Wage Talks with IBA – One More Mere Routine Exercise

Wage Talks with IBA – One More Mere Routine Exercise

WAGE TALKS WITH IBA – ONE MORE MERE ROUTINE EXERCISE. ALL INDIA BANK OFFICERS’ ASSOCIATION

Circular No.22/VII/2018
October 14, 2018
TO
ALL AFFILIATED UNITS / STATE COMMITTEES

Comrades,

WAGE TALKS WITH IBA – ONE MORE MERE ROUTINE EXERCISE.

IBA has invited the nine organizations for a meeting at Mumbai on 12th October 2018 at 12.00 noon.
2. Preceding the meeting with IBA, on 11/10/2018, four officers’ organizations met at INBOC office at 4.45pm, to decide the collective and consensus approach of the organizations on IBA’s proposal of introduction of variable pay in one form or other in the present discussion itself. Amongst us, it has been decided to prioritize the issues: 1. Fractured Mandate; 2. Merger of Banks; 3.Expeditious conclusion of wage talks and 4.Focus on core banking activities and stop misselling of third party products. There are other issues like up-dation of pension, Family Pension and Recruitment of adequate workforce in the Industry. AIBOA was represented by Com.V.Ramabhadran, Convenor, Wage Committee, Com.V.Viswanathan President, AIBOA (MSC), along with the undersigned.
3. The representatives of the nine constituents met in the IBA office as per the requirements of the situation by preponing the meeting scheduled to be held on 14th at Mumbai to 12th at 09.30 hrs, at IBA office. AIBOA was represented by Com.Narendra Kotiawala, DGS, Com.V.Ramabhadran, Secretary, AIBOA along with the undersigned. The meeting commenced a bit late but the decision was unanimous on rejecting the proposal of the IBA on introduction of fixed and variable pay as part of current wage talks. On Merger of three banks, the discussions were inconclusive, as the time scheduled for discussion was at 12.00 hrs.
4. The IBA team was led by Shri. G.Rajkiran Rai, MD&CEO Union Bank of India, Shri.Prashant Kumar, CFO, SBI, Shri.V.G.Kannan CEO IBA, Shri.B.Raj Kumar Dy.CEO IBA, Shri.S.K.Kakkar Sr.Advisor HR&IR IBA, Shri.K.S.Chauhan and other officials of the HR Department participated in the exercise. Shri. R.K. Takkar Chairman Negotiating Team IBA, MD & CEO UCO Bank, and Shri Shyam Srinivasan MD&CEO Federal Bank were on Video Conference mode. The nine unions’ representatives were present in the discussions.
5. In the 90 minutes exchange of expressions between both parties came to an end with the following candid collective and consensus conclusions from 9 unions side to the IBA stand.
· IBA’s earlier offer of 6% on Pay slip Components made on 30th JULY 2018 should be enhanced substantially.
· Introduction of linkage of Pay with Return on Assets[ROA] and also on Operating Profit has been rejected in toto.
· The managements of SBI,BOB,PNB, UNION BANK AND INDIAN BANK should be prevailed upon by IBA as per the advice of CLC to revise their stand to cover all seven scales, as in the past.
6. It has been also made clear that there is every possibility of entering into confrontation mode because of the rigid approach of the IBA.
7. In the post lunch session, the adjourned meeting of the nine constituent unions commenced to transact the remaining issues for arriving at a decision. The representatives of INBOC and NCBE too expressed their organizational stand on merger of Banks. At the end, it was decided to escalate the resistance level in a gradual and sustained manner by the unions culminating in two days strike in the winter session of the Parliament.
8. In our assessment, struggles are the only available avenue to move forward to secure a reasonable wage hike, as the workforce collectively worked to give a substantial gross profit in the year ended 2017 and 2018.ONWARD

Insurance Backed Hospitalization Scheme – AIBOA

Insurance Backed Hospitalization Scheme
ALL INDIA BANK OFFICERS’ CONFEDERATION
ALL INDIA BANK OFFICERS’ ASSOCIATION
ALL INDIA BANK OFFICERS’ CONGRESS
NATIONAL ORGANISATION OF BANK OFFICERS
12.10.2018
The Chief Executive Officer
Indian Banks Association
World Trade Centre Cuffe Parade
Mumbai
Sir,
REG : INSURANCE BACKED HOSPITALISATION SCHEME
We refer to the IBA’s Health Insurance Policy renewed by the member banks, as advised by you after negotiating with UIICL, for the year from 01.10.2018 to 30.09.2019. We understand that in the renewed policy, the insurance company has reduced the Room Rent / Bed Charges ceiling from Rs.5000/- to Rs.4000/- per day.
You will appreciate that the officers are eligible for the hospitalization facility in terms of the Joint Note dated 25.05.2015 signed between the IBA and the four Officers’ organizations. As per the said Joint Note, the officers are eligible for reimbursement of Room Rent / Bed charges upto Rs.5000/- per day, the natural sequel of which is the eligibility for the class of treatment attached to the eligible class of room.
It is true that in the meeting held on 14.09.2018 IBA had proposed to reduce the Room Rent ceiling from Rs.5000/- to Rs.4000/- per day, as IBA had felt that all other hospital charges are linked to room rent and if room rent eligibility is reduced to Rs.4000/- per day all other expenses relating to hospitalization would automatically reduce there by reducing the insurance claims and the claim ratio. We did not give any consent to the IBA’s proposal on that day.
Subsequently vide our letter dated 18.09.2018, all the four Officers’ Organizations informed you that the IBA’s proposal is not acceptable to us and we are not agreeable to any reduction in Room Rent / Bed Charges. Hence we are surprised that in spite of our said communication, IBA has gone ahead with reducing the Room Rent / Bed Charges ceiling from Rs.5000/- per day to Rs.4000/- per day for officers also.
You will appreciate that by reducing the Room Rent ceiling, you are not merely reducing the hospitalization bill but you are basically reducing the eligible class of treatment for the officers. Hence the reduction of Room Rent / Bed Charges ceiling to Rs.4000/- per day for officers is not acceptable to us.
As mentioned by us in the letter dated 18.09.2018, till 10th Bipartite settlement the officers were eligible for Room Rent / Bed Charges upto 125% of the eligibility of award staff and thus were eligible for higher class of treatment. In 10th Bipartite Settlement, the workman were made eligible for the Room Rent at par with the officers there by providing them the same class of treatment as applicable to the officers. The increase in the hospitalization bills, which is the reason given by IBA for suggesting reduction in room rent, may be due to the decision of IBA to provide medical facility to the workman at par with officers in 2015.
While we do not have any grouse against providing medical facility to the workman at par with the officers, you will appreciate that it is not fair on the part of IBA and the Banks now to reduce the eligible class of treatment for the officers because of the increasing hospitalization bills. Hence, we urge you to restore the Room Rent ceiling for officers to earlier limit of Rs.5000/- in terms of our Joint Note dated 25.05.2015.
Sir, as you are aware that the entire premium on the insurance policy of serving employees is paid by the bank and hence we had no reason to have any meeting with you to discuss on the increase/ decrease in premium by the insurance company for the serving employees, our main concern was to discuss the policy of the retirees. The main purpose of our meeting was to find out the ways and means to reduce the burden of premium on the retirees who are required to pay the insurance premium from out of the meager amount of pension received by them. In this connection, we had suggested that the premium should be composite and not segment wise i.e. the premium for the serving employees and the retirees should be the same and that the premium of the retirees should be borne by the bank in the same manner as the banks are reimbursing the medical expenses to the Ex MDs and Ex EDs. We had also made several other suggestions. But from your communication sent to the member banks on 09.10.2018 we find that except for our suggestion to provide flexibility in the insured amount, no concrete steps to make the health insurance affordable to the retirees and to reduce the burden on them seems to have been taken by the IBA.
We urge you to restore the Room Rent ceiling at Rs.5000/- per day to the officers in terms of the Joint Note dated 25.05.2015 and honor bilateralism.
Yours sincerely,

TO ALL UNITS / STATE COMMITTEES
Comrades,

FALSE AND MALICIOUS PROPAGANDA TO DEFAME THE BANK EMPLOYEES TU MOVEMENT UNDER THE BANNER OF UFBU

Our attention has been drawn to a joint circular purported to have been issued by our organisation jointly with AIBEA. First up of all there is no meeting of 9 constituents of UFBU at Chennai today.

The contents are false, malicious and also to bring disrepute to banking unions as they firmly rejected the proposal of IBA, lock, stock and barrel in the recent discussions held on 12th Oct,18 at Mumbai. The release of the circular with the forged signatures of General Secretaries of AIBOA and AIBEA is squarely condemned.

Please don’t be misguided by the false news.

We are initiating appropriate steps to nab the culprit under the provisions of law applicable, as this mishap has to be nipped it in bud.

This is the danger in utilising technology beyond the required level.

Text of UFBU Circular No. UFBU/2018/14 dated 08.08.2018
CIRCULAR No. UFBU/2018/14
Date : 08-08-2018
TO
ALL CONSTITUENT UNIONS/MEMBERS

Dear Comrades,
DISCUSSIONS WITH IBA ON MEDICAL INSURANCE SCHEME

As already informed to units, bipartite meeting was held today between IBA and UFBU regarding renewal of our Medical Insurance Policy for serving employees/ officers as well as for the retirees for the ensuing period 2018-19. IBA team was represented by Shri Rajkumar, Dy. Chief Executive, Shri S K Kakkar, Sr. Advisor (HR&IR), and Shri K S Chauhan, Sr. Vice President (HR). All our constituent unions were present in the meeting.

IBA informed us that United India Insurance Co. has given their proposal for hike in the premium on the Policies both for the serving employees/officers as well as for the retirees as under:

Serving employees/officers : Increase in premium by 29% over existing rate
Retirees(without Domiciliary) : Increase in premium by 110% over existing rate
Retirees (with Domiciliary) : Increase in premium by 144% over existing rate

We strongly objected to such steep hike in the rate of premium and informed the IBA that especially the hike in premium for the retirees is too exorbitant and not appearing to be relatable to actual claim ratio. We urged upon the IBA to take up with UIIC to drastically reduce the premium.

IBA informed us that they are already seized of the issue and the matter is being taken up with UIIC. We pointed out that the following points be kept in mind while finalizing the issue:

• There should be no attempt to discontinue the policy. Policy should be continued and renewed. • The premium rates should be drastically revised downwards. • Pending discussion with UIIC, the Policy for both serving employees and retirees should be extended upto 31-12-2018 with pro rata premium.
• Cost of upfront payment of annual premium should be factored in while finalizing the premium rate. • Change in age profile of serving employees and retirees should be taken into account while working out the revised premium rates.
• IBA should take up with the Government for exemption of GST on premium amount. • Renewed Policy should include a penalty clause for delayed sanction of bills/ reimbursement. • If broker will not be involved in the scheme, suitable mechanism should be put in place to deal with cases of repudiation of claims, etc.
 • Uniform guidelines should be given by IBA for sanction of amount under Buffer allocation. • Premium should be worked out on a composite basis by clubbing both serving employees and retirees.
• Premium for retirees should also be paid by the managements.
IBA took note of the above points raised by us and assured to keep these views in mind while further dealing with the same.
Next round of Talks on 18-8-2018: Next round of Bipartite Talks (Sub-Committee) will be held on 18th August, 2018. Discussions will be held in the forenoon with the Officers Associations and in the afternoon with Workman Unions.
With greetings,
Yours comradely,

Bank Wage Hike: 10th Bipartite settlement 15% – IBA’s Offer 2%

Bank Wage Revision: 10th Bipartite Wage Hike 15% – IBA’s Initial Offer 2%
“UFBU rejects IBA’s initial offer of 2% hike in wage bill- 10th Bipartite settlement, there was increase of 15% hike in wage bill”
UFBU circular on Wage revision talks
Dear Comrades,
• WAGE REVISION TALKS WITH IBA & NEGATIVE ATTITUDE OF IBA-GOVERNMENT
• UFBU REJECTS IBA’s INITIAL OFFER OF 2% HIKE IN WAGE BILL
• DECIDES TO RESORT TO AGITION AND STRIKE ACTIONS
• HOLD MASSIVE DEMONSTRATIONS ALL OVER THE COUNTRY ON 8th/9th MAY
• GET READY FOR 48 HOURS CONTINUOUS STRIKE BY END OF MAY, 2018

“The much delayed negotiations with IBA on our Charter of Demands for wage revision re-commenced on 5th May, 2018 after a gap of nearly six months.

IBA team was led by Shri R.K. Takkar, MD, UCO Bank & Chairman of Negotiating Committee, Shri V.G. Kannan, Chief Executive, IBA, Shri P.S. Jayakumar, MD, Bank of Baroda, Shri Rajkiran Rai, MD, Union Bank of India, Shri Shyam Srinivasan, MD, Federal Bank and Shri S.K. Kakkar, Senior Advisor-HRA, IBA. UFBU was represented by leaders of our nine constituent unions.

Medical Insurance Scheme: The IBA insisted that representatives of UFBU should be part of the Committee to appoint the broker/service provider for administration of the Medical Insurance Scheme. We flatly refused to be part of that Committee since appointment of the Broker is not part of our Settlement and Unions are not to be involved in the same. However, we informed IBA that UFBU will be willing to discuss the problems faced by employees, officers and retirees to ensure that the scheme is implemented without any hassle. It has been decided to discuss the issue further.

Wage increase: We insisted that in view of the inordinate delay since the last meeting, the IBA should come out with their initial offer so that further negotiations can take place and finality reached expeditiously. We pointed out that Government/Finance Ministry have been repeatedly advising all Banks and IBA to expedite the wage revision process but the matter is being delayed. IBA stated that the Banks are facing increasing stress on profitability and the position of the Banks are not that good and this should be kept in mind while discussing the demands for wage revision. We stated that all the Banks are earning Operating Profits and it is only because of huge apportionment towards provisions for bad loans that Banks’ profitability is getting eroded and this in no way can be attributed to the employees and officers working in the Banks. Hence we demanded that there should be adequate and satisfactory wage revision.
However, IBA informed that looking to the present position of the Banks, there are constraints on their part and hence made their initial offer of 2% hike over the total Wage Bill as on 31-3-2017.
We informed the IBA that in the 10th Bipartite settlement, there was increase of 15% hike in wage bill and hence this offer of IBA is highly disappointing and totally unacceptable even as an initial offer.

We demanded that IBA should improve their initial offer so that the matter can be further negotiated to reach a mutually acceptable settlement with satisfactory and adequate wage increase.
IBA regretted their inability to improve their initial offer and hence UFBU outrightly rejected their offer and informed them that UFBU would be compelled to resort to agitational progrmames to press our reasonable demands.

UFBU Meeting: Thereafter, meeting of the UFBU was held and it was decided that the very meager offer of IBA should be brought to the attention of the Finance Ministry for their intervention and at the same time UFBU should commence agitational programmes.
Programme: 8th or 9 th May, 2018

Massive demonstrations all over the country before bank branches either during lunch time or after office hours. In bigger towns and cities, centralised demonstrations should be held.
By end of May, 2018, 2 Days/48 hours continuous Strike action preceded by other agitational programmes. (Dates of the strike will be informed next week after waiting for the response of the Government)

Comrades, we have been exercising utmost patience in pursuing our demands but perhaps IBA and Government have taken it as our weakness. It is time to show our unity and united resentment against the unreasonable approach of the IBA and the casual attitude of the Government in resolving our genuine demands for wage revision. Forge total unity, make the protest demonstrations massive in all places and await our call for strike action.”

UFBU to hold Dharna before Parliament on 21.3.2018

UFBU TO HOLD DHARNA BEFORE PARLIAMENT AT NEW DELHI ON THE 21ST MARCH, 2018 DEMANDING ACTION ON ALL THOSE WHO ARE INVOLVED IN PNB FRAUD

CIRCULAR No. UFBU / 2018 / 02
Date : 24.02.2018
TO ALL CONSTITUENT UNIONS/MEMBERS

Dear Comrades,
• UFBU MEETING HELD AT CHENNAI ON 23RD FEBRUARY 2018
• UFBU DECIDES NOT TO PROCEED WITH OUR STRIKE NOW.
• UFBU TO HOLD DHARNA BEFORE PARLIAMENT AT NEW DELHI ON THE 21ST MARCH, 2018 DEMANDING ACTION ON ALL THOSE WHO ARE INVOLVED IN PNB FRAUD

Further to the meeting of UFBU held at Mumbai on 06.02.2018, another UFBU meeting was held at Chennai on 24.02.2018.

The meeting observed a minutes’ silence to pay homage to former leaders of UFBU Com. S R Bal (BEFI), Com. S R Sengupta (AIBOC) and Com.P.Lakshminarasiah (NCBE) who had passed away recently.
Talks with IBA: The meeting noted that in view of the disturbed situation in the banking sector on account of the recent PNB fraud, IBA had postponed the meeting scheduled for 21.02.2018 and it is expected that the meeting would be called within the next 2 or 3 weeks.

Our call for strike on 15th March: In view of the present situation in the aftermath of PNB fraud and the vitiated atmosphere in the entire banking sector, it was felt proper and accordingly decided not to proceed with the proposed strike on 15.03.2018.

PNB Scam: The meeting was seriously concerned about the manner in which a mega fraud has taken in place in Punjab National Bank and the way the Banks stand exposed to such unthinkable risks. However, the meeting noted that instead of full-scale investigation, attempts are being made to single out some few lower level staff as though they alone are responsible for entire fraud.

No one can hide the fact that there is gross negligence of control, supervision and monitoring as well as possibilities of complicity at various higher levels of management including the top officials of the Bank. Equally, one cannot absolve RBI for its failure to play its role and responsibilities which would have otherwise unearthed these irregularities much earlier.
The meeting felt that all efforts should be taken to restore the faith and confidence of the people at large in the Banks and to protect their hard-earned money in the Banks.

It was decided to undertake campaign programme amongst the public and also undertake programmes on the following issues and demands:

• Take tough action on all those invloved, connected and responsible for the fraud.
• Do not single out lower level staff
• Do not exclude RBIs’ role from the investigation.
• Avoid harassment of employees and officers by mass transfers
• Thorough probe by Joint Parliament Committee
• Restore people’s confidence in banking system.

It has been decided to hold Press Meet in all State Capitals between 5th and 10th March, 2018 to explain our standpoints and demands.

It has also been decided to hold a Dharna before Parliament at New Delhi on 21.03.2018 as a part of our programme to highlight our demands.

It was also decided to take up the issue with Chief Vigilance Commission about the misuse and wrong interpretation of their guidelines by some of the Banks thereby attempting to indulge in unwarranted mass transfers of employees and officers at this juncture.

With greetings,
Yours comradely,
(SANJEEV K. BANDLISH)

Bipartite Talks with IBA on 26.9.2014 – AIBOC

We have received the reaction from many of you on the outcome of the meeting with IBA. Our Confederation expressed its clear view in the UFBU meeting held on 26th September, 2014, that we want quick and sustained agitational programme against the apathy of IBA and the Government on our just and reasonable demands.

We also suggested that our strike call should be for 13th and/or 14th October preceded by programmes like no late sitting, not coming on Sundays and Holidays, Badge wearing, relay hunger strikes, rallies and demonstrations. Undersigned offered the challenge to hold a rally/demonstration on 27th September, 2014 itself at Delhi. However, the above programme only could be decided by the UFBU.

We call upon our members to be in preparedness for any call of the UFBU/organization.

Dear Friends,

WAGE REVISION NEGOTIATIONS- 17.09.2014.

The representatives of UFBU met at 11.00 a.m. to discuss and decide the strategies to be adopted in the negotiations with IBA. It was decided that along with the percentage increase in its offer, other important issues like regulated working hours, 5-day week, and improvements in pension related matters should be raised simultaneously.

In the IBA meeting, Sri Bhasin, who was the Negotiating Committee Chairman till the last meeting and now elected as Chairman of IBA introduced the newly constituted Negotiating Team of IBA under the leadership of Sri Rajeev Rishi, the newly appointed Chairman of Negotiating Committee. Subsequent to brief introduction and completion of formalities, before commencement of negotiations on wage revision, UFBU raised the following issues:

Compassionate Appointment Scheme: While thanking the IBA for its efforts and being instrumental in getting clearance of the Government for introduction of Compassionate Appointment Scheme on the lines available to Central Government employees, UFBU sought clarifications on issues like eligibility, applicability with regard to death cases prior to 05.08.2014, etc., to which IBA conveyed that the matter would be referred to Government and necessary clarifications will be issued on receipt of their advices;

Accounts to be opened under Jan Dhan Yojana: While appreciating and extending the support of UFBU to the initiatives taken by the Government towards extension of banking facility to all the people in the Country, UFBU expressed the following apprehensions:

The compromises on KYC norms may lead to opening of fraudulent accounts for which employees should not be held accountable;

The pressure due to the targets stipulated for opening of accounts are greatly affecting the regular banking activities and services to existing customers; Due to the stipulation on timings for opening of accounts from 8.00 a.m. to 8.00 p.m., employees are forced to work beyond their working hours and are also under severe stress to achieve the stipulated target.

During the negotiations, IBA informed that the UFBU’s demand of 25% increase in pay slip components is on high side and beyond the paying capacity of banks and insisted that UFBU should review its demand, to which UFBU responded as under:

IBA should substantially revise its offer of increase in pay slip components;

The other important issues like regulated working hours, 5-day banking, improvements in pension related matters, etc. should be discussed simultaneously and in a time-bound manner;

The meetings on negotiation have to be held regularly at frequent intervals ensuring expeditious settlement;
UFBU will have flexibility in its demand depending upon the response of IBA on all the above matters.

IBA assured us to schedule the next round of meeting within one week to discuss comprehensively on all the issues. Comrades – every effort is being made by UFBU not only for expeditious conclusion but also for a respectable Tenth Bipartite Wage Settlement. Let us continue to maintain our unity which would strengthen us in achieving our goals.

Further developments will be advised in due course.

Thanking you,

Yours sincerely

Subhash S.Sawant
General Secretary

Details of Bank Bipartite talk on 17.09.2014

Following is the version of Gen. Secy., NUBE regarding bipartite talks held between IBA and UFBU on 17th September 2014.

Nothing conclusive.......

"MEETING WITH IBA ON WAGE REVISION TALKS

Today (17/09/2014) yet another meeting of the negotiating committee for 10th Bipartite Wage Revision took place in Mumbai, the undersigned on behalf of NUBE took part in the negotiations along with ten other unions.

Mr.T.M.Bhasin the newly elected Chairman of IBA in his initial remark gave a brief of the present banking scenario and also explained in detail about the importance of banks’ profitability and paying capacity.

Mr. Rajiv Rishi, the new Chairman of the Negotiating Committee followed it by telling that it would not be possible for IBA to agree to the demands of the Unions for a hike of 25% since the banks were not doing well and the results of the first quarter were not rosy. Further he insisted that other issues should be discussed first and then we decide on the wage factor.

NUBE strongly objected to the stand of IBA and said that postponing a cardinal issue like wage load and discussing on other issues which can be settled simultaneously is nothing but dilly dallying.

Already nearly 8.5 lac Bank men are anxiously waiting for approximately two years patiently and their patience cannot be further tested. The Chairman negotiating committee wanted the unions to reduce their demand of 25% to which some unions agreed provided IBA also raises their offer.

IBA has not offered anything beyond 11% and the meeting concluded with a understanding that we will meet shortly. The way the talks are proceeding, we do not think that there would be any progress in the days to come.

Comrades from the above it is very clear that IBA is in no mood to settle the issue amicably. Their stubbornness is only making the Bank employees restless and paving a path for agitational programmes which is not good for the Industry.

However, we are left with no other alternative than to struggle if not we will be meekly surrendering to the dictates of IBA and history will not pardon us. So let us march ahead and struggle unitedly.

Yours Comradely,

(L.BALASUBRAMANIAN)
GENERAL SECRETARY
NUBE"
