Office Memorandum

Sub: Grant of Advance – Amendment to Rule 80 of Compendium of Rules on Advances to Government Servants.

The undersigned is directed to say that in pursuance of a reference received from the Department of Personnel & Training regarding the demand raised by the Staff Side in the National Council (JCM), the existing provisions of Compendium of Rules on Advances – Rule 80 – relating to Amount of Advances to the families of Government Servants who die while in Service, are retained and amended, as per attached annexure.

2. These orders will take effect from the date of issue of this Office Memorandum. The cases where the advances have already been sanctioned need not be reopened.

3. In so far as persons serving in Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

4. All the Ministries/Departments are requested to bring the amendments to the notice of all its attached and subordinate offices for their information.

Wife has right to know husband’s salary: CIC

New Delhi: Wifes of government servants have a “right” to know salary particulars of their husbands and these details should also be made public by their offices as mandated under suo-moto disclosure clause of the RTI Act, the Central information Commission has held.

Information Commissioner M Sridhar Acharyulu said every spouse has a right to information about the salary particulars of the other especially for the purpose of maintenance.

“More so, wife has a right to know the salary particulars of the husband, who is an employee of the public authority,” he said.

The commissioner further said that the details about a government employee’s salary is no third party information and these have to be voluntarily disclosed under Section 4(1)(b)(x) of the RTI Act.

He said the salary paid to the public authority is sourced from the tax paid by the people in general and it has to be disclosed mandatorily under the RTI section.

“The information about the salary of employee or an officer of the same public authority cannot be considered as a third party information… Public authorities cannot reject such RTI applications about salary under the pretext of the third party information,” he held.

Acharyulu warned the Home Department of Delhi government that such denial of information will be wrongful and could incur penalty. The warning was in context of an application filed by Jyoti Seherawat seeking salary slip of her husband who is employed at the Home (General) department.

The information was denied as her husband gave in written to the department that such an information should not be provided to anyone.

Central Govt. not raising retirement age of its employees

   The government today (9/8/2011) said there is no proposal to raise the retirement age of its employees from 60 years at present.

   "At present there is no proposal to increase the age of retirement of Government servants," Minister of State for Finance Namo Narain Meena said in a written reply to the Rajya Sabha.

Maintenance of Service Books

4.1 The rules governing the maintenance of service books in respect of Government servants are contained in the FRs&SRs and the GFRs. Some important provisions of rules which should be kept in view while maintaining service books are mentioned in the ensuing paragraphs.

4.2  A Service Book should be maintained by the Head of Office for every Government Servant (Gazetted and Non-Gazetted) holding a substantive post on a permanent establishment or officiating in a post or holding a temporary post likely to last for more than one year.
