Recruitment against Physically Handicapped Quota- launch of Special Recruitment Drive–regarding.

Sub: Recruitment against Physically Handicapped Quota- launch of Special Recruitment Drive - regarding.

   Attention is invited to Board’s letters No.E(NG)II/2009/RC-2/5 List dated 27.8.09 and No. E(NG)II/2009/RC-2/7 dated 28.8.09 regarding filling up of vacancies in various categories against the Physically Handicapped Quota. Pursuant to Hon’ble High Court Delhi’s judgement in the Public Interest Litigation filed by All India Confederation of the Blind in WP (C) No.23132/2005, the matter has been deliberated by Board. Accordingly it has been decided to implement the Hon’ble Court’s orders directing Railways to complete recruitment of physically handicapped persons in all categories of Group ‘C’ and erstwhile Group ‘D’ in six months time.

 

   2. As per affidavit filed by the Board in the Hon’ble High Court of Delhi, a backlog of 2377 Group ‘C’ and 1811 Group ‘D’ posts was shown for the period 1.1.96 to 31.10.2008 on the basis of position received from the Railways (Annexure-l). CPOs were directed to place indents on the RRB/RRC for this backlog except for the categories in which exemption was being sought for and therefore, 3% vacancies in such categories were required to be kept vacant. However, the request of Railways for exemption from reservation for physically handicapped persons in certain categories has been turned down by the Ministry of Social Justice and Empowerment and the Hon’ble High Court has directed that these posts should also be filled up.

   3. En order to adhere to the time schedule laid down by the Hon’ble High Court without inviting contempt, the Special Recruitment Drive to fill backlog vacancies in all such posts identified in Board’s letter dated 28.8.09 including the 3% kept vacant, has to be completed within a period of six months from the date of communication of orders, which expires in September, 2012.

   4. Since no exemption has been given in the categories for which exemption was being sought for, all categories as identified in para 2 of Board’s letter dated 28.8.09, where 3% was to be kept vacant, are now required to be filled up. Accordingly, following steps may immediately be taken.

4.1 In case of erstwhile Group D categories:

   a) Recruitment of backlog as well as current vacancies in erstwhile Group D’ category is already being carried out by RRCs. Revision of Vacancies notified vide recruitment advertisements issued in Dec 2010-Jan 2011 to the extent of including vacancies left out, if any, inadvertently, and increasing vacancies already notified;

   b) In case of ongoing erstwhile Group D recruitment exams are scheduled in May-June 2012. Since Physically Handicapped candidates are exempt from Physical Efficiency Test, as soon as the results of written examinations are available, provisional part panel of Physically Handicapped candidates should be formed. It may clearly be stated in the offer of appointment that this is being done in order to adhere to the time Schedule a per Hon’ble Court’s directions and final merit position as well as seniority will be determined on the basis of position in the final panel as and when it is issued. It must be ensured that this exercise is completed by September, 2012.

4.2. In case of Group C categories

   It is presumed that indents have been placed for clearing respective backlog as per directions contained in Board’s letter of 28.8.09.It may be ascertained from RRBs concerned whether indents for Physically Handicapped persons placed on them has been notified or not. For all vacancies not notified yet by RRBs, the indents be taken back by the Zonal Railways/Pus and also, the 3% posts kept vacant in categories mentioned in para 2 of Board’s letter dated 28.8.09, may be covered in this recruitment exercise Vacancies assessed thus will have to be notified by the Zonal Railways/pus as a “Special Recruitment Drive”(SRD) for physically handicapped persons to be conducted by Railways/PUs as a one- time measure. In future, indents will be placed on RRBs as per normal practice.

   5. Procedure and logistics will be determined by General Manager keeping in mind the need to ensure a fair and transparent recruitment.

   6. The exercise has to be completed by September 2012, hence evolving of procedural details and strict monitoring be carried out at appropriate levels to ensure the prescribed time limit is adhered to. Board may be informed at the following stages

(i) issue of notification
(ii) fixing of date of selection
(iii) issue of panel.

   7. SRD for Physically Handicapped Persons will be Carried Out only in respect of Group ‘C’ categories. For erstwhile Group ‘D’ categories, Procedure as at para 4.1 above will be carried out.

   8. RRB and RRC will not carry out this SRD. Special arrangements will have to be made by the Zonal Railways/PUs to conduct this recruitment.

   9. Henceforth, in all recruitment exercises, reservation of 3% against Physically Handicapped Quota will be computed as laid down in Board’s letter of 27.8.09 as per statutory obligation.
