Sub: Clarification on admissibility of Charge Allowance in Indian Railways

Consequent to implementation of recommendations of 7th CPC, various references have been received from Zonal Railways regarding admissibility of Charge Allowance in the CPC pay structure and grant of benefits like DA, HRA etc. on the same.

2. In this context, it is informed that the issue of admissibility of Charge Allowance in 7th CPC pay structure is presently under examination in Department of Personnel and Training.

3. In view of the same, it is informed that any clarifications regarding Charge Allowance can only be issued by Board’s office once guidelines in this matter are issued by DoPT.

Termination of the LARSGESS Scheme in view of directions of Hon’ble High Court of Punjab and Haryana and the orders of Hon’ble Supreme Court of India in SLP (C) No.508/2018 dated 08.01.2018
“It has been decided to terminate the LARSGESS Scheme w.e.f.27.10.2017 i.e. the date from which it was put on hold. No further appointments should be made under the Scheme except in cases where employees have already retired under the LARSGESS Scheme before 27.10.2017 (but not normally superannuated) and their wards could not be appointed due to the Scheme having been put on hold in terms of Boards’ letter dated 27.10.17 though they had successfully completed the entire process and were found medically fit.

Sub: Rest Rules for Running Staff

Ref.: Railway Board’s letters No.E(LL)/2009/HER/1 dated 17.07.2018 and 02.08.2018

Pursuant to discussions held with AIRF, during the last PNM Meeting, held on 21-22 June, 2018, Railway Board vide their letter No.E(LL)/2009/HER/1 dated 17.07.2018 had issued instructions that, Call Books on Running Staff should be served upon only after completion of 16 hours rest at Headquarters and after completion of 8 hours at outstation.

It is, however, quite unfortunate that, Railway Board vide their subsequent letter dated 02.08.2018 have pended the said instructions till adequate number of Running Staff becomes available to fill-up large-number of existing vacancies. This is gross violation of bilateral negotiated settlement with the federation.

AIRF, therefore, desires that, orders of pending the instructions, issued vide Railway Board’s letter dated ibid dated 17.07.2018 be withdrawn immediately in the larger interest of industrial harmony.
This may be treated as “Most Urgent”.

Sub: Clarification regarding grant of PCO Allowance to staff of Production Control Organization (JEs/SSEs.)

Ref.: Board’s letter No. E(P&A)I-2017/SP-1/WS-1 dated 30.08.2017.
In context of Board’s letter cited above, references have been received in Board’s office from some of the Zonal Railways, seeking clarifications regarding entitlement of PCO Allowance of JEs/SSEs drawing pay in higher pay level (i.e. level 7, 8 and 9) under MACPS rather than the pay level available for respective post. This issue has also been raised in PNM Forum by NFIR as item No. 12/2018.
2. The matter has been examined in Board’s office and it has been observed that MACPS provides for grant of Financial Upgradation to the employees on personal basis and the concerned employees continue to discharge the duties and responsibilities of the post held by them. In view of this, it is clarified that JEs/SSEs of Production Control Organisations though drawing pay in higher pay level under MACPS, are entitled for PCO Allowance at the rates prescribed for the respective post held by them with reference to their substantive basic pay drawn by the concerned JEs/SSEs in level 6 and level 7 respectively.
3.This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Appointment on Compassionate Grounds – Railway Board Orders

Sub: Appointment on compassionate grounds.

The issue of considering appointment of compassionate grounds(CG) to sons/daughters, born through other than first legally married wife has been engaging the attention of this Ministry for quite some time, in the backdrop of partial quashing of CG related instructions contained in this Ministry’s letter dated 02.01.1992 regarding such appointments, by the Hon’ble High Court/Calcutta in the case (WPCT 20 of 2009) Namita Goldar & Ors. Vs UOI & Others.

2. In this reard, Railway Board has taken into account following observations of the Hon’ble Supreme Court, on the subject of CG appointment, in the case of State Bank of India & another Vs Rajkumar, (Civil appeal No. 1641 of 2010):
“it is now well settled that appointment on compassionate grounds is not a source of recruitment. On the other hand it is an exception to the general rule that recruitment to public services should be on the basis of merit, by an open invitation providing equal opportunity to all eligible persons to participate in the selection process. The dependants of employees, who die in harness, do not have any special claim or right to employment, except by way of the concession that may be extended by the employer under the Rules or by a separate scheme, to enable the family of the deceased to get over the sudden financial crisis. The claim for compassionate appointment is, therefore, traceable only to the scheme framed by the employer for such employment and there is no right whatsoever out side such scheme…”
3. Railway Board has also taken into account following observation of Hon’ble High Court of Jharkhand (Ranchi) in writ petition No. WP(S) 16 of 2014 (pronounced on 24.07.2014) “Compassionate appointment is a matter of policy of the employer and the employer cannot be compelled to provide compassionate appointment contrary to its policy/scheme. When there is specific circular which clearly provides that the children of second marriage of the employee shall not be eligible for compassionate appointment, no direction can be issued to the respondents to consider the case of the petitioner”

4. The matter has been examined and in supersession of this Ministry’s letter dated 02.01.1992 issued under RBE No. 01/1992 and No. E(NG)II/2012/RC-1/21 dated 03.04.2013, it has been decided that the first right of being considered for compassionate grounds appointment is vested, in cases of death of Railway servants while in service, with the legally wedded surviving widow provided she has not remarried at the time of making request for appointments on compassionate grounds. It is clarified that in cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955, there can only be one one legally wedded wife/widow, as second marriage, while spouse is living, is void/voidable in view of the Section 5(1) read with Section 11 of the Act. In this respect, Railway Board’s letter No. E(D&A) 92 GS 1-1 dated 10.04.1992 connects.

5. If aforementioned legally wedded suriving widow does not want herself to be considered for compassionate grounds appointment, she can nominate, for CG appointment, a “bread winner” for the family from amongst the following”

(a) In cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955 : Son(including adopted son); or daughter(including widowed/ adopted/married/divorced daughter). However, if such Railway Servant has left sons/daughters, who have been treated as legitimate or deemed to be legitimate, under Section 16 of Hindu Marriage Act, 1955, neither widow can nominate them as bread winner for CG appointment nor such sons/daughters can claim CG appointment.

(b) In cases of those Railway Servants who are governed by their respective Personal Laws: Son(including adopted son); or daughter(including widowed/ adopted/married/divorced daughter). However, if such Railway Servant has left sons/daughters through second/subsequent legally valid marriages, i.e. other than through first wife and deceased Railway Servant have failed to obtain requisite permission for such second/subsequent marriage as required under section 21 (relating to restrictions regarding marriage) of the Railway Services (Conduct) Rules, 1966, neither first widow/second/subsequent widow can nominate such sons/daughters as bread winner for CG appointment nor such sons/daughters can claim CG appointment. Moreover, such second/subsequent widow also would not have any right to seek compassionate grounds appointment.

6. All Zonal Railway/PUs/Units are directed to decide cases accordingly.

Discontinuing Reservation Chart Preparation

Based on a similar successful experiment conducted by South Western Railway, the practice of pasting of reservation charts on train coaches was discontinued at New Delhi, Hazrat Nizamuddin, Bombay Central, Chennai Central, Howrah and Sealdah stations of Indian Railways on experimental basis for a period of three months. Keeping in view the positive feedback received from Zonal Railways, it has been decided to discontinue pasting of reservation charts on reserved coaches of trains at all erstwhile A1, A & B category of stations as a pilot project for six months starting from 01.03.2018. 
The logic behind doing away with the practice of pasting of reservation charts on reserved coaches is as under:-

 (i) Passengers holding confirmed ticket are aware of their coach/berth number as the same is indicated on the tickets at the time of booking itself, except in case of First Class air-conditioned class.
 (ii) At present around 65% of the reserved tickets are being issued through internet for which, mobile number is invariably captured on which an SMS is sent at the time of booking. 
(iii) Waitlisted and Reservation Against Cancellation (RAC) passengers get their status update on their registered mobile number through SMS at the time of preparation of first reservation chart which is at least four hours before the scheduled departure of the train.
 (iv) Digital charting system has been installed at major stations and at other stations manual boards are installed for displaying the status of the waitlisted tickets to guide the passengers. 
(v) Apart from the above, Interactive Voice Response System (IVRS) service through 139, online booking website is available for passengers for checking the status of the tickets on real time basis. 
(vi) It will save the cost of stationery as well as savings on account of manpower involved in pasting of reservation charts. 

In view of the reasons mentioned above, now there is no need for the passengers to check their reservation status through the reservation charts displayed on the coaches. Moreover, reservation charts continue to be displayed on the station platforms for passengers including senior citizens who would like to view it on charts/ digital charts in all stations including A-1, A & B category stations.

This information was given by the Minister of State for Railways and Coal Shri Rajen Gohain in a written reply to a question in Rajya Sabha on 14.3.2018.

Please refer to Railway Board’s letter of even number dated 12.10.2017 circulating therewith Office Memorandum No. A-27012/02/2017-Estt.(AL) dated 16.08.2017 of the Deptt. of Personal & Training (DOP&T) containing revised policy instructions on Children Education Allowance admissible to Government servants based on the recommendations of Seventh Central Pay Commission.

2. Deptt. of Personnel &Training has now issued another OM No. A-27012/02/2017-Estt.(AL) dated 31.08.2017 regarding reimbursement of Children Education Allowance for differently abled children of government employees. A copy of the said O.M. is enclosed herewith.

The aforesaid instructions of the DOP&T may be adopted mutatis-mutandis in respect of railway employees.

Sub: Recruitment of staff in Level – 1 of 7th CPC Pay Matrix on Indian Railways – Criteria for Physical Efficiency Test (PET) regarding.

Ref: This office letter No. E(NG)ll/2012/RR-1/14 elated 12.11.2012 (RBE No. 126/2012)
Attention is invited to Board’!? letter under reference prescribing criteria for Physical Efficiency Test (PET) for recruitment of staff for all categories in Level – 1 of 7th CPC Pay Matrix (earlier Grade Pay 1800/-) on Indian Railways.

2. The matter has fuither been reviewed, keeping in view the requirement of the job and it has been decided by Ministry of Railways (Railway Board) to amend the existing criteria for recruitment from open market in all categories in Level-1 , as per norms prescribed below:-

Male Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 4 minute and 15 seconds 5 minutes and 40 second

Female Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 5 minutes and 40 second
3. The above norms will be _applicable in all future recruitment from open market in Level-1. Notification, 1f any, issued may please be amended,Suitably by issuing a corrigendum.
