Sub: Grant of Dearness Allowance to the Teaching and Non—teaching employees of Non-Government Aided/Sponsored Education Institutions who are in the pre-revised scale of pay/Employees of Statutory Bodies/Govt. Undertakings/ Local Bodies etc. with effect from 1st January, 2013.

   The undersigned is directed by order of the Governor to say that the Governor is pleased to direct that all the whole time approved employees of Statutory Bodies/Govt. Undertakings /Local Bodies etc. under the administrative control of this Department, who are in receipt of Dearness Allowance at State Government rates i.e. 45% of Band Pay and Grade Pay taken together, with effect from January 1st, 2012, shall draw Dearness Allowance @52% with effect from 1st January, 2013.

   2. The Dearness Allowance sanctioned hereinabove shall be rounded off to the nearest rupees, in each case.

MEMORANDUM

   In order to provide security of tenure, appropriate emoluments and certain terminal benefits subject to fulfillment of certain conditions to the casual / daily rated / contractual workers who have remained engaged in various Government establishments for a considerable period of more than 10 years in connection with implementation of various schemes / projects of various Departments of the Government two memorandums vide No. 2966-F(P) dated 23.04.2010 and No. 11794-F(P) dated 22.12.2010 were issued by the Government in Finance Department.

   The question of making the provisions of the two aforesaid orders more effective and suitable to the convenience of the Government Establishments / Organizations has been under active consideration of the Government for some time past.

   After careful consideration of the matter an din suppression of the aforesaid orders and all other orders issued by other Departments in the matter, the undersigned is directed by order of the Governor to say that the casual / daily rated / contractual workers, who are remaining attached to various establishments of the Government Departments / Directorates / Regional Offices / Other Organizations for not less than 10 years continuously as on 01.08.2011 and have rendered service for at least 240 days each year will be allowed the following benefits:

   The State Government employees who are enrolled under the West Bengal Health Scheme, 2008 while in service are allowed to exercise option for their enrolment under the Scheme as pensioner within one year of the date of their retirement. It has been observed that due to various reasons such pensioners are not getting the benefits of the Scheme w.e.f. the day next to the day of their retirement.

Clarification on annual increment date in Govt.of West Bengal

MEMORANDUM

   As per provisions of rule 10 of was (ROPA) Rules,2009 w.e.f. 01.01.2006 there is a uniform date of increment and such date is the 1st day of July of every year in respect of the State Government employees. In case of the employees completing 6 (Six) months and above in the revised pay structure as on 1st July of a year are eligible to be granted the increment. In terms of this provision of rules the State Government employees who are not able to join posts in a particular grade on account of promotion / appointment on the 1st day of January of a particular year due to the said date falling on saturday ( where saturday is holiday), sunday or any gazetted holiday are granted their increment on the 1st day of July of the next year.

   2. In the above context the undersigned is directed to state that if a State Government employee is to join post in a particular grade on promotion / appointment on 1st January of a year happens to be Saturday (where Saturday is holiday), sunday or any gazetted holiday actually joins on the 1st working day of the year will be treated to have completed 6 ( six) months service on the 1st day of July of that year for the purpose of granting him increment on that day.

   3. Necessary amendment in the WBS ( ROPA) Rules, 2009 will be done in due course.

Clarification on Maternity Leave in West Bengal Government

Sub : Clarification to Finance Department memo. No. 1146-F(P), dated 14-02-2011.

   In terms of Finance Department Memo. No. 1146-F(P) dated 14-02-2011 a female State Government employee may be granted Maternity Leave for a maximum of 180 days.

   After issuance of the above mentioned order, a question has been raised as to whether a female Government employee who was on Maternity Leave from a date earlier than 01-01-2011 (i.e. effective date of above mentioned order) and such leave is continuing on or after 01-01-2011 without break, is entitled to Maternity Leave for a maximun of 180 days.

   After careful consideration of the matter this Governor has been pleased to clarify that a female Government Employee who was on Maternity Leave from a date earlier than 01-01-2011 and such leave is continuing on or after 01-01-2011 without break is entitled to Maternity Leave for a maximum period of 180 days on existing terms and conditions as stipulated in Finance Department Memo. No. 1146-F(P). dated 14-02-2011.

West Bengal Government Inclusion of some more banks for ePS

MEMORANDUM

   The government has already Introduced the “West Bengal Government’s e-Payment of Salary [ePS) Scheme” vide Finance Department’s Notification No.8301-F dated 26-08-2009 wherein the detail rules and procedures for payment of salary through Public Sector Banks in electronic mode have been prescribed. The Annexure-A of Part-A of the enclosure to the Notification No.8303.-F dated 26-08-2009 has specified the list of 28 Designated Public Sector Banks through which salary can be disbursed.

   The Government has since been considering inclusion of Cooperative Banks and Regional Rural Banks to widen reach of the banks closer to the DDOs and employees.

   Now, it has been decided to designate the following Banks also under the purview of e-Payment Scheme apart from the 28 Public Sector Banks already specified in the aforesaid list:

   1) The West Bengal State Cooperative Bank Ltd. and its affiliated Central Co-operative Banks.

   2) Regional Rural Banks (RRBs) in West Bengal i.e.

   a) Bangiya Gramin Vikash Bank

   b) Paschim Banga Gramin Bank

   c) Uttar Banga Kshetriya Gramin Bank

3) All Urban Cooperative Banks

   In order to accommodate the above-mentioned Banks, following amendments shall be incorporated in the “Guidelines for implementation of West Bengal Government’s e-Payment of Salary [e-PSJ Scheme 2009”

   1) In Part-A, para-5 (page-1) of the Executive Summary of the e-Payment of Salary Scheme 2009, replace “Public Sector banks” with “Public Sector Banks, The West Bengal State Cooperative Bank Ltd. & its affiliated Central Co-operative Banks, all Regional Rural Banks (RRBs) and Urban Cooperative Banks located in West Bengal.

   2) In Part-A, para.1(l) (PAGE-9) of Enclosure to the Notification No.8301-F dated 26-08-2009 of the Finance (Audit) Department replace “Public Sector Banks” with ‘Public Sector Banks, The West Bengal State Cooperative bank Ltd. & its affiliated Central Co-operative Banks, all Regional Rural Banks (RRBs) and Urban Cooperative Banks located in West Bengal”.

   This order will take effect from the dite of issue.

Payment of salary of the Government employees through Bank Account.

Sub:- Payment of salary of the Government employees through Bank Account.

Sir/Madam,

   1. The West Bengal Government’s e-Payment of Salary (ePS) Scheme, 2009 had been introduced in terms of Notification No.8301-F dated August 26, 2009. 1 am directed to inform you that the Government has decided that payment of monthly salary of all the employees of various departments/directorates/regional offices of the State Government will be made compulsory through bank accounts of the employees concerned.

   2. In this connection, I would request you to make necessary arrangement for implementation of Part A of the scheme as mentioned in the Notification NO.8301-F dated August 26, 2009, for all categories of the employees of their regular establishmens. It is requested that steps may kindly be initiated so that the salary for all the employees are paid through credit to their bank accounts, either through Electronic Credit System (ECS) or by way of payment being credited through a designated bank in the employee accounts, latest for the salary month of September, 2011. A brief report of the department concerned on the steps initiated may kindly be sent by end of July, 2011.

   3. In this connection, it may also be noted that the Finance Department has already taken up the matter with the Reserve Bank of India for improvement of the scheme and necessary order in this regard will be issued in consultation with the Reserve Bank of India and other nationalized banks in due course. All the concerned banks are also being requested to extend necessary co-operation in opening salary accounts in favour of the employees with zero balance.

   In continuation of this Department Memo Nos. 1456.F.B. dt:08.11.2006,. 828.F.B. dt. 29.07.2008, 1636-F.B. dt.02.12.2008, 1860-F.B. dt. 06.0l.2009, 2492-F.B. dt. 30.03.09, 1300-F.B. dt. 11.09.2009 and 505-F.B.dt.11.03.2020, the undersigned is directed by order of the Governor to say that the Governor has been pleased to accord sanction to introduce the fixed rake of interest in the Housing Loan Scheme for employees of Govt. of West. Modified Guidelines on Health Scheme in WEST BENGAL

Memorandum

   In partial modification of the memorandum no. 3474-F dt. 11-05-2009 the Governor is pleased to publish the following guidelines for settlement of claims under the West Bengal Health Scheme, 2008:-

   2. For surgical cases reimbursable amount should be calculated following Package rates. Where there is no Package rate for a particular procedure, reimbursement may be made following Package rate of identical procedure.

   3. For non-surgical cases, reimbursable amount may be calculated adding charges for doctor’s visit, bed, investigations, medicines, consumables etc. as per approved rates.

   4. Treatment charges for new-born baby are separately reimbursable in addition to delivery charges of the mother. Baby is entitled to get treatment on the basis of identity card of parents up to six months of age. A separate identity card under the Health Scheme should be obtained within that period.

   5. Costs of implants/ prostheses are reimbursable as per the approved rates or as per actuals whichever is less. Where there is no approved ceiling rate, actual cost may be reimbursed.

   6. If one or more procedures form part of a major treatment procedure, then full package charge would be permissible for the major procedure only and 60% of charge for minor procedures.

   7. If any Government employee/ pensioner or beneficiary is admitted in a recognized hospital on emergency basis, cost of medical attendance and treatment before the ‘Package period’ may be reimbursed adding bed rent , investigation charges, cost of medicines, doctor’s visit, consumables etc.

   8. ‘Package’ starts from the previous day of surgery and during ‘Package period’ bed rent, doctor’s fees, investigations, medicine charges, etc., are not reimbursable.

   9. Duration of indoor treatment under Package has been mentioned in Annexure-I of the notification no. 796-F (MED) dt. 31.01.2011. No additional charge on account of extended period of stay shall be reimbursable if that extension is due to infection on the consequence of surgical procedure or due to any improper procedure and is not justified. The Sanctioning Authorities should carefully examine such cases on the basis of doctor’s note.

   10. Charges for MRI, CT Scan, Endoscopy, Colonoscopy, Ultrasonography, ERCP, Sigmoidoscopy are reimbursable for any disease on the basis of OPD prescription of any recognized hospital. Investigations done in Joint Venture diagnostic centres situated in the Government hospital campuses are reimbursable under the Health Scheme if otherwise admissible.

   11. Cost of artificial appliances e.g. dentures, spectacles, contact lens, etc. are not reimbursable.

   12. Ambulance charge is not reimbursable.

   13. Charges for administering injection/ wound dressing/ Physiotherapy at residence are not reimbursable.

   14. Prior permission of the West Bengal Health Scheme Authority will be required for Human Organ Transplantation, Cochlear implant Surgery; implantation of Dual-Chamber Pacemaker, more than two Stents, more than one Drug-Eluting Stents, AICD, CRT with AICD, Neuro implants, viz. Deep Brain Stimulator Implants, Intra-thecal Pumps, Spinal Cord Stimulators; costly devices like digital hearing aid, etc. and for treatment in a Speciality hospital outside the State.

   15. Under Clause 2(5) of the Health Scheme an employee has liberty to opt out of the Scheme. As there is no provision for re-enrolment under the Scheme such opt out employee/ pensioner will not get re-entry in the Scheme.

   16. Where there is no approved rate of a procedure/ investigation, actual cost may be reimbursed for medical treatment done in a recognized Hospital/ Nursing Home up to 31.01.2011.

   17. In the case of death of a Government employee/ pensioner if hospital dues remain unsettled, the hospital authority may send bills to the concerned office. The office shall take necessary steps for payment of the hospital dues.

   18. Each and every office shall examine and settle the cases under the West Bengal Health Scheme, 2008 on top priority basis. Any over-billing and unnecessary procedures, if done, should be brought to the notice of the Health Care Organisations within 15 days. For any clarification on a particular case, reference should be made to the Medical Cell, Finance Department within 30 days of discharge from the recognized Hospital/ Nursing Home.

   19. Diagnostic centres have entered into agreement under the West Bengal Health Scheme, 2008 for rendering diagnostic facilities only. Reimbursement of the costs of treatment prescribed by any doctor of Polyclinic run by diagnostic centres or any private doctor is not admissible under the Health Scheme.

   20. Extra charges for collecting sample for diagnostic investigations are not reimbursable.

   21. Beneficiaries under the Health Scheme may avail treatment facilities at any recognized Hospital/ Nursing Home/ Diagnostic Centre at his/ her choice within the State.

   22. ‘Medical record’ charge is not reimbursable.

   23. No reimbursement shall be allowed for treatment/ services taken from nonrecognized private hospital/ nursing home/ diagnostic centre except in the following cases:-

(a) Accidental injury,

(b) Acute Appendicitis operation on emergency basis,

(c) Delivery on emergency basis,

(d) Haemodialysis [Rs. 900/- (i.e. 60% of Rs. 1,500/-) per dialysis or actual cost whichever is less],

(e) Removal of foreign body on emergency basis

   Costs up to 60% of the approved rates may be reimbursed if medical treatment is done in a non-recognized private hospitals/ nursing homes/ diagnostic centres in the above cases subject to fulfilment of the following terms and conditions:-

(i) The treatment shall be availed only from private hospitals or nursing homes having valid Clinical Establishment licence.

(ii) The treatment shall be availed for emergency conditions only and this shall be certified by the treating doctor in a specific form.

(iii) The reimbursement for such treatment availed shall be sanctioned by the Principal Secretary of the Department to which the beneficiary belongs with prior approval of the West Bengal Health Scheme Authority.

(iv) No advance shall be available.

Appointment of Govt. employees unmarried daughter on compassionate ground

NOTIFICATION

   In terms of the provision at para 2(2) of this Department Notification No.30-Emp. Dated 02.04.2008 an unmarried daughter of the Government employee, who dies in harness or retires prematurely on being declared permanently incapacitated for service, may be considered as one of the dependants of the Government employee for the purpose of appointment on compassionate ground. In course of dealing with such cases, instances have come to the notice of the State Government that married daughters who, at the time of death or premature retirement of the concerned Government employee and also at the time of making application for the job, were unmarried. The question of admissibility of such married daughters for a job on compassionate ground has been under consideration of the Government for sometime.

   2. After careful consideration of all relevant aspects, the Governor has been pleased to order that a married daughter of the Government employee who, at the time of death or premature retirement of the concerned Government employee, was unmarried, shall be considered for appointment on compassionate ground in terms of Labour Department Notifications No.30-Emp. Dated 02.04.2008 and No.114-Emp. Dated 14.08.2008 subject to the condition that she submits an affidavit to the effect that she will pass on one-third of the emoluments that she will receive as salary and other benefits for the post that she will occupy to her paternal/maternal family.

   3. This order issues with the concurrence of Finance (Audit) Department U.O. No.4549, Group-P (Service) dated 27.12.2010.

   The West Bengal State Government has decided to declare a paid holiday on the occasion of celebration of 1st May 2011 for all categories of workers and employees including the work-charged category in Industrial Establishment where the day has not already been declared as a paid holiday.

INCREASE OF MATERNITY LEAVE IN WEST BENGAL

Kolkata, the 14th February,2011

     The matter of enhancement of the ceiling of Maternity Leave on the recommendation of the Fifth pay Commission has been under active consideration of the Government for some time past. At present a female State Government employee is entitled to Maternity Leave for 135 days in terms of Rule 199 of West Bengal Service Rule, Part-I read with Finance Department Memo No. 3453-F dt 28.03.01.

     After careful consideration of the matter the Governor has been pleased to decide that a female State Government employee may be granted Maternity Leave for a maximum of 180 days subject to the existing terms and conditions as laid down in Rule 199 of the West Bengal Service Rule, Part-I.

This order shall take effect from 01.01.2011.

Necessary amendments of the relevant Rules will be made in due course.
