Sub: State Public Sector Undertaking / Boards - Revision of scale of pay to certain categories of employees - extension to State Public Sector Undertaking / Boards for adoption - Regarding.

   In the G.O. first cited, Government have implemented the revision of scales of pay to the employees of State Public Sector Undertakings / Statutory Boards taking into account the orders issued in G.O.Ms.No. 234, Finance (PC) Department dated 1.6.2009 on the recommendations of the Official Committee on revision of scales of Pay and Allowances etc. to the Government employees based on the recommendation of the Central Sixth Pay Commission.

   2. Government have implemented the revision of scales of pay based on the recommendations of One Man Commission to certain categories in various G.Os and such G.O.s have not been extended to the employees of State Public Sector Undertakings / Boards till date. However, the Chief Executive Officers of all State Public Sector Undertakings / Boards were requested to forward suitable / comprehensive proposal to Government for examination subject to certain conditions mentioned therein.

   3. In the meantime, revision of pay in respect of certain categories like Junior Assistant / Typist/ Assistant / Steno-Typist Grade III, Record Assistant, Record Keeper, Drivers have been ordered in G.O.s 3rd, 4th & 5th cited.

   4. Now, some of the State Public Sector Undertakings / Boards have been requesting to revise the Grade Pay to Assistants, Junior Assistants/ Typists, Steno-Typist Grade III, Drivers etc., in line with the G.O.s mentioned at Para 3 above.

   5. In order to bring out parity and standardization in the pay scales available to the employees of State Public Sector Undertakings / Boards vis-ã-vis Government employees, I am directed to state that the G.O.s 3rd, 4th & 5th cited may be extended to the employees of State Public Sector Undertakings/Boards for adoption duly considering the aspects mentioned at Para 2(a) to 2(f) of Government Letter 2nd cited and subject to the conditions that (a) the State Public Sector Undertakings/Boards should not seek any financial assistance from Government for this purpose and (b) the subject may be placed before the respective Board of Directors for approval.

In continuation to Government Letter 3rd cited, the Chief Executive Officers of all State Public Sector Undertakings / Boards are requested (a) to take into consideration of Government Order 4th cited while sending proposals to Government for examination and (b) to regulate the scales of pay & grade pay in line with the orders issued in Government Order 4th cited, in case, the State Public Sector Undertakings / Boards have already implemented the recommendations of the One Man Commission to their employees with the approval of the Government.

   I am directed to state that the Government in the G.O. first cited have extended the orders issued in G.O.Ms.No.234 Finance (Pay Cell) Department dated: 1.6.2009 [wherein orders were issued on the recommendations of the Official Committee on revision of scales of pay and allowances etc., to the Government employees based on the recommendations of the Central Sixth Pay Commission] to the employees of State Public Sector Undertakings / Boards subject to certain conditions with an intention to bring out parity and standardization in the pay scales available to the employees of State Public Sector Undertakings / Boards vis-à-vis Government employees.

   2) Subsequently, In Government Lr.No.48070/BPE/2010 dated: 23.9.2010 directions were issued indicating that the State Public Sector Undertakings / Boards shall forward suitable/comprehensive proposal to Government for examination in the event of any decision for adopting the revised scales of pay to the employees of State Public Sector Undertakings /Boards being taken by the Board of Directors based on the orders issued arising out on the recommendations of One Man Commission duly taking into account certain aspects mentioned therein.

   3) Now, it appears that some State Public Sector Undertakings / Boards have been fixing higher scale of pay to their staff than that of the scale of pay available for Government employees who are having similar designation, duties and responsibilities, etc., without the orders of Government which aspect has been causing embarrassment and also disparity and non-standardization in the pay scales available to the employees of State Public Sector Undertakings /Boards vis-à-vis Government employees.

   4) In view of the above position, I am directed to inform that all the State Public Sector Undertakings / Boards shall take appropriate action

   (a) to fix the scale of pay to their workers/employees in such a manner that the scale of pay and grade pay so fixed should not exceed the scale of pay and grade pay permissible for Government employees holding the comparable post in Government depts. (i.e. having similar designation / nomenclature, duties and responsibilities, qualification etc.,) There shall be a policy to cap up the wage/salary of the posts at the level as obtained for similarly placed Government employees and under no circumstances the wage/salary of workers/employees in State Public Sector Undertakings /Boards shall stretch beyond the Pay + Grade Pay of similarly placed Government employees as of now and in future revisions;

   (b) to regulate such cases (i.e. where scale of pay has been fixed to their employees higher than that of the pay scale permissible for Government employees for the comparable post) and refix the pay as indicated in para 4(a) above;

   This order may be placed before the Board of Directors in the immediate next meeting.

Revision of Scale of Pay based on the recommendation of the One Man Commission — Consequential revision of terminal benefits — Clarification — Regarding.

Sub: Tamil Nadu Revised Scales of Pay Rules, 2009 — Revision of Scale of Pay based on the recommendation of the One Man Commission — Consequential revision of terminal benefits — Clarification — Regarding.

 1. G.O.Ms.No: 234, Finance (Pay Cell) Department. dated: 1—6--2009.
2. Government letter No: 34124 / Pay Cell / 2009-1, Finance Department, Dated: 26—06--2009.
3. G.O.Ms.Nos: 254 to 338 Finance (Pay Cell) Department, Dated: 26-08-2010.
4. From the Chief Engineer (Buildings) PWD., Buildings Organisation, letter No: E3(1)/45229/2010, dated: 21—12--2010.

I am to invite your attention to the references cited.

2. In the reference second cited, among others necessary general clarification has been issued under Serial No: 8 to the effect that the employees retired between 1--1--2006 and 31--12--2006 are entitled for notional pay fixation in the revised scales of pay, the undrawn pay shall be reckoned for sanctioning pensionery benefits consequent on the implementation of the Revised Scales of Pay. Therefore, it was clarified that the difference amount of encashment of Earned Leave / Unearned Leave on Private Affairs / DCRG due
to revision of scales of pay in respect of the retirees from 1--1--2006 to 31--5--2009 shall be disbursed in three equal annual instalments as specified in the Government Order first read above.

3. In the Government Orders third read above, based on the recommendations of One Man Commission, the scales of pay of certain categories have been revised notionally with effect from 1--1--2006 and from
12—1 2--2007 with monetary benefit from 1 --8--201 0.

4. The Chief Engineer (Buildings) Public Works Department in the reference fourth cited has raised presumption that in the case of employees retired between 1--1--2006 to 31--7--2010 and between 12--12--2007 and 31—7--2010, as the case may be from the posts for which the scales of pay were revised as per the One Man Commission recommendations in the Government Orders third cited and any subsequent orders with effect from 1--1--2006 / 12—12--2007 with monetary benefit from 1--8--2010 and
subsequent dates are also eligible for the difference of encashment of leave salary, DCRG and commutation of pension in three instalments as clarified in the Government letter second cited. In this connection, I am directed to confirm the above presumption.

I am to invite your attention to the references cited.

2) In the reference second cited, necessary guidelines were issued on the fixation of pay in revised Selection Grade / Special Grade scales of pay consequent on the revision of the Ordinary Grade scales of pay based on the recommendations of One Man Commission which was given notional effect from 1—1—2006/12—12—2007 with monetary benefit from
1—8—2010. Hence, I am to inform that the monetary benefit of Selection Grade/Special Grade scales of pay erroneously indicated as 1—1—2007 under note of Annexure —l and in the illustrations of Annexure — II of the Government letter second cited shall take monetary effect from 1—8—2010 only.
