case the Govt. backs out from its assurances, the NJCA has got every right to revive the deferred indefinite strike.

Com. Shiva Gopal Mishra, Convenor, NJCA has made it clear in the circular issued on 7th July 2016, which reads as follows: -

“Though there is positive assurance from the Govt. of India, but all of you will not take rest and assume counseling the cadre and ground staff that they should remain in full preparedness, because if there will not be SATISFACTORY OUTCOME, we will be having no alternative except to agitate the issues again.”

6.      WHAT ABOUT PARITY IN PENSION? WILL IT BE IMPLEMENTED AS THERE IS A CLAUSE IN THE GOVT DECISION THAT THE PROPOSED COMMITTEE WILL EXAMINE THE FEASIBILITY OF IMPLEMENTATION OF THE OPTION No I, ie PARITY IN PENSION TO PAST PENSIONERS

This issue was raised before the Group of Minister by Com. K. K. N. Kutty, who is also the Secretary General of NCCPA (National Co-ordination Committee of Pensioners Associations). It was pointed out to the Finance Minister that even though the Govt. has decided to accept 7th CPC recommendation to have two options to pensioners, it is qualified with the words “subject to feasibility.” The Finance Minister categorically assured the delegation that the Govt. has accepted the recommendations in toto and the Pension Department has only been asked to sort out the difficulties in implementation of the Option-No-I, if any.

7.      WHAT ABOUR DEMANDS OF THE GRAMIN DAK SEVAKS, AS NJCA IS MORE CONCERNED WITH MINIMUM PAY FITMENT FORMULA ONLY

Any increase in the minimum pay and fitment formula for departmental employees (MTS, Postman & PA) will be extended to Gramin Dak Sevaks also proportionately as the GDS Pay Scales are decided based on the pay scales of corresponding category of departmental employees. So, the demand to increase minimum pay and fitment formula of MTS, Postman and PA is equally important for GDS also.

As regards, civil servant status the NJCA has raised this demand before the Govt and 7th CPC. Even though the 7th CPC Chairman, Retired Justice Ashok Kumar Mathur has informed the JCM staff side leaders he will not consider the GDS case as they are not included in the terms of reference of the Commission, the Chairman gave a very damaging recommendation to the Govt. that GDS are not Civil Servants but they are part – time employees and Extra-departmental agents. He further stated that all the GDS are having another main independent income from another source and GDS job is only a side-business. NJCA leaders have raised the issue of GDS before the Cabinet Secretary’s Committee and also before the Group of Ministers. We shall again raise the issue before the proposed high level committee also. Govt. has constituted a separate committee for GDS under the Chairmanship of Retired Postal Board Member Sri Kamalesh Chandra. NFPE, AIPEU-GDS and Confederation has submitted detailed memorandum before the Committee and Secretary General NFPE Com. R. N Parashar, General Secretary AIPEU-GDS Com, P. Panduranga Rao along with other leaders has given evidence before the GDS Committee demanding Civil Servant status. The GDS committee will submit its report before December 2016. Further NFPE and AIPEU-GDS has filed a case in the Supreme Court for grant of Civil Servant status. Supreme Court has transferred the case to Delhi High Court which in turn transferred it to Principal Bench of Central Administrative Tribunal, Delhi. The final argument of the case will take place on 25th July 2016. NJCA, Confederation, NFPE and AIPEU – GDS are jointly trying their level best to get justice to three lakhs Gramin Dak Sevaks of the Postal Department. If the GDS Committee report is against the GDS, then definitely NJCA and Confederation will be fully supporting the agitational programmes of NFPE & AIPEU-GDS including indefinite strike.

The main hurdle is the policy of the NDA Govt. as the Communication Minister of NDA Govt. has rejected our demand for grant of Civil Servant status to GDS.

Successful Strike on 11th July 2016 will fetch decent 7th Pay Commission Pay and Allowances – Confederation of Central Government Employees

Successful Strike on 11th July 2016 will fetch decent 7th Pay Commission Pay and Allowances –Confederation of Central Government Employees and Workers, Karnataka Branch observes in the background of Govt’s decision to withhold Provident Fund withdrawal Policy on the response of Flash Strike by Garment Factory Workers in Bangalore

Comrades,

The flash strike against the recent PF Rules, 2016 of the Central Government (i.e., Centre’s new rule on Provident Fund withdrawal) by large section of Garment Factory Workers and other Industrial Workers of Karnataka State on 18th and 19th April 2016 received immense response and there was a massive protest which resulted in road blocks for hours together, thereby the entire traffic of Bengaluru City was paralyzed. The traffic was also severely affected on Mysore, Tumkur and Hosur roads.

The COC Karnataka extended moral support and sympathy for this Labour Movement. The February 10th notification was under attack from trade unions from the beginning. The notification was published in the gazette on February 26 and created technical problems.

The violence in Bengaluru prompted the Labour Ministry, Govt. of India to cancel the February 10 notification which put restrictions on 100% withdrawal from the PF account.

Within few hours of protest in Bengaluru and other parts of Karnataka state , the Hon’ble Minsiter for Labour, Shri.Bandaru Dattatreya acted upon and withdrawn the notification issued on February 10th and informed that the old system will continue. This is a victory for the workers of the country.

This clearly shows that the Government of India does not want to antagonize the workers. If the Central Government employees also participate in trade union action against the retrograde recommendations of the VII CPC similar to the Garment Workers of Karnataka, we too can get similar results and hope for a better wage revision and a decent wage hike.

This Labour movement of the Garment Workers of Karnataka state is an eye-opener for all other working class in the entire country, Comrades if one state and one particular working class movement can bring changes to the policy of the Central Government, if the entire the entire country the Central Government employees agitate against the retrograde recommendations of the 7th CPC (where only 14 % wage hike was provided against the staff side demand of 80% wage hike and also reducing the number of allowances and reduction in HRA rates) then the Central Government shall provide the decent wage hike by settling the issue of wage hike with the staff side NJCA like the PF issue being settled.

Comrades it is high time to prepare for 11th July strike of Central Government employees under the banner of NJCA. We shall get good results and Central Government shall grant better wage hike than the 7th CPC recommendations. Better we prepare for 11th July strike better wage hike we get.

Comradely yours

7th CPC Recommendations – Confederation National Secretariat Decisions

7th CPC Recommendations – Confederation National Secretariat Decisions

Date : 27-11-2015

Dear Comrades,

National Secretariat of the Confederation of Central Govt Employees & Workers held on 27-11-15 at New Delhi after detailed deliberations on the recommendations of the 7th Central Pay Commission (CPC) has decided as follows :

1.The National Secretariat has come to the unanimous conclusion that many of the recommendations of the 7th CPC are most retrograde and require to be modified before implementation by the Government, especially the faulty and depressed minimum wage arrived at by the 7th CPC and the fitment formula. Some of the recommendations such as abolition of certain allowances etc., are to be rejected.

2. The National Secretariat is of the firm opinion that a united struggle of entire Central Govt Employees including Railways, Defence and Confederation under the banner of National Joint Council of Action (NJCA) can only compel the Government to modify or reject the retrograde recommendations of the 7th CPC and hence it is decided to further strengthen the unity.

3. The National Secretariat further resolved that the form of the united struggle of NJCA should be an indefinite strike, within a time frame, as Govt is moving fast to implement the recommendations. Negotiation with the Government should precede declaration of indefinite strike and intensive campaign among the employees and mobilization, to create sanction behind the demands.

4. In case the requisite movement is not coming about for any reason, Confederation National Secretariat will meet and chalk out its own independent action.

5. Regarding the sector-wise issues relating to the employees of each department, the affiliated organizations of the Confederation in those departments shall take initiative for uniting all like-minded Federations/Associations/Unions in their department and shall organize agitational programmes on departmental specific demands.

6. The National Secretariat decided to insist that the charter of demands of the NJCA and Confederation should include the demands of Gramin Dak Sevaks, Casual/Contract labourers, filling up of vacancies and scraping the New Contributory Pension Scheme.

7. All affiliated organizations of Confederation are requested to intimate by e-mail to the Confederation CHQ (confederationhq@gmail.com or mkrishnan6854@gmail.com) on the required modifications or additions / deletions in the common recommendations (not department-specific) of the 7th Pay Commission on or before 05-12-2015.

8. Available Secretariat members of the Confederation will meet on 07-12-2015 at New Delhi and finalize the common demands to be included in the charter of demands of NJCA. (NJCA meeting is being held at JCM National Council, Staff-side office on 08-12-2015 to finalize the charter of demands and the further course of action).

9. The National Secretariat congratulated all the Central Govt Employees who made the 27th November 2015 ‘All India Protest Day’ at the call of NJCA, a grand success all over the country by wearing ‘black badges’ and participating in protest demonstrations.

Other Decisions:

1. Next All India Workshop-cum-Trade Union Camp of Confederation will be held at Dehradun (Uttarakhand) before March 2016.

2. The National Secretariat extended full support and solidarity to the proposed agitational programmes of Passport Employees Association including ‘Indefinite hungerfast’

DECEMBER 1st & 2nd, 2015 TWO DAYS STRIKE DEFERRED by NFPE

DECEMBER 1st & 2nd, 2015 TWO DAYS STRIKE DEFERRED by NFPE

SECRETARY GENERAL AND ALL GENERAL SECRETARIES OF NFPE & AIPEU GDS (NFPE) WILL SIT ON TWO DAYS HUNGER FAST INFRONT OF DAK BHAWAN, NEW DELHI ON 1st & 2nd DECEMBER 2015

ONE DAY MASS HUNGER FAST IN FRONT OF ALL CPMG / PMG & DIVISIONAL OFFICES ON 11th DECEMBER 2015

TO EXPRESS OUR ANGER, RESENTMENT AND STRONG PROTEST AGAINST THE REJECTION OF THE LEGITIMATE DEMANDS OF THREE LAKHS GRAMIN DAK SEVAKS BY THE NDA GOVT.

The Federal Secretariat of NFPE held at NFPE Office, New Delhi on 26-11-2015, reviewed the whole situation prevailing among the postal employees in general and the Gramin Dak Sevaks (GDS) in particular after the submission of the 7th Central Pay Commission Report to the Govt and also after the appointment of a separate committee for GDS by the Govt, headed by a retired Postal Board Member as Chairman.

The Federal Secretariat  further reviewed the proposed two days strike call given by NFPE and AIPEU GDS (NFPE) for realization of the legitimate demands of the Gramin Dak Sevaks, which  include bringing the GDS also under the purview of 7th CPC treating them as Civil Servants.

The main demand of NFPE and AIPEU GDS (NFPE) in the charter of demands submitted to Govt and Postal Board is “inclusion of GDS under the purview of 7th CPC”. NFPE organized series of agitational programmes for the GDS demands including dharnas, hunger fast, GDS Parliament March, Parliament March under the banner of Postal JCA (NFPE & FNPO), one day strike on 12th December 2012 and 48 hours strike on 12th & 13th February 2014. Due to our agitational programmes the Postal Board was compelled to submit the proposal for inclusion of GDS under 7th CPC to Finance Ministry with favourable recommendations. But the Finance Ministry rejected the proposal three times and it is in this background NFPE & AIPEU GDS (NFPE) decided to go for two days strike on December 1st & 2nd demanding the Govt to include GDS under the 7th Pay Commission.

Even though the Govt refused to include the GDS under the 7th CPC, the 7th CPC has suo moto examined the main demand of the GDS ie., treating them as Civil Servants and extending them all the benefits of the departmental employees, ofcourse proportionately. It is most unfortunate that the Pay Commission headed by a retired Supreme Court Justice as Chairman, has considered our demand and categorically stated that Gramin Dak Sevaks are holders of Civil Posts but outside the regular civil service and hence can not be treated at par with other civilian employees. After this observation of the Seventh CPC even if the GDS are included in the 7th CPC they are not going to get a fair deal. This has compelled us to modify the demand placed by us before the Govt in the charter of demands.

NFPE, from the very beginning has opposed the appointment of an Officer Committee for GDS and NFPE & AIPEU GDS (NFPE) has tried their best to prevent appointment of an Officer Committee and compelled the department to make effort for inclusion of GDS under 7th CPC itself. But now NDA Govt rejected our demand and has unilaterally appointed GDS Committee with a retired Postal Board Member as Chairman and cheated three lakh GDS employees. From our past experiences we know that the retired officers of the Postal Department will never do justice to the Gramin Dak Sevaks.

In view of the fact that 7th CPC has rejected our demand for Civil Servant status and also the Govt has unilaterally imposed the officer committee on GDS, the Federal Secretariat felt that it is not appropriate to go for an immediate strike with the demands raised by us in the charter of demands, i.e., inclusion of GDS under 7th CPC. Now GDS can get justice only if NDA Govt take a policy decision to regularize the services of GDS treating them as Civil Servants. Federal Secretariat is fully aware that we can not expect such a decision without the  change in the policy of the Government towards GDS. To make a change in the policy decision of the Govt., a bigger mobilization and strike of all postal employees including GDS with the active support and solidarity of other central Govt employees under the banner of Confederation of Central Govt Employees and workers and also the JCM National Council Staffside organizations is required.

The Federal Secretariat decided to explore all possibilities and wider consultations for such a united struggle. The Federal Secretariat felt that to pave way for wider consultations, the independent strike call of NFPE & AIPEU GDS (NFPE) need to be deferred and all likeminded organizations are to be brought under a common platform. Accordingly Federal Secretariat unanimously decided to defer the proposed two days strike scheduled to be held on 1st & 2nd December 2015.

The Secretary General and all General Secretaries of NFPE shall sit on two days hunger fast in front of Dak Bhawan, New Delhi on 1st & 2nd December 2015 expressing our strong protest to the Govt and also demanding regularization of Gramin Dak Sevaks by granting them civil servant status with all consequential benefits of regular employees.

The Federal Secretariat, while saluting the grass root level workers for their intensive campaign and preparation for the strike, calls upon them to organize one day hunger fast infront of all CPMG / PMG and Divisional Offices throughout the country on 11th December 2015 to ventilate our anger, resentment and strong protest against the callous and inhuman attitude of the NDA Govt towards three lakh Gramin Dak Sevaks who are the backbone of the Postal Department catering to the needs of the rural population of this country in postal sector.

Federal Executive of NFPE will meet shortly  to review the situation and shall decide future course of action.
