ORDER: 

In the Government Order second read above, orders were issued revising the scales of pay of employees / teachers on a pay scale to pay scale basis' notionally with effect from 1—1—2006 with monetary benefit from based on the recommendations of the Official Committee. Subsequently, One Man Commission was constituted to examine the anomalies, consequent on the implementation of the revised scales of pay and more specifically to examine the representations of the teachers associations to extend Central Scales of pay. The recommendation of the One Man Commission was accepted by Government in to and 87 Government Orders were issued department-wise revising the pay scales of various categories. 

2) As per the orders of the Hon'ble High Court, in W.P.No. 7006 Of 2011, the Government constituted "Pay Grievance Redressal Cell" (PGRC) to examine the representations received from the employees associations Heads of Department / individual employees including the aggrieved petitioners in Writ Petitions filed challenging the G.O.Ms.No.71, Finance (Pay Cell) Department, dated:26—02—2011. An elaborate exercise was done by the PGRC on 4376 representations received from various associations I individuals / Writ Petitioners and heard their grievances in person before arriving at conclusions. Based on the recommendations of the PGRC, 89 Government Orders were issued benefitting around two lakhs employees. 

3) In spite of further revision in pay scales as indicated above, several court cases have been filed by individual employees I associations. seeking further pay revision. Further a number of requests are being made by individual employees / associations and information on present their request are sought under Right to Information Act 2005. which has resulted in voluminous work in Finance Department. Further. nine years has already lapsed since the implementation of revised pay and therefore requests for further pay revisions cannot be entertained at this juncture with retrospective effect. 

4) The Government after careful consideration has decided to examine the anomalies / requests for further pay revision at the time of general pay revision by Commission I Committee. Accordingly, Government direct that the representations received from the associations I individual employees requesting for further revision of Pay Band I Grade Pay be deferred till a Commission / Committee 
is constituted for general pay revision. The Principal Secretaries / Secretaries to Government shall issue necessary instructions in this regard to the Heads Of Department under their administrative control for strict adherence.

Amendments in the Rajasthan State Pensioners’ Medical Concession Scheme, 2009.

Sub: Amendments in the Rajasthan State Pensioners’ Medical Concession Scheme, 2009

The Governor is pleased to make the following amendment in the Rajasthan State Pensioners’ Medical Concession Scheme 2009, namely:

In the said Scheme :-

(i) In Para 8(B), the words “Drug Distribution Centre (DDC) under Mukhyamantri Nishulk Dava Yojna”shall be inserted after the existing words "Jan Aushadhj Kendra” appearing in the first sentence.

(ii) In Para 14(1), the words “and Drug Distribution Centre (DDC) under Mukhyamantri Nishulk Dava Yojna”shall be inserted between the existing words “Rajasthan Sahkari Upbhokta Bhandar” and “shall be authorized shop” in the second line.

(iii) Below existing Para 14 A, the following new Para 14B shall be inserted, namely-

14B- Issuance of Non Availability Certificate to the Pensioner in respect of medicines not available at Drug Distribution Centre under Mukhyamantrj Nishulk Dava Yojna.

(1) The pensioner shall present the medical diary along with photocopy of the prescription, which will be kept by the Drug Distribution Centre who shall provide medicines to the pensioner free of cost.

(2) In case the medicines prescribed by the Authorised Medical Attendant in the medical diary of the pensioner are not available with the DDC, the incharge of the shop shall issue a Non Availability Certificate (NAC) to the pensioner.

(3) The pensioner shall purchase the medicines from the licensed medical shop and shall submit the claim of medicine purchased on the basis of NAC to the respective Treasury Officer.

This order shall be deemed to have come into force with immediate effect.

Grant of family pension to the widowed/divorced daughter- clarification thereof.

Subject:- Grant of family pension to the widowed/divorced daughter- clarification thereof.

Sir/Madam,
I am directed to refer to this office letter No. 2/53/ 2009-1Pension dated 26.4.2010 vide which clarification for entitlement of a person to receive family pension on the date of death of the employee or pensioner was issued.

2. Sometime past the issue has been received in Finance Department for further clarification in r/o family pension to widowed/divorced daughter. After due consideration, in reference to Rule 14 of Haryana Civil Services (Revised Pension) Rules, 2009 and earlier clarification issued vide No. 2/53/2009-1 Pension dated 26.4.2010, it is further clarified that the family pension will be payable to widowed/divorced daughters if she fulfils all the eligibility conditions at the time of death of the Government servant or his/her spouse, whichever is later provided she is still eligible for family pension when her turn comes. The family pension will continue only till she remarries or starts earning her livelihood equal to or more than the sum of minimum family pension and dearness relief thereon.

The position is iliustrated through an example. Shri X, a Pensioner, died in 1985. He was survived by his wife, Smt Y, a son Shri Z and a daughter, Kumal E the daughter being the younger. Kumari E married in 1989 and got widowed in 1995. Smt. Y died in 2000. Thereafter, Shri Z (son) was getting family pension being disabled and died in 2002. Thereafter, the family pension was stopped as. Kuniari E was not eligible for it at that time. She applied for family pension on the basis of Haryana Civil Services (Revised Pension) Rules, 2009. Since she was a widow and had no independent source of Income at the time of death of her mother (family pensioner) and on the date her turn came, she may be granted family pension.

Subject:- Payment of arrears on account of revision of pay scales under the Himachal Pradesh Civil Services (Revised Pay) Rules, 2009

Sir,
   In continuation of this Department’s letters of even number dated: 19th March, 2010, 2nd November, 2010 & 10t March, 2011, on the subject cited above, I am directed to say that Governor, Himachal Pradesh, is pleased to release the 10% (Ten percent) of total accrued amount of arrear on account of revision of pay scales under the Himachal Pradesh Civil Services (Revised Pay) Rules, 2009, to all the regular Government employees consisting of Class-I, II & III categories. This will be over and above the amount of arrears already paid to Class-I & II categories @ 30% and to class-III employees @ 40% of the total accrued amount of arrears. The category of Class-IV employees has been excluded as they have already been paid 100% arrear on account of revision of pay scales.
