S.R.O. 53.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Defence Accounts Department (Auditor) Recruitment Rules, 2009, namely:-

I. (I) These rules may be called the Defence Accounts Department, (Auditor) Amendment Recruitment Rules, 2014.

(2) They shall be deemed to have come into force on the 26th day of September, 2009.

2. In the Schedule to the Defence Accounts Department. (Auditor) Recruitment Rules, 2009, in column 12, after Note 2, the following Note shall be inserted, namely :—

"Note 3: The eligibility service for promotion to the grade of Auditor shall continue to be eight years for persons holding the feeder post of Clerk-cum-Typist on regular basis as on the 26 day of September, 2009.”

EXPLANATORY MEMORANDUM

The principal rules were published on 26th day of September,2009 in the Gazette of India. As per DOPT OM No. AB-14017/12/87-Estt. (RR) dated 18.3.1988, a note to the effect that the eligibility service shall continue to be eight years for persons holding the feeder posts on regular basis on the date of notification of the revised rules was required to be included in the revised principal rules, since the change in the revised principal rules is affecting adversely the persons in the feeder grade who were already holding the post of Clerk-cum-Typist on the date of commencement of the principal rules. however, inadvertently the same was omitted. Hence the above amendment in the recruitment rules is being made effective from 26th day of September, 2009 i.e. the date of commencement of the principal rules. It is hereby certified that by giving retrospective effect to this rule, no one in the service will be affected adversely.

Note:—The principal rules dated the 15th September, 2009 was published in the Gazette of India, Part II, Section 4 vide number S.R.O. 22 on the 26th day of September 2009. Subsequently a corrigendum number S.R.O. 95, dated the 30th October, 2012 was issued in the Gazette of India on 10th day of November, 2012.
