(2) G.O.(Ms) No.138, Personnel and Administrative Reforms (FR.III) Department, dated 26.02.1983.
(3) G.O.(Ms) No.237, Personnel and Administrative Reforms (FR.III) Department, dated 29.06.1993.
ORDER:-
In the Government Order 1st read above, the Maternity Leave admissible to married women Government Servants was enhanced to 90 days which may be spread over from the pre-confinement rest to post-confinement recuperation at the option of the Government Employee. It was also ordered therein that the Maternity Leave will not be admissible to women Government Servants with more than three children. Further, in the Government Order 2nd read above, necessary amendments to Rule 101(a) of the Fundamental Rules were issued, based on the executive orders issued in the Government Order 1st read above. Based on the recommendation of the Tamil Nadu third pay commission and on par with Central Government Employees, orders were issued in the Government Order 3rd read above to the effect that a woman Government Servant with less than two surviving children be allowed Maternity Leave for a period of 90 days from the date of its commencement.
2. The Government after careful consideration direct that the Maternity Leave admissible to married women Government Servants which is 90 days at present be enhanced to 180 days which may be spread over from the pre-confinement rest to post-confinement recuperation at the option of the woman Government Servant. The Maternity Leave will be admissible to married women Government Servants with less than two surviving Children.
3. Necessary amendments to Fundamental Rules will be issued separately.

ReplyDeleteWould this GO be applicable to a person who is already on maternity leave (and supposed to join starting of June as per the old Maternity leave plan of 12 weeks)?

1. will it be applicable to the government employees those who are in probation period?
2. If so, will they get their salary every month without any delay?

ReplyDeleteThe Tamil Nadu Government has not clarified if the 6 months maternity leave is applicable for government employees who are already on maternity leave when the order was issued.
The Central Govt GO has made it very clear that it is applicable as given in point 3 of below GO:

ReplyDeleteI delivered 2nd baby on 7.5.2011.so,this meternity leave rule is applicable for me.i saw first g.o 16.5.2011.but that 's not a correct for me. pls send correct g.o.or explain .
As per G.O. Ms. No. 61 Personnel and Administrative Reforms (FR III) Department dated 16.06.2011, THE WOMEN GOVERNMENT SERVANTS WHO WERE ON MATERNITY LEAVE, PRIOR TO THE ISSUE OF THE ABOVE SAID GOVERNMENT ORDER NO. 51 P & A. R DATED 16.05.2011, AND CONTINUING THAT LEAVE ON OR AFTER 15.05.2011 ARE ALSO ELIGIBLE FOR EXTENDING THEIR MATERNITY LEAVE FOR SIX MONTHS.
ReplyDelete2. The leave can be availed from the pre confinement rest to post confinement recuperation at the option of the woman Government servant
3. The Women Government employees who have not completed the period of probation are also eligible. But the earned leave at their credit as on the date of going on leave will be debited first and the remaining days will be treated as Maternity Leave. For example if a Government servant is having 11 days of Earned Leave at her credit as on the date in which she goes on maternity leave, 11 days of Earned Leave and 169 days of Maternity leave may be sanctioned to her.

Tamil Nadu Government have issued clarifications in respect of maternity leave in GO Ms. No. 61 P & A.R. Department dated 16.06.2011
ReplyDeleteThe G.O. is applicable for those who were on Maternity Leave prior to the issue of the G.O. Ms. No. 51 P & A.R. Dated 16.05.2011 and continuing that leave on or after 16.05.2011 for extending their Maternity Leave for six months

Sir, My wife is an Assistant Engineer in PWD, TN. Due to irreparable defects in the uterus of my wife, we had to go for Surrogacy mother's services. That is ,our child is grown in the womb of a surrogate mother and she delivers the baby and give to us. In this case also post confinement leave is essential to bring up the baby with motherly care and attention. Will this GO be applicable for such mothers also. Is there any other GO to this effect. Kindly clarify,

Hi sir im a tamilnadu government servant who iso maternity leave from jan 2016 im on my first year of service not completed probation my office accountant wrongly credited salary to my account for which I am not eligible how can I refund it or how will they make a recovery
