   The undersigned is directed to invite attention to this Directorate's OM No.12035/16/2010-Pol.II dated 22.12.2010, 24.8.2011 and 18.11.2011 regarding allotment of quarters through Automated System so as to bring transparency in the allotment of quarters, Recently, while reviewing the position of quarters, it was felt that the names of some non-serious applicants continue in the waiting list on year to year basis Such non-serious applicant neither update their data i.e., upgradation of pay by way of increment etc nor they give option for quarters. The Directorate of Estates finds it difficult to assess the exact requirement of quarters in each type because of such non-Serious applicants.

Education Loans for Engineering Students.

   The India Banks’ Association (IBA) had circulated a Model Educational Loan Scheme for implementation to its member banks with broad operational guidelines. Banks may adopt the scheme with discretion to make changes as deemed fit.

   The scheme is for all Indian Nationals who have secured admission to professional/technical courses in India or abroad through an entrance test/merit based selection process.

   As per the scheme, the assessment of the educational loan is based on the employability and earning potential of the student upon completion of the course.

Written Results of Central Armed Police Forces (Assistant Commandants) Examination 2011.

    On the basis of the results of the written part of the CAPF (ACs) Examination, 2011 held by UPSC on 9th October 2011, the candidates with the under-mentioned Roll Numbers have qualified for Physical Standards Test / Physical Efficiency Tests and Medical Standards Tests.  The candidature of all the candidates whose Roll Numbers are shown in the list is Provisional, subject to their being found eligible in all respects.  The candidates will be required to produce the original certificates in support of their claims pertaining to age, educational qualifications, community etc. at the time of the Personality Test.  They are, therefore, advised to keep the said prescribed certificates ready.

Resettlement of Ex-Servicemen.

Some allegations regarding running of resettlement schemes for Ex-servicemen by the officials of the Directorate General of Resettlement have been made by some individuals / agencies. The allegations are regarding availing of multiple benefits by some ESM in connivance with the officials of DGR.

These allegations were investigated by an In-house Enquiry Committee which submitted its report. The matter has been handed over to Serious Fraud Investigation Office (SFIO) under the Ministry of Corporate Affairs for a detailed investigation against the officials mentioned in the report of the In-house enquiry committee. However, to ensure more transparency in the functioning of the DGR`s organization, necessary instructions have been issued.

New Health Insurance Scheme for Government Employees under Consideration.


   There is a proposal for introduction of a health insurance scheme for the central government employees and pensioners on pan-India basis, with special focus on pensioners living in non-CGHS areas. The proposal is to make this scheme voluntary cum contributory for serving employees & pensioners.  However, it is proposed to be made compulsory for the new entrants in Government service.
 
    The salient features of the proposed Health Insurance Scheme are as under;
 
·                     Optional for serving Central Government employees and pensioners including future pensioners,
·                     Compulsory for new recruits,
·                     Covers all the members of family as per CGHS norms,
·                     Sum insured – Rs. 5 lakh per year on a family floater basis,
·                     Corporate buffer of Rs 25 Crore to take care of cases exceeding Rs. 5 lakh,
·                     All pre existing diseases covered from the day one,
·                     Pre and post hospitalisation benefits available,
·                     Domiciliary Hospitalisation benefit,
·                     Maternity benefit upto two living children,
·                     OPD not covered however OPD consultations will be free,
·                     Payment of FMA for meeting OPD needs,
·                     Cashless treatment facility,
·                     Govt. to subsidise significantly the payment of premium,
·                     Employees / pensioners to contribute 20 to 30 percent of the premium,
·                     Identification of beneficiaries through a Smart Card.

New Pension Schemes

   The Government has implemented the New Pension System (NPS) for Government employees who join Central Government (except armed forces) on or after 1st January, 2004.

   The NPS and the old defined benefit (DB) pension system are two different pension systems. Therefore, there can not be any comparison between the two in so far as the benefits to employees are concerned. The Pension benefits under the DB system are defined, however, under NPS the amount of pension would depend on the investment returns, the accumulation upto the age of retirement and level of annuitisation and type of annuity chosen.

   Some representations of Employees’ Associations have been received by the Government. The major reasons for its opposition by the Employees’ Associations are minimum pension, safety and returns on investment. Many measures have been taken to protect the interests of the NPS subscribers, like prescribing a flexible investment pattern, establishing a regulator in the form of the Interim Pension Fund Regulatory and Development Authority and creating the modern institutional architecture of NPS, which is low cost.

Non-Implementation of Equal Wages for Equal Work


   Government has enacted Equal Remuneration Act, 1976 which provides for payment of equal remuneration to men and women workers for the same work or work of similar nature without any discrimination. The Occupational Labour Surveys conducted by Labour Bureau have revealed that none of the establishments surveyed violated the provisions of Equal Remuneration Act, 1976. The difference in the earning of male and female workers at the industry and occupational level is mainly due to seniority/length of service, difference in output etc. The difference in wages and earning at Stratum/All India level is due to inter-unit/inter-State difference in wage rates/earnings of men and women workers. Under the provisions of the Minimum Wages Act, 1948 both the Central and State Governments are the appropriate Governments to fix and revise the minimum wages in the scheduled employments under their respective jurisdictions. There is no concept of National average wage under the provisions of Minimum Wages Act, 1948.

   However, there is a concept of National Floor Level Minimum Wage (NFLMW) which was mooted on the basis of the recommendations of the National Commission on Rural Labour (NCRL) in 1991. The NFLMW has no statutory backing, the State Governments are persuaded to fix minimum wages such that in none of the scheduled employments, the minimum wage is less than the NFLMW. The NFLMW was fixed at Rs. 100 per day which was in effect from 1.11.2009 and has been raised to Rs. 115 per day with effect from 1.04.2011. However, as per survey conducted by National Sample Survey Organisation (NSSO) in 66th round during 2009-10 on average wage/salary earning per day per person for casual labour in public works other than MGNREG Public works is Rs. 93.11 for rural areas, for Casual Labour in MGNREG public works in rural sector it is Rs. 89.03 and for casual labour in other type of works it is Rs. 93.06 for rural and Rs. 121.83 for urban areas.

The examination dossiers of aforesaid 353 (General -174, SC-62, ST-7, OBC-110 ) candidates have been received in this Department for appointment to the Stenographer Grade ‘D’ of CSSS for the Select List Year-2011. Accordingly, they are nominated to the different Cadre Units of CSSS as listed in the Annexure to this O.M. in the order of their merit for appointment as Steno Grade ‘D’ of CSSS.

This Department is now in the process of bringing out pending Select Lists, Pending issue of Select Lists, the vacancies in the grade of US are being filled up on ad-hoc basis. A large number of vacancies in the grade of US will arise shortly in view of promotions to the grade of Deputy Secretary. It has now been decided to promote eligible Section Officers to the Under Secretary grade on ad hoc basis in the CSS for a period of one year. Sub: Recruitment against Physically Handicapped Quota- launch of Special Recruitment Drive - regarding.

   Attention is invited to Board’s letters No.E(NG)II/2009/RC-2/5 List dated 27.8.09 and No. E(NG)II/2009/RC-2/7 dated 28.8.09 regarding filling up of vacancies in various categories against the Physically Handicapped Quota. Pursuant to Hon’ble High Court Delhi’s judgement in the Public Interest Litigation filed by All India Confederation of the Blind in WP (C) No.23132/2005, the matter has been deliberated by Board. Accordingly it has been decided to implement the Hon’ble Court’s orders directing Railways to complete recruitment of physically handicapped persons in all categories of Group ‘C’ and erstwhile Group ‘D’ in six months time.

Maternity Benefit Act, 1961

   Review and amendments of various labour laws is an ongoing process. The Maternity Benefit Act, 1961 was amended in 2008 by which for section 8, the following section was substituted:


   “8(1) Every woman entitled to maternity benefit under this Act shall also be entitled to receive from her employer a medical bonus of one thousand rupees, if no pre-natal confinement and post-natal care is provided for by the employer free of charge.

   (2) The Central Government may before every three years by notification in the Official Gazette increase the amount of medical bonus subject to the maximum of twenty thousand rupees”.

Policy of reservation to Persons with Disabilities

Frequently Asked Questions (FAOs) on the policy of reservation to Persons with Disabilities
   Ans :Reservation to Persons with Disabilities is provided in line with the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, in posts and services under the Government of India.
   Three percent of the vacancies in case of direct recruitment to Group A,B,C and D posts shall be reserved for persons with disabilities of which one per cent each shall be reserved for persons suffering from (i) blindness or low vision (ii) hearing impairment and (iii) locomotor disability or cerebral palsy in the posts identified for each disability;
   Three per cent of vacancies in case of promotion to Group D and Group C posts in which the element of direct recruitment, if any, does not exceed 75% shall be reserved for persons with disabilities of which one per cent each shall be reserved for persons suffering from (i) blindness or low vision (ii) hearing impairment and (iii) locomotor disability of cerebral palsy in the posts identified for each disability.
