Subject:- Rate of Dearness Allowance applicable w.e.f. 01.07.2018 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission

The undersigned is directed to refer to this Department’s C.M. of even No. dated 28th March, 2018 revising the rate of Dearness Allowance w.e.f. 01.01.2018 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission.


2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 142% to 148% w.e.f. 01.07.2018.

3. The provisions contained in paras 3, 4 and 5 of this Ministry’s 0.M.No.1(3)/2008- E.II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

The undersigned is directed to refer to this Department’s O.M. of even No. dated 26th September, 2017 regarding revision of the rate of Dearness Allowance w.e.f 1.7.2017 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission.

2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 139% to 142% w.e.f. 1.1.2018.

Anomalies in implementation of 6th CPC
A National Anomaly Committee, comprising 8 members from the Official-Side and 12 members from the Staff-Side was set up to settle the anomalies arising out of the implementation of the recommendations of the 6th Central Pay Commission.

There were five (5) meetings of the National Anomaly Committee where 55 anomalies were settled out of total 59 anomalies which were raised. The remaining 4 anomalies are pending finalisation.

A National Anomaly Committee comprising 9 members from the Official-Side and 13 members from the Staff-Side has been constituted to discuss the anomalies arising out of the implementation of the recommendations of the 7th Central Pay Commission. An agenda consisting of 18 items has been received from the Staff-Side for discussion which is under examination for convening the first meeting of the Committee.

This was stated by the Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to question in the Rajya Sabha today.

"Presently, we consider the interim report as essential due to the important reasons given below:

 1. The 50% DA merger that was allowed in the 5th Pay Commission is not made available now for Central Government employees

 2. Also the inflation rate in the 6th Pay Commission is very high.”

The terms and references of the 7th Central Pay Commission was approved by the cabinet on 28.02.2014. In the terms and references document, in paragraph (h), it has been said that if needed an interim report can be recommended.

Subject: Recommendations of 6th CPC in Para 6.1.13 regarding lateral entry against identified SAG/HAG posts requiring technical/ specialized knowledge.

The Sixth Central Pay Commission (6th CPC) have inter alia recommended in para 6.1.13 of its Report that some of the SAG and HAG posts in Government requiring technical or specialized knowledge and which are not encadred in any of the Service be identified and filled by suitable officers within the Government as well as by the outsiders.

2. This Department has circulated vide OM of even No. dated 17.06.2013 (copy enclosed). A concept note on the above recommendations to various Ministries/Departments to carry out an exercise in this regard for identifying posts requiring technical/specialized knowledge and to examine the need for such contract appointment in the Ministries/Departments

3. This Department has not received any comments from the Ministries/Departments. It is, therefore, again requested to send your comments on Para-2 above.

4. This issues with the approval of Secretary (P).

Sub: Correlation of the hourly rate of the Industrial Employees deployed on Piecework System in Ordnance Factories in 6th CPC Pay scale w.e.f 01/01/2006

Ref: MoD Letter No. 46(2)/2013-d(Estts/NG). dated 04/03/2014.

Sir,

Kindly refer to the minutes of the meeting held on 06/02/2014 under the Chairmanship of AS (A) with the representatives of the 3 federations i.e. AIDEF, INDWF & BPMS in connection with the notice of “Indefinite Strike”’ from 17/02/2014. With regard to the above demand the following decision was taken:

“Demand was agreed to, However the issue of giving retrospective effect to the same will be examined separately”.

As agreed by MoD. the govt. Orders for correlation of hourly rate in 6″‘ CPC pay scales was issued on 04/03/2014 giving effect from the date of issue of govt. Letter i.e. 04/03/2014. As decided in the meeting held on 06/02/2014, OFB is required to forward a proposal to MOD in this regard for extending the benefit w.e.f. 01-01-2006. It is Pertinent to mention here that OFB has already made a recommendation to MOD for correlation of the hourly rate in 6″‘ CPC Pay scale w.ef 01/01/2006. Since a need is being felt to further elaborate the matter and justify the demand appropriately in proper context, the federations have further deliberated the matter in detail and find it pertinent to bring the following facts which put the things in perspective and justify the demand for correlation of hourly rates w.ef. 01-01-2006.

1) In the past. right from 3rd CPC onwards, and during the entire duration of 4th CPC, the federations were representing for removing the anomalies in the then existing Piece-Work System in which the higher grade employees were given the hourly rate of lower grade and there was no protection for their annual increment and promotional benefits etc. Since the Govt. did not concede the demand of the Federations to remove the anomalies in the then existing Piece work system, the matter went upto the Supreme Court and by the time the Supreme Court was considering the matter, ‘the 5th CPC pay scales were implemented w.e.f. 01-01-1996. The Supreme Court directed to set up a committee to address all those anomalies pointed out by the affected unions.

2) Accordingly the piecework correlation was implemented as per 5″‘ CPC pay scales, which was based on the direction of the Hon’ble Supreme Court. The scheme was implemented w.e.f. 01-03-2000 provisionally for a period of 2 years, and thereafter MoD vide letter dated 18th August 2005 conveyed the sanction of the President for continuation of the Piece Work System in Ordnance Factories on a regular basis w.e.f. 01-04-2002 as contained in the MoD Letter dated 01-03-2000.

3) As elucidated above, the entire scheme, and the methodology therein was under adjudication. As a result of the Supreme Court judgement, a new scheme of correlation of hourly rate which was based on an agreement between the Federations and OFB, came into effect from 01-03-2000. Since the scheme itself was new, which was totally different from the previous scheme, the question of retrospective effect was neither felt nor demanded by the federations, as the same was not possible.

4) The Basic Pay/Time wages of the Industrial employees deployed in Piece-work system in the Ordnance Factories are regulated on the basis of their output/Piecework earnings. For this purpose the hourly rates are correlated in their Pay scales. Since the revised Pay scales based on 6″‘ CPC recommendations was given effect from 01-01-2006, as a natural corollary, the hourly rate correlated in the 6″’ CPC Pay scale should also be effective from the same date i,e. 01-01-2006 and not from a prospective date as has been implemented as an interim measure as per decision taken in the meeting held with the Federations in MoD on 06-02-2014.

5) The principle that the hourly rate of the pieceworkers should be correlated from the date of revision of the pay scales of the workers has already been established by the Court of law and Govt have issued orders accepting the court verdict in the past. Based on the recommendations of the 3rd CPC Govt appointed an Expert Classification Committee(ECC) to revise the pay scales of various trades based on job classification etc. Accordingly the recommendation of the ECC to revise the payscale from Rs.210-290 to Rs. 260-400 w.e.f. 16/10/1981 ,However Govt issued orders on correlation of Piece work rates in the upgraded pay-scale of Rs.260-400 w.e.f. 19/07/1983, i.e.from the date of issue of the Govt Order. However the matter was adjudicated and the court directed Govt to revise the hourly rate of the pieceworkers w.e.f.16/10/1981 i.e. from the date of revision of the pay scale and not from a prospective date. Govt. subsequently issued orders on 16th October 1995 to correlate the hourly rate in the upgraded pay-scale of Rs.260-400 w.e.f. 16/10/1981.

In the view of the above justification it is requested that OFB may kindly forward the proposal to MoD with favourable recommendations for extending the benefit of correlation of hourly rates in 6th CPC pay-scales w.e.f. 01~01-2006.

Benefits of Sixth Pay Commission to retirees

A question has been raised in the Parliament regarding the benefits of 6th CPC to the employees who retired before 1.1.2006, the Dopt Minister Shri V.Narayanasamy replied that the orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

13th STEERING COMMITTEE (11TH TERM) MEETING OF JCM IIILEVEL COUNCIL OF OFB HELD ON 27.02.2013 AT OFB HQRS, KOLKATTA UNDER THE CHAIRMANSHIP OF DDG/IR. MEMBER/PERS ALSO PARTICIPATED FOR SOME TIME TO HEAR THE VIEWS OF THE STAFF SIDE MMEMBERS.

   Prior to this meeting, Member/Pers, OFB convened a meeting to discuss the co-relation piece work on revised pay of 6th CPC in continuation of the earlier meeting held on 12.12.12. In the last meeting three Federations have strongly objected to any reduction in the job rate/Estimates on account of Co-relation in every pay commission.

   No conclusion could be arrived taking our views Member/Pers discussed with DGOF & Chairman and then convened this meeting with Federation leaders.

VII CPC : Short Description about Sixth Pay Commission.

Before discuss about the VII pay commission let us see about sixth pay commission…

SIXTH PAY COMMISSION

   Initially the then government refused to set up sixth pay commission to review the pay and allowances of central government employees. The then finance minister told that there was no need to constitute next pay commission since 50 % dearness allowance was already merged with the basic pay. The employees had threatened to go on a nationwide strike if the government failed to set up 6th pay commission. In July 2006, the Cabinet approved setting up of the sixth pay commission. This commission has been set up under the Chairmanship of Justice B.N.Srikrishna with a timeframe of 18 months to submit the report. The cost of hikes in salaries is anticipated to be about Rs. 20,000 crore for a total of 3.5 million government employees. The commission submitted the Report to the Government on March, 24, 2008.

   The Sixth Pay Commission mainly focused on removing ambiguity in respect of various pay scales and mainly focused on reducing number of pay scales .It recommended for removal of Group-D cadre.

   The Fifth CPC had compressed many scales. The number of pay scales was reduced from 51 pay scales as on 31.12.1995 to 34 pay scales by the Fifth CPC. In many cases, this led to the promotion and feeder cadres being placed in an identical pay scale. Although Department of Expenditure issued orders that existence of the feeder and promotion posts in the same pay scale will not constitute an anomaly, however, these orders have consistently been rejected by the various courts of this country. The sixth pay Commission, therefore, decided to evolve a new system of pay scales that would effectively address most of the existing anomalies.

Pre 2006 Pensioners : Benefits of 6th CPC to Pre 2006 Pensioners - reg.

   Whether the Central Government employees, who retired before 2006 have been deprived off the benefits of Sixth Pay Commission as recommended by the Central Pay Commission..?

   The Minister of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy answered in the Parliament to the question above quoted on 19th December 2012 as follows...

   The orders for implementation of the recommendations of VIth Central Pay Commission for revision of pension of pre-2006 retirees were issued vide Department of Pension & Pensioners’ Welfare OM No.38/37/08-P&PW(A) dated 1.9.2008. As per para 4.1 of this OM, the pension/family pension of existing pre-2006 pensioners/family pensioners will be consolidated w.e.f. 1.1.2006 by adding together.

   The undersigned is directed to invite reference to para 2 (i) of this Department’s O.M. No. AB—14017/66/2008-Estt. (RR) dated 9th March, 2009, which provides that where all the posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay/pay scale, the suitability of the incumbents need not be assessed for granting them the higher replacement scale/grade pay/pay scale, there is also no need for the incumbents to complete any minimum eligibility service in the earlier scale of pay. There will be no change in the inter seniority of the incumbents in the merged scale which shall be decided based on the general instructions on the subject.

ANOMALIES IN PAY SCALE OF TEACHERS.

   The below information stated by the Minister of State in the Ministry of Human Resource Development Shri.DR.D.Purandeswari in response to a written question in Lok Sabha.

   Majority of School Teachers in the country, are under the administrative control of State/UT governments who prescribe their salary and allowances as well as the terms and conditions of service.

   For schools under the administrative control of the Central Government, revised pay scales based on the recommendations of the Sixth Central Pay Commission for teaching staff have been adopted and no anomalies are reported.

How to calculate the annual increment for Central Government employees as per 6th CPC..?

   The logic is very simple, but everyone should know about the procedure of calculation.

We explain with some illustrations…..

   The increment is an increase in pay for each year in a particular date. As per 6th CPC the annual increment has been granted on 1st July of every year and the qualifying period for earning an increment is six months on 1st July. One increment is equal to 3% (three per cent)  of the sum of the pay in the pay band and the grade pay will be computed and rounded off to the next multiple of ten.

   As per the Rule No.13 of CCS(Revised Pay) Rules 2008, “In the case of calculation of increments under the revised pay structure, paise should be ignored, but any amount of a rupee or more should be rounded off to next multiple of 10. To illustrate, if the amount of increment comes to Rs.1900.70 paise, then the amount will be rounded off to Rs.1900; if the amount of increment works out to be Rs.1901, then it will be rounded off to Rs.1910.”

   In pursuance of the 6th Central Pay Commission recommendation to formulate separate rules to regulate service conditions of General Reserve Engineer Force (GREF) personnel, Border Roads Development Board (BRDB) had suggested Directorate General Border Roads on 12th August, 2009 to constitute a Committee under the Chairmanship of Additional Director General (Border Roads) with members as Deputy Director General (Pers), Deputy Director General (Medical), a Director level officer representing Administrative Cadre and a Director level officer representing Border Roads Engineering Service Cadre. Accordingly, a draft GREF Act has been prepared by the Committee and submitted to BRDB Sectt. However, a decision in the matter can be taken after careful examination of the various connected issues in consultation with various stakeholders.

   This information was given by Defence Minister Shri AK Antony in a written reply to Shri (Capt.) Jai Naraian Prasad Nishad in Lok Sabha today.
