Historic 16 days GDS All India Strike – Confederation

Historic 16 days GDS All India Strike – Confederation

Circular No.CHQ/02/2018 Dt.11-06-2018
Dear Comrades,
Historic 16 days GDS All India Strike
Red salute & Revolutionary greetings to all
United we stand .. divided we fall ….
The AIPEU-GDS CHQ convey its sincere thanks to all GDS comrades for their support, cooperation, encouragement during the period of 16 days indefinite strike from 22nd May to 06th June 2018. The strike is a historical and heroic-one in the history of Postal Trade Union movement in India. This is the strike against ‘discrimination shown by the Department & Government’, ‘anti-worker policy of the Govt’. and for ‘self-respect’ of GDS all over the country. This is only a first step and there are miles to go for the cause of GDS and our goal is ‘civil servant status to GDS’,
The decision taken by our CHQ in consultation with NFPE leadership to serve strike notice is quite right as it was discussed elaborately in our 3rd AIC, Allahabad and decided to go on indefinite strike during May 2018. The BEDEU served strike notice and went on strike from 14th May. The AIGDSU & NUGDS served strike notice on 03rd May to commence their indefinite strike from 22nd May. Even though our union is not consulted on the strike issue, to oppose the policy of the Govt and regarding GDS for immediate implementation of Kamalesh Chandra Committee Report and also to maintain total unity amongst GDS cadre, it is decided to serve notice by our Union for indefinite strike from 22nd May itself. BEDEU expressed their inability to share our platform. Our stand during negotiations and subsequent decisions was that unity should be maintained and our Union should not withdraw from the strike unless and until all other GDS unions also decided for withdrawal of strike. The initiative taken by our leadership in making personal contacts with other GDS Unions and timely decisions resulted in building up total unity of 3 lakhs GDS and maintaining it throughout the strike, till end.
The GDS CHQ express its sincere thanks to NFPE CHQ, NFPE & FNPO leadership for extending full support and solidarity by giving call for nationwide wearing of black-badge, demonstration, dharna, and relay hunger fast. CHQ appreciates the decision of the P4 CHQ to serve strike notice in support of GDS strike from 23rd May and it is continued till the GDS strike end.
Red salute to the decision of C-o-C, Kerala Circle during their joint Circle conference and all NFPE & FNPO departmental unions participated in the indefinite strike from 22nd to 31st May (10 days) along with GDS strike. In Andhra Pradesh, Postal JCA (NFPE & FNPO) departmental unions participated in the GDS strike for 4 days. In Tamil Nadu all NFPE departmental unions participated for 4 days. In West Bengal all NFPE departmental unions continued for 4 days in the strike. In Telangana P3 & P4 unions participated for 4 days. In remaining circles, all departmental unions of Postal Federations totally extended their cooperation, support and solidarity to striking GDS during 16 days of strike.
The GDS indefinite strike in the country attracted the attention of World Federation of Trade Unions (WFTU). The Central Trade Unions viz., CITU, AITUC, INTUC extended their solidarity and wrote to Govt. The fraternal organizations viz., Confederation of Central Govt Employees & Workers, AIPRPA (Postal & RMS Pensioners Association), NFPE, FNPO, IP/ASP Associations etc., extended their solidarity and support to the indefinite strike. There was full support from general public, print and electronic media. Com. Sitaram Yechury, General Secretary, CPI(M), Com. Pinarayi Vijayan Chief Minister, Kerala and many other political leaders and people’s representatives wrote letters to Prime Minister of India demanding immediate settlement of GDS strike and implementing Kamalesh Chandra Committee Report.
Various types of agitational programmes conducted during the 16 days viz., rallies, demonstrations, public meetings with participation of distinguished public representatives, submission of memorandums at various levels of Govt & administrations by our GDS in all Circles.
It is very much regret to mention here that this strike caused the lives of about 8 GDS comrades all over India. CHQ convey its deep grief on their demise and condolences to their family members.
The 16 days strike caused total disruption of rural postal services due to closing of 1.29 lakh Branch Post Offices and paralyzed the rural postal system in all the Circles. From the beginning to end the GDS are determined to continue the indefinite strike till the demand is resolved. The frustration prevailed among the GDS due to discrimination and delay lead to an emotional situation leading to total strike for 16 days. The Union leaders were cautioned by the cadres not to withdraw the strike and messages floated in SMS & What’sapp.
From 18th May to 5th June, many rounds of discussion took place in formal and informal meetings with the Officers of the Department besides two days reconciliation meeting with Regional Labour Commissioner (Central), New Delhi with four strike participant GDS Unions resulted in vain. Every time, the Department appealed for calling off the strike without any written assurance/agreement on our demand. All GDS unions taken a firm stand unitedly to continue the strike till an honourable settlement is reached.
The positive response in favour of GDS from public, political parties & leaders, MPs, MLAs, MLCs and many other public representatives, Trade Unions compelled the Govt and Department to change their stand. Thus major recommendations of Kamalesh Chandra Committee on wage increase approved in the Cabinet meeting held on 6th June 2018. Though other recommendations are still pending, as the major demand is approved all the GDS unions unanimously decided to call off the indefinite strike on 16th day i.e., 06th June. Comrades, we should be very vigilant that any major deviations from the recommendations of Kamalesh Chandra Committee, our union along with other GDS Unions and with the support of Federations will start agitation programmes, if necessary.
AIPEU-GDS CENTRAL WORKING COMMITTEE MEETING:: 04TH SEPTEMBER 2018: It is notified by CHQ that the Central Working Committee meeting of AIPEU-GDS will be held on 04th September 2018 in New Delhi. Notice and agenda will be circulated soon. CWC will review the entire situation after the strike and organizational issues would also be discussed and suitable decisions will be taken.
ONE DAY STRIKE OF CENTRAL GOVT EMPLOYEES AND WORKERS ON 15 NOV,2018: The National Convention of Central Govt employees held on 10th June 2018 in Hyderabad Employees unanimously decided to conduct one day strike on 15th November 2018. “grant of Civil servant status for GDS” has been included as an important demand in 10 point charter of demands. As an affiliate of Confederation, AIPEU-GDS members also should participate in all the programmes including one day strike called by the Confederation of Central Govt employees and workers. State Govt employees of all the States will also participate in the strike on 15th Nov 2018. Another Circular will be issued in detail.
On 5th September 2018 Confederation, NFPE and many other class and mass organizations are going to conduct massive rally in New Delhi. As an affiliate of Confederation and NFPE, the GDS members of AIPEU-GDS have to participate in the programme. All the Circle Secretaries and CHQ office bearers nearby Delhi are requested to mobilize the GDS members for 4thSep programme and make it a grand success.
Financial Position of CHQ: It is well aware to all the members that AIPEU-GDS is well established in almost all divisions in all circles during the last 6 years period. We have participated in the recent membership verification (Sep-2017) and got more percentage of membership for recognition. It is stopped abruptly by the department and re-verification is yet to be ordered. To run our organization much more effectively at CHQ level, it needs financial support from the members. It is requested that during drawal of arrears of GDS Pay Committee, every member shall donate minimum Rs.100 (maximum amount may be remitted as per your capacity) to CHQ through the divisional / Circle Unions to fulfill the utmost needs of CHQ. All Branch / Divisional / Circle Secretaries are requested to approach the members for their generous financial contributions to our Union ensure the support to CHQ positively.
Address of the CHQ: General Secretary, AIPEU-GDS Dada Ghosh Bhawan 2151/1, New Patel Road New Dehil – 110 008 ….. Remittance will be made by MO to the above address & with full address of remitter.

HISTORIC GDS ALL INDIA STRIKE
ORGANIZE ONE DAY HUNGER FAST IN FRONT OF MAJOR POST OFFICES ON 31st MAY 2018, THURSDAY, 10 AM TO 5 PM

JOIN THE SANCHAR BHAWAN MARCH (MARCH TO COMMUNICATIONS MINISTER’S OFFICE NEW DELHI) IN LARGE NUMBERS ON 1st JUNE 2018 AND MAKE IT A GRAND SUCCESS
Dear Comrades,
As you are aware the indefinite strike of GDS Unions (AIPEU-GDS, AIGDSU, NUGDS & BEDEU) entered the 8th day today. All India strike percentage is 96%. Five rounds of discussions held with Secretary, Department of Posts, Additional Director General, Posts and conciliation meetings of Regional Labour Commissioner failed due to the adamant and negative attitude of the Government and Department. As per the call of NFPE and all affiliates of NFPE, departmental employees in Postal department organised black badge campaign and protest demonstration as solidarity support to the GDS strike. In five states (Kerala, Tamilnadu, Andhra Pradesh, Telangana and West Bengal) departmental employees also organised solidarity strike eventhough in four states (Tamilnadu, Andhra Pradesh, Telangana and West Bengal) they have withdrawn the solidarity strike on the fourth day due to compelling reason. In Kerala departmental employees of NFPE and FNPO are continuing their strike. In all states including those states where the departmental employees have withdrawn the solidarity strike, 100% GDS employees are continuing their strike.
Confederation of Central Government employees & Workers has already given call for daily demonstration in front of Postal and RMS offices and also extend full support and solidarity to the strike.
As the strike is continuing Confederation National Secretariat and NFPE Federal Secretariat has decided to organize mass hunger fast in front of major Post office/RMS offices on 31st May 2018 Thursday from 10 AM to 5 PM. It is also decided to mobilise maximum number of employees from Delhi and nearby states in the Sanchar Bhawan March already announced by the striking GDS Unions on 1st June 2018 Friday at 10:30 AM.
All affiliates and State/District Level Coordinating Committees of Confederation and NFPE are requested to organize the above mentioned programmes in an effective manner with biggest participation of employees.

BPMS has Decided that All the Affiliated Unions will Support the Indefinite Strike from 11th July 2016

Ref : BPMS / CIRCULAR / 17th TC / 07

Dated : 30th Jun 2016

To,
The Office Bearers & CEC Members BPMS
President / Secretary of Unions
Affiliated to BPMS

Sub :- AGITATIONAL PROGRAMME ON 7TH CPC

Dear Brothers & Sisters,
Sadar Namaskar.

1. As we are aware that after a long deliberation between the stake holders and the Departments/Ministries, concerned Secretaries had submitted their recommendations on the 7th CPC to the Empowered Committee and after considering it, the Central Cabinet has accepted the recommendations of the 7th CPC on 29th June 2016 ignoring the submissions of this Federation.

2. The Govt has not enhanced the Minimum Pay from Rs 18000/- to 24000/-, Multiplying Factor from 2.57 to 3.42, rate of increment from 3% to 5%, non-merging of any of the pay scale of Group ‘C’, non-resolving the issue of MACP etc.

3. This has caused discontentment amongst the employees. It has to be kept in the mind that the then Defence & Finance Minister Shri Arun Jaitley and MoS of PMO Dr. Jitendra Singh had assured the delegation of BPMS/BMS to resolve the above issues in favour of the employees. But now the Govt has reneged to its promises.

4. In this situation, Bhartiya Mazdoor Sangh, Govt Employees National Confederation & BPMS have decided to observe an agitational programme with immediate effect till 08th July 2016. In this agitational programme, Gate Meetings, Slogan shouting, Dharna, Procession, March, Demonstration at Main Gate etc will be organized as per feasibility. On the last day (08.07.2016) unions will submit a memorandum to respective Head of Departments & local Hon’ble Member of Parliament addressed to Hon’ble Prime Minister of India with a copy to BPMS.

5. Further, Shri Shiv Gopal Mishra, Convener, NJCA has requested to BPMS vide his letter (No NJC/2016/07th CPC dated 07.06.2016) to support in the proposed indefinite strike commencing from 11th July 2016. This Federation has considered the same and decided that all the affiliated Unions will support the indefinite strike from 11th July 2016.

We hope for full support and cooperation to give a great success to the programme.

With regards.

Brotherly yours,

(M P Singh)

Dated: 14.06.2016

Hon’ble Prime Minister of India,
152, South Block,
Raisina Hill,
New Delhi-110011

Respected Sir,

Sub: Non-settlement of our demands – Decision to go on “Indefinite Strike” commencing from 11.07.2016 – Request for your intervention and support

I write this on behalf of the apex level body of all the Central Government Employees Organizations who are participating in the Negotiating Forum; called the Joint Consultative Machinery. The JCM as a Negotiating Forum was conceived and implemented in 1966 after the prolonged discussions with the Staff Associations and the Federations in the Central Services in the wake of first industrial action in 1960. The idea of setting up the JCM was in realization of the absence of a platform to discuss, deliberate and settle the demands/issues/grievances/problems of the Civil Servants. Up to 1995-96 the JCM, which has a three level negotiating platform was functioning well, meetings were regular. However, after the promulgation of the new recognition Rules in 1993, the meetings at the Ministry level became few and far between and at the national level, the deterioration stepped in a little latter. The National Council, which was to meet thrice in a year did not  meet even once in a year. The last meeting of the National Council was held on 15.05.2010 The organizations participating in the JCM were demanding the meeting to be held, but the pleas were ignored by the successive Cabinet Secretaries. The Charter of Demands (copy enclosed), in pursuance of which the strike is decided to be organized, has arisen due to long neglect of the grievances of the employees/workers.

When the 7th CPC was set up in February, 2014, no announcement for Interim Relief or DA Merger was made by the then government, which had all along been the practice whenever the government had set-up the Pay Commissions earlier. We fully co-operated with the Commission, submitted a memorandum detailing the issues and explained the reasoning behind each demand. The 7th CPC submitted report on 19.11.2015 to the government. In our communication dated 10.12.2015 (copy enclosed), we sought improvement/amendment over the recommendations of the 7th CPC and explained our demands both in writing and orally before the Empowering Committee. Most of the meetings were monologues except perhaps the last one. What we have understood, is that, the Empowering Committee might not come forward to make any major changes. A fruitful meeting is supposed to be a dialogue where both parties at the negotiating table exchange their understanding, views and difficulties and reach a mutually acceptable position. In 1998, when the then Cabinet Secretary decided not to have such a dialogue with the Staff Side and unalterably issued the Government Notification on the 5th CPC recommendations, the then government did set up a committee of Group of Ministers. The GoM held discussions on all issues and averted the strike action. The 1998 situation establishes, without an iota of doubt, that, the Staff Side has always taken reasonable stand on all the issues and paved way for settlement.

The one and only recommendation made by the 7th CPC was to provide some relief to the past old pensioners. The Department of Pension & Pensioners’ Welfare has unfortunately recommended to the Cabinet Secretary that, even that recommendation must be rejected on the specious plea that the requisite relevant records might not be available.

These developments have caused anguish, anxiety and anger amongst the workers. It is now more than six months that the Commission submitted its report. If the government comes forward to hold a meaningful discussion with the leaders of the NJCA, a mutually acceptable settlement can be brought about and the impending strike, slated to commence from 11.07.2016, can ultimately be avoided.

We seek your co-operation, supports and intervention in the matter

Yours faithfully,

Sd/-

Controller General of Accounts (CGA) Warns Employees Against Going on Strike

Controller General of Accounts (CGA) warns employees against going on strike

Employees are opposing several of the Seventh Pay Commission recommendations

The Controller General of Accounts (CGA) has warned its employees that proceeding on strike could lead to wage cuts or even dismissal. This, after the All India Civil Accounts Employees Association and the All India Association of Pay and Accounts officers joined the call for an indefinite strike from July 11 in protest against several recommendations of the Seventh Pay Commission.

The strike call, issued by the National Joint Council of Action (NJCA) representing trade unions of railway, defence, postaland other central government employees, is to protest against the computation of minimum wage as recommended by the Seventh Pay Commission, which is to be implemented this year. “There is no statutory provision empowering the employees to go on strike,” the circular issued by the CGA, in possession of The Hindu, said.

“The Supreme Court (in a previous case) also agreed that going on strike is a grave misconduct under the Conduct Rules and that misconduct by government employees is required to be dealt with in accordance with the law.”

The strike was supposed to have begun on April 11, but was postponed to July 11.

DECEMBER 1st & 2nd, 2015 TWO DAYS STRIKE DEFERRED by NFPE

DECEMBER 1st & 2nd, 2015 TWO DAYS STRIKE DEFERRED by NFPE

SECRETARY GENERAL AND ALL GENERAL SECRETARIES OF NFPE & AIPEU GDS (NFPE) WILL SIT ON TWO DAYS HUNGER FAST INFRONT OF DAK BHAWAN, NEW DELHI ON 1st & 2nd DECEMBER 2015

ONE DAY MASS HUNGER FAST IN FRONT OF ALL CPMG / PMG & DIVISIONAL OFFICES ON 11th DECEMBER 2015

TO EXPRESS OUR ANGER, RESENTMENT AND STRONG PROTEST AGAINST THE REJECTION OF THE LEGITIMATE DEMANDS OF THREE LAKHS GRAMIN DAK SEVAKS BY THE NDA GOVT.

The Federal Secretariat of NFPE held at NFPE Office, New Delhi on 26-11-2015, reviewed the whole situation prevailing among the postal employees in general and the Gramin Dak Sevaks (GDS) in particular after the submission of the 7th Central Pay Commission Report to the Govt and also after the appointment of a separate committee for GDS by the Govt, headed by a retired Postal Board Member as Chairman.

The Federal Secretariat  further reviewed the proposed two days strike call given by NFPE and AIPEU GDS (NFPE) for realization of the legitimate demands of the Gramin Dak Sevaks, which  include bringing the GDS also under the purview of 7th CPC treating them as Civil Servants.

The main demand of NFPE and AIPEU GDS (NFPE) in the charter of demands submitted to Govt and Postal Board is “inclusion of GDS under the purview of 7th CPC”. NFPE organized series of agitational programmes for the GDS demands including dharnas, hunger fast, GDS Parliament March, Parliament March under the banner of Postal JCA (NFPE & FNPO), one day strike on 12th December 2012 and 48 hours strike on 12th & 13th February 2014. Due to our agitational programmes the Postal Board was compelled to submit the proposal for inclusion of GDS under 7th CPC to Finance Ministry with favourable recommendations. But the Finance Ministry rejected the proposal three times and it is in this background NFPE & AIPEU GDS (NFPE) decided to go for two days strike on December 1st & 2nd demanding the Govt to include GDS under the 7th Pay Commission.

Even though the Govt refused to include the GDS under the 7th CPC, the 7th CPC has suo moto examined the main demand of the GDS ie., treating them as Civil Servants and extending them all the benefits of the departmental employees, ofcourse proportionately. It is most unfortunate that the Pay Commission headed by a retired Supreme Court Justice as Chairman, has considered our demand and categorically stated that Gramin Dak Sevaks are holders of Civil Posts but outside the regular civil service and hence can not be treated at par with other civilian employees. After this observation of the Seventh CPC even if the GDS are included in the 7th CPC they are not going to get a fair deal. This has compelled us to modify the demand placed by us before the Govt in the charter of demands.

NFPE, from the very beginning has opposed the appointment of an Officer Committee for GDS and NFPE & AIPEU GDS (NFPE) has tried their best to prevent appointment of an Officer Committee and compelled the department to make effort for inclusion of GDS under 7th CPC itself. But now NDA Govt rejected our demand and has unilaterally appointed GDS Committee with a retired Postal Board Member as Chairman and cheated three lakh GDS employees. From our past experiences we know that the retired officers of the Postal Department will never do justice to the Gramin Dak Sevaks.

In view of the fact that 7th CPC has rejected our demand for Civil Servant status and also the Govt has unilaterally imposed the officer committee on GDS, the Federal Secretariat felt that it is not appropriate to go for an immediate strike with the demands raised by us in the charter of demands, i.e., inclusion of GDS under 7th CPC. Now GDS can get justice only if NDA Govt take a policy decision to regularize the services of GDS treating them as Civil Servants. Federal Secretariat is fully aware that we can not expect such a decision without the  change in the policy of the Government towards GDS. To make a change in the policy decision of the Govt., a bigger mobilization and strike of all postal employees including GDS with the active support and solidarity of other central Govt employees under the banner of Confederation of Central Govt Employees and workers and also the JCM National Council Staffside organizations is required.

The Federal Secretariat decided to explore all possibilities and wider consultations for such a united struggle. The Federal Secretariat felt that to pave way for wider consultations, the independent strike call of NFPE & AIPEU GDS (NFPE) need to be deferred and all likeminded organizations are to be brought under a common platform. Accordingly Federal Secretariat unanimously decided to defer the proposed two days strike scheduled to be held on 1st & 2nd December 2015.

The Secretary General and all General Secretaries of NFPE shall sit on two days hunger fast in front of Dak Bhawan, New Delhi on 1st & 2nd December 2015 expressing our strong protest to the Govt and also demanding regularization of Gramin Dak Sevaks by granting them civil servant status with all consequential benefits of regular employees.

The Federal Secretariat, while saluting the grass root level workers for their intensive campaign and preparation for the strike, calls upon them to organize one day hunger fast infront of all CPMG / PMG and Divisional Offices throughout the country on 11th December 2015 to ventilate our anger, resentment and strong protest against the callous and inhuman attitude of the NDA Govt towards three lakh Gramin Dak Sevaks who are the backbone of the Postal Department catering to the needs of the rural population of this country in postal sector.

Federal Executive of NFPE will meet shortly  to review the situation and shall decide future course of action.

Make the 2nd September 2015 All India Strike a historic success.

Dear Comrades,
We have placed on our website the synopsis of the discussion the leaders of the Central Trade Unions had with the Group of Ministers on the 12 point charter of demands. The Central Trade Unions evaluated the Government’s response to the strike call and have come to the conclusion that in the absence of any tangible result, the strike action must take place.  The only issue on which there had been a concrete proposal from the Government was on the question of raising the bonus ceiling.  In fact such an assurance has been given by the earlier Government also.  Due to the pressure exerted by the employing class, the said assurance could not be translated into reality.  To have the assurance to be put into practice, the Bonus Act has to be amended and that is possible only in the next session of the parliament.  In other words, if one is to believe the assurance held out by the Government on the question of raising the ceiling for bonus computation, it can only have prospective effect i.e. for the next year 2016.  We firmly believe that the corporate would not allow the present government to give effect to this assurance.  The acrimonious ceiling on bonus while allowing unlimited extraction of profit for the companies is to be fought out through bitter struggles.

There had been no word from the Government on the question of rolling back its proposals on the labour reforms. The proposed labour reforms will hurt the working class most.  The regularization of contract workers, payment of minimum wage, ensuring statutory Pension benefit, the registration or recognition of trade unions within a stipulated time limit to enable the workers to have the right to collective bargaining, the non implementation of the agreements reached at the various tripartite Labour conferences were some of the significant issues on which the working class sought settlement. Introduction of 100% FDI in Railways, 49% in Defence, corporatisation & privatisation of government entities, end for contract/casual temporary employment also met with stoic silence or rejection.  The Group of Ministers has successfully eluded the issues. The BMS unions have declared that they would withdraw from the strike action.  Their decision being political based is understandable, but is difficult to appreciate. We can only hope against hope that they would realize the reality of the situation in the days to come and become part of the joint struggles very soon.

The 7th CPC has sought further time to submit its report.  They are now likely to submit their report by 31st December, 2015.  Given the way the commission had acted on this vital issue, we are not certain of it.  It is on the specious plea that they would be submitting their report within the stipulated time, they had rejected our demand for interim relief.  They ought to have submitted an interim report to the Government before seeking further time on the memorandum submitted by the Staff Side on merger of DA and Interim relief.  Even if the report is submitted say by 31st December, 2015,  which we feel is unlikely, the Government is bound to take another six months to take a view on the Commission’s recommendations.   It is incumbent upon the National JCA to meet immediately and take appropriate decision in the light of the unexpected step taken by the Commission in seeking further time to submit its report.  They must go ahead with the decision to go on strike from 23rd November, 2015 demanding the Commission to submit urgently an interim report on merger of DA and Interim relief.

There had been no positive steps taken by the government to revive the functioning of the JCM at National or Departmental levels.  There appears to be no intention on their part to cause discussion on our charter of demands.   In this background we must revitalize and rejuvenate the functioning of our   Organizations at all levels.  We have received excellent reports of the strike preparation from all over the country.

DO EVERYTHING NEEDED TO MAKE THE 2ND SEPTEMBER, STRIKE A STUPENDOUS SUCCESS.

With greetings,

Yours fraternally,

M.Krishnan
Secretary General
