Mutual Transfer Involving Employees Working in Two Different Grades

Mutual Transfer involving employees working in two different grades
“Mutual Transfers may also be permitted between staff in two different grades but only in the recruitment grade of the cadre and not in intermediate grades.”
GOVERNMENT OF INDIA
 MINISTRY OF RAILWAYS
 (RAILWAY BOARD)
No.E(NG)I-2018/TR/8
New Delhi, Dated: 26.10.2018
The General Manager (P),
All Indian Railways/PUs,
New Delhi.

Sub:- Mutual Transfer involving employees working in two different grades.

In terms of para 310 of IREM Vol. I 1989 Edition, Railway Servants can seek mutual transfer in the corresponding cadre of two Divisions/Offices/Railways and retain the seniority of the junior employees in their respective new units. The procedure for mutual transfer have recently been further simplified vide:-

(i) Board’s letter No. E(NG)I-2017/TR/24 dated 22.09.2017 (RBE No. 131/2017) which delegates powers to Divisional Railway Managers in respect of mutual transfer, and

(ii) Board’s letter No. E(NG)I-2017/TR/19 dated 06.07.2018 (RBE No. 99/2018) which enabled employees working in Level-I (GP Rs. 1800) belonging to any department/cadre to go on Mutual Exchange basis transfer with another employee working in Level-I (GP Rs. 1800) irrespective of cadre.

2. With a view to further enable employees to seek Mutual Exchange Transfer and in view of clarifications sought by some Zonal Railways in this regard and the demand of both and Federation e.g. NFIR and AIRF, Board have considered the matter. It has been decided that Mutual Transfers may also be permitted between staff in two different grades but only in the recruitment grade of the cadre and not in intermediate grades.

3. Both the employees seeking mutual exchange shall have to give a written undertaking accepting reversion unconditionally and willingly in their own interest to the recruitment grade and bottom seniority in their respective new Unit in order to avoid future litigation. The expression mentioned in preceding lines, should necessarily be incorporated in the application submitted by the employee concerned. The “Note” below para 2(b)(iii) of Board’s letter No. E(NG)I-2017/TR/24 dated 22.09.2017 as mentioned in para 1 above stands deleted.

4. Other terms and conditions for mutual exchange including community restrictions contained in Board’s letter No. E(NG)I-2004/TR/16 dated 14.08.2017 and 22.10.2007 remain.

Please acknowledge receipt.

Grant of regular absorption of staff working in Quasi Administrative Offices

Joint letter by both Federeations addressed to Chairman Railway Board on “Non-redressal of issued discussed by the Federations – Grant of regular absorption of staff working in Quasi Administrative Offices/Units in the erstwhile Group ‘D’posts”

NFIR
National Federation of Indian Railwaymen
3, Chelmsford Road, New Delhi – 110055
Affiliated to: Indian National Trade Union Congress (INTUC)
International Transport Workers’Federation (ITF)
No.II/IB/2018
Dated: 24/09/2018
The Chairman,
Railway Board,
New Delhi

Dear Sir,
Sub: Non-redressal of issues discussed by the Federations – Grant of regular absorption of staff working in Quasi Administrative Offices/Units in the erstwhile Group ‘D’posts – reg.

Ref: Federations Joint letters No.II/IB dated 09/05/2016 & I5/05/2017 to CRB.

Federations have repeatedly been inviting kind attention of the Railway Board at all levels including at the level of Hon’ble MR, CRB to the DC/JCM item No.27/2006, urging decision for absorption of staff working in the Quasi Administrative Office/Units against erstwhile Group ‘D’ vacancies since long.

The subject was also discussed by NFIR and AIRF in full Board meetings held on 07/02/2014, 01/10/2015 and 04/02/2016. Federations are deeply disappointed that though years passed, the issue is still pending unresolved. The Federations Joint communications to the Railway Board Chairman vide letters dated 09/05/2016 and 15/05/2017 have unfortunately not yielded positive result.

The Federations have re-iterated through joint letter dated 09/05/201, the justification for restoration of the earlier policy formulated in the year 1973 & 1977 to facilitate regular absorption of staff working in Quasi Administrative Offices/Units. The Federations had sent another letter dated 15/05/2017 requesting to arrange a meeting at the level of Hon’ble MR and CRB, unfortunately no meeting has been convened as yet. Federations desire to state that 12 valid points were conveyed to the Railway Board on the legal opinion tendered by the Learned ASG relating in this particular case, but however there has been no positive response yet. Federations once again enclose a copy of 12 points for consideration at the level of Railway Ministry which we feel are sufficient to keep the policy alive. The subject was also highlighted by the Federations during. Standing Committee Meetings held between the Federations and the Railway Board (MS, DG/P etc.) on 7th Feb, 2018, 4th April, 2018 without any positive result which is unfortunate

The Federations also reiterate that the decision of Railway Board vide dated 10/06/1997 was arbitrary as the same was issued without consultations with us which amounts to breach of agreement reached with the Federations during previous periods.

We therefore requests the CRB again to kindly intervene and see that a meeting takes place at your level early to settle this long pending issue besides other issues where agreements have been reached but not implemented so far. Alternatively we suggest a special meeting with Hon’ble Railway Minister early.
Yours faithfully

Pharmacist Day – NFIR

Pharmacist Day – NFIR

NFIR’s Hearty greetings and congratulations to the Pharmacists of India and Indian Railways:

Today – 25th September, 2018 being the Pharmacist Day World Over, NFIR feels privileged to convey hearty greetings and good wishes to the Pharmacist community as a whole in general and Indian Railways pharmacists in particular.
Pharmacists have been playing crucial role for providing qualitative Health Care to patients, despite facing all odds and difficulties. Sadly the Indian Railways pharmacists in particular and Pharmacists if Central Government in general are not taken care of adequately by the Government although their entry qualification (associated with training) warrants allotment of higher pay structure. The Railway Pharmacists are aware that NFIR has been fighting for the cause of this category and various issues of Pharmacists have been taken up at the level of Railway Ministry, Departmental Anomaly Committee and National Anomaly Committee.

The MACPS aberration causing deprival of financial upgradation to this category has also been taken up by NFIR
While extending NFIR’s total support to the Pharmacists, the Federation hopes that the Pharmacists would continue their yeomen service with determination and devotion for providing qualitative service to all those who need. NFIR wishes happy days to Railway pharmacists and their family members.

The Chairman,
Railway Board,
New Delhi

Dear Sir,

Sub: Incidents of violent attacks on Railway employees in the course of performing their duties-reg.

Of late, it is noticed that the Railway employees are becoming targets of physical attacks by the unruly people/antisocial elements. In this connection, NFIR cites the case of recent physical attack on Travelling Ticket Examiner of S.C. Railway (Secunderabad Division) by a group of people who are habituated of travelling unauthorizedly and threatening on duty staff. It has further been reported that three persons have attacked the Gate Keeper (Track Maintainer) at Level Crossing Gate on Northern Railway and chopped off his left arm on 17th September, 2018. Similar attacks on staff were also reported from different places and no adequate action has been taken by the concerned Law & Order Authorities to deter the miscreants.

Also read: Latest NFIR Letters to Railway Board

The Railway Staff who perform duties in the field and at remote places are developing constant fear of criminal attacks on them by the miscreants. In order to maintain the morale of staff, it would be necessary to urge upon the concerned high level authorities who are accountable for maintaining Law & Order situation to take effective measures. So far as Level Crossing Gates are concerned, provision of CCTV cameras may be considered seriously to facilitate detecting the culprits for further action.

NFIR, therefore, requests the Railway Board to kindly see that concrete steps are taken to protect the Railway Staff working in the field and in the remote sections of the Railway system. Federation may please be kept advised of action being taken by the Railway Board early.

Yours faithfully

Filling up of vacancies on the Railways

Filling up of vacancies on the Railways

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)
RBE No.119/2018
No. E(NG)II / 2018/RR-1/22
New Delhi, dated 20/08/2018
The General Manager(p),
All Zonal Railways/ Production Units,
(As per standard mailing list).

Sub: Filling up of vacancies on the Railways.

Attention is invited to instructions contained in Board’s letter No.E(NG)II/2007/RR-1/10/Pt.(110865) dated 25/06/2014 specifying the carious factors which must be taken into account while computing vacancies for placing indents. It was inter alia mentioned therin that staff likely to go on transfer to other Railways/Divisions in a particular calendar year must also be accounted for in the pool of vacancies while placing indents with the Recruiting Agencies.
It has been observed that large number of applications for Inter Railway transfers are pending on Railways. Such transferred have a direct bearing on railway working, especially in terms of manpower because of huge gap between outflow and inflow of staff.
It is, therefore, reiterated that while placing indents for fresh recruitment notifications in future the computation done duly of vacancies must be done duly taking.into account all the pending requests of Inter-Railway transfers. For this purpose, requests forwarded to the recipient Railway/Division as on the cut off date of assessment of vacancies should be regarded as pending requests. DR Quota in GP 4600 should be Eliminated Totally – NFIR

DR Quota in GP 4600 should be Eliminated Totally – NFIR

The DR quota in GP 4600/- should be eliminated totally and to be filled only by promotion

No.II/1/2018
Dated: 21.8.2018
The Secretary (E),
Railway Board,
 New Delhi
Dear Sir, Sub: Promotional prospects of the staff particularly working in Grade Pay Rs.1800/-and Rs.4600/- Ref’: (i)Railway Board’s letter No.E(NG)l/2018/PM l/14 dated 13/07/2018 (ii)NFIR’s letter No.ll/l/2018 dated 19/07/2018 (iii)Railway Board’s letrer No.E(NG)-I/2018/PM 1/14 dated 13/08/2018 & l7/08/2018
Kind attention is invited to the references cited above with regard to the subject relating to promotional prospects of staff particularly working in GP 1800/- and 4600/-.
In the above context, NFIR suggests the following for consideration :-
a) The technology inducted in the various categories necessitates improvement in the entry qualification of Technician itself. The Technical staff have conveyed to the Federation that Technician cadre needs to be restructured duly revising the qualification upwardly and for JE’s posts, the entry qualification needs to be revised to BE/B.Tech.
b) The DR quota in GP 4600/- should be eliminated totally and to be filled only by promotion.

c) While the Railway Board had enhanced the entry level qualification for recruitment through all modes in GP 1800/- Pay Level (RBE No.73/2017) in technical departments, the entry level qualification for Technician has not been revised. For improving the efficiency levels, this aspects needs to be addressed.
d) As highly qualified staff have joined against safety and other than safety category posts, frustration is growing among them due to no career growth for them. In this connection Federation cites the case of a Senior Technicians on a Zonal Railway who possess MBA/PGD (HRM) qualification but they are not able to become JE/SSE as their qualification is not matching with the requirement. They are also not made eligible to appear for GDCE due to restrictions laid down by the Board. In order to meet the genuine aspirations of these qualified staff on Zonal Railways, the GDCE needs to be improved as below :-

Entitlement from safety to safety,
From Safety to non-safety, from non-safety to non-safety and from non-safety to safety (for all GDCEs).
The above points may be not examined so that when meeting is fixed all issued can be discussed in detail for improving railway systems as well career of staff.
Yours faithfully,

Revival of Indefinite Strike – AIRF & NFIR Yet to Take a Decision!

Revival of Indefinite Strike – AIRF & NFIR yet to take a decision
Railway Federations (AIRF & NFIR) are yet to take a decision regarding revival of indefinite strike

NJCA MEETING – 18-08-2018

CONFEDERATION, NFPE AND AIDEF INSISTED REVIVAL OF INDEFINITE STRIKE — AUTHORIZED NJCA CHAIRMAN AND CONVENER (RAILWAY FEDERATIONS – AIRF & NFIR) TO TAKE FINAL DECISION REGARDING INDEFINITE STRIKE .

NJCA meeting was held on 18-08-2018. Government has ignored the ultimatum given by NJCA and has not given any cognizance to NJCA’s Resolution adopted on 03-07-2018 and the letter dated 03-07-2018 addressed to Cabinet Secretary.
Government has betrayed NJCA and entire Central Government employees and Pensioners. Therefore, the Representatives of Confederation, NFPE and AIDEF insisted to revive the indefinite strike and start preparations for the strike immediately, as all employees are eagerly waiting for such a decision from NJCA.
Railway Federations (AIRF & NFIR) are yet to take a decision regarding revival of indefinite strike. After discussion it was decided to authorize the Chairman & Convener of NJCA (Railway Federations – AIRF & NFIR) to take final decision and convey the same to Government and also to all constituent organizations of NJCA.
As NJCA could not take any final decision regarding strike, Confederation shall go ahead with its decision to organize one day nationwide strike on 15th November 2018. In the mean time all Central Trade Unions (other than BMS) and independent Federations (including Confederation) are holding a National Convention at New Delhi on 28th September 2018. If any decision for strike is taken in that convention, the date of the Confederation’s strike will be changed to synchronize with the date(s) of the Central Trade Unions and independent Federations, as already decided in the June 10th Hyderabad National Convention.

(ii) NFIR’s letter No. IV/RSAC/Conf./Part IX dated 12/01/2018 & 07/02/2018 to Secretary, Railway Board, copy endorsed to EDPC-I and ED (IR), Railway Board. (iii) NFIR’s letter No. IV/RSAC/Conf./Part. IX dated 16/04/2018 addressed to CRB & copy enclosed to MS, FC, DG(P) etc.

During discussions on some important staff issues on 06th June, 2018 and thereafter, you have assured that the Railway Board would revise the kilometrage rates and other Allowances of Running Staff satisfactorily very soon, taking into account the NFIR’s proposal seeking revision at Rs. 648.

In this connection, I request you to kindly appreciate that the abnormal delay in obtaining the concurrence of Ministry of Finance for revision of kilometrage allowance rates has been causing disappointment among Running Staff. I further bring to your kind notice that while revision of various Allowances has already been granted from 1st July, 2017, this particular case of revision of kilometrage rates for Running Staff is continued to remain pending even after lapse of one year.

I therefore, request you to kindly intervene to see that concurrence of Ministry of Finance is obtained at the earliest for revising the kilometrage rates of Running Staff with retrospective effect. A line in reply is solicited.
Yours faithfully,
(Dr. M. Raghavaiah)

Pay Matrix Level 8 to JE – NFIR

Pay Matrix Level 8 to JE/CMA/DMS/JE(IT) in Railways Grave injustice done by successive Pay Commission to the category of Junior Engineers and Senior Engineers in Railways

No. IV/NFIR/ 7 CPC (Imp)/2017/R.B. Part II
Dated: 23/07/2018
Shri Piyush Goyal,
Hon’ble Minister of Railways,
Rail Mantralaya,
New Delhi.

Dear Shri Goyal Sahib,

Sub: Grave injustice done by successive Pay Commission to the category of Junior Engineers and Senior Engineers in Railways-growing dissatisfaction, discontentment and frustration among Technical Supervisors – kind intervention requested.

Ref: (i) Hon’ble MR’s D.O. letter No. PC-VII/2015/R-U/9 dated 20/04/2017 to Hon’ble Finance Minister. (ii) NFIR’s letter No. IV/NFIR/7 CPC (Imp) /2017/R.B.- Part II dated 19/02/2018 to CRB and copy endorsed to MS. MF, FC, DG(P) etc. (iii) NFIR’s PNM File No. 03/2018 and 10/2018.

NFIR has been pursuing the case of Graduate Engineers/Diploma Engineers and Supervisory Officials working in different Departments since several years at the level of Railway Ministry for rectifying the imbalances in their pay structure to ensure justice to these Supervisory Officials who have been let down not only by the previous Pay Commissions but also by the Railway Board.

Pursuant to NFIR’s follow up action through PNM fora (Agenda Item No. 03/2018 & 10/2018), the Railway Board through Action Taken Statement dated 10th May, 2018 has conveyed that the proposal regarding upgradation of 75% of Senior Supervisors from Level 7 (erstwhile GP 4600) to Level-8 (erstwhile GP 4800), to bring parity has already been sent to the Ministry of Finance and Hon’ble MR has also sent D.O. letter dated 20th April, 2017 to the Hon’ble Finance Minister seeking approval. The Railway Board has also informed the Federation that a meeting also been held with the Officials of Finance Ministry on 21st February, 2018 and action on hand for obtaining clearance.
NFIR brings to the kind notice of the Hon’ble MR that despite D.O letter of Hon’ble MR vide letter dated 20th April, 2017and discussions held by the Railway Ministry with Ministry of Finance on 21/02/2018, approval of Ministry of Finance has not yet been received. Hon’ble MR may kindly appreciate that in this case the Railway Ministry conceded that grave injustice has been meted out to Graduate Engineers, Diploma Engineers and Supervisory Officials in the Railway resultantly approached the Ministry of Finance to approve for upgradation of 75% posts of erstwhile GP 4600/Level-7 to erstwhile GP 4800/Pay Level-8.

Hon’ble MR may kindly appreciate that on this issue, there was an agreement between the full Board and the Federations for total replacement of GP 4600 (6th CPC)/Pay Level-7 of 7th CPC with GP 4800 (6th CPC)/Pay Level-8 of 7th CPC but sadly, the agreement has not been implemented till date.
NFIR, therefore seeks your kind intervention for the purpose of obtaining approval of the Ministry of Finance for upgradation of posts to GP 4800/- (Pay Level-8) without further delay.
With regards,
Yours sincerely,
 sd/-
