Fixation of pay on promotion of pre-revised merged pay scales between 1.1.2006 and date of notification of CCS(RP)Rules 2008

No.F-2-1/2015-E.III (A)
Government of India
Ministry of Finance
Department of Expenditure

New Delhi, the 16th October, 2015

Office Memorandum

Subject: Cases of promotion taking place in the pre-revised pay structure between 1.12006 and the date of notification of CCS(RP) Rules ,2008 and the subsequent merger of the pre-revised pay scales of the promotional and the feeder posts in a common Grade- fixation of Regarding.

The undersigned is directed to Say that consequent upon coming into force of the CCS(RP) Rules, 2008, which were notified on 298.2008 but are effective from 1.1.2006, fixation of pay on promotion on or after 1.1,2006 is carried out as per Rule 13 thereof. This Rule is invoked only in cases of promotion from one Grade pay to another in the revised pay structure.

2. In terms of Section I of Part-A of the First Schedule of the CCS(RP) Rules, 2008, which provides for revised pay structure in the form of applicable pay Bands and Grades pay corresponding to various pre-revised pay Scales, certain pre-revised pay Scales have been merged in a common Grade pay in the revised pay structure w.e.f. 1.1.2006, In view of this, the posts in those pre-revised pay scales which have been merged in a common Grade pay w.e.f. 1,1.2006, are normally required to be merged even if these posts constituted feeder and promotional grades in the pre-revised pay structure.

3. However, in cases where such merger of feeder and promotional posts in the wake of their come to lie in the Same grade pay has not taken place due to administrative reasons and the posts continue to retain their promotional and feeder character as per the relevant Recruitment Rules, this Ministry issued instructions vide OM 10/2/2011-E.III A dated 7.1.2013 providing for fixation of pay on promotion in such cases under Rule 13 of CCS (RP) Rules, 2008 subject to the conditions laid down therein.

4. Now, instances have been brought to the notice of this Ministry where the feeder and promotional posts have been merged in view of the merger of the pre- revised pay scales applicable to the erstwhile feeder and promotional posts in a common grade/post after the promulgation of CCS(RP) Rules), 2008, due to which the character of posts being promotional and feeder grades as existing during the period from 1.12006 to the date of notification of CCS(RP) Rules, 2008 stood rescinded with retrospective effect from 1.12006 and, consequently, a question has been raised as to whether Rule 13 of CCS(RP) Rules, 2008 may apply for fixation of pay on promotion taking place during the period between 1.1.2006 and the date of notification of the said Rules, when the fixation of pay was actually done as applicable in the event Of promotion in the pre-revised Structure.

5. The matter has been considered in the light of the provisions contained in the OM No. 20020/4/2010-Estt.D dt.13.9.2012 issued by the Department of Personnel & Training, which has been issued in the context of the posts/grades merged in pursuance Of the recommendations of the 6th Central pay Commission. This OM provides, inter-alia, that the Status of a government servant as on 29.8.2008 including those who have earned promotion between 1.12006 and 29.09.2008 will be protected as appointment/promotions are made as per the provisions of the recruitment rules applicable to the post/grade.

6. Accordingly, it has been decided that in cases where promotion took place in the pre-revised pay structure during the period between 1.12006 and the date of notification of CCS(RP) Rules, 2008 when the pre-revised and revised pay scales were different and the posts carried the character of feeder and promotional grades, pay fixation on such promotion Shall be allowed under Rule 13 of the CCS(RP) Rules, 2008, subject to the following conditions:-

(i) The promotion had taken place between 1.1.2006 and the date of notification Of CCS(RP) Rules, 2008 as per the Recruitment Rules then in vogue, which clearly provided for such posts being promotional grade for the feeder grade from where the promotion took place and where the posts were subsequently merged in a single post/grade consequent upon promulgation of the CCS(RP) Rules, 2008.

(ii) FR. 22 (r) I), which was applicable for fixation Of pay on promotion before promulgation of CCS(RP) Rules, 2008, was invoked for fixation of pay in these cases in the pre-revised structure during the period between 1.1.2006 and the date of notification of the CCS(RP) Rules 2008.

(iii) The concerned employees had opted to come over to the revised pay structure from a date occurring prior to the date Of notification of CCS(RP) Rules, 2008.

(iv) The concerned Recruitment Rules have been amended subsequently to provide for merger of these grades into a single grade/post.

7. This order applies only in case of promotions carried out in the pre-revised structure during 1.1.2006 and the date of notification of CCS(RP) Rules, 2008. Thus, the benefit of Rule 13 of CCS(RP) Rules, 2008 would not apply in Cases of appointment to the post which was in the higher pay scale in the pre-revised pay structure, where such appointment is made after the date of notification of CCS(RP) Rules, 2008.

8. In its application to the employees serving under the Indian Audit and Accounts Department, this order issues with the concurrence Of the office Of CMG.

9. The Hindi Version of this OM is attached.

Fixation of pay of State Government Employees on their appointment in Central Government, subsequent to implementation of CCS (RP) Rules, 2008.

No. 12/1/2009-Estt (Pay-I)
Government of India
Ministry of Personnel, Public Grievances and Pensions
Department of Personnel & Training

New Delhi the 28th August, 2014

OFFICE MEMORANDUM

Subject: Fixation of pay of State Government Employees on their appointment in Central Government, subsequent to implementation of CCS (RP) Rules, 2008.

The undersigned is directed to say that the method of fixation of pay of State Government employees on their appointment under the Central Government has been spelt out in this Department’s OM No. 12/l/94-Estt(Pay-I) dated 24 March, 1994, 3rd January, 1996 and OM NO. 13/2/99-Estt (Pay-I) dated 18.6.2001.

2. The question of fixation of pay in cases of appointment from State Govt. to Central Govt. consequent upon revision of pay scales on acceptance of the recommendations of the VI Central Pay Commission in the revised pay structure has been considered in consultation with the Department of Expenditure and the President is pleased to decide that in cases of appointment of State Government employees in Central Government on or after 1.1.2006, pay will be fixed in the following manner:-

(a)        Where the State Government has revised the Pay scales of their employees on the pattern of VI Central Pay Commission at the base index of 115.76 as per AICPI (IW) 2001 series w.e.f. 1.1.2006 the pay of these State Government employees on their appointment under the Central Government would be fixed as follows:

(i) When the appointment is to a post carrying higher Grade Pay, one increment equal to 3% of the sum of the pay in the existing grade pay will be computed and rounded off to the next multiple of 10. This will then be added to the existing pay in the pay band. The grade pay corresponding to the higher post will thereafter be granted in addition to this pay in the pay band. In cases where the appointment involves change in pay band also, the same methodology will be followed. 7th Pay Commission – Fitment Formula, Fixation of Pay on promotion and Date of effect of 7th CPC Pay, proposed by National Council, Staff Side, JCM in the Memorandum submitted to 7th CPC

7th Pay Commission – Fitment Formula, Fixation of Pay on promotion and Date of effect of 7th CPC Pay, proposed by National Council, Staff Side, JCM in the Memorandum submitted to 7th CPC

Chapter – VIII Fitment Formula

The fitment formula suggested by all the earlier Pay Commissions was not reflective of the actual revision of wages. The employees who were on rolls on the date of implementation of the Commission’s recommendation comparatively received lesser benefit than the new entrants. Amongst the existing employees also, more benefit accrued to persons with lesser service period. This happened due to the rejection of the demand of the Staff Side to have point to point fixation.

8.2 The anomalous situation was addressed during the discussion the Staff Side had with the Group of Ministers in September 1997, over the implementation of the recommendations of the 5th CPC. In the place of 20% of the basic pay recommended by the 5th CPC as fitment formula the Staff Side could negotiate and settle it at 40%. The said agreement brought about near total satisfaction over the revision benefit amongst all sections of employees. The said 40% benefit brought about uniform multiplication factor too.

8.3. Taking these in to consideration, we suggest that the multiplication factor (26000/7000 = 3.7) may be applied uniformly in all the cases to arrive at the revised pay in the new scale of pay.

Chapter –IX

Fixation of Pay on promotion.

In the case of Promotion from one grade to another in the revised pay structure, the fixation is presently done as under:-

(a) One increment equal to 3% of the sum of the Pay in Pay Band and Grade Pay will be computed and rounded off to the multiple of 10. This will be added to the existing Pay in the Pay Band.

(b) However, the Pay so fixed must not be less than the minimum of the Pay Band to which he is promoted.

(c) The individual so promoted will get the Grade Pay assigned to the cadre to which he is promoted.

Exception to the general rule is, (a) When promotion takes from PB 4 to HAG scale of Rs.67000 – 79000, after adding one increment, pay in the Pay Band and existing Grade Pay will be added. To the figure so arrived at a sum of Rs.2000/- will be added. The pay so fixed is subject to a minimum of Rs.67000 and a maximum of Rs.79000

(b) The promotion from the Grade of Under Secretary/equivalent to the Grade of Deputy Secretary/Equivalent. The pay of the other will be fixed by granting an amount equal to two increments. i.e., 6 % of their Basic Pay. The figure so arrived at, a sum of Rs.1000 i.e., the difference between the Grade Pay of Under Secretary and Deputy Secretary (7600-6600) will be added .

9.2 We suggest that the financial benefit on promotion must not be an insignificant amount. In most of the Departments promotion is based upon a qualifying Exam or skill test. In the case of employees the promotions are made very many years after the stipulated residency period in the Feeder Cadre, due to the non availability of vacancy at the higher grades.. After undergoing the rigours of the exam/test or after prolonged period of service in the feeder cadre, if the financial benefit is pittance, it only brings about a sense of desperation and frustration. In most of the field formations, the promotions are accompanied by transfer from one place to another. The financial benefit he received on account of promotion often gets washed away in the reduced allowances like HRS, CCA etc. when posted to unclassified Cities, increased expenses involved in setting down at another location viz. Finding new accommodation, shifting, school admission for children etc.

9.3 We suggest that the benefit on promotion, therefore, should be:
“Two increments in the feeder cadre with a stipulation that the amount of benefit so arrived at must not be less than Rs. …………….

Chapter – X Date of effect.

Since the 5th CPC made its recommendation to have decennial wage revision, there had been no specified time limit fixed for effecting a reappraisal of the pay structure in Government Service. However, on an average, such revision has taken place once in 10-12 years.

10.2 India chose the IMF prescribed economic policies for faster growth in 1991. In the neo- liberal economic regime, old values, social ethos, standard of living underwent vast stride. Profit in any manner or at any cost became the slogan for the private enterprises to survive. In a competitive business world, the public sector could not remain an island of uprightness. In order to compete with the private sector, public sector, perhaps per force had to charter the course of reducing cost of production by casualization of their workforce. The Government had to change its recruitment policies, shed many of its functions, outsource, contractorise etc. to reduce its expenditure and consequently the fiscal and revenue deficits.

10.3 The point, we would like to mention, is that such changes, coming in quick succession brought about an urgency for the reappraisal of the principles of wage determination and other service conditions.

The new enterprises employing and administering sophisticated technological innovations did offer hefty pay packets to the few talented and skilled workforce, throwing the subtle wage structure in the society out of balance.

10.4 This apart, the Indian economy experienced a heavy thrust of inflation. The prices of articles, especially of food and other consumables registered enormous increases. The Government either failed or became ineffective to arrest the spiralling rise in prices. This hurt the fixed wage earners and devastated the middle class employees, who were to maintain a certain standard of living and status in the society. We may in this connection cite the observation of the 3rd CPC (of course made in a different context) and the 4th CPC to bring home the necessity of periodical wage revision.

“A dispirited public service can never be expected to function satisfactorily and to rise to the occasion, when a crisis occurs. It should not be forgotten, as pointedly referred to again by the Priesley Commission, that the process of deterioration arising from a sense of grievence on the part of the staff may be a slow one, particularly in a service with high traditions. By the time the tendency manifests itself, irrepairable damage may have been done. We may add that because of the cadre system, the full impact of deterioration in the calibre and the competence of the new recruits will be felt by the country after a time lag of 20-25 years, when they will be moving to the top and playing a vital role in the governance, of the country, as during the interval, their senior colleagues may be shouldering the burden. At that stage, restoration of administrative standards, may be well nigh impossible in the short time, as public servants in the top echelons take time to train and mature”.

The pay structure has therefore to be satisfactory all through and has to be formulated on a consideration of all the relevant factors.

“At the same time, it is necessary to revise the pay scales as and when necessary. The aim of such revision is not only to take note of changes that may have taken place in the relevant facts and circumstances bearing on pay scales, but also to rectify or fill any errors or omissions that may have occurred in the earlier pay determination. Where pay revision are announced at specified periods of time that gives hope to the employees who can look forward to a better deal on the next occasion. Periodic revision or review of pay scales thus serves to avoid conflict with the employer and enables the employees to prepare, with the reasonable hope that their grievances and claims would be gone into once again in a determined and honest manner. It generates the sense that there is hope for them in time to come and that it would be unnecessary to take the path of agitation or confrontation. The terms of reference of such review bodies are often decided in consultation with representatives of employees so that matters agitating their minds, or of particular interest to them, may fall within the purview of the review body and be adjudged in a satisfactory manner.”

10.6. In the organised private sector wages are on the basis on an agreement reached between the workers and employers through bilateral discussions. The tenure of their agreements is not for more than 3 years. It is not only to cater to the needs of workers that such short tenure is assigned to the agreements but the employer too, wanted the wage and other issues reviewed periodically.

10.7 Public sector managements are not free or autonomous enough to decide upon the wage and other service conditions of the worker. The Bureau of public enterprises and other Governmental agencies do make intervention on certain policy issues and ensure that no wide disparity exist in the matter among the public enterprises.

10.8 In most of the PSUs, the workers have asserted the need for a 5 year wage revision, despite the directive to the contrary of the Bureau of Public enterprises. Government and the management of PSUs had to succumb to this demand.

10.9 In January, 20102 the percentage increase over 306.33 all India Consumer Prie Index (12 monthly average) was 50% i.e., exactly after the 6th year, the wage revision of 5th CPC was given effect to. In January, 2011, the percentage increase over 115.76 all India Consumer Price Index (12 monthly average) crossed over 50% mark, i.e./, exactly after 5 years from the date on which the 6th CPC recommendations were implemented. The real erosion of wages would be much more than 50%(Pl. See our memorandum on Interim Relief .) As on 1.1.2011, the real value of erosion was about 174% if the retail prices of the commodities as on that date are taken into account. It was in realisation of this indisputable fact that the 5th CPC suggested for merger of DA with Pay to treat the DA component as pay for all purposes, so that the employee will have an immediate relief from the erosion in the value of wages.

10.10.Neither we could elicit a decision from the Government to merge DA with pay on 1.1.2011 due to the absence of a specific recommendation from the 6th CPC nor could we make them to agree to set up the 7th CPC. We had to resort to collective trade union action to impress upon the necessity of wage revision. The Government’s response, though, belated did avoid a confrontation, which was brewing and gathering momentum amongst the rank and file of the Central Government employees.

10.11 We, therefore, request the 7th CPC to make the following recommendations to the Government:

1.To merge DA and treat the same as pay for all purposes as and when the DA entitlement reaches 50%

2. To set up the next wage revision body or Pay Commission sufficiently before the expiry of five years.

3. To implement their recommendations with effect from 1.1.2014 especially in the background that the desirable tenure of the earlier Commission’s recommendations expired on 1.1.2011.

Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay

CIRCULAR
Office of the Principal Controller of Accounts (Fys)
10-A, S.K. BOSE ROAD, KOLKATA-700001

No. Pay/Tech-1/01 (6th CPC) /2014/01

Date: 30-01-2014

To
All Group Controllers

Subject: Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

References hove been received from different Br. AOs and Factories regarding extension of benefit of 3% increment in terms of MoF, Deportment of Expenditure OM No. 10/02/2011-E.III/A dtd 07.01.2013 [click here to view] to those employees who were promoted f rom CM-II to CM-l/AF to JWM/MCM to CM on or ofter 1.1.2006.

In this connection, it may be stated that as per MoF, Deptt of Expenditure OM No. 10/02/2011-E.III/A dtd 07.01.2013, benefit of fixation of pay under FR 22(1) (a) (l) can be extended when both the feeder and promotional grades were placed in the identical revised pay scales based on the recommendation of the 6th CPC and where the existence of both the erstwhile posts are continued in 6 CPC and at the same time the promotional post also involves assumption of higher responsibilities as envisaged in the MoF OM No. 169/2/2000-lC dtd 24.11.2000.

In this context, it is also significant to mention that after 6th CPC, the posts of CM-II & I and AF & JWM have been merged and replaced by a single grade of CM or JWM with a grade pays of Rs. 4200/- and Rs. 4600/- respectively. Therefore, promotion between these grades after 6th CPC remains no more available and no movement within merged grade is practically possible and the basic conditions stipulated in G of I, MoF OM dtd 24-11-2000 including assumption of higher charge and existence of feeder and promotion grade are not fulfilled. Thus the benefit of 3% increment for movement from CM-II to CM-I and AF to JWM is not admissible in terms of proviso to para 2 of the aforesaid OM dtd 7.1.2013.

Whereas, in case of movement from MCM to CM, it may be stated that prior to 1.1.2006, the MCM grade was not a hierarchical post. The MCMs were part of HS cadre during 5th CPC. After the restructuring of Artisan cadre w.e.f 1.1.2006, the MCM grade has become a separate hierarchical post and cannot be treated within the strength of the HS. Hence, the condition stipulated under proviso to para 3 of MoF OM dtd 7-1-2013, that the promotional movement should be between two different posts of feeder and promotion post prior to 1 /1/2006 now carrying some grade pay, is not fulfilled in the case of the MCM also w.e.f 01-0.l -2006.

As such, promotionol benefit in terms of MOF OM dtd 7.1.2013 to the CM-l & JWM on their promotion from CM-II/MCM & AF respectively on or after .l.1.2006 may not be considered for admittance.

Br. AOs under your control may please be intimated accordingly.

Addl. C of A (Fys) has approved.

This figure will be rounded off to the next multiple of 10 and will then become the pay in the applicable pay band. In addition to this, the grade pay corresponding to the pre-revised pay scale will be payable….”

(The fitment tables given in the Annex-I to the Department of Expenditures OM dated 30.8.2008 are to be used for pay fixation as done on 1.1.2006 only and incase of normal replacement pay scales as per para 2(i) and para 2(u) respectively of the aforesaid OM For fixation of pay in the revised pay structure subsequent to 1.1.2006, the Rule 11 of CCS(RP) Rules, 2008 refers).

2. The issue of fixation of pay with references to the pre-revised pay scale of Rs.7450-11500 and payment of arrears was taken up by Establishment Division of this Department with Department of Expenditure. A clarification dated 10.12.2013 issued by Estt (Pay) is enclosed.

3. It is further clarified that inclusion in the Select List does not ante date the seniority of the officers. No. 961840/2013-Estt. (Pay-I)
D/o Personnel & Training
Establishment (Pay-I) Section

Vide the U.0. dated the 14th December, 2009, D/o Expenditure had allowed fixation of pay with reference to the pre-revised pay scale of Rs.7450-11500 to those promoted as Assistants / PAs between 1.1.2006 to 31.8.2008. They were, however, not allowed arrears from 1.1.2006 till the date of their promotion, as they had come over to the revised pay on the date of their promotion.

2. Seniors to such promotee Assistants / PAs, however, were subsequently allowed stepping up of their pay with reference to these officials. Such senior officials were also not allowed arrears on the ground that the officials with reference to whom they had got their pay stepped up were also not entitled toso.

3. The issue has been reconsidered in consultation with D/o Expenditure as this amounts to compelling the senior official, who was already serving as Assistant /PA prior to 1.1.2006 and opted for fixation of his pay under revised pay rules from 1.1.2006, to opt for revised pay structure from the date of stepping up with the junior.

4. It is, therefore, clarified that the senior is entitled to arrears of pay from the date he opted to come over to the Revised Pay Scales till the date of stepping up of pay. These will be paid on the basis of pay actually fixed as on 1. 1.2006.

5. The CS Divisions are, therefore, advised to issue a clarification in respect of similarly placed persons in CSS / CSSS.
