Payment of salary to teachers despite dismissal of their writ petition a pure loot of the state exchequer : Allahabad HC

The Allahabad High Court today held that the payment of salary to teachers from the state government funds, despite dismissal of their writ petition in default by the High Court, is a pure loot of the state exchequer.

This remark was made by Justice S U Khan, where the court came to know that those teachers of state, who were getting salary on the strength of the interim order of the High Court, are still receiving their salary even after dismissal of their writ petition in default by the court.

Passing this order on a writ petition filed by Siyaram Yadav and others of district Jaunpur, the court asked the Chief Standing Counsel to seek complete information from the District Inspector of Schools (DIOS) of all the districts in the state in this regard and supply the same to the court by preparing a chart indicating therein, that in each district how many teachers are being paid salary under the interim orders of the High Court, where writ petition are more than 10 years old.

The information should also disclose that salary of how many such teachers has been stopped for their failure to furnish evidence of pendency of writ petition and since when.

The court has also directed that the state government shall also initiate disciplinary proceedings against all those DIOS, who continued to pay salaries to such teachers since May 2009 onwards and shall intimate the court regarding the action taken against all such DIOS.

The court will rehear this case on December 13. UNI
