Job On Compassionate Ground 

Compassionate Appointments in Government are regulated as per instructions issued by Department of Personnel and Training Office Memorandum No. 14014/6/94-Estt.(D) dated 09.10.1998 as amended from time to time. All these instructions have been consolidated vide Office Memorandum No. 14014/02/2012-Estt.(D) dated 16.01.2013 and as per these instructions 5% of direct recruitment vacancies in a year in Group ‘C’ posts can be filled up by compassionate appointment. 

The time limit of three years for making compassionate appointment has been withdrawn vide this Department’s Office Memorandum No. 14014/3/2011-Estt.(D) dated 26.07.2012. 

Department of Personnel & Training only lays down the policy of compassionate appointment which is implemented by the Administrative Ministries/Departments while considering the cases of compassionate appointment. The Administrative Ministries/Departments are required to monitor the state of implementation of compassionate appointment under their respective jurisdiction. DoP&T does not have information on specific details on the number of applications under consideration of the Union Government for appointment on compassionate grounds, Ministry-wise/Department-wise. 

This information was given today by Minister of State for Personnel, Public Grievances and Pensions, Dr. Jitendra Singh in a written reply to a question in Rajya Sabha by Shri Narendra Kumar Kashyap.

EMPLOYMENT TO DEPENDANTS

Will the Minister of PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-

(a) whether there is a provision in the Government to provide employment to the dependant of a person who dies in harness on compassionate grounds;

(b) if so, the details of the rules laid down in this regard;

(c) whether there is a provision to give jobs to these dependants within a prescribed time-limit;

(d) if not, the reasons therefor; and

(e) the details of the number of such cases pending alongwith the time by which they are likely to be disposed of, Ministry/ Department-wise?

ANSWER

(a) & (b): Compassionate Appointment in Government are regulated as per instructions issued by Department of Personnel and Training’s vide Office Memorandum No. 14014/6/94- Estt.(D) dated 09.10.1998 as amended from time to time. All these instructions have been consolidated vide Office Memorandum No.14014/02/2012-Estt.(D) dated 16.01.2013.

   This has reference to your office letter No. Staff/175 -SEL / 2013 dated 29.08.2013 on the subject cited above.

   2. In this context, it may be clarified that the Scheme was initially introduced in case of GDS subject to the same condition applicable to regular employees under No. 43-212/79/Pen dated 04.08.1980.  With the introduction of the merit points and procedure for selection under letter of even number dated 14.12.2010 as amended from time to time, all conditions applicable to compassionate appointment scheme relating to regular employees continue to apply in matters the Scheme does not envisage a specific provision in the context of compassionate engagement of a dependent of the GDC [in case of death only].
