Increasing minimum pension under PF pension optees

(a)whether there is any proposal to increase the minimum pension of Provident Fund (PF) pension optees and if so, by what amount;

(b)whether it would be retrospective;

(c)by when the proposal would be implemented; and

(d)the number of subscribers going to be benefited as on date?

ANSWER

MINISTER OF STATE FOR STEEL, MINES, LABOUR & EMPLOYMENT 
(SHRI VISHNU DEO SAI)

(a): Yes, Sir. The minimum pension shall be of Rs. 1000/- per month to member and widow(er) pensioners under Employees’ Pension Scheme, 1995 for the financial year 2014-15.

(b) & (c): The details are being worked out.

(d): The number of persons expected to be benefited under Employees’ Pension Scheme, 95 from this notification is 28 lakh (approximately).

   Kindly refer this office circular No. 478 dated 13.02.2012 under which instructions  regarding re-grouping of certain trades in terms of Para 7.3 of circular No. 430 dated 10.03.2010 has been issued. Some PDAs have expressed doubts regarding revision of service pension on the basis of re-trading of group due to non-indication of trade in PPO.

NPS.1 The CCS(P) Rules are applicable to govt. servants appointed on or before 31.12.2003.Are the employees who joined pensionable establishments of Govt. of India after 31/12/2003 eligible for any benefits under these rules?

   In accordance with DoP&PW O.M. No. 38/41/06-P&PW(A) dated 5.5.2009 such employees who joined after 31/12/2003 and/or their families may be given the benefit of disability pension or family pension provisionally till the finalization of rules under the National Pension System (NPS) on death/injury.

Sub: Revision of 1/3rd commuted pension portion of pension in respect of Government servants who had drawn lump sum payment on absorption in Central Public Sector Undertakings/Central Autonomous Bodies-Implements of Government’s decision on the recommendations of the 6th Central Pay Commission.

   The undersigned is directed to say that orders have been issued vide this Department’s OM of even number dated 11.7.2013 for revision of 1/3rd restored pension of absorbees w.e.f. 1.1.2006 by multiplying pre-revised 1/3rd pension by a factor of 2.26, if it is more beneficial than the revised 1/3rd restored pension as per this Department’s CM. No.4/3812008-P&PW(D) dated 15.92008. These orders have been issued in compliance of the order dated 27.9.2011 of the CAT Hyderabad Bench in CA No.710/2010 read with their order dated 22.4.2013 in C.P. 26/2012.

   Attention is invited to Para 6 of the notification No.CPAO/Tech/CFI/2012 of this office published in the leading newspaper on 21st October 2012 in which banks were instructed to update their master data based on the life certificates submitted by the Pensioners/family pensioners and forward the updated master data through the CPPC to CPAO. The additional information submitted may also be scanned and send through CPPC to CPAO.

Sub:- Revision of 1/3rd commuted portion of pension in respect of Government servants who had drawn lumpsum payment on absorption in Central Public Sector Undertakings/Central Autonomous Bodies - stepping up of notional full pension w.e.f. 24.9.2012.

   Orders for revision of 1/3rd restored pension of absorbees, who had drawn lumpsum payment on absorption, were issued vide this Department O.M. of even number dated 15.9.2008. As per para 2A of the said OM, the full pension of the absorbees was notionally revised w.e.f. 1.1.2006 in accordance with the instructions contained in this Department O.M. No.38/37/08-P&PW(A) dated 1.9.2008. The payment of DR and additional pension to old pensioners is regulated on the basis of the notional full pension.

Sub:- Revision of provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972.

   The undersigned is directed to say that in pursuance of Government’s decision on the recommendations of Sixth Pay Commission, orders for revision of pension of pre-2006 pensioners w.e.f. 1.1.2006 have been issued on 1.9.2008.

   The following categories of pensioners were entitled to provisional pension as in the pre-2006 pay-scale:-

   a) Employees suspended before 2006 and also retired before 1.1.2006

   b) Employees suspended before 2006 but retired after 1.1.2006

   c) Employees who retired before 1.1.2006 and against whom departmental/judicial proceedings were pending at the time of retirement.

Subject: Permanent absorption of Central Government employees and employees of the Union Territories in the autonomous bodies of the Union Territories counting of service for pension.

   The undersigned is directed to refer to the Department of Personnel & AR's (now Department of Pension and Pensioners’ Welfare) O.M. No, 28/10/84-Pension Unit dated 29.8.84 down the provisions for regulating the cases of the Central Government employees going over to a Central autonomous; body or vice-versa for purpose of counting of past service for pension in the new organization, and to say that certain Union Territory Administrations have sought clarification if the autonomous bodies of the UT’s financed wholly or substantially by the UT Administrations can be treated at par with the autonomous bodies of the Central Government for the purpose of implementing the instructions contain in O.M of 29.8.84 referred to above.  In this context it has also been pointed out by the UT Administrations that there are similarities between the administrations of the UTs and the Central Government extending to the terms and conditions of employment of the staff of the UTs, their scales of pay, then governance by the CCS (Pension) Rules, 1972 etc. It has, therefore, been urged that the benefit available to the employees of the Central Government when absorbed in autonomous bodies wholly or substantially financed by the Central Government and vice versa for counting of past service for pension, should also be extended to the employee of the UTs when absorbed in the autonomous bodies wholly or substantially financed by the Govts. Of UTs and vice versa.

Subject:- Revision of Pension of Pre-2006 Pensioners - reg.

   The undersigned is directed to say that in pursuance of Government' s decision on the recommendations of Sixth Central Pay Commission, orders were issued for revision of pension/family pension vide this Department's OM No.38/37/08-P&PW(A) dated 1.9.2008, as amended from time to time.

   2. The pension/family pension of pre-2006 pensioners was stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008 with effect from 24.9.12 vide this Department OM of even number dated 28th January, 2013.

NOTIFICATION
New Delhi, the 21st December, 2012

   G.S.R. 928(E).- In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and, after consultation with the Comptroller and Auditor General of India in relation to conditions of service of persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely:-

   (1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2012.

   (2) Save as otherwise provided, these rules shall come into force on the date of their publication in the Official Gazette.

   2. In the Central Civil Services (Pension) Rules, 1972, (hereinafter referred to as the said rules) in rule 5, in sub-rule (2), the proviso shall be omitted and shall be deemed to have been omitted with effect from the 1st Day of January, 1996.

   3. In the said rules, rule 29 shall be omitted.

   4. In the said rules, for rule 29A the following rule shall be substituted, namely:-

Sub: - Revision of pension of pre-2006 pensioners - reg.

   The undersigned is directed to say that in pursuance of Government's decision on the recommendations of Sixth Central Pay Commission, orders were issued for revision of pension/family pensioners vide this Department's OM No.38/37/08-P&PW(A) dated 1.9.2008, as amended from time to time.

   2. It has been decided that the pension of pre-2006 pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008, as amended from time to time, would be further stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above-referred OM dated 30.8.2008 of Ministry of Finance, Department of Expenditure.

Pension of Defence Personnel

   There has been no undue delay in notifying pension by the Pension Sanctioning Authorities and no abnormal delays have been reported in payment of pension by the Pension Disbursing Agencies i.e. Banks, Treasuries and Defence Pension Disbursing Offices.

   If the payment / pension has not been disbursed by the Bank on receipt of PPO, then as per the guidelines of Reserve Bank of India, interest @2% per month has to be disbursed on the amount due to the pensioners by the paying Bank, wherever delay occurred

Sub:- Eligibility of children from a void or voidable marriage for family pension - clarification regarding.

   The undersigned is directed to refer to this Department's O.M. No.1/16/96-P&PW(E), dated 2.12.1996 whereby it was clarified that Pensionary benefits will be granted to children of a deceased Government servant/pensioner from void or voidable marriages when their turn comes in accordance with Rule 54(8). It is mentioned in Para 4 of the O.M. that "It may be noted that they will have no claim whatsoever to receive family pension as long as the legally wedded wife is the recipient of the same."

Allegation of Non-Payment of Pensionary Benefits to Nk Surender Singh not Correct

   In a press conference today, retired Nk Surender Singh of 2 GRENADIERS and an ex NSG Commando expressed some grievances against the government. These pertained to alleged lack of adequate compensation and financial benefits to those who were killed/injured in the 26/11, Operation Black Tornado in Mumbai. Response with respect to the issues raised is enumerated in succeeding paragraphs.

   In the 26/11 Mumbai operations, one Officer and one Non Commissioned Officer were martyred and 17 Officers and Other Ranks were injured. Both martyrs Major Sandeep Unnikrishnan and Havildar Gajender Singh were awarded the Ashok Chakra (Posthumous). The NOK of Major Unnikrishnan got a financial compensation of approximately Rs.1.3 Crores and a flat. Similarly, the wife of Havildar Gajender Singh received approximately Rs.1.27 Crore, a petrol pump and a flat. His mother too received Rs.15 Lakhs approximately. Both these personnel also received enhanced pension benefits as applicable in the Army.

Rs.2300 crore approved to meet the demands of Ex-servicemen pensioners.

   The Union Cabinet has approved the recommendations of the Committee headed by Cabinet Secretary for benefits to ex-servicemen on four issues.   The financial implications of the improvements made as per the Cabinet decision on the four items are broadly estimated at Rs.2300 crore per annum.  The details are as follows:
 
I.             One Rank One Pension:
 
   On One Rank One Pension, the demand of the Defence Forces and Ex-Servicemen Associations is that uniform pension be paid to the Defence Forces personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension be automatically passed on to the past pensioners.
 
            The difference in the pension of present and past pensioners in the same rank occurs on account of the number of increments earned by the defence personnel in that rank.  There is also a difference between the pension of pre 1.1.06 and post 1.1.06 retirees belonging to a particular rank.  The UPA Government on two previous occasions has taken decisions to narrow the gap between the present and past pensioners, particularly those belonging to the ranks of JCOs and Other Ranks.

Contribution Towards Employee’s Pension Fund.


   An amount of Rs. 14,767.47 crore (as per unaudited Balance Sheet of 2011-12) has been received as contribution in Employees’ Pension Fund for the financial year ending on 31.3.2012.

   An amount of Rs. 1,62,980.04 crore is balance in Employees’ Pension Fund Contribution Account as on 31.3.2012.

   The whole amount of Employees’ Pension Fund stands invested. Rs. 57,087.01 crores is invested in Public Account and balance is invested in securities.

Pension can't be withheld due to pending criminal case: CAT


   Pension and increments of a public servant cannot be withheld only on the basis a pending criminal case against him unless he is convicted, the apex administrative tribunal has held.

   "It is amply clear that only on the basis of the case pending against the applicant (Primary School Head Master Lakhi Ram), pension cannot be withheld under Central Civil Services (CCS Pension) Rules, 1972," a two-member bench of Central Administrative Tribunal headed by Justice Meera Chhibber said.
