REVISION OF GRADE PAY OF LDC To RS. 2400/- AND THAT OF UDC TO RS. 2800/- REQUEST FOR YOUR PERSONAL INTERVENTION FOR TAKEN UP A CASE TO MINISTRY OF FINANCE

Dear Sir,

1. With due respect and humble submission, I the undersigned state the following few lines for your kind consideration and favourable action pl.

2. I am defence civ employee working under Ministry of defence and presently posted in modified field area. I written this letter to you for inform of the pathetic conditions of LDC & UDC working in the defence est. The following grievances in r/o LDC/UDC regarding Pay & allces is as under:

(a) Sixth Pay Commission has denied an appropriate pay structure to the LDC 8. UDC of Government of India Offices in the light of raising the academic and technical qualification and responsibilities assigned. The officials in these cadres are initiating the official work and made responsible for smooth functioning of the offices, have been granted a simple replacement grade pays. In fact the Grade Pay granted to the post of LDC is only Rs.1900 which is just Rs.1oO more than the grade pay of MTS, i.e. Rs.1800/-. In the mean time the academic & technical qualifications to get selected to the post of LDC have been raised. On the other hand. the Pay Commission has recommended the merger of various group D posts and upgraded their grade pay from Rs. 1400 to Rs.1800 and also given them additional benefit of 3 MACPs to the merged posts. Moreover, all the pre-revised pay scales above UDC from Accountant to Assistant Administrative Officer- have been merged and granted Rs. 4200 - 4600 grade pay.

(b) As per the Staff Selection Commission notification Lower Division Clerks are entrusted with routine nature of work, for example registration of Dak, maintenance of section diary, file register, file movement register, indexing and recording of files. typing, comparing. dispatch, preparation of arrears and other statements etc. Whereas in practice most of the Non CSCS office (where total staff strength is not more than 100) has been allocated with average one Administrative Officer. 1-2 Assistants. two UDC and 3 to 4 LDC and in a normal Non CSCS office. it has 5-6 mayor sections which could only be allocated to UDC & above as per the DoPT guide lines, viz. Accounts Section (where, various payments are processed and released. Income Tax, Budget, NPS, monthly Expenditure Statement, reconciliation are done), (ii) Store & purchase Section. Establishment Section (where service records, leave and other personal matters are processed), Bill Section, where various kind Bills have been scrutinized for passing etc. RTl, Court Cases, handling of Audit Para etc. Since the number of UDCs sanctioned is much lesser than the actual requirement, LDCs are posted in the major section. Thus in contrary to the nature of duties of LDC as given in the DoPT manual as well as the Staff Selection notification the quality and quantity of work done by the LDC & UDCs are much higher in these offices. The officers are only taking decision on the file put up by the LDCs/UDC on all the matters.

(c) In accordance with the recommendation of 6th Pay Commission, Government India has raised the academic qualification from Matriculation to 12th class pass or equivalent and technical qualification of typing from manual typewriter to sophisticated computer or getting selected to the post of LDC through Staff Selection Commission. It is to be noted that typing on computer is far different from the typing on typewriter because for typing on computer one should have the knowledge of the operation of computer for which onerequired to undergo a computer diploma programme. The academic qualifications required for both LDC & DEO are the same i.e. 12th class pass or equivalent. As regards the technical qualification the candidate appearing for the post of LDC requires 10500 KDPH/9000 KDPH English and Hindi typing respectively on computer whereas the candidate appearing the DEC requires 8,000 KDPH on Computer. But the grade pay granted/fixed for the post of LDC is 1900 and the same for DEO is 2400. Moreover, the DEO has only to entry the readymade data given to them whereas the LDCs have to create data/draft letters and then to type on computer, putting up the matter through file note with justification with the support of rules and procedure. Thus LDC does more work in qualitatively and quantitative terms with less grade pay than that of the DEO.

(d) Even though the raising of academic qualification of MTS from 8th Standard to Matriculation, duties prescribed for the earlier Group D and the present MTS are the same. Whereas the academic & technical qualification of the LDC have been upgraded and assigned heavy responsibilities on them by the office concerned. Majority of the persons selected for the post are graduates and even post graduates and qualified to handle any kind of assignment. The job profile of the post has undergone significant changes after introduction of modernization in Government offices. Now, computers have taken the place of typewriters.

During the 5th Pay Commission, pay scale 8-1 to S-4 were granted to the group D posts and pay scale S-5.was granted to LDC i.e. one step above than the pay scale of the Group D posts which never crossed over the pay scale of LDC. In the 6th Pay Commission the pay band of MTS (formerly group D), LDC & UDC are same and Grade pay of LDC is 1900/- and that of MTS through MACP is 2400/.

(e) Rajasthan government had set up Shri Govind Sharma committee to study the upgradation of the grade pay of LDC & UDC. Following a very positive recommendation from the Committee the Rajasthan Government has raised the grade pay of LDC and UDC from the Rs. 1900 & 2400 to 2400 and 2,800 respectively. Also the names of posts ëLower Division Clerkí and ëUpper Division Clerkí have been changed as ëClerk grade-IIí and ëClerk grade-Ië respectively. Similarly, the Punjab. Himachal Pradesh and Haryana Government have reportedly upgraded the grade pay of LDC & UDC

(f) Ministry of Defence Offices especially the subordinate offices are functioning smoothly virtually due to the fact that LDCs & UDCs are shouldering heavy responsibilities. But the Pay Commission has not considered equal pay for the work done by them. This has been a demoralizing effect on the already desperate young and talented cadre in the Government offices. From the above it is evident that the upgradation of the grade pay of LDC & UDCs is a genuine issue. We, therefore, justifiably request you to put a case for revision of Grade Pay of LDC to Rs. 2400/ and that of UDC to Rs. 2800/. It is to be noted that cases of several cadres in the Administrative branch were considered and favorable decision was taken by the 6th CPC but the case of LDC & UDC were left out. The LDC and the UDC also deserve higher grade pays than the present one, to commensurate with the qualifications and assignments attached to these posts after the implementation of the recommendations of the 6th Pay Commission.

(g) We are poor LDC and UDC. Nobody has time to understand us. Everybody tries to have best of comforts, income and all other facilities to the higher class of employees. The lower levels of employees are doing hard works. Among them there will be graduates and postgraduates along with'few numbers of SSLC or Plus Two or pre-degree qualified. But whatever may be the qualification of the higher class, whether SSLC or PDC or Plus Two. there is no problem. Everybody will get enough. But in the case of LDC and UDC they have to suffer a lot of financial burden. Try to make awareness among the high powered DOPT about our problems.

(h) The GOIís stepmother treatment towards the Clerical Staff working in the Sub-ordinate Offices must be stopped. There should be parity between the CSCS & the Clerical Staff working in the Sub-ordinate Offices of the Ministry. We have seenthat the Govt. has wisely protected the CSCS by implementing NFSG Scheme & Cadre Restructure after the Vlth CPC. But the same procedure has not been extended to Sub-ordinate services.

2. In view of the above, I seek your kind personal intervention for getting a favorable decision to revise the GP at Rs. 2400/ and 2800/ respectively to LDC & UDC.

Thanking you,

Yours Sincerely

Sd/-

LDC/UDC ISSUE: Going through the comments of the viewers!

LDC/UDC ISSUE: Going through the comments of the viewers!

Dear friends,

More than two dozen comments have been posted on the JCM Staff Side memorandum, recommending upgradation of Grade Pay of LDC, published in this web site. Most of the LDCs working in various Departments, posted comments are stated that they are doing duties of higher posts with Rs. 1900 Grade pay. A person who is working in the KVS has written that in his Organization LDCs are doing duties of UDC and LDC both because in maximum offices single LDCs are posted and they are compelled to complete the work by sitting extra time. (Our opinion is that the Staff Associations of the KVS should demand for increased sanction of Administrative Staff in accordance with the work load and also for an immediate cadre restructuring for the Administrative Staff. According to the recommendations of the Central Pay Commissions cadre restructuring should be done in every five years).

It is no doubt that LDC & UDC are the backbone of the Government Offices especially the subordinate offices and they should get a respectable pay scale. Since the 6th Pay Commission has raised the Educational and technical qualification for the post it has become an anomaly and that is why this Association has taken up the issue to the higher authorities and as such the issue gained popularity. Resultantly, Confederation and JCM Staff Side was forced to recommend upgraded grade pay for LDCs in their Memorandum to the 7th Pay Commission. Moreover, Department of Expenditure was compelled to issue a common circular for upgradation of Grade Pay of LDC & UDC at Department level through restructuring. But the said order was not adequate to meet the demand and as such we have filed a case in CAT Jabalpur.

Some of our friends proposed to take up the issue to the Prime Minister & Finance Minister again. Several of our friends writing comments have proposed to call a strike on the issue of upgradation of the Grade Pay of LDC & UDC. Both are not the demand of the time, I think. As regards to writing letter to Prime Minister, we had already written a letter to the then Prime Minister and same was forwarded to the DoPT and what action has been taken on it by the DoPT, JCA & Ministry of Finance, all are before us. If we sent another letter to the present Prime Minister it will also go through the routs in which our previous letter was travelled. As regards the calling of strike it is only possible when there is a Federation of Ministerial Staff Association representing the entire Ministerial Staff persists and taking a decision unanimously. You all are aware that I had requested all our friends to come to Delhi in support of the Confederation Dharna on 9th January 2014 so that we may put up the issue effectively before the Confederation. But nobody except some leaders of Delhi State Government Administrative Staff Association has come to attend the Dharna. Thus conducting a strike, even a Department level strike, is not as easy as the comment writers think.

Some of our friends have written that large number of posts of LDC & UDCs are lying vacant in their Department and is not filling up the vacancy by the authorities. This should be tackled at their Department level itself. Staff Associations of the respective Department should take initiative for the same.

As regards the case filed by us in the CAT Jabalpur, we have filed the same with an intention to send a message regarding the seriousness of the issue to the Government, 7th Pay Commission and the JCM Staff Side. As a result JCM Staff Side has discussed the matter and accordingly the recommendation for the upgradation of the Grade Pay of LDC has been sent to the Pay Commission. In order to defend the payment of Rs. 2400 Grade Pay to DEO, DoPT has recently issued a revised model recruitment rule for the DEO. And yet, I am sure, 7th Pay Commission will definitely consider the upgradation of Grade Pay of LDC in its report. The case filed in the CAT Jabalpur will go on for a favorable decision so as to get the upgraded Grade Pay to LDC w.e.f. 1.1.2006.

As regards granting of Rs. 4200 Grade Pay to UDCs, all Associations are requested to send the proposal in their memoranda  to the 7th Pay Commission on the ground that UDCs are assigned with the duties of Assistants in most of the subordinate offices as the sanctioned posts of Assistants in these offices is far less than the actual requirement.

Confederation’s Memorandum to 7th CPC:

Confederation has proposed to submit a separate Memorandum to 7th Pay Commission. Even though the LDC & UDC issue, submitted by us have been incorporated in the JCM Staff Side Memorandum, any Association is willing to put up anything new regarding to the upgradation of the LDC/UDC and issues related to other administrative Staff and the cadres of common category including MTS may please send their proposal to the Confederation in the following e-mail id by 14th of this month.

Will the 7th CPC fulfil the demands of LDCs and UDCs?

For a number of years now, especially after the 6th CPC, the problems faced by LDCs and UDCs have started gaining prominence. The unity and sense of purpose among them makes them look all set for the kind of victory that Pharmacists had. Common sense of purpose, unity and dedication sure make success possible!

In order to decrease the number of grades, the 6th Pay Commission combined all the different grades between Grade Pay 1300 to Grade Pay 1800 into a single grade – Grade Pay 1800, thereby wiping out the entire Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those who lacked the minimum education levels, illiterates and everybody else were lumped into Group ‘C’. Their Grade Pay was also raised to Rs. 1800. But, at the same time, employees working as LDCs, who have a minimum educational qualification of Class XII and also possess some technical education, were not given any upgrading. Instead, they now had to share their grade with lesser-qualified former Grade ‘D’ employees.

The next huge trouble originated from the MACP. Those who didn’t get any promotion for years are given career upgradations through MACP. LDCs who didn’t get any promotions for more than 10 years were given their next grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere Rs. 100 turned out to be a huge disappointment to many. Similarly, those with Grade Pay 2400 were hoping for a jump to Grade Pay 4200, but were instead forced to upgrade with only Grade Pay 2800 as per MACP rules. That anger kept seething too, because the different is 1400.

The most important demand of the LDCs and UDCs is to upgrade the current Pay Scale-Grade Pay.

Grades are decided based on the educational qualification of the employees. An LDC possesses a minimum educational qualification of Class XII and also has some technical qualifications. The basic salary of an LDC is just Rs. 1900 + 5830 = Rs. 7730.00. They want it revised to Rs. 2400 + 7510 = Rs. 9910.

The big question is – will the 7th CPC grant this demand?

LDC-UDC Issue : Case Filed for Grade Pay 2400 to LDC

LDC-UDC Issue : Case Filed for Grade Pay 2400 to LDC

CASE FILED

Dear friends,

A case for the upgradation of the grade pay of LDC to Rs. 2400 has been filed before the CAT Jabalpur by this Association. Since UDC is a promotion post of LDC, the grade pay of the UDC would automatically go up. However, this Association is thinking to file a separate case for granting of Rs. 4200/ Grade pay to UDCs. The case of Steno Grade III (Rs. 2400 GP) is similar to UDC and as such a mention of their name has also been made in the table submitted.

Copy of the case filed will be published in this web site in an appropriate time.

With warm greetings

LDC-UDC Grade Pay Issue – Demanding upgradation of the grade pay of LDC & UDC to Rs. 2400 & 2800

DEPARTMENT OF EXPENDITURE DIRECTS THE MINISTRY OF STATISTICS & PROGRAMME IMPLEMENTATION TO SEND PROPOSAL FOR UP-GRADATION OF GRADE PAY OF LDC & UDC TO THEM

Dear members/friends,

Department of Expenditure (DoE) vide OM No. 58(2)/E.III(B)/2014 dated 18th February, 2014(enclosed) has forwarded the letter/documents demanding upgradation of the grade pay of LDC & UDC to Rs. 2400 & 2800 respectively, to the Financial Adviser, Ministry of Statistics & Programme Implementation(MoS&PI) with a direction to examine the representations and forwarding the same to DoE for consideration in the form of a proposal, through IFD. In this respect, this Association has already made it clear that the LDC & UDC issue is a clear anomaly aroused due to the discriminatory recommendation/implementation of the 6th Pay Commission and the same is to be rectified as an anomaly and not as a cadre restructuring. As has already informed you that this Association has decided to file a case in the CAT by 1st week of March for getting implemented the upgradation from the date of implementation of the 6th CPC and the preparation for the same is in full swing. However, since the DoE has directed the MoS&PI in favour of upgradation of Grade Pay of LDC and UDC, a letter demanding implementation of the upgradation from 1.1.2006 is being sent to the Joint Secretary, MoS&PI before filing the case.

Yours Sincerely

LDC-UDC ISSUE: TOWARDS A FINAL ACTION

Dear friends,

It has been informed you through our earlier letters that Confederation had decided to conduct a day long Dharna action at Jantar Mantar Delhi demanding immediate Constitution of 7th Pay Commission, Merger of 50% DA to Basic Pay, Grant of Interim Relief etc. In the mean time we were eager to take up the LDC-UDC issue, which have been raising us for the last two years, in a larger platform and as such representatives of the Union/individual of LDC & UDC in various Departments were requested to come to the Dharna place of the Confederation on 9th January 2014. Prior to this, this Association has published a letter, in response to the comments posted in our web site on the subject, for discussion and finalization of the line of action to be taken to achieve the goal. Being a cadre issue Confederation has not been agreeing to include the LDC-UDC issue in its main charter of demands. But the popularity gained on the issue due to our efforts for quite some time has become a matter of attraction and rethinking by the Confederation also. In such a situation the presence of large number of representative of LDC-UDC in the Dharna would have been beneficial to impress the Confederation to add the demand in the main demands of the Confederation.

But, unfortunately, except the representatives of the Association which have membership of LDC & UDC who attend the Confederation meetings regularly, no new unit/individual has participated in the programme. And yet, the issue of LDC-UDC have been discussed in the Dharna as well as the Extended National Executive Meeting on 10/01/2014 as several speakers including Shri M Krishnan, Secretary General Confederation termed the issue as genuine and pledged to support the fight.

On the issue, Shri M Krishnan has advised me to prepare seriously for filing a case in the Principle CAT immediately. He further said that the Confederation knows genuineness of the demand, but we have to convince the importance of the issue to the Government. Simply adding this item in the Confederation Charter will not work at this later stage (at the stage of the constitution of 7th CPC). Thus, in order to convey the seriousness of the issue to the 7th CPC also, filing a case in the Court is essential as the CPC monitor all pending court cases of grievances in its own importance which ultimately would pave way for a better pay scale for the LDC & UDCs in the 7th CPC.

In view of the above this Association is intending to file a case in the Principle CAT Delhi and two Kolkata based Associations are also interested to join us. In this connection necessary documents are being collected so that the case may be filed by March 2014.

All members/readers are requested to keep the inspiration that given us so far continued. Please give your valuable suggestion through your comments, SMS, e-mail every stage to maintain our spirit to fight this genuine issue.

With warm regards,

Yours Sincerely

LDC-UDC ISSUE-TOWARDS A FINAL ACTION PAPER SUBMITTED IN THE DELHI MEETING

Dear friends,

This is an assembly of the representatives of deprived & low paid but highly responsible employees in the clerical cadre of category of Group C working in various offices of Government of India offices i.e. LDC & UDC whose cases have been ignored by successive pay commissions and Governments with regard to the payment of equal pay for equal work and genuine promotional avenues. On the other hand, the various Employees Federations in which the Administrative Staff including the LDC & UDC are members in Ministries/Departments of the Government of India have not been taking interest to resolve the issue of LDC & UDC so far and as such the issue could not be highlighted. During the last few months we have done vigorous campaign justifying the higher Grade pay to these sections through the web site www.aiamshq.blogspot.in. The issue has been widely published in various employees’ web sites including Central Government Employees News, gconnect.in etc who have actively supported our endeavor. As a result now the matter has become much popular and more or less all central Government Employees Associations have realized the gravity of the issue. It is to be mentioned here that the Confederation of Central Government Employees & workers has actively supported us to bring the issue before the authorities concerned. The matter was discussed in the Confederation’s National Executive Meeting on several occasions and accordingly the issue was put up as an additional item in the National Anomaly Committee (NAC) meeting in the year 2011. But the item could not be discussed in the NAC so far due to the fact that the Government has differed from their earlier decision of convening a final meeting of NAC to discuss the additional NAC items and the decision of MACP Anomaly Committee.

By coming to the subject matter, instead of presenting a detailed report on the LDC & UDC issue, I would like to put up a list of events to throw light on the matter and the action initiated to achieve demand so far, in this meeting.

1. Why the entire LDC & UDC cadres of Govt. of India are disappointed?

1.1 Sixth Pay Commission has denied an appropriate pay structure to the LDC & UDC of Government of India Offices in the light of raising the academic and technical qualification and responsibilities assigned. As per SSC notification, Lower Division Clerks are entrusted with routine nature of work viz. Dispatch, Diary, maintenance of file register, file movement register, indexing and recording of files, typing, comparing, preparation of arrear and other statements etc. But in practice, particularly in subordinate offices these cadres are entrusted with quality and highly responsible administrative sections. Here, these cadres have been made responsible for the smooth functioning of the office. The grade pay of LDC is Rs. 1900 which is just Rs. 100 more than the Grade pay of MTS. Moreover, the posts of all erstwhile group D, below the post of LDC have been merged and upgraded to Rs. 1800. Similarly, the pay scales of the staff above the level of UDC in the Administrative section have been merged and upgraded.

1.2 Several of posts with unskilled work in various Ministries have been granted more pay than the pay of LDC. A man working as dhobi, Nai, Mochi, Sweeper of Railway Protection Force get Rs. 2000 Grade pay; a Dak runner of Income Tax Department get more pay/benefit than a LDC. Instances of several other posts are also available.

1.3 The Grade Pay granted to the Data Entry Operator in Government of India Offices is Rs. 2400/ and the same for the LDC is Rs. 1900. The academic qualifications required for both LDC and DEO are the same i.e. 12th class pass or equivalent. And the technical qualification/skill for the candidates appear for the post of LDC requires 10500 KDPH/9000 KDPH English and Hindi typing respectively on computer whereas the candidate appearing the DEO requires 8000 KDPH. As regards the work assignment, the DEO has only to entry the data given to them whereas the LDCs have to create data, draft letters and then to type on computer, putting up the matter through file note with justification with the support of rules and procedure. Thus LDC does more work in qualitative and quantitative terms with less grade pay than the DEO.

1.4 As per records available with this Association, LDC & UDCs or posts equivalent to LDC & UDC in several State Governments that granted to the posts in Central Government. Majority of these State Governments have implemented the 6th Pay Commission.

1.5 ACP granted on hierarchical post basis so far has been replaced with MACP wherein a hierarchical grade pay only is provided. As such low paid employees whose hierarchical grade pay and promotional grade pay are different suffered a lot. As a result an LDC will get the first financial up gradation only to the Grade Pay of Rs. 2000 on his completion of 10 years service. It is to be noted that similar cases are available in various cadres. From the above, it can be assessed how the Government’s mind set work for the LDC & UDCs.

2. Action initiated to resolve it and events occurred thereafter.

2.1 Aggrieved over the aforesaid negligence on the part of Government of India, the All India Association of Administrative Staff has sent a letter to the Prime Minister vide letter dated 16/04/2010 and the Prime Minister’s Office has forwarded the same to DoPT for action vide letter dated 18/05/2010. When DoPT has not taken any action on the basis of frequent enquires through RTI Act till June 2013, the Association has written another letter to the Prime Minister’s Office along with the copies of the RTI replies vide letter dated 20/06/2013.

2.2 The letter sent to the PM’s office has been forwarded to DoPT for action vide PMO letter dated 15/07/2013. CS –II section of the DoPT, having found it as a matter of anomaly, has forwarded the same to the JCA Section for action vide letter dated 13/08/2013.

2.3 On 16/09/2013 this Association has written a letter with full justification for the upgradation of the Grade Pay of LDC & UDC to the members of National Anomaly Committee and requested their personal intervention on the matter.

2.4 The JCA section, without considering the fact that an item for the upgradation of grade pay of LDC & UDC has already been pending with the National Anomaly Committee for discussion, has returned the case to CS II vide letter dated 14/08/2013 with suggestion to process the case along with the LDC & UDC of Central Secretariat at CS II in consultation with Department of Expenditure.

2.5 Without considering the merits of the JCA’s aforesaid letter, the CS II has returned the case to this Association vide letter dated 19/09/2013 with a direction to take it up with Department of Expenditure. In this respect, the related officer in DoPT has informed me orally that the LDC & UDC of Central Secretariat have not demanded upgradation of pay so far. CS II is dealing the issues of LDC & UDCs of Central Secretariat and as such the cases which do not come under CS II (LDC & UDC of subordinate Offices) are not considered and as such it has been returned.

2.6 On 14/10/2013, the case was forwarded to the Secretary, Department of Expenditure along with comparative study of Pay structure granted to the MTS, DEO and LDC as well as the pay structure of LDC & UDC of State Governments getting more pay than their counterparts in Central Government.

3. Confederation’s efforts & results.

3.1 Subsequent to forwarding of the representation to Department of Expenditure, Confederation of Central Government Employees & Workers has written a letter in support of the upgradation of grade pay of LDC & UDC to the Department of Expenditure vide letter dated 25/10/2013.

3.2 In response to Confederation’s aforesaid letter, Department of Expenditure has issued a letter to the Financial Advisor; Department of Personal & Training stating that the representations received from the Individuals and Associations, for upgradation of grade pay of LDC & UDC, is forwarded to the concerned Administrative Ministry/Departments with an advice to examine the representation. And, asked to forward the cases to Department of Expenditure on the basis of merit of the case.

3.3 The National Secretariat Meeting of the Confederation held on 28/11/2013 discussed the matter and after detailed deliberations Com. S.K. Vyas, JCM National Council, Standing Committee Member has opined that even though this issue is already with Anomaly Committee, no finality could be reached due to the fact that the meeting of the committee had not been convened for long. As Government has announced 7th CPC there is every possibility of Government referring these anomalies to 7th CPC. Hence he advised the Association to seek legal remedy also while continuing our efforts to settle the issue in the Anomaly Committee.

4. State of LDC & UDC in Railways & Defense Departments.

4. In the Railways, where a larger number of Junior Clerks with Rs. 1900 grade pay is posted has not demanded the upgradation of the grade pay so far. This Association has written letters to 9 members of NAC belonging to Railways to support the demand. And even though the charter of upgradation of grade pay of Junior Clerk is not reflected in the charter of demands put up by the Railways Unions. Similarly, hundreds of LDC & UDC serving in the Defence Ministry contacted me to convey their disappointment on the present grade pay of LDC in comparison with the quality work assigned to them by their Ministry. But the demand for the upgradation of grade pay has not been raised by the employees’ associations in the Railways.

5. Conclusion:

Hundreds of comments demanding major and result oriented action on the issue have been posted in our web site and also in various other web sites so far. Besides, we have been receiving messages through SMS, e-mail, over phone and even through post from the LDC & UDCs of various Ministries of GOI. It is clear; LDC & UDC posted in various Ministries are of the view that the time has come to take a final action towards the fulfilment of the demand raised. And we are assembled here to decide the action programme to be chalked out at this stage. Our web site has published three letters during the last one and half months to ascertain the view of the readers. So far the readers have proposed four line of action to reach the goal and a letter containing the said action was posted in our web site on 30th December 2013. As has already said, the Confederation has already opined to seek legal remedy. And yet, representatives of the LDC & UDC assembled here today has to discuss all the four points put forth and take a final decision regarding future action on the subject.

I am sure this meeting will be in a position to reach a logical decision on the matter.

With warm regards,
Yours Sincerely,

TKR Pillai
General Secretary

TOWARDS A FINAL ACTION ON LDC & UDC GRADE PAY ISSUE…

TOWARDS A FINAL ACTION

WHY THE REPRESENTATIVES OF LDC & UDC SHOULD ASSEMBLE AT DELHI ON 9TH JANUARY 2014…?

This Association has been receiving opinion from LDC & UDCs of various Ministries of GOI in respect of upgradation of grade pay viz. (1) taking up of the LDC & UDC issue through political leaders including Sonia Gandhi (2) Challenge the present pay structure of LDC & UDC in the Principle bench of CAT. (3) Conducting pen-down strike to achieve the demand; and now we have a 4th opinion i.e. getting the grade pay of LDC & UDC upgraded through restructuring.

As regards the option (1) above, several of the experienced persons have advised me the way is not workable because no political leader/Multi-cadre Associations would support a particular cadre without considering the after effect of the pay structure of other cadres. Even the railway unions have not demanding upgradation of grade pay of the lakhs of junior clerks working in the railways.

Through option (2), we can put up the actual work load of LDC & UDC in subordinate offices; the decision of the pay Commission increasing the educational & technical qualification of LDC without an equal increase in the pay structure; subsequent increase of Grade pay by several state Governments who have implemented the 6th CPC in their state and other related issues before the court through a very good advocate.  It is worth to mention here that Confederation also has advised us to file a case in the principle CAT on the issue.

The 3rd opinion as received i.e. conducting of pen down strike by the LDC & UDCs is not practical because these LDC/UDC are spread over various ministries of GOI and lack of a common Association/Federation representing all these LDC & UDC. Moreover, we have the experience that major Federations, in which LDC & UDC of the respective Departments also members are not taking any active initiation to resolve the LDC/UDC issue.

As regards the 4th point, the instructions of Ministry of Finance to the FA, DoP&T is not complete. Restructuring of LDC & UDCs by each ministry according to merits of the representation made by the Associations is not practical. DoPT has to issue detailed instruction regarding the nomenclature of the posts, time frame for its implementation etc.

Thus in order to take a decision/forming a steering committee for further action a meeting of the representative/ Associations is organized on 9th January 2013 at New Delhi. The venue will be JANTHAR-MANTHAR i.e. the venue of Dharna of Confederation. The top leaders of Confederation will be available in the venue to take advice on the issue. We appeal all our friends, who gave me much energy to fight the case so far, to please attend the meeting.

All friends who attend the meeting may please co-operate by making their own arrangements for stay at Delhi.

With regards

Yours sincerely

(TKR Pillai)
General Secretary

LDC-UDC ISSUE: A STEP FORWARD

DEPARTMENT OF EXPENDITURE WRITES TO FA, DoPT

Dear friends,

While going through the letter of the Ministry of Finance, as given below, it has become more clear that the Ministry of Finance is not willing to consider the genuine case of  Lakhs of LDC & UDC of the Government of India Offices. It appears, the Ministry of Finance proposes Ministry/Department wise restructuring(with the provision of reduction of number of posts while applying matching/saving) of the posts. the proposal is not practical since the LDC & UDC are common cadres and spread over the entire Government of India Offices of various Ministries unless the MoF/DoPT clarifies the position further. In this context, the matter was discussed  in the National Executive Meeting of the Confederation and the decision taken in it is given below. Thus all of us should prepare for the action as proposed by the Confederation. I feel it would be better if we exibit our unity/strength in the proposed Nation wide Mass Dharna called by the Confederation  on 9th January 2014 at Delhi. I have discussed the matter with some like minded Associations who will also attending the Dharna Programme. All our friends are requested to give their valuable comments/opinion so that we may take the appropriate action on the matter.
