Sub: Recovery of Provident Fund under EPF Scheme, 1952 – Reg.

With reference to the captioned subject, I am to forward herewith a copy of DO. Letter no.CAIU/011(33)2015/HQ dated 6th June 2016 which is self – explanatory.

The salient features highlighted by Sri. C.Chakraborty, Addl. Central Fund Commissioner-II, EPFO, New Delhi in his letter is reproduced hereunder:

1. The issue of coverage of contract workers under the EPF & MP Act, 1952 has been flagged as an area of top most concern by the Government of India.

2. Contractors claim huge amount towards EPF of contract workers from the Principal Employer (KVS) but either do not deposit it at all or deposit it partly, thus depriving these workers of Provident Fund, Pension and Insurance benefits.

3. As per Paragraph 30(3) of EPF Scheme, 1952, it is the responsibility of the principal employer to pay both the contributions payable by him in respect of the employees directly employed by him and also in respect of the employees employed by or through a contractor.

4. In their website www.epfindia.gov.in on the “establishment search option”, a provision is available to verify as to whether the agencies and contractors having Provident Fund Code numbers are regularly depositing Provident Fund contributions every month to check the compliance position of the agencies and contractors to the provisions of the Act and the Schemes framed there under to which the contracts are awarded by the department.

5. To bridge the gaps and with the view to make the system more robust, transparent and to reduce the cost of compliance for the employer, EPFO has launched a facility for the principal employers to register at the EPFO website the details of contract employers of each contract awarded, which can be viewed and updated at any time.

6. The Regional and Sub-Regional office will also take steps to secure compliance of employees engaged by the contactor towards Employees Provident Fund.

7. A representative can be deputed to contact the concerned Regional PF Commissioner of the Regional/Sub-Regional Office to know further methodology.

8. The details of the contract employers of each contract should be uploaded to facilitate compliance under EPF and MP Act, 1952.

It is requested that the contents of DO letter dated 6th June 2016 may be brought to the notice of all the Principals under your region and may also be noted at your end for compliance in letter and spirit.

Abolition of Affidavit and Attestation by Gazetted Officer and adoption of Self-Certification in KVS

Sir/Madam,

In pursuance of the Ministry of Personnall Public Grievances & Pensions D.O. letter No.K-11022/67/2012-AR dated 17.07.2014, read with Govt. of Punjab Memo No.3/7/2010-Trg.(3)/1007 dated 10.03.2010, the competent authority, KVS has decided to implement the following in KVS with immediate:-

1 . Self -attested photocopy of Date of Birth Certificate by the parents/legal guardian of the child should be accepted, at the time of grant of admission instead of attestation by a Gazatted Officer/any other Authority.

2. All self-attested photocopy of testimonials from the candidates appointed in KVS be accepted instead of attestation by a Gazatted officer/any other Authority.

3. However, the self attested photocopies of Date of Birth certificate & other testimonials must be verified from the original documents for authenticity and a certificate to this effect must be recorded by Principal/Head of Office etc on the photocopy of the document before placing it on records.

This may be circulated among all Kendriya Vidyalayas functioning under your administrative jurisdiction with the instructions that the same may be brought to the notice of all staff members under proper acknowledgement. These instructions be followed by all Regional Offices/ZIETs Joint & KVs Commissioner meticulously.

Admission Guidelines for KV Schools with effect from Academic Session 2016 -17

KENDRIYA VIDYALAYA SANGATHAN – GUIDELINES FOR ADMISSION IN KENDRIYA VIDYALAYAS

PART- A

GENERAL GUIDELINES

1. In supersession of all the guidelines governing admissions in Kendriya Vidyalayas that have been issued in the past, the following guidelines are issued to regulate admissions in the Kendriya Vidyalayas with effect from the academic session 2014-15. These guidelines are not applicable to Kendriya Vidyalayas located abroad.

2. DEFINITIONS

Unless the context suggests otherwise, the definition of the following terms used in these guidelines would be as below:-

(i) CENTRAL GOVERNMENT EMPLOYEES: An employee who draws his emoluments from the consolidated fund of India.

(ii) TRANSFERABLE: An employee who has been transferred at least once in the preceding 7 years shall be deemed to be transferable.

(iii) TRANSFER: An employee would be treated as transferred only if he/she has been transferred by the competent authority from one place/urban agglomeration to another place/urban agglomeration which is at a distance of at least 20 kms. and minimum period of stay at a place should be six months.

(iv) AUTONOMOUS BODIES / PUBLIC SECTOR UNDERTAKINGS: Organizations which are fully financed by the government or where the government share is more than 51 per cent would be deemed to be autonomous bodies/ public sector undertakings.

3. PRIORITIES IN ADMISSION

The following priorities shall be followed in granting admissions:-

(A) KENDRIYA VIDYALAYAS UNDER CIVIL/DEFENCE SECTOR:

1. Children of transferable and non-transferable Central government employees and children of ex- servicemen. This will also include children of Foreign National officials, who come on deputation or transfer to India on invitation by Govt. of India.

2. Children of transferable and non-transferable employees of Autonomous Bodies / Public Sector Undertaking/Institute of Higher Learning of the Government of India.

3. Children of transferable and non-transferable State Government employees.

4. Children of transferable and non-transferable employees of Autonomous Bodies/ Public Sector Undertakings/Institute of Higher Learning of the State Governments.

5. Children from any other category including the children of Foreign Nationals who are located in India due to their work or for any personal reasons. The children of Foreign Nationals would be considered only in case there are no Children of Indian Nationals waitlisted for admission.

Note: Preference in Admission to wards will be based on the number of transfers of the parents in the last 7 years.

(B) KENDRIYA VIDYALAYAS UNDER PUBLIC SECTOR UNDERTAKINGS/ INSTITUTES OF HIGHER LEARNING:

1. Children and grandchildren of employees of the Project Sector/Institutes of Higher Learning which are the sponsors of the Vidyalaya, Children of Project employees & Post Graduate students who are working on long term research projects, Children of regular Council of Wardens (COW) employees and children and grand children of retired employees.

Note: Preference in Admission will be given to children of serving employees, grand children of serving employees and children and grand children of retired employees in that order.

2. Children of transferable and non-transferable Central government employees and children of ex- servicemen. This will also include children of Foreign National officials, who come on deputation or transfer to India on invitation by Govt. of India.

3. Children of transferable and non-transferable employees of Autonomous Bodies/Public Sector Undertaking/Institute of Higher Learning of the Government of India.

4. Children of transferable and non-transferable State Government employees.

5. Children of transferable and non-transferable employees of Autonomous Bodies/ Public Sector Undertakings/Institute of Higher Learning of the State Governments.

6. Children from any other category including the children of Foreign Nationals who are located in India due to their work or for any personal reasons. The Children of Foreign Nationals would be considered only in case there are no children of Indian Nationals waitlisted for admission.

4. ELIGIBLE AGE FOR ADMISSION
