INDWF/Circular/025/2016

Date 05.07.2016

To
All Affiliated Unions of INDWF,
Office Bearers & Working Committee members of INDWF

Dear Colleague,

INDWF vide its circular No.24 Dt 28.06.2016 communicated to all our affiliated unions to continue the momentum generated, to hold demonstrations, rallies etc in all work places every day from 4th July, 2016 to 10th July, 2016 to intensify the Indefinite Strike w.e.f.11.07.2016 from 0600 Hrs as per the decision of NJCA.

After the Cabinet meeting of Government of India held on 29.06.2016 approved the 7th CPC recommendations without any change in the Empowered committee’s recommendations which has disappointed the Central government employees as a whole. The Cabinet further considered appointing committees for the following issues to a committee to decide within a period of 4 months.

1.)The commission examined a total of 196 existing Allowances and by way of rationalisation, recommended abolition of 51 Allowances and subsuming of 37 allowances. Given the significant changes in the existing provisions for allowances which may have wide ranging implications the cabinet decided to constitute a committee headed by Finance Secretary for further examination of the recommendations of 7th CPC on allowances. The committee will submit its report within 4 months in a time bound manner. Till a final decision, all existing allowances will continue to be paid at the existing rates.

2) Cabinet decided to constitute two separate committees.

a) To suggest measures for streamlining the implementation of National Pension System (NPS).

b) To look into anomalies like to arise out of implementation of the commission’s report.

Main features of the adverse recommendations of VII CPC and cabinet approval.

Minimum pay increased from Rs.7000/- to Rs.18000/- only against Rs.26000/- increase of total pay on revision is 7000 + 125% of DA Rs.8750 =Rs.15750/-. Total minimum pay Rs.18000 —Rs.15750 = increase only Rs.2750/-. Out of Rs.2750/- 10% Pay towards NPS = Rs.1800 – balance Rs.950/- Total increase amounts only Rs.950/- for next 10 years. No increase in allowances, All interest free advances abolished. This has caused very serious discontentment among Central Government employees.

* CCL — 1st year 100% salary 2nd year only 80% salary

*Meagre increase in minimum pay.

*Fitment Factor is 2.57 to apply for pay revision.

* CGIES (insurance) no change.

* Rate of annual increment retained at 3%.

After the approval of VII CPC report by Government of India on 29.6.2016, the NJCA met on 30.06.2016 at Delhi and unanimously decided to continue the Indefinite Strike w.e.f.11.07.2016.

On 30.06.2016, the NJCA was informed to meet Finance Minister and some ministers at Home Minister residence. Accordingly, few NJCA members met the ministers at 09.30 p.m. The views of NJCA and the disappointment of Central Government employees placed before them. Then Finance minister suggested out on the issue of minimum pay and multiplication factor may be referred to a committee. But NJCA leaders said that if any official meeting is convened or official communication issued, it may be placed before the NJCA and consider to meet and discuss otherwise, we do not agree and continue with our Strike proposal.

Then the NJCA met on 01.07.2016 again the above views were adopted and decided to meet on 06.07.2016 awaiting for any official communication from the Government of India.

Hence, it is intimated to all our affiliated unions, the attitude of Government of India without holding any discussions and not willing to settle the demands through mutual discussions and deciding unilaterally ignoring the National Council JCM is considered a highly objectionable and not agreeable. Thus, NJCA decided to proceed with our decision to commence Indefinite Strike w.e.f.11.07.2016 from 6.00 a.m. onwards.

Any progress before 10.07.2016 takes place, it will be accordingly intimated but till such time you have to proceed with all action for the success through Indefinite Strike.

Yours Sincerely,

Sd/-

Railway Streamline procedure for issue of concession certificate to physically challenged persons (Divyang)

Ministry of Railways has decided to streamline the procedure for issuing of concessional certificate to physically challenged persons (Divyang) in case of change of residence and also in some other cases for the convenience of the passengers. Indian Railways has already facilitated convenient booking of concessional tickets including online ticketing for the physically challenged persons.  The following decisions have been taken to streamline various issues : -

1.      In those cases where the applicant has shifted to a new place and his/her concession certificate has been issued by the Government Hospital of his/her previous residence, he/she may be allowed to apply to DRM’s office (suppose A) of current residence. This division will then get the concession certificate verified by the concerned division/zone (suppose B) in which the Government hospital falls which has issued the concession certificate. Such division/zone will then send the verification report to the referring division (A) which had sent the verification request. Based on the verification report, Division ‘A’ will issue the ID card to the physically challenged person or to his/her representative (with proper authority letter) on his/her behalf. However, original certificates (including address proof indicating current residence) must be shown at the time of collection of card. The time limit for disposal of the application/issue of ID card in such cases is two months from the date of receipt of application.

2.      The photo I.D. card issued to the eligible physically handicapped person is valid for five years from the date of issue or till the last date upto which the concession certificate is valid whichever is earlier after which it has to be renewed/re-issued for which the same procedure as for issue of fresh photo ID card is to be followed.

As per rules under IRCA Coaching Tariff No. 26 Para (1) Vol. (II), in certain cases as indicated above the validity of concession certificate exceeds five years : -

In case of permanent disability, the concession certificate is valid for ten years in the age group of 26 to 35 years.
In case of permanent disability, the concession certificate is valid for whole life of the concerned person above the age of 35 years.

In cases mentioned above where the validity of concession certificate issued by the hospital authorities is 10 years or the whole life as the case may be, fresh verification of the concession certificate is not required for renewal of photo I.D. card in case the existing concession certificate is still valid. Remaining conditions/procedure for issue/renewal of the photo I.D. card will remain the same.

iii) OFB Instruction No. 75/2010/PCC dated 11/08/2010 (available in OFB COMNET).

It has been observed from the correspondences received from various Factories/ Units that whiles preparing the relative merit point, after lifting the ban on 3 years time limit on compassionate appointment, some factories /units have awarded more marks as per the new slab rates in comparison with the old slab rates (viz, Family Pension (excluding DA), Terminal Benefits & movable/Immovable property ) while agonists some others, less marks have been awarded (viz. monthly income of earning member of the family & No. of unmarried daughters) although the net outcome more or less is the same. The same is creating confusion while processing the case of compassionate appointment.

2. In this connection, attention is invited to the MOD communication dated 22/01/2010 and dated 14/05/2010 circulated vide above reference, wherein it has been clearly mentioned that after implementation of the 6th CPC recommendations, the point allotted to various aspects i.e., family pension and terminal benefits etc. have become redundant and that the revised point based on a 100 point scale will be adopted in place of 100 poInt scale circulated vide I.D. The Govt may Increase the Minimum Pay to defuse Strike Threat- Livemint

The Govt may Increase the Minimum Pay to defuse Strike Threat- Livemint

Under pressure from the unions, the government has indicated that it may increase the minimum monthly pay of central government employees beyond the Rs.18,000 suggested by the Seventh Pay Commission, seeking to defuse a strike threat.

The assurance has divided several government unions on whether to go ahead with the indefinite strike starting 11 July.

Three cabinet ministers—finance minister Arun Jaitley, home minister Rajnath Singh and railway minister Suresh Prabhu—met representatives of several government staff unions late on Thursday for almost two hours and assured them that their demand would be looked into.

The unions have been demanding Rs.26,000, higher than the Rs.18,000 approved by the cabinet on Wednesday on the Seventh Pay Commission’s report. The government said it was more than doubling minimum pay from Rs.7,000 after accepting the recommendations of the commission, which would put an extra Rs.1.02 trillion in the hands of 10 million government employees and pensioners.

“Three top ministers called us and we met at Rajnath Singh’s house for two hours till 11pm last night. We have been assured that the minimum wage issue is going to be referred to one of two committees that the government is setting up to rectify any anomalies in the pay commission recommendations’ implementation,” said Shiva Gopal Mishra, general secretary of the National Joint Council of Action (NJCA), a confederation of several government staff unions.

The council claims a membership of 3.3 million, including workers of Indian Railways, the country’s largest employer.

Mishra said Jaitley accepted their concern. “He said the government will try to rectify some of our demands, including minimum wage,” the NJCA general secretary said.

Union leaders claimed that the pay commission’s recommendation and the government’s announcement raising minimum pay from Rs.7,000 to Rs.18,000 had glossed over the fine print.

“Now, base pay plus dearness allowance (DA) makes the minimum wage Rs.15,700. They have increased it to Rs.18,000,” said K.K.N. Kutty, national president of the Confederation of Central Government Employees and Workers.

“When you are doing away with DA in the new system, the hike cannot be just Rs.2,000,” said C. Srikumar, general secretary of the All India Defence Employees Federation, a union of civilian workers in factories and establishments under the ministry of defence.

Mishra said the home minister assured them that “their interaction with us has the blessings of PM Narendra Modi”.

“On minimum wage, we are for a negotiated settlement and it seems there is some consideration at the highest level,” he added.

An office-bearer at an employees’ union said the government’s offer had posed a dilemma to union leaders, noting that it wasn’t a written assurance, “without which it will be tough to accept that the government is indeed serious in reworking the minimum wage”.

The offer had ended up dividing the unions on whether to proceed with the strike, this person said on condition of anonymity. “And we could not reach a conclusion on Friday on our next course of action,” he said, adding that the railway workers’ union was hesitant about going on strike.

Mishra, who is also the general secretary of All India Railwaymen’s Federation, sounded a conciliatory note.

“We are fighting for the welfare of our own workers…a strike is an option if government does not listen to us. There seems to be a political willingness to solve what we are demanding and that’s what was indicated last night,” Mishra told reporters in New Delhi.

On Friday, NJCA wrote to all unions that “government has proposed to refer the issue of minimum wage and fitment formula (for calculation of salary) to a committee for reconsideration. The NJCA will await communication in this regard from the government”.

It said that it will meet on 6 July again to decide on the proposed strike.

What is interesting is that increasing the minimum pay will change the salary fitment calculations. If the minimum wage is hiked from Rs.18,000 to even Rs.20,000, the fitment rate will be higher than the 2.57 times approved by the government based on the pay commission recommendations.

“If the 2.57 fitment formula is tinkered with, then salary and pension in general for all segments of employees will go up, putting further stress on the exchequer. So the government has to walk a fine balance and a lot of homework is required,” said a government official, who declined to be named.

The acceptance of the pay commission recommendations is a potential boost to the consumer economy.

A further hike could lift consumption further, but it will be tough on government finances, the official said.

Rating agency India Ratings and Research Pvt. Ltd said the gross impact of pay hike on the economy is likely to be Rs.94,775 crore.

“The central government will receive income tax on this payout and collect excise duty on consumption, after sharing the increase in income tax and excise duty with states. Thus the net impact on the central government finances is estimated to be Rs.80,641 crore,” said D.K. Pant, chief economist of India Ratings and Research.

Finance Minister Promises ‘Minimum Pay’ 7th Pay Commission Hikes

New Delhi: Finance Minister Arun Jaitley has promised to consider to hike the minimum pay of central government employees beyond Rs 18,000, a day after the cabinet cleared 7th Pay Commission award for its employees.

Central government employees have been demanding hike in minimum pay since November 19, when 7th Pay Commission headed by Justice A K Mathur submitted its report to Jaitley.

The Finance Minister said he was not ‘rigid’ on the issue and the government will try to rectify some of employees’ demands including minimum pay.

Jaitley met with representatives of central government employees unions at Home Minister Rajnath Singh’s house for two hours till 11pm on Thursday night.

Jaitley, Rajnath Singh and Railways Minister Suresh Prabhu attended the meeting and assured unions leaders of central government employees that their demand would be looked into.

“The minimum pay of central government employees Rs 18,000 was made on recommendations of the 7th Pay Commission. But government will consider hiking it after discussions with all stakeholders,” he said in the meeting.

“Three ministers called us and we met them at Home Minister Rajnath Singh’s house late on Thursday for almost two hours. We have been assured that the minimum pay issue is going to be referred to one of two committees that the government is setting up to rectify any anomalies in the pay commission recommendation implementation,” Shiv Gopal Mishra, General Secretary of the National Joint Council Action (NJCA), a confederation of several central government employees’ unions, told reporters after the meeting.

The council claims a membership of 3.3 million, including the central government employees – Railways, Defence, Postal, Income Tax, Central Customs and Central Excise etc.

NJCA already have rejected Modi government’s overall 23.5 percent pay hike bonanza based on 7th Pay Commission recommendations and would go on indefinite strike from 6 am, 11 July.

They have been demanding Rs 26,000 as minimum pay instead of Rs 18,000 approved by the government based on the 7th Pay Commission’s recommendations.

Mishra also said the Home Minister assured them that “their interaction with us has the blessings of PM Narendra Modi”.

“On minimum pay, we are for a negotiated settlement and it seems there is some consideration at the highest level,” he added.

The increasing the minimum pay will change the salary fitment factor. If the minimum pay is hiked from Rs.18,000 to even Rs.20,000, the fitment factor will be higher than the 2.57 times approved by the government based on the pay commission recommendations.

If the 2.57 fitment formula is tinkered with, then salary and pension in general for all central government employees will go up.

NJCA wrote to all central government employees unions that “government has proposed to refer the issue of minimum pay and fitment factor to a committee for reconsideration. The NJCA will await communication in this regard from the government”.

It said that it will meet on 6 July again to decide on the proposed indefinite strike from July 11.

BPMS has Decided that All the Affiliated Unions will Support the Indefinite Strike from 11th July 2016

Ref : BPMS / CIRCULAR / 17th TC / 07

Dated : 30th Jun 2016

To,
The Office Bearers & CEC Members BPMS
President / Secretary of Unions
Affiliated to BPMS

Sub :- AGITATIONAL PROGRAMME ON 7TH CPC

Dear Brothers & Sisters,
Sadar Namaskar.

1. As we are aware that after a long deliberation between the stake holders and the Departments/Ministries, concerned Secretaries had submitted their recommendations on the 7th CPC to the Empowered Committee and after considering it, the Central Cabinet has accepted the recommendations of the 7th CPC on 29th June 2016 ignoring the submissions of this Federation.

2. The Govt has not enhanced the Minimum Pay from Rs 18000/- to 24000/-, Multiplying Factor from 2.57 to 3.42, rate of increment from 3% to 5%, non-merging of any of the pay scale of Group ‘C’, non-resolving the issue of MACP etc.

3. This has caused discontentment amongst the employees. It has to be kept in the mind that the then Defence & Finance Minister Shri Arun Jaitley and MoS of PMO Dr. Jitendra Singh had assured the delegation of BPMS/BMS to resolve the above issues in favour of the employees. But now the Govt has reneged to its promises.

4. In this situation, Bhartiya Mazdoor Sangh, Govt Employees National Confederation & BPMS have decided to observe an agitational programme with immediate effect till 08th July 2016. In this agitational programme, Gate Meetings, Slogan shouting, Dharna, Procession, March, Demonstration at Main Gate etc will be organized as per feasibility. On the last day (08.07.2016) unions will submit a memorandum to respective Head of Departments & local Hon’ble Member of Parliament addressed to Hon’ble Prime Minister of India with a copy to BPMS.

5. Further, Shri Shiv Gopal Mishra, Convener, NJCA has requested to BPMS vide his letter (No NJC/2016/07th CPC dated 07.06.2016) to support in the proposed indefinite strike commencing from 11th July 2016. This Federation has considered the same and decided that all the affiliated Unions will support the indefinite strike from 11th July 2016.

We hope for full support and cooperation to give a great success to the programme.

With regards.

Brotherly yours,

(M P Singh)

NFIR Clarified that there is No Change on Indefinite Strike Decision of NJCA

Status of HRA and TA in 7th CPC Salary

The Government has decided to Constitute a committee to examine the 7th CPC Allowances. We cannot assume anything about the rates of Allowances until the Committee submit its report on Allowances.

Mainly the HRA and TA are one of the Main component of Salary.

So the government employees are disheartened by the Government decision to take time to decide on these allowances.

Already it has been reported that 7th CPC will be implemented in a staggered manner.

Now it is clear that, if the 7th Pay Commission come into force with immediate effect after publication of Gazette Notification, the HRA and TA will be paid at Sixth CPC rates in pre revised Scale. It means the amount of HRA and TA paid in Sixth CPC will continue for next few months. The Central staffs will be paid all the allowances in pre revised Scale up to the Committee decides on Allowances. It will take more than four months for Government to decide on HRA and TA.

So actual increase on account of 7th pay commission implementation will be 14.29 percent over Sixth CPC Basic + 125% DA. The increase in Basic Pay only will be reflecting in 7th CPC salary .

Nobody can say that 7th CPC gives 23.45% increase in Pay and Allowance for CG employees at least for some time.
