ORDER

   As per the Government Orders read as 1st and 2nd paper above, Government have issued orders revising Pay and Allowances of State Government employees, staff of educational institutions, teachers, University employees etc. Service organizations and individuals pointed out that those employees who got regular promotion on or after 01.07.2009, but before 26.02.2011, and exercised option for fixation of pay as per option (a) or (b) of Rule 28A Part I KSRs, and employees who got regular promotion before 01.07.2009 and exercised option for the promotion post in the pre-revised scale of pay as per option (b) under Rule 28A Part I KSRs and whose increment date fell due after 01.07.2009, would suffer monetary loss in comparison with their juniors who were promoted on a later date, even though they exercise option for Pay Revision 2009 as per Note under Rule 7(3) Annex II of Government Order read as 1 and 2 paper above. Further, employees who were promoted on or after 26.02.2011
and whose pay have already been fixed under pre-revised scale before change over to the revised scale due to the time limit stipulated for exercising option to the promotion post also suffer monetary loss. Hence the Service Organizations and individuals requested Government permission for exercising re-option for promotions referred above for minimizing loss.

   2. Government have examined the matter in detail and are pleased to order that the following categories of employees will be permitted to exercise re-option for fixation of pay on promotion under Rule 28A Part I K.S.Rs.

     (a) Employees and teachers who got regular promotion before 01.07.2009 but exercised option (b) under Rule 28 A Part I KSRs, with effect from the increment date falling on or after 01.07.2009.

     (b) Employees and teachers who got promotion during the period from 01.07.2009 to 26.02.2011 and have exercised option (a) or (b) under Rule 28A Part I KSRs, for fixation of pay in the pre revised scale of the pay of the promoted post.

     (c) Employees and teachers who got promotion after 26.02.2011 and whose pay have been fixed in the promoted post under option (a) or (b) of Rule 28A Part I KSRs, in the pre revised scale (due to the time limit of one month fixed for exercising option) based on their option.

   3. The above categories of employees will also be given a chance for re-option for 2009 Pay Revision provided they exercise re-option for fixation under Rule 28 A Part I KSRs, as per para 2 above. The permission for re-option for fixation under Rule 28A Part I KSRs, and for Pay Revision 2009 shall be subject to the conditions mentioned below.

   (i) Re-option for fixation on promotion under Rule 28A Part I KSRs/ Pay Revision 2009 shall be exercised within three months from the date of this order. Employees retired on or after 01.07.2009 will also be permitted to exercise re-option.

    (ii) Arrears on account of re-option will be paid with effect from date of effect of reoption.

   (iii) The excess amount to be refunded on re-option shall be adjusted against the arrears admissible with effect from the date of effect of re-option. The balance amount, if any, after adjustment shall be refunded in lump.
