Loans and Advances by the Central Government – Interest Rates and other Terms and Conditions.

Subject:- Loans and Advances by the Central Government – Interest rates and other terms and conditions.

Reference this Ministry’s Office Memorandum F.No.5(3)-B(PD)2014 dated 29th December, 2014 on the captioned subject.

2. The lending rates, categories and conditions prescribed in the aforesaid Office Memorandum have been reviewed. The revised rates of interest, categories and conditions as given in the Table below, would be applicable from 1st April, 2015 and till the time these are reviewed:

* Loans to State Government would be under EAP loans only. For Ways & Means loans, State Govts. have access to RBI window. In case any State has any specific contingent requirement, the proposal would be considered on case specific basis by Budget Division.

 The window of investment and working capital loan to CPSUs from Government of India in general, is hereby closed. CPSUs, in general, are hardly having debt and hence should raise debt from market or from banks.

Only if CPSU is justified as significant from ‘Strategic’/ ‘Security’ angle, banks refuse loan to it and it has no real assets including land, to monetise, would loan be extended to it at 11% with the prior approval of Budget Division. However, wherever Investment and Working Capital loan has already been extended to CPSUs in 2015-16, the rate of interest would be at 11.50% and 13.50% respectively.

@The window pertaining to loans to Financial Institutions in the Public Sector, Port Trusts, KVIC, NHAI, Municipal Corporation of Delhi, National Co-operative Development Corporation (NCDC), Commodity Boards, Social Service

Institutions, Individuals etc. in general, is hereby closed seeing the offtake under this in last 3 financial years. However, if a specific case still comes in future, it would be examined by the Budget Division, DEA on merits of that case.

3. The terms, including interest rate of loans to Foreign Governments may be settled in consultation with Budget Division. Terms for on-lending of funds under externally aided projects should be in accordance with the prescribed pattern. In case, deviation is considered necessary, Budget Division should be consulted.

4. The interest rates prescribed above assume timely repayments and interest payments and hence no further rebate in rates is to be allowed for timely payments.

Instructions for processing foreign visits of officers of the Government of India for approval of Screening Committee of Secretaries (SCoS)

Subject: Instructions for processing foreign visits of officers of the Government of India for approval of Screening Committee of Secretaries (SCoS).

This Department has been receiving references seeking clarification on certain issues with reference to this Department’s OM of even number dated 05-01-2016 on the above subject. Accordingly the following clarification is issued:-

a)  Approval of SCoS is not required in case of foreign visits of upto Joint Secretary level officers as part of foreign training component, Mid-Career Training Programme (MCTP) or any other training, irrespective of number of members and days”.

b) The provision of seeking approval of Cabinet Secretary for condoning delay in submission of proposals sent less than 15 days before the date of departure of delegation has been done away with.

c) Calculation of number of foreign visits in respect of any officer will be with reference to calendar year.

Committee of Secretaries is being Constituted to consider the 7th CPC Recommendations

Dear Sir,

The Report of the 7th Central Pay Commission was submitted to the Government on 19.11.2015. A COPY of the Report is placed on the website of Ministry of Finance (www.finmin.nic.in)

2. The process to examine the recommendations of the Commission has to commence immediately. An Empowered Committee of Secretaries chaired by cabinet Secretary is being constituted to consider the recommendations in its entirety and after considering the views of all the Departments as well as the Staff Associations and JCM. An implementation Cell is also being created In this Ministry to process the recommendations based on the views of the Ministries/Departments , Staff Associations and JCM for submitting the matter for consideration of the empowered Committee of Secretaries and thereafter for approval of the Cabinet based on the conclusions arrived at by the Empowered Committee of Secretaries.

3. Thus, the process to consider the, recommendations before it reaches a final shape for approval of the Cabinet requires consultation amongst all the Ministries/Departments who may formulate their opinion based on the views of Staff Associations under their administrative control.

Understanding the important Recommendations of 7th Pay Commission

4. Accordingly. it is requested that the following action may be taken on an urgent basis in your Department:

(i) A Nodal Officer at the level of a Joint Secretary may be nominated immediately. Whom the implementation Cell in this Ministry would be interacting with during the course of processing of the recommendations

(ii) The recommendations of the Commission may be examined in regard to issues concerning your Department and the views thereon may be furnished to this Ministry within three weeks.

(iii)The recommendations of the Commission may be examined in regard Posts/Cadre/service/ organization under your Department and the views thereon may be furnished to this Ministry within three weeks.

(iv) While formulating the views of your Department, the comments, if any of any of the recognized Staff Associations under the administrative control of your Department. may also be obtainedand taken into account.

(v) In case your Department has any view on any of the recommendations contained in the Report, even though it may not directly pertain to your Department, may also be furnished under a separate category within three weeks.

(VI) In case you have any other suggestion to make in this regard, the same will b appreciated.

5. I request you, accordingly to kindly ensure that the action on the above points is given utmost priority and the same is completed within the stipulated timeline of three weeks.

Grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) to Central Government Employees for the year 2014-15 — Extension of orders to Autonomous Bodies.

Subject:- Grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) to Central Government Employees for the year 2014-15 — Extension of orders to Autonomous Bodies.

Orders have been issued vide this Ministry’s Office Memorandum No.7/24/2007 E-III(A) dated 16th October, 2015 authorizing 30 days emoluments as Non-PLB (Ad-hoc bonus) for the accounting year 2014-15 to the eligible Central Government employees not covered by the Productivity Linked Bonus Schemes, subject to terms and conditions laid down therein.

2. The undersigned is directed to say that it has now been decided that the Non-PLB (Ad-hoc) bonus so admissible subject to the terms and conditions laid down in the aforesaid orders, may be extended to the employees of autonomous bodies, partly or fully funded by the Central Government which (i) follow the pattern of pay structure and emoluments identical to that of the Central Government and (ii) do not have any bonus or ex-gratia or incentive scheme in operation.

3. In case of doubt as to the operation of these orders the clarificatory orders, circulated vide this Ministry’s O.M. No.14(10)E-Coord/88 dated 4.10.88, as amended from time to time, may be kept in view, mutatis mutandis.

4. Any request for funding by the Government to meet the liability on account of Non-PLB (Ad-hoc bonus) in respect of various autonomous organizations would not be considered by the administrative Ministries concerned, as the expenditure on Non-PLB (Ad-hoc bonus) should be met from within the existing budgetary provisions of the respective organizations. While the Autonomous Bodies not funded by the Central Government may also adopt these orders as per their own administrative and financial judgment in respect of their employees, no liability for funding will, in any case, lie on the Central Government on this account.

Fixation of pay on promotion of pre-revised merged pay scales between 1.1.2006 and date of notification of CCS(RP)Rules 2008

Subject: Cases of promotion taking place in the pre-revised pay structure between 1.12006 and the date of notification of CCS(RP) Rules ,2008 and the subsequent merger of the pre-revised pay scales of the promotional and the feeder posts in a common Grade- fixation of Regarding.

The undersigned is directed to Say that consequent upon coming into force of the CCS(RP) Rules, 2008, which were notified on 298.2008 but are effective from 1.1.2006, fixation of pay on promotion on or after 1.1,2006 is carried out as per Rule 13 thereof. This Rule is invoked only in cases of promotion from one Grade pay to another in the revised pay structure.

2. In terms of Section I of Part-A of the First Schedule of the CCS(RP) Rules, 2008, which provides for revised pay structure in the form of applicable pay Bands and Grades pay corresponding to various pre-revised pay Scales, certain pre-revised pay Scales have been merged in a common Grade pay in the revised pay structure w.e.f. 1.1.2006, In view of this, the posts in those pre-revised pay scales which have been merged in a common Grade pay w.e.f. 1,1.2006, are normally required to be merged even if these posts constituted feeder and promotional grades in the pre-revised pay structure.

3. However, in cases where such merger of feeder and promotional posts in the wake of their come to lie in the Same grade pay has not taken place due to administrative reasons and the posts continue to retain their promotional and feeder character as per the relevant Recruitment Rules, this Ministry issued instructions vide OM 10/2/2011-E.III A dated 7.1.2013 providing for fixation of pay on promotion in such cases under Rule 13 of CCS (RP) Rules, 2008 subject to the conditions laid down therein.

4. Now, instances have been brought to the notice of this Ministry where the feeder and promotional posts have been merged in view of the merger of the pre- revised pay scales applicable to the erstwhile feeder and promotional posts in a common grade/post after the promulgation of CCS(RP) Rules), 2008, due to which the character of posts being promotional and feeder grades as existing during the period from 1.12006 to the date of notification of CCS(RP) Rules, 2008 stood rescinded with retrospective effect from 1.12006 and, consequently, a question has been raised as to whether Rule 13 of CCS(RP) Rules, 2008 may apply for fixation of pay on promotion taking place during the period between 1.1.2006 and the date of notification of the said Rules, when the fixation of pay was actually done as applicable in the event Of promotion in the pre-revised Structure.

5. The matter has been considered in the light of the provisions contained in the OM No. 20020/4/2010-Estt.D dt.13.9.2012 issued by the Department of Personnel & Training, which has been issued in the context of the posts/grades merged in pursuance Of the recommendations of the 6th Central pay Commission. This OM provides, inter-alia, that the Status of a government servant as on 29.8.2008 including those who have earned promotion between 1.12006 and 29.09.2008 will be protected as appointment/promotions are made as per the provisions of the recruitment rules applicable to the post/grade.

6. Accordingly, it has been decided that in cases where promotion took place in the pre-revised pay structure during the period between 1.12006 and the date of notification of CCS(RP) Rules, 2008 when the pre-revised and revised pay scales were different and the posts carried the character of feeder and promotional grades, pay fixation on such promotion Shall be allowed under Rule 13 of the CCS(RP) Rules, 2008, subject to the following conditions:-

(i) The promotion had taken place between 1.1.2006 and the date of notification Of CCS(RP) Rules, 2008 as per the Recruitment Rules then in vogue, which clearly provided for such posts being promotional grade for the feeder grade from where the promotion took place and where the posts were subsequently merged in a single post/grade consequent upon promulgation of the CCS(RP) Rules, 2008.

(ii) FR. 22 (r) I), which was applicable for fixation Of pay on promotion before promulgation of CCS(RP) Rules, 2008, was invoked for fixation of pay in these cases in the pre-revised structure during the period between 1.1.2006 and the date of notification of the CCS(RP) Rules 2008.

(iii) The concerned employees had opted to come over to the revised pay structure from a date occurring prior to the date Of notification of CCS(RP) Rules, 2008.

(iv) The concerned Recruitment Rules have been amended subsequently to provide for merger of these grades into a single grade/post.

7. This order applies only in case of promotions carried out in the pre-revised structure during 1.1.2006 and the date of notification of CCS(RP) Rules, 2008. Thus, the benefit of Rule 13 of CCS(RP) Rules, 2008 would not apply in Cases of appointment to the post which was in the higher pay scale in the pre-revised pay structure, where such appointment is made after the date of notification of CCS(RP) Rules, 2008.

8. In its application to the employees serving under the Indian Audit and Accounts Department, this order issues with the concurrence Of the office Of CMG.

DA Order for Central Government Employees - Revised Rates effective from 1.7.2015.

OFFICE MEMORANDUM

Subject: Payment of Dearness Allowance to Central Government employees – Revised Rates effective from 1.7.2015.

The undersigned is directed to refer to this Ministry’s Office Memorandum No. 1/2/2015-E-II (B) dated 10th April, 2015 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 113% to 119% with effect from 1st July, 2015.

2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1(3)/2008-E-II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of Dearness. Allowance payable under these orders shall be paid in cash to all Central Government employees.

4. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

5. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Grant of Transport Allowance to Central Government Employees.

Subject:- Grant of Transport Allowance to Central Government Employees.

Reference is invited to Ministry of Finance, Department of Expenditure 0.M. No. 21(2)/2008-E.II(B) dated 29th August, 2008 regarding grant of Transport Allowance to Central Government employees, consequent upon implementation of the recommendations of the Sixth Central Pay Commission (6th CPC).

2. The Government has since considered the re-classification of cities/towns/localities as per Census-2011 (population criteria) for the purpose of Transport Allowance. Accordingly, the President is pleased to decide the revised classification of cities, towns and localities, for the purpose of grant of Transport Allowance at higher rates to Central Government employees, as per Annexure-1. Therefore, the table below Para ‘1’of O.M. dated 29.08.2008 stands partially modified as under:-


The revised classification of ,cities/towns/localities for the purpose of grant of Transport Allowance shall take effect from 1st April, 2015.

4. The orders will apply to all civilian employees of the Central Government.

The orders will also be applicable to the civilian employees paid from the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and the Ministry of Railways, respectively.

5. All other conditions mentioned in Department of Expenditure 0.M. No. 21(2)/2008-E.II(B) dated 29.08.2008 shall remained unchanged.

6. In so far as the persons working in the Indian Audit and Accounts Department are concerned, this Order issues in consultation with the Comptroller and Auditor General of India.

Re-Classification/Upgradation of Cities/Towns on the basis of Census-2011 for the purpose of grant of House Rent Allowance (HRA) to Central Government employees.

Subject:- Re-Classification/Upgradation of Cities/Towns on the basis of Census-2011 for the purpose of grant of House Rent Allowance (HRA) to Central Government employees.

Reference is invited to this Department’s O.M. No. 2(13)/2008-E.11(B) dated 29.08.2008 relating to grant of House Rent Allowance (HRA) to Central Government employees on the recommendations of the 6th Central Pay Commission (CPC) whereby a list of cities/towns classified as “X”, “Y” and “Z” for the purpose of grant of HRA was enclosed as Annexure. The matter relating to re-classification of cities/towns on the basis of Census-2011 for the purpose of grant of HRA to Central Government employees has been considered by the Government.

2, The President is pleased to decide that in supersession of all the existing orders relating to classification of cities/towns for the purpose of grant of HRA to Central Government employees, cities/towns shall now be re-classified as “X”, “Y” and “Z” for the purpose of HRA as enumerated in the Annexure to these orders.

3. Consequent upon implementation of the recommendations of the 5th Central Pay Commission, certain cities/towns were placed in a lower classification as compared to their existing classification for HRA purpose, vide this Department’s G.M. No. 2(30)/97- E.II(B) dated 03.10.97. However, these cities/towns were allowed to retain their existing higher classification, vide Para 3 thereof; and further extended vide O.M. No. 2(21)/E.II(B)/2004 dated 16.03.2005 & O.M. No. 2(13)/2008-E.II(B) dated 07.01.2009. As other cities/towns to which protection of retaining earlier higher classification was allowed, got upgraded during the intervening period and as on date only two cities i.e. Ajmer in Rajasthan and Durgapur in West Bengal were retaining such protection. Consequent upon upgradation of these two cities also on the basis of their population as per Census-2011, provisions contained in Para 3 of this Department’s O.M. No. 2(30)/97-E.II(B) dated 03.10.97 which Were allowed to further continue vide G.M. dated 16.03.2005 & 07.01.2009, stand withdrawn/discontinued.

4. Special orders allowing continuance of HRA at Delhi (‘X” class city) rates to Central Government employees posted at Faridabad, Ghaziabad, NOIDA and Gurgaon, at Jalandhar CY” class city) rates to Jalandhar. Cantt., at “Y” class city rates to Shillong, Goa & Port Blair vide this Department’s O.M. No.2(13)12008-E.11(B) dated 29.08.2008, and continuance of HRA at par with Chandigarh (“Y” class city) to Panchkula vide this Department’s O.M. No,2(13)/2008-E.II(B) dated 04.03.2011, shall continue to be applicable till the recommendations of 7th CPC are considered by the Government.

5. These orders shall take effect from 1st April, 2015.

6. The Orders will apply to all civilian employees of the Central Government.The orders will also be applicable to the civilian employees paid from the Defence services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and the Ministry of Railways, respectively.

I am directed to refer to your letter No. HR&IR/KSC/GOVT/665 dated 25th May, 2015 on the above subject and to say that Government has ‘No objection‘ to IBA authorizing the Banks to pay revised salary and arrears of pay and allowances to serving officers and revised pension and arrears to existing pension optees retired w.e.f. on or after 1.11.2012 as per the provisions at the Joint Note pending amendments to the Officer’s Service Regulations/Pension Regulations subject to the provisions made by the respective banks in the particular year.

2. As regards declaring 2nd and 4th Saturday as holidays and other Saturdays as full working days is concerned. IBA may rater to this Department’s letter No. 4/1/7/2015-IR dated 2.6.2015.

Sub: Payment of Pension through PAO Cash Counters-reg

As per Para 7.5 of Civil Accounts Manual, the pensioners have been provided the facility of getting their pension payment through PAO Counters, if he/she opts so. As per Para 7.5.8 of Civil Accounts Manual, all PPO issuing authorities are supposed to furnish an abstract of PPO in Annexure ‘C’ for the pensioners who desired to draw pension through PAO Counters to Central Pension Accounting Office for incorporating these details in database of CPAO. Accordingly, a Circular to this effect was issued by CPAO to all CCAs/CAs/AGs vide No. CPAO/Tech/Computer Cell/Misc./2011-2012/1385 dated 08.02.2012.

2. As a part of “Digital India”, CPAO has introduced online submission of Annexure ‘C’ through CPAO’s website. Now PAOs can submit online details of such pensioners who opt for drawing pension from PAO Counters. As such, there is no need to send the hard copy of the same to the CPAO. This will facilitate the automatic construction of pensioners’ data in CPAO’s database.

3. Steps to submit aforesaid details are as follows:

(i) Visit CPAO’s website: www.cpao.nic.in.
(ii) Login as PAO with existing Username and Password.
(iii) Click on “Data Capture Module for Pensioners getting Pension from PAO Cash Counter”.
(iv) Enter the fields provided chronologically by using “Next” Button.
(v) By clicking “Submit” Button at the end, the details will be captured in CPAO’s database.

4. All Pr.CCAs/CCAS/CAs (holding independent charges)/AGs are requested to instruct the PAOs under their jurisdiction to provide the details of pensioners (all present pensioners/family pensioners) who have opted to draw their pension directly from PAO Cash Counters using online facility at CPAO’s website.
