Outsourcing of Jobs in Government Departments

Outsourcing of Jobs in Government Departments

OUTSOURCING OF JOBS IN GOVERNMENT DEPARTMENTS

A Ministry or Department may procure certain non-consulting services in the interest of economy and efficiency and prescribe detailed instructions and procedures for this purpose without, however, contravening the basic guidelines provided in rule 199 to 206 of “General Financial Rules 2017” (GFR 2017). As each Ministry/Department is competent to procure services at their level to meet seasonal or short-term requirements, the centralised data is not maintained in this regard.

There are detailed procedures laid down for procurement of such non-consulting services including e-procurement in Chapter 6 of the GFR 2017 and the “Manual for Procurement of Consultancy &Other Services, 2017”. Ministries are competent to decide the mode depending on the nature of work, nature of competency required etc. Any deviation or violation can be dealt by the Ministry appropriately. The wages for the persons engaged on contract/outsourcing cannot be less than the minimum wage fixed/notified by the concerned State Government.

The Government posts are regularly filled up in accordance with the recruitment rules. Each Ministry/Department is responsible for appointment of regular employees against vacant posts after completing all procedural formalities. The centralised data of vacancies and backlog vacancies is not maintained.

The above information was provided by the Minister of Personnel, Public Grievances and Pensions and Minister of State for Prime Minister’s Office Dr.Jitendra Singh in written reply to a question in Lok Sabha today.

ANSWER

THE MINISTER OF STATE FOR HEAVY INDSUTRIES AND PUBLIC ENTERPRISES (SHRI P. RADHAKRISHNAN)

(a): Revised Voluntary Retirement Scheme (VRS) in Central Public Sector Enterprises (CPSEs) was introduced by the Government in May, 2000. The salient features of the revised VRS Policy are as under:

VRS in CPSEs that can sustain a VRS with their own Surplus Resources.

Enterprises, which are financially sound and can sustain VRS on their own, can frame their own schemes of VRS and make it attractive enough for employees to opt for it. They may offer as compensation upto 60 days salary (only Basic Pay + DA) for every completed year of service. However, such compensation will not exceed the salary for the balance period of service left.

VRS in Marginally Profit or loss Making and Sick and Unviable CPSEs

Marginally profit /loss making CPSEs as well as sick and unviable units may adopt either

(i) the Gujarat Model, under which the compensation is computed by allowing 35 days salary for every completed year of service and 25 days for each year of the balance service left until superannuating, subject to the condition that the compensation shall not exceed the sum of salary for the balance period left for superannuation

The employees who have completed not less than 30 years of service will be eligible for a maximum of 60(sixty) months salary/ wage as compensation and this will be subject to an amount not exceeding the salary/wage for the balance period of service left.

(b) & (c): Implementation of the VRS Scheme in different categories of CPSEs, including unviable or sick units of Central Public Sector Enterprises (CPSEs), as per the provisions of revised VRS Scheme, is monitored by the administrative Ministries / Departments concerned. Presently, there is no proposal to implement Voluntary Retirement Scheme (VRS) to the employees of units of HMT Group of Companies located in Hyderabad.

(d): Department of Public Enterprises is implementing Counselling, Retraining & Redeployment (CRR) Scheme to provide opportunities of redeployment through counselling and retraining to separated employees of CPSEs rendered surplus as a result of modernization, technology upgradation and manpower restructuring in CPSEs. The basic aim of the Scheme is to re-orient VRS optees through short duration training programmes to enable them to adjust to theirnew environment and adopt new vocations after their separation from CPSEs due to VRS/VSS or retrenchment due to closure / restructuring of the enterprise. The objective is to equip them with skill/expertise enabling them to be deployed in self-employment activities mainly.

(d) whether the Government proposes to formulate any scheme for providing welfare measures and improving the service conditions of such workers; and

(e) if so, the details thereof and if not, the reasons therefor?

ANSWER

Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office. (DR. JITENDRA SINGH)

(a): The fundamental principles applicable to all Ministries/Departments regarding engagement of consultants and outsourcing of services are provided in General Financial Rules 2005. The Ministries/ Departments may hire external professionals, consultancy firms or consultants for a specific job which is well defined in terms of content and time frame for its completion or outsource certain services. A Ministry/Department may outsource certain services in the interest of economy and efficiency and it may describe detailed instructions for this purpose. As the respective Ministries/ Departments are empowered to outsource certain services on their own, no centralized data is maintained.

(b)&(c): Engagement of contract labourers is regulated under the Contract Labour (Regulation & Abolition) Act. The Central Government is the appropriate Government in respect of the establishments falling in central sphere. The interest of contract labourers in terms of wages and other service conditions are safeguarded under this Act. As far as the security in term of wages is concerned, as per Rule 25(2)

(v)(a) of the Contract Labour (Regulation & Abolition) Central Rules, 1971 , the wages of the contract labour shall not be less than the rates prescribed under Minimum Wages Act, 1948 and in cases where the contract workers perform the same or similar kind of work as the workmen directly employed by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work. The liabilities to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer.

The Social Security aspects of contract labourers under Employees Provident Fund and Miscellaneous Provision Act, 1952 and Employees state Insurance Act, 1948 are enforced by the Employees Provident Fund organization and Employees State Insurance Corporation respectively provided the establishments in which contract labourers are working are covered under the said Acts.

In the Central sphere, the Central Industrial Relations Machinery (CIRM) has been entrusted with the responsibility of enforcing the provisions of the Act and rules made thereunder. Aggrieved workers may raise their issues, if any, before the Appropriate Authority under Labour laws.

(d)&(e): The Social Welfare Schemes of the Government are also applicable to the Contract Labourers if they fulfil the conditions of the Scheme to be eligible for the benefits of a particular Scheme. However, the interests of Contract Workers are protected specifically under Contract Labour (Regulation & Abolition) Act, 1970.

Some of the prominent social welfare legislations are as follows:-

#Payment of Gratuity Act, 1972 # Employees’ Provident Fund & Misc. Provisions Act, 1952 # Employees’ Pension Scheme, 1995 # Employees’ State Insurance Act, 1948 # Minimum Wages Act, 1948 # Payment of Wages Act, 1936 # Maternity Benefit Act, 1961 # Equal Remuneration Act, 1976 # Payment of Bonus Act, 1965 # Workmen Compensation Act, 1923 # Mines Act, 1952 # Factories Act, 1948 # Industrial Dispute Act, 1947 # Contract labour (Regulation & Abolition) Act, 1970

Will the Minister of COMMUNICATIONS AND INFORMATION TECHNOLOGY be pleased to state:-

(b) if so, the details thereof and the reasons therefor; and

(c) the corrective steps taken/being taken by the Government in this regard?

ANSWER

THE MINISTER OF COMMUNICATIONS AND INFORMATION TECHNOLOGY & LAW AND JUSTICE (SHRI RAVI SHANKAR PRASAD)

(a) No, Madam, They are not eligible.

(b) Gramin Dak Sevaks are not regular govt. employees. They are part time workers and are governed by a separate set of Conduct and Engagement Rules. They do not form part of the regular civil service. They are engaged for only 3-5 hours daily work. It is mandatory for them to have an independent source of livelihood before being engaged as Gramin Dak Sewak. Hon’ble Supreme Court in the case of Union of India and Others vs. Kameshwar Prasad 1998 SCC (L&S) page 447 held that P&T Extra Departmental Agent (C&S) Rules, 1964 are a complete code governing service, conduct and disciplinary proceedings against Extra Departmental Agents [now called Gramin Dak Sevaks]. On discharge from service on attaining the age of 65 years or on death, Gramin Dak Sevaks [GDS] are paid Ex-Gratia Gratuity and Severance Amount as approved for them by the Cabinet.

The Ex-gratia Gratuity is paid at the rate of half months basic Time Related Continuity Allowance [TRCA] drawn immediately before discharge of service for each completed year of service subject to a maximum of Rs. 60000 or 16.5 months basic TRCA last drawn whichever is less. The minimum service prescribed for this is 10 years. In addition, Severance Amount is paid at the rate of Rs. 1500 for every completed year of service subject to a maximum of Rs. 60000. The Government has already introduced Service Discharge Benefit Scheme in lieu of severance amount scheme effective from 01.04.2011 for the benefit of Gramin Dak Sevaks on the basis of the New Pension Scheme (NPS), specifically NPS Lite Scheme launched by the Pension Fund Regulatory and Development Authority (PFRDA). Under this scheme, the Government as well as Gramin Dak Sevaks concerned now contributes @ Rs. 200/- per month.

(c) Does not arise in view of reply to (b) above.
