The issue of placement of Graduate Engineers (Drawing) joined railways prior to 01/09/1998 came up for discussion in the separate meeting held between the Federations and the Board (MS/FC) on 1910512015. During the meeting following key points were emerged:-

In a Production Unit like ICF, there are 11 Graduate Engineers. These were recruited prior to 1998 in the pre-revised Scale of Pay of Rs. 5500-9000.

These Engineers were promoted to the pre-revised Scale of Pay of Rs. 6500-10,500 through normal promotion and a few through LDCE.

Since LDCE quota for promotion to pre-revised Scale of Rs. 6500-10,500 was very very limited, only a couple of persons were accommodated and the remaining persons were promoted through normal promotion against promotion quota.

Federation also desires to highlight a peculiar case of Shri Karthikeyan. N of ICF. He was working as JE-II in the pre-revised Scale of Rs. 5000-8000 (required entry qualification is Diploma in Engineering only) during the period 1992 to 1996. Since he was holding Engineering Degree he was subsequently recruited against DR Quota in the V CPC Pay scale of Rs. 5500-9000 on 11/12/1996. However he was treated as holder of entry Grade Pay Rs. 4200/- only from the date of his appointment.

2. Although in the meeting held on 19/05/2015 with the Railway Board (MS & FC) the discussions were inconclusive, the Federation did mention that those Drawing cadre staff recruited with the entry qualification of B. Tech were allotted incorrectly the pay Scale of 5500- 9000 (6th CPC/GP 4200/-), instead granting them the 5th CPC pay Scale of 6500-10500(6th CPC GP 4600/-). To remedy this Anomalous situation, it was suggested that in the case those Engineering Graduates (Drawing), they be reckoned as holders of entry Gp 4600/- -PB-2for the limited purpose of MACP duly appropriately modifing the Board’s ietter dated 20th June 2011 for covering all such cases.

As another meeting date has not yet been fixed, the issue continues to remain unresolved. It is also relevant to place on record that while some Engineering Graduates benefited on account of induction against LDCE quota, the similarly placed Engineering Graduates who got appointed against promotion quota vacancies of Rs. 6500-10,500 (5th CPC) have not been covered-for the against LDCE Quota. This anomalous situation needs to be rectified for ensuring equal reatment to all the Engineering Graduates of Drawing cadre whether reached pay scale of Rr. 6500-10500 through promotion or through LDCE quota.

NFIR, therefore, requests the Railway Board to reconsider their decision and see that all Engineering Graduates of Drawing cadre are granted MACP duly treating them as holders of entry Grade Pay of Rs.4600/-(PB-2).

(1) Financial up-gradation under MACPS to the directly recruited Graduate Engineers Considering entry Grade Pay as Rs. 4,600/- for the purpose of MACP to all the directly recruited Engineering Graduates in Design/Drawing Cadre and other Cadres.

Reference notes on pre-page.

2. The issue relating to grant of third financial upgradation under MACP Scheme to employees who have completed 20 years of service after earning first promotion has been considered by this Department in consultation with the Department of Expenditure.

3. Specific reference of Ministry of Railways was illustrated as under:
i) Date of joining as JAA (GP Rs. 2800/-) (on DR basis) - 12.11.1984
ii) Date of 1st Promotion as AA --- 08.11.1987

In the above case, as he could not complete 24 years of service as on 31.08.2008, he could not avail 2nd ACP. The employee was allowed 2nd MACP w.e.f. 01.09.2008 and his eligibility for grant of 3rd MACP will be on completion of 30 years of service ie. w.e.f. 12.11.2014.

4. The basic concept of MACP Scheme is to provide 1st, 2nd and 3rd financial upgradations to an employee in consideration of completion of 10/20/30 years of regular service in the same scale/Grade Pay respectively. Regular service for grant of benefits commence from the direct entry grade. The Scheme also provides for grant of financial upgradation whenever a person has spent 10 years continuously in the same grade pay.

5. Even though the illustrations No. (i), (ii) and (iii) of para 28 of the Scheme suggest that while 2nd MACP could be given after overall 18 years and the 3rd one after overall 28 years, the fact remains that in both the cases the crucial 2nd and 3rd MACPS is being given only after the mandatory 10 years residency for the 2nd and 3rd MACP respectively. Thus, the 3rd MACP is intended to be given based on either 10 years from the 2nd MACP/Promotion or 30 years of the overall service. Either of these two conditions needs to be fulfilled. In this case, neither of these is fulfilled. The 2nd MACP is rightly given on 1.9.2008 - the date of effect of the MACPS itself. Now either 10 years from 01.09.2008 or overall 30 years service will need to be fulfilled for grant of the 3rd MACP ie. w.e.f. 12.11.2014. Hence, the proposal of the Ministry of Railways is not found to be covered within the parameters of the MACP Scheme.

6. In view of the above, it is not possible to agree to the proposal for grant of third financial upgradation under MACP Scheme to employees who have completed 20 years of service after earning first promotion as the same involves alteration of the basic concept of the MACP Scheme.

Implementation of MACP Scheme over Indian Railways – Discrepancies — Reg.

Ref. (i) Board’s letter No.PC-V/2009/ACP/2 dated 10/6/2009(RBE No.101/2009) and dated 29/12/2011 (ii) Board’s letter No. PC-V/2011/M/3/AIRF dated 25/2/2014

The Modified Assured Carrier Progression scheme (MACPS) came into effect in terms of RBE No.101/2009 dated 10/6/2009 modifying the ACP scheme already invogue before this scheme. The Railway Board’s letter supra gives detailed provisions of MACPS as also clarifies a numbers of related issues. The illustration on page No. 9 of the said letter states at (a) under Para 28 that “in case an employee had earned first promotion within a period less than 10 years, say in 8 years of regular service and then continues in same grade pay for further 10 years, without any promotions, he will be entitled for 2nd financial upgardation under MACP on completion of 8+10=10 years and 3rd financial up gradation on completion of further 10 years service i.e. after 8+10+10=28 years.”

Most of the Zonal Railways have implemented MACPS on the basis of above illustration in various categories of Railway staff. The Railway Board, however, while clarifying the matter vide their letter dated 29/12/2011 have stated that “1s, financial up gradation would be on completion of 10 years of continues service in same grade pay, 2nd on completion of 20 years service from the date of initial appointment or 10 years from the date of Is, financial upgradation/prornotion, whichever is earlier & 3rd financial up gradation would be admissible on completion of 30 years regular service of initial appointment or 10 years from the date of 2nd financial upgradation/promotion whichever is earlier.” The illustration under Para 28 in the Board’s letter dated 10/6/2009 has, however, been reiterated in the letter dated 29/12/2011 also. It is evident from the clarification that an employee would be eligible for 2nd & 3rd financial upgradation after completion of 10 & 20 years service from his/her first promotion.

However, the clarification further issued vide Board’s letter under reference at S.No-2 is in contradiction to the above provisions so far as the concluding line of the said letter is concerned, which states that ” It is not possible to agreed to grant of 3rd financial upgradation under MACPS on completion of 20 years of service after 1st promotion/ upgradation.

The Board are therefore, requested to further look into the matter in totality, as this would undo the provision already made vide Railway Board’s letter dated 10/6/2009 & 29/12/2011,resulting in a lot of recoveries from the staff in case of whom the MACPS has been implemented in terms of Railway Board’s letter under reference at S.No-1. This issue may be discussed with AIRF threadbare, so that there is no contradiction creating confusion in implementation of MACPS prevailed over Indian Railways and recoveries, if any being initiated on this account in any Zonal Railway, may be stopped till finalization of this issue.
This may kindly be treated as urgent.

NFIR vide its letter dated 30/01/2013 had invited attention of the Railway Board (MS) to clarification issued by the Railway Board vide letter dated 13/12/2012 and illogically upheld further vide letter dated 05/03/2013. In its letter dated 30/01/2013, while explaining rule position in detail, Federation had demanded meeting at the level of Railway Board (MS) considering its wider implications and the inappropriate stand taken by the Railway Board, besides keeping in abeyance the implementation of instructions dated 13/12/2012. Unfortunately, Railway Board did not take any action despite Railway Board (MS) verbal assurance. The wrong stand taken by the Railway Board on the issue has resulted into affecting undue recoveries from the salaries of staff on some Zonal Railways creating deep sense of resentment among them who are now feeling aggrieved and agitated.

2. In this connection, NFIR wishes to invite once again the kind attention of the Railway Board (MS) that the clarification dated 13/12/2012 allows financial upgradation under MACPS under promotional /cadre hierarchy whereas the MACP Scheme permits granting financial upgradation in Grade Pay hierarchy and is admissible upto GP Rs. 12000/- in PB-4.

This proves the contention of the Federation that the said clarification is grossly erroneous as the same is against the policy guidelines on MACPS and may not withstand judicial scrutiny.

3. Apart from above, NFIR wishes to bring to the notice of Railway Board (MS) following additional facts for kind information and necessary action:-

That the Ministry of Health & Family Welfare, Nirman Bhawan, New Delhi vide O.M. No.Z2901171/2012-N dated 11th April 2013, which is the nodal ministry in sofar as para-medical staff are concerned has permitted financial upgradation in PB-3 with GP Rs.6600/- to the nursing staff pursuant to the judicial scrutiny of the issue at the level of Supreme Court.

That the Federation is shocked to know from many Zonal Railways that based on Railway Board’s clarification issued on 13/12/2012 recoveries from all similarly placed staff, including para-medical staff has since begun and the staff are being put to totally disadvantageous position.

4. Federation further wishes to clarify that the O.M. dated 11th April 2013, should be implemented mutatis-mutandis in favour of railway employees who are similarly situated as any action contrary to the said O.M. will be contempt the orders of Apex Court.

NFIR. therefore, requests the Railway Board (MS) to immediately withdraw the clarification issued under letter dated 13/12/2012, as requested earlier and issue suitable instructions to all General Managers etc.. not to affect recoveries. Federation is, however, ready to discuss the issue at the level of Railway Board (MS). Federation may be kept advised of the action taken.

   Ref : Railway Board’s letter No. PC-V/2009/ACP/2 dated 13-12-2012 (RBE No. 142 / 2012, PBC No. 189 / 2012).

   Consequent to issue of Railway Board’s letter dated 13-12-2012 (RBE No. 142 / 2012), many doubts have been raised from various quarters as to how the the clarification given is to be followed.

   In terms of the above cited letter, an employee holding feeder post in a cadre where promotional post is in the same Grade Pay, financial upgradation under ACP / MACP scheme cannot be to a higher Grade Pay than what can be allowed to an employee on his normal promotion and would be granted the same Grade Pay. The doubts were with regard to the terms used i.e., “In same Grade Pay” and “Normal Promotion”.

   The undersigned is directed to refer to NFIR’s letter No. IV/MACPS/09/Pt-6, dated 23/05/2013 and to state that the matter has been examined in consultation with DoP&T, the nodal Department of Government on MACP Scheme has been clarified that the incumbents of the lower post CANNOT be treated as initially appointed in the upgraded post just because the two lower rungs of the promotional hierarchy have been abolished under two consecutive cadre restructuring. In fact, it is the post which are upgraded.  The incumbent’s appointment to the upgraded post is by way of promotion only.

   Consequent upon implementation of the orders, modifying ACP Scheme as MACP Scheme on the basis of recommendations of VI CPC, many employees were granted financial upgradation under MACP Scheme w.e.f  01.09.2008. T.A. amount was claimed by the employees as per their old grade pay prior to their financial upgradation, and they are due for the arrears of TA with retrospective effect due to implementation of MACP orders.

   The matter was taken up by our affiliate, S.C. Railway Mazdoor Union, with South Central Railway Administration, requesting payment of supplementary claims relating to difference of TA on enhanced pay of the employees who have been granted benefit of financial upgradation under MACP Scheme with retrospective effect.

Ref:  Railway Board’s letter No.PC-V/2009/ACP/2(RBE No.100/2012) dated 12.09.2012

   As per Railway Board’s letter under reference, while extending benefit of financial upgradation under MACP Scheme, the candidates selected through LDCE/GDCE on a post for which recruitment rules provide for Direct Recruitment, their promotion through above process on the said post are to be treated as Direct Recruitment for the purpose of granting benefit under the said scheme.
