Implementation of the Recommendations of 7th CPC- Fitment Factor and Pay Fixation for Running Staff

Sub: Implementation of the recommendations of 7th CPC- Fitment Factor and pay Fixation for Running Staff.

The undersigned is directed to refer to the above mentioned subject and to the letter dt. 05.08.2016 of GS/AIRF and letters dt. 04.08.2016 & 23.08.2016 of GS/NFIR.

2. In this connection, it is stated that unlike during the sixth CPC where there were separate fitment tables for pay fixation, in the Seventh CPC only a single multiplication factor of 2.57 and a single Pay Matrix table has been recommended and accepted. Paragraph 2 of the Resolution dt. 25.07.2016 refers. Therefore, no other maltiplication factor or Pay Matrix/Fitment table can be used for pay fixation for any category of staff.

3. Further, as brought out in para 12 of the Resolution dt. 25.07.2016 Pay fixation of running staff (who draw Running Allowance) has been clubbed with fixation of pay of Doctors (Who draw NPA). The methodology and illustration for computing revised basic pay in the case of Doctors have been clearly brought out in para 7 (B) (ii) of the Notification dt. 25.07.2016 of Ministry of Finance. It may be observed that the rate of increase in the illustration in the case of Doctors is also not exactly 14.29%. In fact, para 12 of the Resolution mentioned that actual raise in pay at the time of initial fixation is to be ensure at about 14.29%. The figure of 14.29% therefore is not an absolute percentage of raise which has to be ensured. A similar methodology of pay fixation for running staff (keeping the basic multiplication factor at 2.57) has been applied in consultation with and approval of Ministry of Finance.

4. It may also be seen that while fixing the pay after revision in the appropriate cell of the applicable level in the Pay Matrix. the actual increase in pay works out practically to around three times the pre-revised basic pay of the running staff.

5. Therefore, pay revision for Running Staff has been done in terms of approved formulation and no separate fitment table can be issued in this connection, as brought out above.

Please refer to Railway Services (Revised Pay) Rules, 2016 notified vide GSR No. 746 (E) dated 28.07.2016 forwarded with Railway Board endorsement No. PC VII/2016/RSRP/1 dated 28.07.2016 and further instructions and schedule circulated vide Railway Board’s letter No. PC-VII/2016/RSRP/2 dated 2.08.2016 (RBE No.93/2016).

2. In continuation to the rules/instructions circulated vide Boards’s letter referred above, performa of statement of fixation of pay for fixing the pay of existing employees already in services as on 1.01.2016 while implementing the 7th CPC recommendations is enclosed here with as Annexure ‘A’. Further action to fix the pay may be taken as per the instructions contained in para 6 of Board’s Letter No. PC-VII/2016/RSRP/2 dated 02.08.2016.

Implementation of 7th CPC : Finance Ministry prepared a Cabinet note based on ECoS report – AIDTOA

Based on the ECoS report, the Finance Ministry may be preparing a Cabinet note and the VII CPC issue may come up for approval by the Cabinet as early as June 29.

CONFRONTATION WILL BECOME INEVITABLE IF UNILATERAL ORDERS ARE ISSUED

It seems that Govt. is not in favour of a negotiated settlement on the 7th CPC related issues. Based on the ECoS report, the Finance Ministry may be preparing a Cabinet note and the issue may come up for approval by the Cabinet as early as June 29.

The Seventh CPC report was submitted on 19th November 2015 after a delay of about 3 months. The Government especially the Finance Minister had assured that the final decision over the report will be taken within 4 months. On 19th June 2016, the delay has crossed seven months. Till date the Govt. has not come forward for a negotiated settlement. Instead, Empowered Committee of Secretaries (ECoS) headed by Cabinet Secretary conducted a meeting with the staff side on 1st March 2016. In the meeting Govt. did not disclose its mind on any of the demands raised by the staff Side in the charter of demands submitted to Govt. Staff Side explained the justification for each demand but official side didn’t make any comment, either positive or negative. The concluding paragraph of the minutes of the meeting reads as follows:

“After hearing the participants, Cabinet Secretary observed that the deliberations have helped ECoS in understanding the major concerns of the staff side and said that all issues have been taken note of. He assured that fair consideration will be given to all points brought out by JCM before taking final views. He further stated that the ECoS needs to examine the Report of the Commission in entirety as well as the issues raised by JCM in consultation with all other stake holders. As such, it may take some time to take a final call on the recommendations of the Commission.”

It may be seen that, neither did the Govt. side made any commitment on any demands, nor did they indicate in the minutes that further discussion will be held with the staff side to arrive at a negotiated settlement on each demands. It seems that the Govt. is moving ahead to issue unilateral orders taking the staff side for a ride.

The JCM staff side Secretary, in his letter dated 2nd May 2016, addressed to Cabinet Secretary, has made the stand of the staff side clear, without any ambiguity. The letter reads as follows:

“I have been directed to draw your attention towards minutes of the Standing Committee of National Council JCM held on 7th May 2008 and our rejoinder submitted to Govt. in the matter of Report of 6th CPC.

You will kindly find that it was not only a general discussion, but also official side explained their views on each and every issue.

I would therefore request your good self to kindly arrange for similar type of meeting for bi-lateral settlement on each of the issues raised by the staff side, NC/JCM before the Empowered Committee of Secretaries.”

Thus the picture is clear now. The Government, it seems, has a hidden agenda to take the staff side for granted without giving any further opportunity for a negotiated settlement. The staff side on the other hand has taken a position that if unilateral orders are issued, without taking the staff side into confidence, the NJCA shall go ahead with the indefinite strike from 11th July 2016 as already informed to the Govt.

The coming days are crucial. If the Govt. adopts delaying tactics or issue unilateral orders rejecting our demands, then confrontation shall become inevitable. The stand taken by the then Nehru Govt. that “Pay Commission report is an award and is not negotiable” has resulted in the historic indefinite strike of 1960, which commenced on July 11th midnight.

Central Government Employees and Officers comprising Railways, Defence, Postal and other Central Government departments are demanding modification in the recommendations of 7th Central Pay Commissions including minimum wage and fitment formula. Other demands are scrapping of New Contributory Pension Scheme, No FDI in Railways and Defence, filling up of vacancies, No outsourcing, downsizing, contractorisation and corporatisation etc.

The NJCA & CCGGOO had already given strike notice to Government. As the Government is not ready for a negotiated settlement, the Central Government employees and Officers have to intensify the campaign and preparations and make the strike a total success.

About 33 lakhs Central Government Employees and Officers will participate in the strike. 40 lakhs Central Government Pensioners have declared their solidarity with the strike. Central Trade Unions had also extended their full support. State Government Employees Federations have cautioned the Central Government that they will also be compelled to join the strike if Government refuses to settle the demands relating to 7th CPC recommendations as majority of the state Governments are implementing the Central pay parity to their employees also.

On the one hand NJCA & CCGGOO are fighting for the cause of Central Government Employees and Officers and on the other hand rumour mongers are spreading false news through social media. Rumour mongers are coming out daily with different kind of news and pay scales about 7th Pay Commission. Please don’t believe rumour mongers on WhatsApp, Facebook and other social media sources.

There had been no meaningful discussions with the NJCA & CCGGOO so far. The computation of Minimum wage by the 7th CPC deserves to be rejected as the commission has, in a bid to suppress the entitlement doctored the formula itself. The wages of an MTS in civil service, who is a group C employee cannot be less than Rs 26000 on the basis of the formula evolved in 1957 to which the Government is a party. There cannot therefore be any question of reduction in the quantum of minimum wage.

The NPS, which the Government introduced for those joined after 1.1.2004 in Government service has to be construed as a fraud perpetuated and deserves to be abandoned. There cannot be two classes of civil servants in the country; one making contribution but still not getting any assured pension and the other entitled for a statutory defined pension without any contribution. Those who are covered by the NPS in Central Civil Service are now more than 40% of the total personnel. The Government must be bold enough to address this issue.

It is high time, that the Government comes forward, hold meaningful and fruitful discussion with NJCA & CCGGOO and settle the Charter of demands. The continued procrastination is a sure step to confrontation and the Central government employees in the Country will certainly commence the strike action from 11.7.2016.

The entire civil services, which include the Railways, Postal, Defence and all other services of the Government of India, will come to a grinding halt on 11.7.2016.

A meeting of the Empowered Committee of Secretaries (E-CoS) was held on 1 st March, 2016 in the Cabinet Secretariat under the chairmanship of the Cabinet Secretary to discuss issues raised by Staff„side of JCM

2. Welcoming the members of E-CoS and JCM Staffside, Cabinet Secretary observed that the meeting had been called to take a note of concerns of Staff-side of JCM regarding recommendations of the 7th CPC and invited the members Of Staff-side of JCM to share their views on the recommendations.

3. Opening the discussion, representative of Staff-side of JCM expressed gratitude to Cabinet Secretary for inviting them for interaction regarding the recommendations of the 7th CPC and requested that more frequent interactions of JCM may be held to resolve outstanding issues across the table. It was expressed that 7th CPC has recommended a meager increase of 14% in the minimum pay as against increase ranging up to 54% during previous Pay Commissions. It was further stated that the recommendations on minimum pay, allowances, advances etc. will cause difficulty to employees. Representative of Staff-side informed that they have already submitted a charter of demands to the Cabinet Secretary bringing out the issues. These have also been discussed in the meeting of JS (IC) with Staff-side of JCM held on 19.02.2016.

4. Major concerns expressed by JCM Staff-side were as under:

The minimum pay of Rs. 18000/- p.m. recommended by the Commission is on lower side and needs to be revised upward by taking into account the prices of commodities as on 01.07.2015 and appropriately factoring in for social obligations & housing.

(ii) New Pension Scheme should be done away with. Persons governed by the NPS are deprived of Family Pension and do not have provision of provident fund. As a result they are at a disadvantageous position as compared to the persons governed by the old system.

(iii) Recommendations on allowances need to be properly examined before taking a decision.

(iv) Fixed Medical Allowance should be increased from existing Rs. 500 p.m. to Rs. 2000 p.m. as majority of cities are not covered under CGI-IS and people residing outside the CGHS covered area are unable to meet their medical needs with meager amount of Rs. 500 p.m.

(v) Recommendation regarding withdrawal of non•interest bearing advances may not be accepted.

(vi) Outsourcing of services should be discouraged as the contract workers are being exploited by contractors and at the game time the service delivery is being compromised due to inefficiency and lack of accountability of low aid contractual staff.

(vii) Enhancement in contribution towards Group Insurance Scheme, is not justified as this would reduce the actual increase in take home salary considerably. If the rates are to be raised, the Government should bear the insurance premium

(viii) The recommendation regarding grant of only 80% of salary for the second year of Child Care Leave need not be accepted as this would deter women from availing of CCL, which was introduced as a welfare measure.

(ix) Annual increments be granted @ 5% instead of existing 3% and increments may be granted on two dates viz., 1 st of January and 1 st of July of every year as in the present system of grant of increment on 1 st July of every year, employees joining/promoted after 1 st January, who do not complete 6 months services as on 1 st July, have to wait for up to 18 months for grant of increment.

(x) The Commission’s recommendation of downgrading the Assistants of Central Secretariat for bringing in parity with their counterparts in the field offices is not appropriate.

(xi) Recommendation regarding PRIS need not be accepted as no scientific mechanism has been devised to assess the performance of employees and the same could e courage favoritism.

5. Issues regarding financ al upgradation under MACPS in promotional hierarchy without grading stipulation. grant of two increments on promotion introduction of Productivity Linked Bonus, treating Grameen Dak Sevak as Government employees, removal of pap of 5% on compassionate appointment 8i full pay and allowances In case of Work Related Illness and Injury Leave improving promotional avenues for technical and supervisory staff etc. were also raised by members of JCM.

6. During the discussion, representatives of JCM also suggested that the Nodal Officers nominated by various Ministries/Departments may hold interactions with recognized Staff Associations and other stakeholders under their purview so as to identify issues specific to those Ministries/Departments for redressal.

7. 7th CPC Implementation Cell Seeks Comments and Views from all Ministries/Departments

Subject: Comments of the Ministries/Departments on Recommendations of 7th Central Pay Commission – Request to Expedite – regarding.

All the Ministries/Departments, vide the D.O.No.1-4/2015-EIII.A dated 21.11.2015 from Joint Secretary (Pers), Department of Expenditure were requested to formulate their views/comments on the issues and the posts/services under them with reference to the recommendations of the 7th Central Pay Commission and forward it to the Department of Expenditure within a period of three weeks.

2. The action involved on part of the administrative Ministries/Departments was also discussed, in detail, in the meeting with the Nodal Officers on 02.02.2016 and all the Nodal Officers were requested to furnish their comments in the ‘prescribed proforma’ circulated in the meeting, along with soft copy to the ‘jsic-cpc@nic.in within two weeks i.e. by 17.02.2016. The responses received so far are not satisfactory and comments of the most the Ministries/Departments are still awaited.

3. The Implementation Cell which is working as the secretariat of the Empowered Committee of Secretaries (E-CoS) has been asked to furnish considered views of the Ministries/Departments on the recommendations of the 7th CPC.

4. In view of the above, the comments of the Ministries/Departments may be furnished to the Implementation Cell. Department of Expenditure, immediately.

This may be treated as most urgent.
