Subject: Official dealings between the Administration and Members of Parliament and State legislatures – Observance of proper procedure.

The undersigned is directed to refer to this Department’s Office Memorandum No. 11013/4/2011-Estt.(A) dated 1st December 2011 subsequently reiterated vide D.O. letter dated the October 9, 2012 from Secretary (Personnel), O.M. No. 11013/2/2012-Estt.A dated 19.11.2014 and O.M. of even No. dated 7.02.2018 (copies enclosed) on the subject mentioned above and to reiterate these instructions for strict compliance on the recommendations of the Committee of Privileges, Lok Sabha in its Sixth Report tabled in the Lok Sahha on 20.12.201 7 and Committee on Violation of Protocol Norms and Contemptuous Behaviour of Government Officers with Members of Lok sabha in its Fourth and Fifth Report tabled in the Lok Sabha on 01.08.2018.

2. All Ministries/ Departments are requested to ensure that instructions issued through aforementioned communications are followed by all officials concerned, both in letter and spirit. Violation of these guidelines will be viewed seriously.

3. Chief Secretaries of all States/ UTs are requested circulate these instructions to all State Government officials at the State/ Division and District levels and sensitize them with regard to their duties and obligations in so far as the movement of Members of Parliament in general and more particularly during Parliament sessions. It is also requested to periodically review implementation of these instructions.

The undersigned is directed to refer to this Department’s OM of even number dated 01.06.2018 (copy enclosed) on the subject mentioned above vide which all cadre units were requested to take the preparatory actions for promotion.
2. All-Cadre units are once again requested to complete all the following preparatory actions required for promotions at the earliest:-
i. To ensure for updating all the particulars of CSSS officers in CSCMS portal in a time bound manner.
ii. Preparation in all aspects for conducting the DPC meeting, immediately;
iii. Availability of APARs for the period upto 2017-18 in respect of eligible CSSS officials/officers.
iv. Up-to-date information with regard to vigilance clearances with major and minor penalties, details of officers retired on superannuation or otherwise, cases of refusal of promotion etc. may be made available readily.

S.O. 3964(F).—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with rule 6 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and in supersession of the notification of the Government of India in the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) number S.O. 3570(E), dated the 9th November, 2017, and after consultation with the Comptroller and Auditor General of India in relation to person serving in the Indian Audit and Accounts Department, except as respects things done or omitted to be done before such supersession, the President hereby directs that with effect from the date of publication of this Order in the Official Gazette, all civil posts under the Union, shall be classified as follows,

Subject: Reiteration of instructions relating to application of own merit in Direct Recruitment for appointment of Other Backward Classes (OBCs)- regarding

The undersigned is directed to say that the Hon’ble Supreme Court in its judgment in the case of R.K.Sabharwal vs. State of Punjab, had, inter-alia, observed that “the reserve category candidates can compete for the non-reserve posts and in the event of their appointment to the said posts their number cannot be added and taken into consideration for working out the percentage of reservation.”

2. As per instructions issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997, in direct recruitments to Central Government jobs and services, the reserve category candidates who are selected on the same standard as applied to general candidates will not be adjusted against reserved vacancies. As per instructions issued vide DOP&T OM No. 36011/1/98-Estt.(Res) dated 01.07.1998, only when a relaxed standard is applied in selecting a reserved candidate, for example in the age limit, experience, qualification, permitted number of chances in written examination, etc., such candidates will be counted against reserved vacancies.

3. It has been brought to the notice of this Department by the Hon’ble Parliamentary Committee on Welfare of OBCs that these instructions are not being followed in some cases in direct recruitments to Central Government jobs and services. It is, therefore, reiterated that while making Direct Recruitments, guidelines issued vide this Department’s OM No.36012/2/96-Estt.(Res) dated 02.07.1997 and OM No.36011/1/98-Estt.(Res) dated 01.07.1998 may be kept in view by all concerned.

4. All Ministries/ Departments are requested to bring the contents of this O.M. to the notice of all concerned for information and compliance.

Policy for Removal of Non-Performing Civil Servants

The provisions under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rule, 1972 and Rule, 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 have laid down the policy of periodic review and premature retirement of non-performing Government servants.

Up to January, 2018, a total of 21,195 Group ‘A’ and 47,039 Group ‘B’ officers have been reviewed, out of which provisions of FR 56(j) and relevant rules were invoked/recommended against 83 Group ‘A’ and 128 Group ‘B’ officers, including 15 officers of All India Services.

This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh, in written reply to a question in the Rajya Sabha today.

The Union Minister of State (Independent Charge) of the Ministry of Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy & Space, Dr Jitendra Singh said here today that the Government led by Prime Minister Shri Narendra Modi is sensitive to employees’ concerns and a number of decisions taken during the last four years, are aimed in the direction of addressing employees’ issues and providing them a motivating environment.

Dr Jitendra Singh was speaking to a delegation of Bharatiya Mazdoor Sangh (BMS) led by Shri M. Sudhakar Rao, Secretary General of Geological Survey of India Employees Sangh affiliated to BMS.
The members of the delegation submitted two memoranda to the Minister. One of them related to the alleged discrepancy in Recruitment Rules (RRs) of the Non-Gazetted Group ‘B’ Assistants in the Ministry of Mines, Geological Survey of India. The other memorandum proposed the setting up of a Joint Consultative machinery for arbitration.

Dr Jitendra Singh held a detailed discussion on each of the issues raised. He said that he will get the issues examined.

Opening of Office on Holidays

As per Fundamental Rules (F.R.) No.11, the whole time of a Government servant is at the disposal of the Government which pays him, he may be employed in any manner required by proper authority without claim for additional remuneration.

Sometimes with a view to meeting the exigencies of work such as when a Government business has to be transacted immediately or a deadline is to be met, the Head of Office can, in the interests of public service, take a decision to keep the offices open fully or partially even on public holidays. The staff who are deployed on official duty on public holidays are, however, compensated by granting them compensatory leave.

Need for laying down procedure for registering complaints in case of any Government/private office remaining open on public holidays has not been felt.

This was stated by the Minister of State for Personnel, Public Grievances & Pensions and Prime Minister’s Office, Dr. Jitendra Singhin a written reply to question in the Lok Sabha today.

Charges against Government Officials

No such consolidated data is maintained by this Department regarding vigilance probe for the charges of misappropriation of public funds and income more than the known sources against officers of All India Services and other Allied Central Services. However, for officers of Indian Administrative Service (IAS), Department of Personnel & Training (DoPT) is the Cadre Controlling Authority (CCA) and for Indian Police Service (IPS), the CCA is Ministry of Home Affairs (MHA).

As per available information, sanction for prosecution on the specific charges of misappropriation of public funds and disproportionate assets has been issued against 12 IAS/IPS officers in the last three years (2015-2017).

Further, 01 retired IAS/IPS officer was convicted on corruption charges, and 02 IAS/IPS officers were terminated from service in the last three years on charges of misappropriation of funds.

This was stated by the Minister of State for Personnel, Public Grievances & Pensions and Prime Minister’s Office, Dr. Jitendra Singhin a written reply to question in the Lok Sabha today

Dr. Jitendra Singh inaugurates DoPT Workshop on International Women’s Day

The Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh inaugurated a workshop on International Women’s Day here today. The day long Workshop was organised by DoPT on the theme of “Women Empowerment, Opportunities and Challenges.”

Addressing the gathering, Dr. Jitendra Singh said we need to look at women’s issues in a new perspective of the 21st century. He said, today women are leading in almost all fields including the Central Armed Police Forces (CAPFs) and the Armed Forces. The Minister said, the challenge for women today is how to use their evolving potential to the best.

Several women achievers in various fields and creativity were awarded on the occasion.

Secretary, DoPT, Shri C. Chandramouli, Director General, Doordarshan, Smt. Supriya Sahu and renowned classical dance artist Smt. Rama Vaidyanathan were also present at the event.
