Sir,
Three Recognised Federations in Defence have served Strike notice to go for Strike from 17.02.2014 to the Secretary, Ministry of Defence o settle some of the outstanding and long pending demands of Defence Civilian Employees.

On the basis of the Strike notice, a meeting was convened by ministry of Defence to discuss the demands under the Chairmanship of Addl. Secretary, Ministry of Defence on 06.02.2014. During the discussion some of the issues were agreed and accordingly necessary orders were issued on the settled demands.

In this particular demands i.e. granting of Rs.4600/- Grade Pay w.e.f.01.09.2008 for those Industrial Employees who have completed 30 years of regular and continuous service and got Rs.5000-8000 on or before 31.12.2005 irrespective of their grade on completing 24 years service under ACP Scheme has been agreed to consider.

Accordingly after the meeting M of D,(Civ-I) has issued necessary order vide I.D.No.11(5)/2009-D (Civ-I) Dt 06.02.2015. to grant Rs.4600/- on completion of 30 years of regular service either w.e.f 01.09.2009 or after the date of completion of 30 years through MACP-III. In this letter, M of D mentioned that the benefit of MACP-III will be granted for HS/MCM employees only whereas, there are many number of skilled employees who got Rs. 5000-8000 due to stagnation on or before 31.12.2005 and are also eligible along with HS/MCM employees since they did not get promotions in their hierarchy. This draft and final order is merely an error, that it was not viewed skilled employees are also available in the Directorates due to heavy stagnation and continue to remain in the Skilled grade for 30 years.

This error is purely due to unnoticed and not brought to the knowledge of M o D but this has created a serious anomaly and denied the benefit of granting MACP Rs.4600/- Grade Pay to skilled employees. This M of D letter was issued with the acceptance and approval of Defence Finance authorities.

When the issue was raised by the Staff side several times in the steering committees and in the main meetings of Departmental Council JCM, M of D, necessary action has been initiated by M of D to consider/include skilled category employees who got ACP-2 Rs.5000-8000 on or before 31.12.2005. Unfortunately, it seems Def (FM) refused to consider and also DOP&T has also not agreed.

In this respect, we would like to submit that this issue is very much genuine and the skilled grade employees are also equally eligible for MACP-3 for Rs.4600/- either from 01.09.2009 or on completion of 30 years along with HS/MCM. It is also pertinent to mention that grade is not the criteria for ACP/MACP, only the present Pay/Grade pay and total number of regular and continuous service is the only criteria for granting financial upgradation.

It is therefore, requested the M of D may issue suitable amendment to the M of D letter Dated 06.02.2014 to grant the financial upgradation to skilled employees to avoid an ligation on the subject.

Implementation of financial Upgradation under ACP/MACP in DGOF

Dear Colleagues,

In the recent meeting of the OFB JCM III Level council held on 25th and 26th August, 2014 at OFB HQrs, Kolkatta. During the meeting, the Staff side raised the issue regarding proper implementation of financial upgradation under ACP/MACP. Some Factories implemented properly and some factories denied implementing the same. Accounts authorities also did not agree the proposals of Factories.

In this regard, it was agreed by the official side to convene the Admin/Personnel officers of Ordnance Factories at NADP, Nagpur alongwith Accounts Officials for which the issues of ACP/MACP is required to be forwarded for discussion to Ordnance Factory Board within 10 days.

Therefore all the Unions are requested to submit the details of ACP/MACP issues unsettled immediately with reference to the orders on the subject.

— Upto 31.08.2008 — ACP under Financial upgradations is to be granted on Promotional Hierarchy ignoring the promotion granted prior to 01.01.2006 for the erstwhile Group D employees and Labourer USK to Labourer SK.

— NIEs Group ‘D’ — Labourer SSK — then Tradesman SSK all should be ignored for ACP and their promotion to SK should also be ignored and 1st ACP should be Rs.2400 Grade Pay and 2nd ACP should be Rs.4200/- Grade Pay if they are eligible before 31.08.2008.

— NIEs Group ‘D’ categories like Peon, Duftry, Gestner Operator, Tracer etc., are eligible for promotions as per SRO of NIEs induding Durwans to supervisor and Chargeman. This has not been fully implemented, Whether this has been implemented If not what are the actions from the respective Factories.

— ACP till 31.08.2008 and MACP w.e.f. 01.09.2008 which is promotional hierarchy and Grade Pay hierarchy respectively whether this has been implemented/ Granted to the eligible employees.

In continuation of this Department’s letter of even number dated: 7th July, 2014, on the subject cited above. I am directed to say that the objective of the Assured Career Progression Scheme issued by the State Government is to ensure three financial upgradationsl enhancements to a regular employee in his entire service career. The Finance Departments instructions ibid only supplemented the position already given in Assured Career Progressions instructions dated: 15.12.1998 & 09.08.2012, as far as the three upgradations in the entre service career are concerned.

It is further clarified that Finance Departments instructions dated: 07.07.2014 were made applicable with immediate effect with the objective that all the cases pending on that day or arising after that has to be examined, in the light of instructions ibid.

Sub:- Grant of ACP to Draftsmen.

Dear Sir,

I may draw your kind attention to the following judgments of Tribunal / High Court and the Supreme Court:

1 CAT Bombay Bench order dated 28.2.2005 in O.A. No.124/2004 Shri K.M. Khopkar & others Vs UoI.

2 Bombay High Court order dated 11.12.2006 in writ petition No. 5269/2005 Union of India & others Vs K.M.Khopkar

3 Supreme Court order dated 10.7.2007 in Petition for SLP (C) CC5027/2007 Union of India & others Vs K.M. Khopkar.

The Hon’ble CAT Bombay has ruled that the placement irregular scale on the basis of Ministry of Defence letter dated 15.9. 1995 granted to Draftsmen of other Departments in pursuance of CPWD Arbitration award cannot be treated as regular promotion and ACP benefit rightly granted to the applicants cannot be withdrawn.

The High Court Bombay has upheld the above ruling of the CAT Bombay.

The Supreme Court had dismissed the appeal observing that they do not find any merit to interfere in this case.

2. The question is whether all draftsmen of other departments would be granted the benefit of this judgment. They are similarly placed employees and there are several directions of the apex court that in the case of similarly placed employees, a decision given by Courts should be treated as judgment in rem and Government should extend such benefits to all similarly placed employees so that there is no multiplication of litigation in a matter which has already been adjudicated.

3. I, therefore, request you kindly to consider and extend the benefit of above ruling which has already attained finality to all the draftsmen not only working in Department of Defence Production & Supplies but also in all other Central Government Departments.

4. Action Taken on this matter may kindly advice to us.

Subject:- New Assured Career Progression Scheme on completion of 4, 9 & 14 years of service in a cadre and old (8-16-24-32) Assured Career Progression Scheme for regular government employees.

Sir/Madam,
I am directed to invite a reference to the subject cited above and to state that an Assured Career Progression Scheme was introduced vide FD's instruction No. Fin(PR)B(7)-51/98 dated; 15th December, 1998 w.e.f. 01.01.1996. Subsequently on revision of pay scales w.e.f. 01.01.2006, the operation of this scheme was stopped after 26.08.2009. After that new Assured Career Progression Scheme on completion of 4,9 and 14 years of service in a cadre w.e.f. 27.08.2009 has been introduced vide this Department's letter of even number dated: 9th August, 2012, in respect of State Government employees. This scheme is optional. An existing employee including employee having less than 4 years service has been given the option either to continue in the existing ACP Scheme after a service of 8, 16 24 & 32 years of service or to opt 4,9 & 14 years ACP Scheme.

2. Para 2 (i) (a), Para 2 (vi) & Para 2 (vii) of this Department's letter No. Fin(PR)B(7)-51/98 dated: 15th December, 1998, vide which old ACP Scheme (8-16-24-32) has been introduced, provide as under:-

2. (i)(a) After a service of 8 years in a post or posts in the same "Cadre" (hereinafter referred as-the same post) an employee, who is not promoted to the next higher level on account of non availability of a vacancy at such higher level or non existence of a promotional level in the "Cadre" shall be granted the payscale which is next higher in the hierarchy of pay scales given in Column No.3 of the 'First Schedule' annexed to Rules, 1998. If on 01.01.1996 or the date opted under Rule 6 of Rules, 1998, an employee becomes entitled to a higher pay scale on account of protection under the said rules, he shall be granted such higher pay scale.

2. (vi)  If an employee is promoted to the next higher promotional post in the regular way at any time before one of the benefits under this scheme becomes due, the grant of such benefit shall stand postponed accordingly and shall be granted after completion of service of 8 years in such promotional post. If the promotion of an employee to higher post occurs after having got placement in higher scale or the proficiency step up/steps up under this scheme, the benefit of only one increment instead of two increments normally admissible on promotion shall be given in fixing his pay in the scale of pay of the promotional post.

2. (vii) An employee shall be entitled to a maximum of two placements in higher scale and a maximum of two proficiency steps-up in his entire service career under this scheme.

3. Similarly, Para 3 (a) of this Department's letter No. Fin(PR)B(7)-59/2010 dated: 9th August, 2012, vide which new ACP Scheme has been introduced on optional basis envisage that a government employee after rendering a service of 4, 9 and 14 years in a post or posts without any financial enhancement in the same cadre/post, who is not promoted to a higher level on account of non availability of a vacancy or non existence of a promotional avenue in the cadre, shall be granted the grade pay, which is next higher in the hierarchy of grade pays given in the schedule annexed to Revised Pay Rules, 2009, upto the maximum grade pay of Rs. 8900 and on placement in the next higher grade pay in the hierarchy of grade pays after a service of 4, 9 and 14 years, the pay of an employee shall be fixed at the next higher stage in the pay band. As per Para 4 (a) of this scheme an employee shall be entitled to a maximum of three placements in the next higher grade pays in the hierarchy of grade pays with benefit of one increment each at every placement, under this scheme. Para 4(f) provides that- other existing conditions governing the grant of ACPS shall continue to be applicable

4. From the above it is clear that the benefit under Assured Career Progression Scheme is allowed to those Government servants who have no promotion avenues and remain stagnated on same cadre/post for long time due to non availability of promotional posts. According to Para 2 (vii) of the old Assured Career Progression Scheme and Para 4 (a) of new ACP Scheme, the prescribed placements/ proficiency steps-ups/ progressions are to be given in the entire service career and both these schemes are aimed at to provide financial benefits where no promotional avenues are available to an employee.

5 Moreover, the overriding objective of an assured career progression scheme is to ensure at least three financial up-gradations/enhancements/promotions to a regular employee in his entire service career. Therefore. in partial modification of earlier orders on ACP schemes it is directed that, once an employee has already got three enhancements/financial up-gradations i.e. grant of progression under the new or old ACPS, or promotion or any other financial enhancement except the annual increment or the general pay revision based on the pay commission, in fourteen years or more of his/her entire service thereafter, he will not be entitled for placement in next higher grade pay in the ACPS scheme introduced vide FD’s instructions dated 9th August, 2012. However, it is clarified that after availing three enhancements/up-gradation/promotion, an employee will be eligible to take the benefit of normal promotions available in his service career.

6. It is also clarified that if vacancy in higher/promotional post exists and an employee is eligible for promotion, then the promotion post will be filled prior to the grant of any benefit under the ACP scheme.

7. The instructions given in FD letter dated 9th August 2012 will be subject to the instructions given in this letter, For any further interpretation/ clarification/ modification of the decisions contained in the circular letter, the Finance Department shall be the final authority.

8. These instructions will be applicable with immediate effect and may be brought to the notice of all concerned for strict compliance and these orders are also available on http://himachal.nic.in/finance/PayRevision.html.

MACP-An Unsettled Issue Of Sixth Pay Commission Recommendation.

   MACP is said to be the abbreviation of Modified Assured Career Progression Scheme, but many central government employees feel that it is Meaningless Assured Career Progression Scheme. The main objective of introducing ACP scheme was to grant financial benefits for the govt servants, those who are not getting promotions due to lack of promotional avenues. Before the introduction of ACP scheme in 1999, many central government employees retired from service without getting even single promotion in some departments. The worst part of this story is, apart from not getting promotion, they were not even been granted annual increment for many years until their retirement, as they reached the maximum of their Pay Scale. Working without any promotion and increment until the retirement is pathetic. It was the prevailing situation till the date of introducing ACP scheme.

Financial up gradation under ACP Scheme

   Upon introduction of ACP scheme, central government employees were granted two financial up gradation on the completion of 12 years and 24 years of regular service respectively in the same post. According to the ACP Scheme, the central government employees were to be granted next higher pay scale of their Promotional Hierarchy as financial up gradation under ACP Scheme. So the pay equalant to the promotional post had been ensured under ACP scheme for the government servants after completion of 12 and 24 years of regular service if they were not granted regular promotion. Many central government employees were benefited by this scheme where there were no promotional avenues available for them.

Dear Dr.Sayamal,

   Issue of redressal of anomalous and disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres of CPWD has been taken up with DoPT through several proposals since Me very inception of the scheme but none of the proposals has found favour. This has resulted in great discontent to the Subordinate Engineering cadre of CPWD.

   Above issue was also discussed with you informally on 1.8.2013. It was apprised that individual option to choose either earlier ACPS or MACPS by the employee is the only solution to cater to the concerns of all individuals. A proposal of this Ministry in this regard under consideration in DoPT.

Subject:- Stepping up of pay of PAs of CSSS in case of ACP followed by ad-hoc promotion.

   The undersigned is directed to say that the issue of senior PAs of CSSS who got their ACP followed by ad-hoc promotion prior to 1.1.2006 and are drawing less pay than PAs of CSSS who got their ACP and ad-hoc promotion after 1.1.2006 has been receiving attention. The Note 7 below Rule 7 of CCS (Revised Pay) Rules, 2008 provides that “where in the fixation of pay under sub-rule (1), the pay of Government servant, who, in the existing scale was drawing immediately before the 1st day of January, 2006 more pay than another Government servant junior to him in the same cadre, gets fixed in the revised pay band at a stage lower than that of such junior, his pay shall be stepped upto the same stage in the revised pay band as that of the junior.

Western Railway have also mentioned that the post of Motorman is filled by holding selection from the working Loco Pilots (Passenger & Goods) and only the remaining unfilled posts of Motorman are filled through RRB.

Extension of Modified Assured Career Progression Scheme to the Staff Car Drivers of Central Government

“13. Existing time-bound promotion scheme, including in-situ promotion scheme, Staff’

Car Driver Scheme or any other kind of promotion scheme existing for a particular

category of employees in a Ministry/Department or its offices, may continue to be

operational for the concerned category of employees if it is decided by the concerned

administrative authorities to retain such Schemes, after necessary consultations or they

may switch-over to the MACPS. However, these Schemes shall not run concurrently

with the MACPS.”



The above condition of MACP Scheme accordingly stands modified to this effect, in other words, the Staff Car Driver Scheme and the MACPS shall run concurrently.

The undersigned is directed to refer to this Department’s O.M. No.35034/3/2008-Estt. (D) the 19th May,2009 regarding introduction of Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees and to say that para 13 of Annexure-I of the Scheme provides that Existing time-bound promotion scheme, including in-situ promotion scheme. Staff Car Driver Scheme or any other kind of promotion scheme existing for a particular category of employees in a Ministry/Department or its offices, may continue to be operational for the concerned category of employees if it is decided by the concerned administrative authorities to retain such Scheme, after necessary consultations or they may switch over to the MACPS. However, these Schemes shall not run concurrently with the MACPS.



2. In pursuance of the decision taken in the meeting of the Departmental Council (JCM) of Department of Personnel & Training held on 08.05.2010 in respect Agenda Item No. 57.31, it has been decided in consultation with the Department of Expenditure, the benefits of the MACPS shall also be extended to the regular Staff Car Drivers of the Central Government Ministries/Departments/Offices, as a fall back option, if they are unable to get promotion within the percentage based present system.



3. Para 13 of the Annexure-I of the MACPS accordingly stands modified to this effect. In other words, the Staff Car Driver Scheme and the MACPS shall run concurrently.



4. All Ministries/Departments may give wide circulation to this decision for general guidance and appropriate action in the matter.
