Instructions regarding applying for GPRA under Ladies Pool

Subject:Instructions for applicants applying for General Pool residential accommodation (GPRA) under Lady Officers’ Pool.

As per the provisions of SR 317-B-8 of the Allotment of Government Residences (General Pool in Delhi) Rules, 1963, ‘Lady Officers Pool’ is maintained separately for allotment of GPRA to married lady officers and single lady officers in the ratio of 2:1.`Married lady officer’ means a lady officer whose marriage is subsisting and who is not judicially separated from her husband. All other women employees fall in single lady officer category.

2. But, it has been observed in many cases that at the time of applying in DE-II Form, a single lady officer apply under single lady category but after marriage of her, do not update her status in DE-II Form and gets accommodation in single lady officer category despite being married. This allotment violates the existing provisions of the Allotment of Government Residences (General Pool in Delhi) Rules, 1963.

3. Therefore, it is to inform that the following instructions should be followed strictly by the applicants applying under Lady Officers Pool and also by the Nodal Officer of the office of the applicant:-

a) The personal information furnished in DE-II Form by a woman employee has to be verified by the office of the applicant as to whether the employee is married or single at the time of submission of the Form as well as at the time of acceptance of allotment of  GPRA.

b) A single lady officer should update her records in DE-II Form as soon as she gets married and she will be included in the waiting list of married Lady Officers for the eligible type of accommodation and will get allotment of GPRA from married Lady Officer quota only. In case, a Lady Officer is found to have suppressed information of her marriage and gets an allotment of GPRA from single Lady Officer quota, the allotment shall be cancelled and appropriate action shall be taken as per rules.

Action against subletting of Residential Accommodation and misuse of Garage by the Allottees – Directorate of Estates Orders

Subject:- Action against subletting of General Pool Residential Accommodation & Garage and misuse of Garage by the allottees.

It is to inform that substantially large number of cases of subletting of General Pool Residential Accommodation (GPRA) & Garages and misuse of Garages by the allottees have been found in Central Government Residential colonies in Delhi and other places in the country. The Directorate of Estates has been inspecting Government colonies and recommending all administrative authorities/offices to take disciplinary action against the allottees, who are found to be subletting residential accommodation and garages.

2. It is also found that some of the allottees of general pool residential accommodation misuse the allotted garage, for purposes other than the purpose for which the garage has been provided to them. This also gives rise to unhygienic atmosphere and may involve antisocial elements in the Government colonies and thus, pose security threats.

3. In order to curb the menace of subletting of general pool residential accommodation & Garage, the SR 317-B-20 and SR 317-B-21 of the Allotment of Government Residences(General Pool in Delhi) Rules, 1963 were amended recently. As per these amendments, no officer shall share the residence allotted to him or any of the out-houses, garages and stables appurtenant thereto except with his family and immediate relations. Such out-houses, garages, stables and servant quarters shall be used only for bonafide purposes. If an officer sublets a residence allotted to him or any portion thereof or any of the out-houses, garages or stable appurtenant thereto, he/she may without prejudice to any other action that may be taken against him/her, be charged such damages from the date of inspection by the Directorate of Estates, as may be determined by the Central Government from time to time.

4. By these amendments, the provision of sharing of accommodation has been totally withdrawn and the allottee shall reside with his family and immediate relations only. In case, subletting is proved against an allottee, double the rate of damages are to be imposed from the date of inspection apart from major penalty proceedings under CCS(CCA) Rules 1965 for violation of CCS(Conduct) Rules, 1964 and breach of rules and conditions of the Allotment of Government Residences(General Pool in Delhi) Rules, 1963, which could lead to dismissal from service.

5. Therefore, it is felt that there is a need to bring awareness on ill effects of subletting of GPRA & Garages among the existing allottees of GPRA as well as among prospective allottees of GPRA. The Ministries and Departments of Government of India are requested to make wide circulation of this Circular among their employees and the employees of their Attached and Subordinate offices on the repercussion of subletting of GPRA & Garages and misuse of Garages, so that no allottee of GPRA shall indulge in such illegal activities.

6. CPWD is also requested to give wide publicity of this circular among the allottees in Government colonies in all places through their respective Service Centres.

The Lower Divisional Clerks (LDCs) in these regional offices are recruited through the Staff Selection Commission (SSC) and on posting in the regions their service are governed by the Directorate of Estates.

Guidelines for allotment of alternate general pool residential accommodation in the Automated System

Sub: Guidelines for allotment of alternate general pool residential accommodation in the Automated System of Allotment on declaration of a house unsafe/dangerous or re-development of government colonies or GPRA required for any other public purpose.

 The undersigned is directed to refer the subject mentioned above and to say that henceforth allotments of alternate general pool residential accommodation to allottees on declaration of a house unsafe/dangerous or re-development of government colonies or GPRA required for any other public purpose shall be done through Automated System of Allotment [ASA] with effect from 16.9.2014.

2. It has been decided with the approval of the competent authority that in case of complete government colonies declared unsafe/dangerous, the allottees of such colonies shall be placed enbloc over the unified (change/initial) waiting list for same type of accommodation and the allottees may make preferences of houses in the ASA for allotment.

3. In cases where individual houses in Government colony are declared as unsafe/dangerous the alternate allotment of accommodation to be made on priority on the following basis:

a) Vacancies in the same locality or nearby locality to be identified for priority allotment where such occupants would be given priority in the same type of accommodation over unified (change/initial) waiting list.

b) The allottee of ground floor accommodation may apply for ground floor and above and the allottee of first floor above may apply for fist floor and above and allotment will be made accordingly.

c) Equal number of identified vacancies will be placed for allotment in ASA in relation to number of such unsafe/dangerous houses.

4. The request of allottee, whose residential accommodation declared as unsafe/dangerous by the concerned maintenance agency shall be entered into ‘Unsafe Accommodation Register’ of ASA by the concerned Allotment Section.

5. It has been further decided that where a house declared as unsafe/dangerous for living, the declaration will be by an officer not below the rank of an Executive Engineer, CPWD and he should satisfy himself before issue of certificate of declaration. The unsafe/dangerous house(s) may be reported to NIC, Directorate of Estates online by CPWD on such declaration.

6. It has also been decided that where an entire government residential colony is declared unsafe/dangerous for living by CPWD or required to be vacated for re-development, a certificate of declaration from DG, CPWD will only be accepted along with the work plan to make the colony habitable within a period of 3 years in consultation with Works Division of Ministry of Urban Development.

7. This OM supersedes the instructions of the Directorate of Estates O.M.No.12035(1)/91-Pol.II dated 21.2.1991 and O.M.No.12035/16/2005-Pol.IIdated 5.9.2005.

Directorate of Estates - Introduction of Automated System of Allotment through eAwas

OFFICE MEMORANDUM

Sub: Introduction of Automated System of Allotment through eAwas in respect of 40 Type VII houses of Secretaries Pool [SG] in New Moti Bagh, New Delhi with effect from 1st September, 2014.

The undersigned is directed to invited attention to this Directorate OMs of even number dated 8.4.2010 and 24.8.2011 vide which Automated System of Allotment [ASA] was introduced in respect of higher types of accommodation i.e. Type IV(Special) to Type VI B [C-1]. It has now been decided to introduce the Automated System of Allotment in respect of 40 Type VII houses of Secretaries Pool in New Moti Bagh, New Delhi with effect from 1st September, 2014 as per the following norms:

i) With effect from 1st September, 2014 onwards only online applications will be accepted through e-Awas in respect of 40 Type VII houses of Secretaries Pool (SG) in New Moti Bagh, New Delhi [www. estates. nic. in]

ii) Every applicant will have to create an account in e-Awas and fill up the required application form by following the instructions on the screen. After completing the process online, the officers shall take out a print¬out of the application and get the same duly forwarded to the Directorate of Estates through their office. On receipt of hard copy of application duly forwarded by their office, the account of the Officer shall be activated by sending him/her a Registration Number (which will work as his/her ID) and a Password through SMS and/or email.

iii) Once the applicant has received his/her registration number and log-in password through SMS and/or email, then he/she will be able to operate his/her account and make required changes in his/her preferences/choices etc. as and when required online.

iv) Officers in the waiting list will have to indicate their option against specific houses online between 1st to 9th of every month and who do not exercise any option till 5.00 P.M. of the 9th day of the month will not be allotted any house.

v) Applicants may be able to revise/modify their choices/preferences for the houses any time between 1st day of a month to 9th day of a month upto 5.00 p.m.

vi) A separate waiting list will be prepared as per explanation to SR 317-B-5(f). The vacant houses available for allotment as on the last date of the month will be frozen and used for allotment through automated system of allotment.

vii) Automated allotments through Automated System of Allotment will be made on 10th day of every month. To begin with, the first allotment will be made on 10th September, 2014.

viii) Allotment of houses as per choices/preferences of applicant will be considered on 10th of each month only for those applicants whose accounts have been in activation in the preceding months.

ix) If an officer refuses to accept a house allotted to him/her in accordance with his/her choice, then he/she will be debarred for allotment for next three months.

Consolidated Instructions for allotment of government accommodation from General Pool to National and State level Political Parties.

Sub: Consolidated Instructions for allotment of government accommodation from General Pool to National and State level Political Parties.

The undersigned is directed to Invite attention to the Directorate of Estates, Ministry of Urban Development the revised guidelines for allotment of government accommodation from general pool to Political parties issued vide O.M.No.12014/2/96-Pol.ll dated 20.7.2000 and O.M.No.12014/2/96-Pol.II(Vol.ll) 29.8.2013 and the guidelines for allotment of government accommodation from general pool to State level Political Parties issued vide O.M.No.12/11/2000-CDN-l/Pol.ll dated 4.5.2001 and O.M.No.12014/1/2010-Pol.ll dated 15.3.2010. The content of these instructions on the subject mentioned above have been consolidated for the facility of reference and necessary action. The revised instructions shall be as under:

(i) The National Political Parties, which have been recognised as such by the Election Commission of India, shall be allowed to retain/secure allotment of one housing unit from General Pool in Delhi for their office use on payment of licence fee under FR 45A i.e. the normal licence fee.

(ii) The said accommodation will be provided for a period three years during which the party would acquire a plot of land in an institutional area and will construct its own accommodation for party office.

(iii) One residential accommodation would be allotted / allowed to be retained by the Party President of a recognized National Party provided that no other accommodation has been allotted to him/ her in any other capacity.

(iv) The other buildings allotted or in occupation of any political party stand cancelled. However, a period of six months or upto the time the allotment has been made, whichever is earlier would be given to the party to make alternate arrangement and vacate the Government accommodation.

(v) Only those recognized State level Political parties that have a minimum strength of four Members In both Houses of the Parliament could be considered for allotment of officer-residence in Vitthalbhai Patel House.

(vi) Such accommodation may be provided in V.P. House only.

(vii) One double suite accommodation in V.P. House may be allotted to the recognized State level party.

(viii) The said accommodation will be provided to the State level party as long as it is recognized by the Election Commission of India and has adequate representation in the Parliament as decided by the CCA.

2. This O.M. supersedes the Directorate of Estates O.M.No.12014/2/96-PoI.ll dated 20.7.2000, O.M.No.12/11/2000-CDN-I/poI.II dated 4.5.2001 and O.M.No.12014/1/2O10-poI.II dated 15.3.2010 and O.M.No.12014/2/96- Pol.II(Vol.II) 29.8.2013.

   In terms of SR-324(4), the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries & Departments of the Government of India throughout the country (except in respect of substandard/unclassified accommodation of Ministry of Defence, accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.

The Allotment of Garages (General Pool In Delhi Rules. 1964
(as amended upto September, 2013)

   1) The rules in this Division may be called the Allotment of Garages (General Pool in Delhi) Rules, 1964.

   2) These rules shall apply to the allotment of garages to allottees of such residences of Type-V(A) and Type-V(B) to which garages are not attached.

   3) They shall come into force on the 1st day of March, 1964.

SR-317-M-2:- In these rules unless the context otherwise requires:-

   (a) “Allotment” means the grant of a licence to occupy a garage in accordance with the provisions of these rules.

   (b) “Director of Estates” means the Director of Estates to the Government of India and includes an Additional, Deputy and Assistant Director of Estates.

   SR-317-M-3:- An officer who has been allotted a Type-V(A) or Type-V(B) residence to which a garage is not attached and owing a motor car shall be eligible for allotment of a garage in the locality in which his residence is situated.

Subject: Period of retention of General Pool accommodation on retirement of allottees - Regarding

   Consequent upon amendments in Supplementary Rules 317-B-11 and 317-B-22 of Allotment of Government Residences (General Pool in Delhi) Rules, 1963 vide Notification of even number dated 19.6.2013, the permissible period of retention of General Pool accommodation to the allottees who retire on or after 23.4.2013, is as under:-

   (a) In cases of accommodation allotted prior to 01.07.2013: 2 months on normal licence fee, another 2 months on double of the normal licence fee, further 2 months on four times of the normal licence fee and subsequent 2 months on six times of the normal licence fee.

Sub:- Furnishing of information regarding transfer, retirement, voluntary retirement, resignation, missing, long leave (with medical certificate and without medical certificate) and death of Government officials, who have been allottees of General Pool Residential Accommodation (GPRA) and disciplinary action taken against the delinquent allottees of GPRA to the Directorate of Estates.

   I am directed to refer to this Directorate O.M. of even number dated 25.1.2002 on the subject mentioned above requesting all Ministries/Departments of the Government of India to furnish a monthly information in respect of transfer of allottees of General Pool Residential Accommodation to ineligible office/outstation posting/voluntary retirement / resignation / death to this Directorate immediately on occurrence of such events along with details of general pool residential accommodation occupied by such allottees in order to take timely follow up action. In the said OM it was also requested that a copy of orders of transfer, voluntary retirement and resignation may be endorsed to this Directorate as this would not only avoid unauthorized occupation of government accommodation but it would improve availability of government accommodation for allotment to other government servants who are in the waiting list.

Subject:- Revision of rates of damages for unauthorised occupation of General Pool Residential Accommodation in metropolitan cities of India.

   The undersigned is directed to refer to this Directorate’ O.M of even number dated 6th December 2012 notifying the revised rates of damages to be chargeable from unauthorized occupants of General Pool Residential Accommodation (GPRA) from 1st January 2013. The revised rates were different for Central and Non-Central localities as well as for higher and lower types at the same station. It was also noticed that for some categories, the revised rates were very high, in some cases, even more than the basic pay of the eligible officers. The rates revised vide above- said OM have been reviewed on receipt of feed-back from the allottees and it is felt that the concept of Central/Non-Central area at the same station is discriminatory and should be done away with.

Sub: Allotment of General Pool Residential Accommodation to the employees of State/Union Territories Governments posted in Delhi.

   The allotments of residential accommodation to the employees of State/Union Territories Governments working in Delhi are governed as per guidelines issued vide O.M.No. 12016/2/80.Pol.II(Pt.III) dated 19.9.1997 and letters of even number dated 24.9.2004 and dated 3.8.2009.

   2. The matter has been re-examined. In order to streamline the earlier instructions and in supersession of the OM and letters as referred above, it has now been decided to make allotments to the employees of State and Union Territories Governments posted in Delhi on the following basis:

   1. The State/Union Territories Government employees will be allotted accommodation only by Directorate of Estates, on the recommendation of the concerned Resident Commissioner against the prescribed quota. The State/Union Territories Governments will not make any allotment on their own.

Subject: - Allotment of General Pool residential accommodation (C-I houses to Secretary/Secretary equivalent officers and Chairpersons / Members of Commissions / Tribunals etc.

   Attention is invited to this Directorate’s O.M. of even number dated 11.09.2007 modified vide OM dated 08.10.2010 and 29.12.2011 wherein decision to allot C-I houses among Secretaries, Secretary equivalent officers and Chairpersons/Members of Commissions/Tribunals in the ratio of 2:1:1 and to prepare three waiting Lists i.e. List-A, List-B and List-C was communicated. Further it was also decided vide OM dated 11.05.2011 that no HAG officer waiting in list A or list B will be allotted C-I house if an Apex Grade officer is waiting in the other list. Thus, HAG officers will be allotted C.I houses only after meeting the claim of the Secretary/Secretary equivalent officers irrespective of availability of units as per the above ratio.

   The undersigned is directed to refer this Directorate’s OM of even number dated 19.11.2001 vide which revised guidelines for allotment of Government accommodation to the Journalists and Press Cameramen were circulated. The matter has been further considered by the Government and it has been decided to revise limit of emoluments for Journalists/Press-cameramen Category- I and category- II. Accordingly para 1(b) (i) to (iii) of this office OM of even number dated 19.11.2001 has been substituted as under: -
