Grant of One Time Relaxation for Compassionate Appointments – BPMS

Govt. of India, DoP&T O.M. No. 14014 / 6 / 94- Estt (D) dated 09th Oct 1998 read with O.M. No. 14014/23/ 99- Estt (D) Dated 03rd Dec 1999 has a provision to give a compassionate appointment to one of the dependent for the survival of his family, if the employee unfortunately dies during his service period; leaving his family behind to survive, but it is limited to 5% of the vacancies falling under direct recruitment quota in any Group ‘C’or ‘D’ post. Not only this, under this 5% quota DR of Group ‘C’ & ‘D’ defence civilians, the dependants of Group ‘A’ & ‘B’ defence civilians and all uniformed personnel (of Army, AirForce & Navy) are being granted compassionate appointment but the 5% vacancies under DR of Group ‘A’ & ‘B’ defence civilians and uniformed personnel are not added. Due to this, a large number of wards are waiting for their appointment on compassionate grounds to look after the family.

This federation has made lot of efforts on the subject and it may be noteworthy to mention the following correspondence (1) BPMS Letter No. BPMS / MOD / Comp. Apptt. /219 (8/3/L) . dated 04.04.2016 (2). Hon’ble RM’s DO No. 4930/VIP/RM/2016, dated 02.06.2016 (3). MOD ID No. 19(1)/2016-D(Lab), Dated 05.07.2016 (4). OFB letter No. 039(6)/PER/POLICY, Dated 14.07.2016.
Further, this issue has been discussed on several occasion with the present Raksha Mantri also but no action is seen as yet.

On the other hand, the families of dependents are suffering and are becoming desperate on account of inaction on such an important and sensitive issue.

The Central Executive Committee Meeting being held at Dehu Road (Pune) took serious cognizance of the issue and demands that the Government should take immediate necessary steps to solve the issue.

(a) whether it is a fact that 1573 posts of Barrack and Store (B&S) Cadre of Military Engineer Services (MES) were revived through Ministry of Finance during September, 2016; 
(b) if so, the details of vacancies filled-up till date;
 (c) if not, reasons for delay of 18 months in filling up of vacancies; 
(d) the date by which all revived posts will be filled-up alongwith details of recruitment / DPCs conducted during last three years at each level; and 
(e) the details of DPC conducted during last three years in respect of all cadres of MES at each level with present position of each case?

(b) to (d): Post Cadre Review of the Barrack and Store Cadre, which was completed on 15th December, 2017 a number of posts have been upgraded and some have been abolished. These will require amendment of the recruitment rules before filling up of posts.
 (e) A total of 44 Departmental Promotion Committees have been conducted for various cadres of Group ‘A’ and Group ‘B’ Officers of MES in the past three years.

 (d) whether it is also a fact that direct recruitment of officers of B&S cadre has not been done during last eight years;

(d) to (f): A proposal for direct recruitment of 24 Barrack and Stores Officers was initiated in 2013. Observations made by UPSC in 2016 thereon have since been addressed. In the meantime, cadre review of Barrack and Stores Cadre which had been undertaken, was completed on 15th December, 2017, following which a number of posts have been upgraded and some have been abolished. These will require amendment of the recruitment rules before filling up of vacant posts.

Reference: HQrs office letter No.25012/AN/X/2014 dated 15.17.2014.

As you are that certain stations have been categorized as ‘Hard’ and ‘Tenure’ stations for the purpose of transfer/posting. In order to rotate staff/officers at hard and tenure stations, a fixed tenure has been prescribed for each of the stations.

2. The service conditions and the accessibility of facilities at various hard and tenure stations continue to change from time to time. Overall economic and infrastructural development in these areas cans for a review from time to time. Hence, the competent authority has decided to review the status of all hard and tenure stations.

3. In order to take an appropriate view on continuation/discontinuation addition of any new station in this category, it is requested that your considered views in respect of hard and tenure stations falling under your jurisdiction may be communicated to HQrs office latest by 15th April 2018 in the enclosed proforma. While forwarding your comments, the degree of climatic/topographic hardships at these stations, availability of basic facilities like schools, hospitals, accommodation etc., accessibility of the station by rail or road or any other mean and effect of revised tenure on volunteers for different stations, if any, may be taken into consderation.

Subject: Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in respect of Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 in respect of Officers and JCOs/OR equivalent.

Reference is invited to Special Army Instructions (SAI-2008), Special Air Force Instructions (SAFI-2008), Special Navy Instructions (SNI-2008) dated 11.10.2008 and Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017 in respect of Officers and JCOs/OR equivalent.

2. In 6th CPC regime pay fixation on promotion in respect of Defence Services Personnel was governed by provisions contained in SAI-2008, SAFI-2008 and SNI-2008. These provisions regulates pay fixation on promotion, wherein an Officer has an option to get his pay fixed in the higher post either from the date of his promotion or from the date of next increment. Similarly, consequent upon implementation of ih CPC, the pay fixation on promotion from the date of promotion is regulated by Rule 12 of the Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017 in respect of Officers and JCOs/OR equivalent. This methodology of fixation of pay on promotion to a post carrying duties and responsibilities of greater importance, of a Defence Services Personnel in case he opts for pay fixation from the Date of Next Increment (DNI) has been considered in this Department.

3. After due consideration in this matter, the following is decided as follows:

(i) A Defence Personnel, who is promoted or upgraded from one rank to another, subject to the fulfilment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties or responsibilities of greater importance than those attaching to the post held by him/her. Such, Defence Personnel may opt to have his/her pay fixed from the Date of his/her Next Increment (either 1st July or 1st January, as the case may be) accruing in the Level of the post from which he/she is promoted, except in cases of appointment on deputation basis to an ex-cadre post or on direct recruitment basis or appointment/promotion on ad-hoc basis, as applicable in the Defence Services.

(ii) In case, consequent upon his/her promotion, the Defence Personnel opts to have his/her pay fixed from the date of his/her next increment (either 1st July or 1st January, as the case may be) in the Level of the post from which Defence Personnel is promoted, then, from the date of promotion till his/her DNI, the Defence Personnel shall be placed at the next higher cell in the level of the post to which he/she is promoted.

(iii) Subsequently, on DNI in the level of the post to which Defence Personnel is promoted, his/her Pay will be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) may be granted in the Level from which the Defence Personnel is promoted and he/she shall be placed, at a Cell equal to the figure so arrived, in the Level of the post to which he/she is promoted; and if no such Cell is available in the Level to which he/she is promoted, he/she shall be placed at the next higher Cell in that Level.

(iv) In such cases where Defence Personnel opts to have his/her pay fixed from the date of his/her next increment in the Level of the post from which he/she is promoted, the next increment as well as Date of Next Increment (DNI) will be regulated accordingly.

4. It is further reiterated that in order to enable the officials to exercise the option within the time limit prescribed, the option clause for pay fixation on promotion with effect from date of promotion/ON I shall invariably be incorporated in the promotion/appointment order, as per applicability, so that there are no cases of delay in exercising the options due to administrative lapse.

5. This issues with the concurrence of Ministry of Finance vide their 1D No. 4-23/2017-IC/E.III (A) dated 22.3.2018.

Cap On educational Concession to Children of Missing/Disabled/Killed Soldiers Removed

Government has decided to continue educational concessions to the children of Armed Forces Officers/Personnel Below Officer Ranks (PBORs)/Missing/Disabled/ Killed in Action without the cap of Rs. 10,000 per month.

Ministry of Defence had persuaded the Finance Ministry twice in this regard, which is agreed upon by the latter.

The above educational concession will be admissible only for undertaking studies in a government/government aided schools/educational institutes, Military/Sainik Schools and other schools or colleges recognised by the Central or State Governments including the autonomous organisations financed entirely by the Central/State Governments.

The undersigned is directed to say that this division has been receiving proposals from Line Dtes and Defence Federations to grant 10 days Casual Leave to the Defence Civilian employees in such Defence units wherever the entitlement is less than 17 days Gazetted holidays.

2. In this connection, para 9 of the Appendix-III of the CCS(Leave) Rules, 1972 is reiterated as under: –

“Entitlement (per calendar year) – 8 days – For those entitled to 17 holidays 10 days – For those not entitled to 17 holidays.”

3. All concerned are therefore requested to ensure that the entitlement of Casual Leave to the Civilian employees in the Defence Establishments under MoD who are covered under CCS(Leave) Rules, 1972, is adhered strictly as per Para 9 of the Appendix-III of these Rules.

Compulsory Military Service to Govt Servants – Matter is with DOPT

The Parliamentary Standing Committee on Defence has recommended five years Compulsory Military Service to Government Servants to be made mandatory and it was informed that the matter is now with DOPT

The Standing Committee on Defence, headed by Maj Gen B C Khanduri, AVSM (Retd) has submitted its 40th Report on ‘Demands for Grants (2018-19)’ to the Central Government this month.
The Committee, taking into the account of acute shortage of manpower in Officers Rank in Armed forces, has recommended five Years Compulsory Military Service should be Made mandatory for Government Officers on their initial appointment to address this issue. When the Committee asked the Ministry of Defence about the status of this recommendation, the Ministry has said that the matter has been taken up with DOPT and response of the Department is awaited

The Committee has taken serious view over the functioning of Bureaucrats in respect of addressing the issue of Shortage of Manpower in Armed Forces. The standing Committee is not satisfied with the Ministry’s reply and made the following observations and recommendations in the Report.
The observation and Recommendation of the Committee as follows …

Shortage of manpower in the forces ” From the data furnished by the Ministry, the Committee note that there is a shortage of 7679 Officers and 20,185 JCOs/ORs in Army, 1434 Officers and 14,730 Sailors in Navy, 146 Officers and 15,357 Airmen in Air Force”

While examining the Demands for Grants 2017-18, the Committee pondered on this issue and recommended for providing five years of compulsory military service to such aspirants wanting to directly join Central and State Government Gazetted services. The Ministry, in its Action Taken Reply on the matter has stated that the recommendation regarding providing five years compulsory military service to such aspirants wanting to directly join Central and State Government services, with a view to overcome shortage of officers in Armed Forces, has been taken up with Department of Personnel and Training (DoP&T). The response of the Department is awaited.

Apparently, the Ministry of Defence has not taken up the matter with due seriousness with the DOP&T. The Committee, while recommending five years of compulsory military service to such aspirants wanting to directly join Central and State Government Gazetted services, have taken into account the fact that there is a perennial and alarming shortage of Officers and PBOR in the Armed Forces, which needs to be corrected. The Committee, once again express their desire that the issue of shortage of officers needs to be given priority for being addressed.”

In the same report the Committee fired the Ministry of Defence on another issue with the following comments

“ The Committee found the reply as bureaucratic in nature and not conveying anything about specific actions taken or proposed”

So it appears that the Standing Committee on Defence is very serious in addressing the issue of Shortage of Manpower in Armed Forces by enforcing Five Years Compulsory Military Service to such aspirants wanting to directly join Central and State Government Gazetted services .

As the matter is now with DOPT, it is believed that the Central Government may accepts this recommendation though it had earlier rejected the Proposals submitted in Parliament for implementation of Compulsory Military Training for Youths and Citizens.

Central Trade Unions decides to observe All India Protest Day on 15th March 2018

The meeting of the Central Trade Unions held on 22nd February 2018 at INTUC Office New Delhi expressed indignation and strongly condemned the Government of the day for their intensified attack on the lives and livelihood of the people and seriously compromising the national interest.

Attack on working class centering around dismantling labour laws designed to completely casualise employment conditions through various routes like amending Contract Labour Act, introducing Fixed Term Employment etc has assumed aggressive height. Further it is noted that the Government is out to erase the public sector from the industrial map of the country. Specific cases of attack on privatization of railways, opening coal mining to private and foreign companies without any restriction whatsoever, mass scale privatization as well as destruction of defence production network through widespread outsourcing, thereby dismantling the almost half of the ordinance factories are some of the examples of the gross anti-people and anti-national actions of the Govt. Accumulation of huge non-performing assets of the public sector banks arising out of pilferage of bank-funds by deliberately defaulting private corporate coupled with recent explosion of frauds with bank fund engineered by the same corporate class is also a reflection of the anti-national act of the Govt indulging and patronizing the same big-business class.

The Central Trade Unions reiterated their utter condemnation against the Union Budget 2018-19 which is basically anti-worker and anti-people in character and engineered a deception on the mass of the people through loud populist slogans without actually making any resource allocation.

The Central Trade Unions denounced the Govt of India’s surreptitious move in postponing the 47th session of Indian Labour Conference, thereby reducing tripartism to a mockery.

CTUOs noted with satisfaction the surging struggles by the working people in different sectors throughout the country, both organised and unorganized.

The workers and federations of coal and transport have been preparing for united industrywide actions to be undertaken shortly. All the Federations of Defence Production workers have jointly decided to go in for nationwide strike on 15th March 2018. Many more sectoral actions are in the offing.

The CTUOs while reiterating their resolve to intensify preparation for indefinite strike in the days to come, calls upon all their constituents and working people in general irrespective of affiliations to jointly observe

 In solidarity with the striking Defence Production workers against anti-national privatization move · Against the Anti-people Deceptive Union Budget 2018-19.

Sub: Scheme for compassionate appointment – Relative merit points and revised procedure for selection.

The undersigned is directed to say that the Department of Personnel & Training under the Ministry of Personnel, Public Grievances and Pensions is the nodal department for Government of India’s Scheme for compassionate Appoinment. While considering requests for compassionate appointment, a balanced and objective assessment of financial condition of the families of the applicants has to be made taking into account the assets and liabilities and other relevant factors. The main object of the Scheme is to alleviate the family of the deceased government servant/member of the Armed Forces from indigence and help it get over the emergency. Accordingly, vide Ministry of Defence I.D. No.271/93/D(Lab) dated 2.11.93, Ministry of Defence had developed a 100-point weightage system containing various parameters/attributes to decide the most deserving cases amongst the large number of Defence ID No. 19(4)/824-99/1998-D(Lab) dated 9.3.2001. Consequent upon implementation of the 6th CPC Report, parameters of all these attributes were further revised in 2010 vide MoD note No. 19(3)/2009/D(Lab) dated 22.1.2010 and 14.5.2010. Presently, the attributes on 100-points scale are – Quantum of Family Pension (20 Points); Terminal Benefits (10 points); Monthly income of family from other sources (05 points); Movable/immovable property held by the family (10 points); No. of dependents (15 points), No. of unmarried daughters (15 points); No. of minor children (15 points) and Left over service (10 points). As per the parctice, compassionate appointment is given to the highest score earner.

2. Now, consequent upon implementation of the 7th CPC pay structure, the finacial parameters are required to be revised again. Certain organisations/ formations under Ministry of Defence have been requesting for revision of relative merit points and procedure for selecting the most indigent applicant(s) for compassionate appointment after death/medically boarding-out of the Government servant/member of the Armed Forces on whose income the family was wholly dependent.

3. As per 7th CPC structure, the minimum pension stands revised from Rs.3,500 p.m. (as per 6th CPC) to Rs.9,000 p.m. which approximately comes out to be 2.57 times the old pension. The Govt. of India have also approved this factor of 2.57 for working out revised pay, based on which DCRG, Family Pension and Leave encashment are calculate. Accordingly, the monetary parameters/attributes such as Family Pension, Terminal Benefits, Monthly income of earning member(s) and income from property and lates market value of the Movable/Immovable property have been revised by the multiplying the fitment factor of 2.57 or so, for arriving at the present-day weightage points. However, other non-monetary parameters/attributes viz. No. of Dependents, No. of Unmarried Daughter, No. of Minor Children and Leftover Service have been kept unchanged.

4. Accordingly, with the approval of the competent authority, various parameters on the 100-points scale of weightage system stand revised as under with immediate effect:-

(a) Basic Family Pension / Monthly Amount received under National Pension System
(20 points)

(d) Movable/immovable property of the family (Latest Market Value including Fixed Deposit/Bank balance etc. but excluding the lump sum amount received as mentioned in (b) above
(10 points)

5. the revised guidelines will take place with immediate effect. However, cases already considered by the Boards of Officers constituted for considering requests for compassionate appointment as per the previous guidelines need not be re-opened.

6. However, for considering belated requests for compassionate appointment where the death/disablement of Govt. servant/member of Armed Forces took place long ago, weightage points towards ‘Terminal Benefits’ may be awarded in the following manner:-

(a) For cases where death of the deceased Govt. servant occured prior to 9.3.2001, parameters of ‘Terminal Benefits’ given in MoD ID note dated 2.11.1993 will be applicable:

(b) For cases where death of the deceased Govt, servant occurred on or after 9.3.2001 till 21.1.2010, parameters of ‘Terminal Benefits’ given in Mod ID note dated 9.3.2001 will be applicable: and
(c) For cases where death of the deceased Govt. servant occurred on or after 22.1.2010 till 31.12.2015, parameters of ‘Terminal Benefits’ given in MoD ID note dated 22.1.2010 will be applicable.

7. All the concerned are advised to strictly follow these weightage points and guidelines keeping in view the instruction issued by the DoP&T/MoD, from time to time for assessing comparative merit of the applicants for compassionate appointment.

Pay fixation benefit equal to one increment under FR 22(I)a(i) to the MCM (GP 4200) on promotion to the post of CM (GP 4200) and upgradation under MACP Scheme

Please find enclosed a copy of MOD ID No.50 (71)/2ol7-D(Estt/NG) dated 14/11/2017 regarding granting of benefit equal to one increment to the MCMs on their promotion to the post of CM. The letter is self explanatory.

In case the ibid benefit was withheld, in any of your Branch Accounts Offices, due to want of clear directives from this HQrs office in this regard, the same may be expeditiously regulated now accordingly.

Subject: Non implementation of the MOD ID No. 11(5)/2009-D(Civ-I)(PC-II) dated 06.07.2016 regarding pay fixation benefit in case of promotion from Master Craftsman to Chargeman(T).

Refer MoD ID No. 11(5)/2009-D(Civ-I)(PC-II) dated 24.08.2017 addressed to this section on the above mentioned subject, copy endorsed to OFB.

2. D(Civ-I)/MoD has forwarded OFB ID No. Per/I/Ol/CR/658/2017 dated 19.07.2017 and AIANGOS L/No.AlANGOs/CEHQ/FGK/17 dated 06.07.2017 and 09.08.2017 on the subject wherein it has been informed that PCA(FyS) Vide their UO. Note dated 09.06.2017, have not agreed to grant the benefit of pay fixation benefit in case of promotion from Master Craftsman to Chargeman(T) as communicated by D(Civ-I)/MoD dated 06.07.2016, till finalization of the revised SRO of MCM and Chargeman(Tech). CGDA, Delhi Cantt to whom the matter was referred by PCA(Fys) for a possible resolution has also confirmed that in the absence of revised Recruitment Rules, promotions to or from grades which were not present earlier, may not be considered as authorised under rules.

3. From the order dated 06.07.2016, it is learnt that the incumbents of the post of MCM (carrying Grade Pay Rs. 4200/-) on their promotion to the post of Chargeman (Grade Pay Rs. 4200/-) as per instructions on the MACP Scheme, are entitled to the pay fixation benefits at the time of grant of financial benefit under the MACP Scheme. This is more so in view of the fact that the provisions of the FR 22(l)(a)(1) are invoked in case of non-functional up-gradations wherein the individual remain in the same post but are granted the next higher grade pay in the promotional hierarchy. In this context, D(Civ-l) has informed that the order issued by MoD vide ID No. 11(5)/2009-D(Civ-I)(PC-II) dated 06.07.2016 related to the subject was issued after due consultation with DoP&T and Ministry of Finance.

4. In view of the above, OFB is requested to convey the above mentioned clarification to the PCA(Fys) so that it may allow the benefit equal to one increment as available on pay fixation under FR 22(i)(a)(1) to the MCM on their promotion to the post of Chargeman/Upgradation under the MACP Scheme.

5. Regarding advice related to amendment of the RRs of the posts of MCM and Chargeman, it is intimated that it is in the process in terms of restructuring order No. 11(5)/2009-D(Civ-I) dated 14.06.2010 wherein MCM Grade Pay was made equal to that of Chargeman.

6. The views of DoP&T and Ministry of Finance on the D(Civ-I)/MOD order dated 06.07.2016 have been arranged and the same are enclosed for better understanding of the case by the PCA(Fys).
