Subject: Revision of pension of pre-2016 pensioners/ family pensioners in implementation of Govt. decision on the recommendations of the 7th Central Pay Commission concordance tables-regarding.

Reference: (1) This office Circular No. 570 dated 31.10.2016 and No. 585 dated 21.09.2017. (Available on the website of this office www.pcdapension.nic.in) 

(2) GoI, MoD letter No.17 (01)/2017/(02)/D(Pension/Policy) dated 17.10.2018.

Attention is invited to Para-4 of Gol, MoD letter No. 17 (01)/2017/(02)/D(Pension/Policy) dt 05.09.2017 circulated vide Circular No. 585 dated 21.09.2017, wherein it has been mentioned that revision of pension! family pension of all Armed Forces Personnel who retired! died prior to 01.01.2016 under first formulation was to be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale! pay band and grade pay at which they retired! died. This was to be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non Practising Allowance, where applicable, and ‘X’ Group pay Classification Allowance for JCOs/ ORs, if applicable, notified in terms of 7th CPC orders, also to be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and termed as notional reckonable emoluments as on 01.01.2016. The higher of the two Formulations i.e. the pension/family pension already revised in accordance with Gol, MoD letter No. 17(01)/2016-D(Pen/PoI) dated 29th October 2016 and modified vide letter No. 17(01)/2017 (01)/D(Pen/PoIicy) dated 04.09.2017 or the revised pension/ family pension worked out in accordance with Para 5 above, shall be granted to pre-2016 Armed Force Pensioners as revised Pension/ Family Pension w.e.f. 01.01.2016.

2. GoI, MoD vide letter No. 17(01)/2017/(02)/D(Pension/ Policy) dated 17.10.2018 has issued concordance tables to facilitate fixation of notional pay of pre-2016 defence pensioners! family pensioners by the concerned Record offices and attached Pay Account Offices in case of JCO/ORs of the three Services and PCDA(O) Pune/ Naval Pay Office, Mumbai/ AFCAO New Delhi in case of Commissioned Officers of Army/ Navy/Air Forces respectively. A copy of ibid Gol, MoD letter dated 17.10.2018 enclosed herewith for further necessary action, which is self-explanatory.

3. In view of the above, Record Offices are requested to prefer/forward the claims for revision of pension in respect of Pre-1.1.2016 pensioners/family pensioners in accordance with the instructions given in this office Circular No. 585 dated 21.09.2017 by using this concordance table for fixing the notional pay of the pensioner. However, it is informed that the LPC-cum-Data Sheet circulated in Circular No. 585 dated 21.09.2017 is under modification along with amendment in the software programme. An utility programme in this regard is also under development. The same along with detailed instructions will follow shortly.

Concordance Tables for Defence Pensioners

Point-wise explanation of transition of Pay in Concordance table

1. This concordance table comprises of transition of pay pertaining to Sailors from 3rd CPC to 7th CPC. (Seven groups- X,Y,Z, Flight Engineers, Flight Signalers/Flight Gunners, Y Group(S/M, IMSF,Aviation,MA Part II), Z Group (S/M, IMSF)

2. As per Rule 11 of Special Navy Instructions No.1/S/86 “a sailor who has been drawing the maximum of the existing scale for more than one year as on 1st January 1986 shall be allowed the next increment in the revised scale with effect from 1st January 1986” The row starts with Max refer to the same condition.

3. SI stands for Stagnation increment.Those who reached Maximum of scale for more than two years are getting benefit of stagnation increment.

4. In calculation of increment for X-Group sailors in 6th CPC, X pay may Please be added to Basic and Grade pay X pay for sailors was 1400 during 6th CPC

5. 6th and 7th CPC does not contain any provision regarding Max of Scale and Stagnation increment Hence not considered.

6. On trade rationalization during the currency of 5th CPC, the personnel in the erstwhile “Spl.Group” drawing higher pay scales were transited to the respective pay groups as per their entry level qualification w.e.f 10 Oct, 1997 in the lower pay scales with basic pay protection.

Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission on revision of provisions regulating Pension/Gratuity/Commutation of Pension/Family Pension including pensionary awards notified in terms of casualty pensionary awards Fixation of Pension of Commissioned Officers of Army Medical Corps/Army Dental Corps/Remount & Veterinary Corps retired during 1.1.2016 to 30.6.2017.

Sir,

The undersigned is directed to refer to this Ministry’s letter No.17(02)/2016/D(Pen/Pol) dated 4th September, 2017. In accordance with Para 4.1.1 of said letter, the emoluments reckoned for calculation of pension include Non Practicing Allowance (NPA) granted to Medical officers of Army Medical Corps /Army Dental Corps / Remount & Veterinary Corps.

2. For Medical Officers of Armed Forces who have retired from 1.1.2016 to 30.6.2017, their pension is based on emoluments which included NPA @ 25% of the pre-revised pay. Orders have been issued by Ministry of Defence vide letter No. 4(10)/2017/D(Med) dated 28th September, 2017 for grant of NPA to serving medical officers @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the medical officers retired/retiring on or after 1.7.2017 are entitled to pension based on emoluments which include NPA at the rate of 20% of the revised basic pay.

3. The matter regarding revision of pension the Medical Officers of Armed Forces who retired during 1.1.2016 to 30.6.2017 based on revised rate of NPA has been examined by the Government. It has been decided that all kind of pension/family pension in respect of Medical officers of Armed Forces who retired/died during 1.12016 to 30.6.2017 and were drawing NPA at old rates on the date of retirement/death, shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the basic pay on the date of retirement. The fixation of pension/ family pension of retired Medical officers of AMC/ADC/RVC in the above manner, shall be further subject to the condition that emoluments (i.e. Basic Pay MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand and five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.

4. This issues with the concurrence of Ministry of Defence(F1nance/Pension) vide their ID No. 10(8)/2018/Fin.Pen dated 11.05.2018.

Guidelines for conducting Pension Adalats

1. Objective

   The intention of conducting Pension Adalats is to look into the grievances of Pensioners so as to redress the same by taking on-the-spot decisions there by reducing the delays, if any, in the settlement of their legitimate dues. This kind of interaction with the Pensioners would instill in them a sense of being cared for and attended to, thus, dispelling their feelings of isolation and neglect. It will also give an idea of the kind of problems/difficulties that are being faced by the pensioners and help in identifying the areas of concern in policy that require our urgent attention for amendment, etc.

2. Frequency, Date and Time

   2.1 Pensioners’ Adalats may he held twice around January and July every year. Venue and date will he fixed by the concerned organization in consultation with the stakeholders and notified through advertisements inleading newspapers/other media. Subject : Enhancement of amount of Ex-gratia payable to Reservists and families of Reservists - reg.

 

   The undersigned is directed to refer to this Ministry's letter No. 13/39042/AG/PS-4(a&c)/1331/C/ D(Pension/Services) dated 29.122000 sanctioning monthly payment of an amount of Rs. 600/- per month as ex-gratia to the Reservists who were discharged prior to 1.4.1968 and who having rendered minimum qualifying service required for grant of pension, had opted / accepted for lump sum amount of gratuity at the time of release from service and have not availed benefits of rehabilitation assistance granted by the Government and were not in receipt of any other pension. This amount was payable with effect from 1.11.1997. Similarly, the monthly payment of ex-gratia sanctioned to the widows and dependent children of the deceased Reservists, who had opted to receive one time lump sum gratuity in lieu of pension, in terms of this Ministry's letter No. 10 (7.)./-92./D (Pension/Services) dated. 30.3.1992, was also revised/consolidated from 1.11.1997 to Rs. 605/- per month in terms of this Ministry letter No. 13/40029/AGIPS-4(d)/1/B/13 (Pension/Services) dated 7.1.1999.

Pension of Defence Personnel

   There has been no undue delay in notifying pension by the Pension Sanctioning Authorities and no abnormal delays have been reported in payment of pension by the Pension Disbursing Agencies i.e. Banks, Treasuries and Defence Pension Disbursing Offices.

   If the payment / pension has not been disbursed by the Bank on receipt of PPO, then as per the guidelines of Reserve Bank of India, interest @2% per month has to be disbursed on the amount due to the pensioners by the paying Bank, wherever delay occurred

Allegation of Non-Payment of Pensionary Benefits to Nk Surender Singh not Correct

   In a press conference today, retired Nk Surender Singh of 2 GRENADIERS and an ex NSG Commando expressed some grievances against the government. These pertained to alleged lack of adequate compensation and financial benefits to those who were killed/injured in the 26/11, Operation Black Tornado in Mumbai. Response with respect to the issues raised is enumerated in succeeding paragraphs.

   In the 26/11 Mumbai operations, one Officer and one Non Commissioned Officer were martyred and 17 Officers and Other Ranks were injured. Both martyrs Major Sandeep Unnikrishnan and Havildar Gajender Singh were awarded the Ashok Chakra (Posthumous). The NOK of Major Unnikrishnan got a financial compensation of approximately Rs.1.3 Crores and a flat. Similarly, the wife of Havildar Gajender Singh received approximately Rs.1.27 Crore, a petrol pump and a flat. His mother too received Rs.15 Lakhs approximately. Both these personnel also received enhanced pension benefits as applicable in the Army.

Rs.2300 crore approved to meet the demands of Ex-servicemen pensioners.

   The Union Cabinet has approved the recommendations of the Committee headed by Cabinet Secretary for benefits to ex-servicemen on four issues.   The financial implications of the improvements made as per the Cabinet decision on the four items are broadly estimated at Rs.2300 crore per annum.  The details are as follows:
 
I.             One Rank One Pension:
 
   On One Rank One Pension, the demand of the Defence Forces and Ex-Servicemen Associations is that uniform pension be paid to the Defence Forces personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension be automatically passed on to the past pensioners.
 
            The difference in the pension of present and past pensioners in the same rank occurs on account of the number of increments earned by the defence personnel in that rank.  There is also a difference between the pension of pre 1.1.06 and post 1.1.06 retirees belonging to a particular rank.  The UPA Government on two previous occasions has taken decisions to narrow the gap between the present and past pensioners, particularly those belonging to the ranks of JCOs and Other Ranks.

Project ‘SANGAM’ for Defence Pensioners Launched

   Controller General of Defenc Accounts (CGDA) Shri Nand Kishore recently launched a software project ‘SANGAM’ for defence pensioners in a function at its headquarters at Delhi Cantonment. Speaking on this occasion, Controller General of Defence Accounts mentioned that the project ‘SANGAM’ will provide useful Management Information System (MIS) to the financial planners in the Ministry of Defence.

   Project ‘SANGAM’ is a software which will facilitate issuance of corrigendum pension payment orders. This will address the demand from the ex-servicemen for issue of individual corrigendum pension payment order consequent to implementation of recommendations of Sixth Central Pay Commission (6th CPC).
