2. It is requested that the Minutes of the Meeting may be gone through, necessary action may be taken and the Action Taken Report (ATR)/views/comments on point(s) concerned may be forwarded to D(JCM) Section immediately with the approval of the concerned JS/HOD/HOO.

3. It is further requested that in those cases where action is/are pending and not yet finalized , the progress achieved so far may be furnished from time to time to D(JCM) Section till finalization of the case.

Subject : Intimation regarding “Call Attention Strike” in the Defence Establishment.

Respected Madam,

This is to inform you that a meeting of the three recognized Federatiuon (AIDEF, INDWF, BPMS) has taken place at Kolkata on 05.01.2018. The meeting noted with, deep concern that the 4 joint representations submitted by the three recognized Federations have been ignored and neither the Government has responded nor came forward to have a negotiated settlement as in the past. In the mean time unfortunate that the Government has taken the following decisions arbitraraly. This decisions will have serious implications on the Security of the Country and also on the Defence Civilian Employees

1)To close down 14 Station WKPS under EME and to Convery Army Base Workshops in to GOCO Model.

2)To close down 4 Depots under DGOS.

3)To close down 39 Military Farms

4)To declare more than 31000 Defence Civilian Employees of Army Units surplus including in MES.

5)Government orders were issued for grant of Rs. 10000 as Uniform Allowance in place of stitched uniforms affecting the 5 DEF Group of Factories and its nearly 10000 Employees including almost 2000 Woman Employees. The decision to further declare 39 itmes of DEG Group Factories including Army Logo Uniform and Parachutes etc as Non-Core items inspite of the commitment given by DDP.

In view of the above development it has been decided to stage a massive demonstration on 15.02.2018 at Delhi before the Parliament and followed by a “One Day Call attention Strike” during March, 2018 by the employees of the Defence Establishments. We still hope that Hon’ble RM will take a serious note of the present situation and settle the issues amicably by holding a full fledged negotiations with the recognized Federations.

Sub: Grant of HRA/CCA at Hyderabad Rates to the Defence Civilian Employees working at Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak

Ministry of Finance, Department of Expenditure vide ID No. 2(2)12007/E-li (B) dated 19.02.2007 have informed MoD that the MoD should checkup the matter with the State Government/Local Authorities to confirm whether Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak are two different cities or both are one and the same. It was further clarified that if it happen to be the same city then HRA I CCA is already admissible at Hyderabad rates being part of Hyderabad (UA). Accordingly, Ministry of Defence after consulting the State Government Authorities have issued instructions vide ID No. 6(6)/2005 D (Civ.) dated 16.05.2007 clarifying Yeddumailaram (Medak) and Eddumailaram (Census Town). Medak are one and the same city and accordingly they are eligible for HRA / CCA as applicable to Hyderabad (UA).

Ministry of Finance vide its ID No. 2(2)/2007-E-li(B) dated 01.12.2014 have advised Ministry of Defence that payment of HRA at Hyderabad rates to the employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak may be stopped with immediate effect. Accordingly, Ministry of Defence have issued instructions to Ordnance Factory Board to immediately reduce the rate of HRA to the above employees from existing 30% to 10%.

In this regard it is stated that Eddumailaram (Census Town) was declared / treated as Urban (i.e. Census Town) at 2001 Census vide Government of India, Ministry of Home Affairs, Director of Census Operation Letter No. 4646/Census CeIl/2001 dated 12.08.2002 (copy enclosed for ready reference) Moreover, as per the publication of Government of Andhra Pradesh regarding concept of Urban Agglomeration defined in Chapter 1 of introduction, concepts and definitions, jurisdictional changes, Rural – Urban Frame Andhra Pradesh in Para 1.3.7 ¡t is clearly mentioned that the Medak District falls within the Urban Agglomeration of Hyderabad (UA).In view of the above Department of Expenditure ¡s requested to re-examine the whole issue in terms of the supporting documents stated in the Preceding Para and arrange to issue instructions to continue 30% HRA for the Defence Civilian Employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak,

This issue may please be considered seriously and urgently since the Defence Production Unit is facing serious industrial unrest owing to stoppage of HRA at par with Hyderabad (UA) rates.

An early decision is solicited.

From time to time Defence Civilian employees have been raising the demands that they should be granted Field Area allowance and Modified Field Area allowance as applicable to the Service Personnel and for providing other allowances like Aeronautical Technical Allowance, Airworthiness Certificate Allowance, Flight Charge Certificate Allowance etc. at par with technical defence personnel.  It has not been found feasible to accept these demands as the job requirements and service conditions of Service Personnel and Defence Civilian employees are totally different.

Subject: Payment of Overtime Allowance in the revised pay to the employees of Defence Industrial Establishments governed by Factories Act,1948.

   Consequent upon revision of pay structure as per the VI CPC recommendations, the matter regarding payment of OTA,as per revised pay to the employees of the Ddfence Industrial Establishments under Factories Act,1948 has been considered in consultation with the Ministry of Labour & Employment and DOP&T.That Ministry have clarified that OTA is a statutory provision and it would be admissible to the employees covered under the statutory provision of the Factories Act,1948 on the basis of revised wages with effect from the date the wages were revised.

   2.OTA on the basis of revised wages after implementation of VI CPC recommendations, is subject to the conditions stipulated in this Ministry’s O.M No.14(1)/97/D(Civ-II) dated 1st July 1998.

   3.This issues with the concurrence of Defence (Finance/AG/PB)vide their I.D No.133/AG/PB dated 18th April 2011 and after consultation with Ministry of Labour & Employment vide O.M.No.Z-16025/75/2009-ISH-II dated 14-01-2011.

Restructuring of Cadre of Artisan Staff in Defence Establishments-Clarification

Subject : Restructuring of Cadre of Artisan Staff in Defence Establishments in modification of the 6th CPC recommendations-Clarifications regarding.

Consequent upon the issuance of MoD letter of even number dared 14th June 2010 on the above mentioned subject, clarifications were sought by various Defence Establishments and Staff Associations on the following issues:

(i) Whether to treat the placement of 50% of the existing Highly Skilled Workers (Grade Pay:Rs.2400) as Highly Skilled –I (Grade Pay:Rs.2800) as Promotion for the purpose of ACP;and

(ii) To grant one time relaxation in respect of the employees who have already been granted financial up gradation in the Pay scale of Rs.5000-8000 in accordance with the ACPs between 01-01-2006 and 31-08-2008.

2. The matter has been considered in consultation with the Department of Personnel &Training and Ministry of Finance and it is clarified that:

(i) Placement of 50% of the existing Highly Skilled Workers (Grade Pay:Rs.2400) as Highly Skilled Worker Grade-I (Grade Pay:Rs.2800) with effect from 01-01-2006 will be treated as promotion for the purpose of ACP;and

(ii) While carrying out the restructuring as per Ministry of Defence letter of even number dared 14th June 2010,Financial up gradation (in the Pay scale of Rs.5000-8000),granted to the Highly Skilled Workers (in the Pay scale of Rs.4000-6000) between the period from 01-01-2006 to 31-08-2008 under ACP Scheme of August,1999,will not be withdrawn as a one time measure.

The points raised by the respective members on NG Staff issued:

1.As the post of the Chargeman grade II & Grade I and the post of Assiatant and office supererindent have been merged due to the implementation of recomendations of 6th PC so the resultant vacant posts should be filled up immediately by granting one time relaxation from the residency period stipulted by DOPT OM dated 24th march 2009.further the vacant post of Asst.foreman and JWM should also be filled up.

SS/BPMS Official side views:DOPT norms contained in OM dated 24-3-09 is applicaable to all central governament employees. As such relaxation pf DOPT norms are not possible at this stage. OFB has issued instructions to effect promotions to CM(T&NT) vide OFB order dated 22-01-2010.Relaxation at this can not be accorded.Poweer to relax residen cy period rests with MOD and it may take time and entire process of promotion may be delayed.promotions to AF for 2009-10 is over.

Decision: A proposal for one time relaxation of residency period for the promotion from the feeder grade(merged) to the higher grade maay be taken up with MOD.

2.Promotion of all eligible Chargeman to AF/FM/SH. Promotions of all eligible (approximately 411) chargeman (ex-cm I/T&NT) against over all vacancies be ordered from GP Rs.4200/- to Rs.24600/- during the current financial year(before march 2010)through review DPC-2009-2010.It will facilitate paricy amongst streem and gainful utilisation of vacancies.

BKS/AIANGO. It was decided that DPC for 2010-11 may be convened at the earlist.

3.Filling the LDCE vacancies of CM against 25% from available wait list candidates in ordnance factories. RS/INDWF. last examinations of LDCE to fill 25% CM II was conducted during the year 2008. Due proposed merger of CM II with CM I, LDCE examinations were not conducted during 2009 and till date. Action is in hand for conducting LDCE during 2010.

4.Transfer Policy. BRN/BPMS . The existing policy of OFB for GOs and NGOs are faulty due to which the credibility of OFB is going down and lot of rumours are spreading to defame the prganization.He suggested for framing suitable transparent transfer policy in consultation with staff side. He also suggested to(i)stop the implementation of intger factory transfers on public interest,(ii)unavoidable transfers may be executed in the month of June/july,(iii)to issue transfer orders on promotion only etc.,.It was stated that the existing policy wasd being reiewd by the official side.

5.Creation ofseperate discipline as CM II Tech/Electical(Electronics) BNR/BPMS.OFB has issued order on 25-1-2010 with drawing its earlier instructions dated 28-5-07 regarding the promotions of Fitter Electronics to CM. Some factories are effecting th order for the individuals aalready promoted to CM (Electrical/Electronics0 It was stated that a circular would be issued to the factories not to reopen the pas cases.

6.No recruitment /joining of JWM through LDCE/UPSC till merger of AF/FM/SH with JWM. BKS/AIANGO. PROPOSAL IS NOT AGREED TO. Point is closed.

7.Gainful utilisation of vacancies and one time relaxation in eligib ility for promotion from CM to AF/FM/SH - BKS/AIANGO To fill up the remaining 2436(approx.2847-411=2436) vaciencies in Grade of AF/FM/SH.-Official side views :Right at this moment it is not advisable to go for relaxation in residency period.

8.Up gradation of & Merger AF/FM/SH with JWM w.e.f 1-1-06 as per Govt. Orders. BKS/AIANGO. Officials side says that the proposl for merger of the posts of AF/FM/SH with JWM w.e.f 1-1-06 is still under the examination of MOD along with another proposal for upgradation of pre-revised pay scale of Rs.7400/- Rs.11000/- to Rs.7500/- Rs.12000/- and accordingly awarding respective higher pay.It is decided that staff side requested that the merger orders of AF to JWM should be issued byOFB at the earliest. It was decided that the pending proposals may be pursued with MOD for early finalisation of the issue.
